Millier J. iyamoto -Mills . Swanson A. Farrell J es . Kelly Gen anager ISSUE: The District Code and state law require that the Board conduct a public hearing prior to considering placement of Capacity Use charges, assessments for Contractual Assessment Districts (CADs), Alhambra Valley Assessment Districts (AVADs) and fee deferral programs on the County tax roll. RECOMMENDATION: Establish May 5, 2011 as the date for a public hearing to receive comments on placing the Fiscal Year 2011 -12 Capacity Use Charges and assessments for CADs, AVADs and the assessments for other fee deferral programs on the County tax roll for collection. FINANCIAL IMPACTS: None by this action, however, the staff recommendation to place assessments and charges on the County tax roll is the most efficient and cost effective method of collection. The alternative, direct billing would incur additional staff time and could result in a lower rate of collection of these charges. ALTERNATIVESICONSIDERATIONS: The Board may decline to establish the recommended public hearing date or may elect to choose a different date. However, a public hearing must be held if assessments and charges are to be placed on the County tax roll for collection. BACKGROUND: Commercial tenants and commercial property owners may elect to participate in the District's Capacity Use program for payment of capacity Fees over a 15 -year period. Property owners who have formed CADs have agreed to pay for sewer improvements over a ten -year period. Property owners who have formed AVADs have agreed to pay for sewer improvements over a 15 -year period. Payments are to be collected by placing assessments on each property owner's tax bill.
