Feedback from SWB
• Goal - statewide policy
• Agriculture
• Storm water
1900,
• Eliminate the potential to "game" the
system
• Continuously keep an issue "under study"
• SWB "wants less work"
SWB Proposed Fix
• Test of Significant Toxicity (TST)
• Guilty until proven innocent
• False violations
• Possible impairment receiving water, TMDL
• Effluent violations / Enforceable action
• Potential citizen lawsuits
• Undermine public perception of recycled water
• Numeric Limit
• Violations
• Easier for SWB to enforce (not really)
3
Issues Raised at Hearing

• Do not include us
• Do not use numeric limits
BACWA Issues
• Apply to everyone
• Agriculture
• Storm Water
• Do not use TST / use point estimation
• Numeric limits not reasonable for toxicity
