ISSUE: Board of Directors' authorization is required for the General Manager to amend
an existing Consulting Services Agreement when the total cost of work exceeds
$25,000.
RECOMMENDATION: Authorize the General Manager to execute an amendment to
increase the cost ceiling of an existing Consulting Services Agreement with DKF
Solutions from $23,000 to $75,000 to provide safety program consulting services.
FINANCIAL IMPACTS: The additive cost of this amendment is $52,000.
ALTERNATIVES /CONSIDERATIONS: One alternative is to seek safety consulting
services from another organization. Another alternative is to delay identification and
implementation of improvements to the safety program until the District has additional
resources to perform this work in- house. Neither alternative is recommended.
BACKGROUND: On August 19, 2010 the District contracted with DKF Solutions to
review, evaluate and provide recommendations to improve the District's safety program.
Work has been performed at the rate of $120 per hour with a cost ceiling of $23,000.
$21,340.00 has been spent to date on the following services and projects:
• Provision of safety and risk management training classes to District
supervisory personnel,
• Development of an audit mechanism to allow the District to monitor and
evaluate compliance with its safety program, policies and procedures,
• Line by line review of seven safety directives with recommended
improvements to meet current CalOSHA requirements,
• Provision of additional tools and materials to implement improvements in
the seven reviewed programs, and
• Ongoing review and comment on draft updates to these program
materials.

CONSULTING SERVICES.
Staff is requesting to amend the agreement with DKF Solutions to raise the cost ceiling
to $75,000. The proposed amendment would add $52,000 to the cost ceiling of this
agreement. With the additional funds requested, we will be able to ensure that the
remaining safety directives are compliant with current CalOSHA requirements, to
implement best safety practices for the wastewater industry and to develop customized
on -line training modules for the safety program.
RECOMMENDED BOARD ACTION: Authorize the General Manager to execute an
amendment to increase the cost ceiling of an existing Consulting Services Agreement
with DKF Solutions from $23,000 to $75,000 to provide safety program consulting
services.
