ISSUE: A resolution of the Board of Directors is required to accept new easements, to
execute quitclaim deeds for existing easements, and to record documents.
RECOMMENDATION: Adopt resolutions accepting three grants of easements,
authorizing the President of the Board of Directors and the Secretary of the District to
execute Quitclaim Deeds, and staff to record the documents with the contra costa
County Recorder.
FINANCIAL IMPACTS: $36,843 was paid for these three permanent easements to
support the future construction work of the South Orinda Sewer Renovations Project,
Phase 5 (District Project 5989).
ALTERNATIVES/CONSIDERATIONS: None.
BACKGROUND: The District plans to install
approximately 600 feet of 6 -inch ductile iron
pipe by open -cut method within the proposed
new sanitary sewer easements, which are
located in the backyards of these residential
properties as part of the "Camino Encinas
site" of the South Orinda Sewer Renovations
Project, Phase 5 (DP 5989). Once the new
sewer is operational and the existing sewer
has been appropriately abandoned, staff
proposes to record quitclaim deeds to
relinquish the District's easements for the
sewers no longer a part of the District's sewer
system.

PROPERTY OWNERS (DISTRICT PROJECT 1554 — PARCELS 33 -35 *), AND
AUTHORIZING STAFF TO RECORD THE DOCUMEN
The sewer renovation work at the Camino Encinas site was originally part of last year's
Hall Drive Sewer Renovations Project, Phase 213, DP 5932, but was removed from the
construction contract when staff was unsuccessful in acquiring all of the necessary
sewer easements to support the project work.
Subsequently, staff, in collaboration with District Counsel, initiated the process for
acquisition of the needed easements through eminent domain (condemnation)
proceedings. On February 25, 2011, staff notified the property owners by letter that the
Board of Directors had scheduled a hearing to consider a Resolution of Necessity to
acquire the subject easements through condemnation. Following this notification, the
remaining property owners signed grant of easement deeds, which eliminated the need
to proceed with the Resolution of Necessity hearing.
These three permanent sanitary sewer easements are the first three of eighteen
easements needed for the project that staff anticipates acquiring from property owners
in south Orinda. Grants of easements will be submitted for Board acceptance as they
are signed by the property owners.
RECOMMENDED BOARD ACTION: Adopt a resolution accepting grants of easements
from John and Juliet Fiero, Azita and Troy Taylor, and Kenneth and Gretchen Lewis,
property owners at 51, 47, and 43 Camino Encinas, Orinda, respectively; adopt a
resolution authorizing the execution and recording of Quitclaim Deeds for the property
owners at the addresses listed above (District Project 1564, Parcels — 33 -35 *); and
authorizing staff to record the documents with the Contra Costa County Recorder.
