ISSUE: The Board of Directors' authorization is required to amend consulting
agreements beyond staff's authority.
RECOMMENDATION: Authorize the General Manager to execute an amendment to
an existing technical consulting services agreement.
FINANCIAL IMPACTS: The cost ceiling on the existing agreement will be increased by
$38,500.
ALTERNATIVES /CONSIDERATIONS: The Board could decide not to authorize the
General Manager to execute an amendment. This is not recommended since the
project would lose LEED points.
BACKGROUND: The new CSOD facility has been designed to achieve a LEED
certification from the U.S. Green Building Council. LEED is an internationally
recognized green building certification system, providing third party verification that a
building is designed and built using strategies aimed at improving energy savings, water
efficiency, CO2 emissions reduction, improved indoor environmental quality, and
impacts related to these systems.
The new building will include premium efficiency equipment and lighting, a
high - efficiency hot water system that combines the building heating with solar and
domestic hot water, light shading systems, preparing the facility for future photovoltaic
(solar ready), and an HVAC energy management system. LEED grants points for
enhanced commissioning of these products and systems. Enhanced commissioning
consists of construction verification and post - installation inspections that confirm the
systems were built as intended in the design and achieve their maximum efficiency.

During the development of the project plans and specifications, the District entered into
an agreement with Cogent Energy, Inc. to provide design review and commissioning
specifications. Cogent Energy was selected because they possess the necessary
experience and capability to provide inspection services locally. The current agreement
amount is $25,000.
Due to their role in preparing the project specifications and their unique understanding
of the project, staff recommends amending the existing agreement with Cogent Energy,
Inc. to include providing enhanced commissioning services. Staff has negotiated a
$38,500 increase to the existing contract, bringing the total agreement amount to
$63,500.
The environmental impacts of the CSOD Administration, Crew, and Warehouse Facility
were addressed in the Collection System Operations (CSO) Facilities Improvements
Project Mitigated Negative Declaration approved by the Board of Directors on
December 21, 2007. Subsequently, a Notice of Determination was filed in compliance
with the California Environmental Quality Act (CEQA).
RECOMMENDED BOARD ACTION: Authorize the General Manager to execute an
amendment to an existing technical consulting services agreement with Cogent Energy,
Inc. in the amount of $38,500.
