Resolution of Application to LAFCO re annexation proceedingsCentral Contra Costa Sanitary District $Q, ' BOARD OF DIRECTORS POSITION PAPER 014 Board Meeting Date: January 6, 2011 subject: ADOPT A RESOLUTION OF APPLICATION REQUESTING THAT CONTRA COSTA LAFCO INITIATE PROCEEDINGS TO ANNEX TEN SEPARATE ANNEXATION AREAS IN DANVILLE AND RESCIND RESOLUTION 2010 -027 (DISTRICT ANNEXATION 179) Submitted By: Initiating Dept \Div.: Jarred Miyamoto - Mills, Principal Engineer Engineering /Environmental Services REVIEWED AND RECOMMENDED FOR BOARD ACTION: oto -Mills A. Firrell K. Alm mes M. 411y, eneral Ma_ ager ISSUE: A Resolution of Application is required to request the contra Costa Local Agency Formation Commission (LAFCO) to initiate annexation proceedings. RECOMMENDATION: Adopt a Resolution of Application to initiate LAFCO annexation proceedings for the revised ten (110) areas designated as District Annexation 179 and rescind Resolution No. 2010 -027. FINANCIAL IMPACTS: The District incurs costs to prepare annexation applications and pays fees to LAFCO, the county Surveyor, the Department of Fish and Game, and the State Board of Equalization for annexation processing. Annexation costs are recovered as "annexation charges" when property is connected to the public sewer system. ALTERNATIVESICONSIDERATIONS: The Board could decline to initiate annexation for these areas, which would require that the property owners apply directly to LAFCO for annexation to the District. BACKGROUND: On May 20, 2010, the Board of Directors adopted Resolution 201 0 -027 requesting that LAFCO initiate annexation proceedings for District Annexation 179. Recently, the Contra Costa Assessor's office informed staff that Area 179 -2, the property on 246 W. Prospect Avenue, Danville, has already been annexed to the district as part of District Annexation 6 (Area 15) in 1962. The Contra Costa Assessor's office also found six (6) unannexed parcels in the proximity of the current proposed annexation areas that could be included in District Annexation 179. These six (6) parcels are located on El Dorado Avenue, Danville. In addition, staff has concluded that one (1) property in Area 179 -7 (853 Diablo Road, Danville) may not be exempt from the California Environmental Quality Act (CEQA). As a result, staff recommends that the Board adopt a new Resolution of Application and rescind Resolution 2010 -027. W ENVRSEMPosition Papers \Miyamoto- Mills\2011 \1 -6 -11 Board Mtg \PP DA 179 Rev. ADOPT A RESOLUTION OF APPLICATION REQUESTING THAT CONTRA COSTA LAFCO INITIATE PROCEEDINGS TO ANNEX TEN SEPARATE ANNEXATION AREAS IN DANVILLE AND RESCIND RESOLUTION 2010 -027 (DISTRICT ANNEXATION 179) In the current proposed annexation, twenty -one (21) properties in Danville have been organized into ten (10) separate "annexation areas" to eliminate "islands" within District boundaries. Due to the jurisdictional and tax boundary changes to each parcel, District staff has complied with LAFCO's request for administrative ease by limiting annexation areas to no more than ten (10) contiguous parcels, which has resulted in ten (10) unique annexation areas for this application. All of the annexation areas are within the District's Sphere of Influence (Sol) and the County Urban Limit Line. The general location of each annexation area is shown on Attachment 1. Staff has drafted a Resolution of Application requesting that LAFCO initiate annexation proceedings for the ten (10) areas in Danville that are described below: • Annexation Area 179 -1 is comprised of four (4) existing single - family homes on Houston Court, West Prospect Avenue and Quinterra Lane. • Annexation Area 179 -2 is comprised of two (2) existing single - family homes and four multi - family homes on El Dorado Ave. Annexation Area 179 -3 is comprised of one (1) existing single - family home on Estates Drive. • Annexation Area 179 -4 is comprised of one (1) existing single - family home on El Dorado Avenue. • Annexation Area 179 -5 is comprised of one (1) existing single - family on El Dorado Avenue. • Annexation Area 179 -6 is comprised of two (2) existing single - family homes on Sky Terrace. • Annexation Area 179 -7 is comprised of three (3) existing single - family homes on Buckeye Lane and Diablo Road. • Annexation Area 179 -8 is comprised of one (1) existing single - family home on Danville Boulevard. • Annexation Area 179 -9 is comprised of one (1) existing single - family home on Danville Boulevard. District staff has concluded that annexation of each property in Annexation Areas 179 -1 through 179 -10 (inclusive) is exempt from CEQA under District CEQA Guidelines Section 15319, since each would involve annexation of existing lots for exempt facilities. Adoption of the recommended resolution will establish the Board of Directors' independent finding that annexation of these properties is exempt from CEQA. RECOMMENDED BOARD ACTION: Adopt a Resolution of Application to initiate LAFCO proceedings for District Annexation 179 including the finding that annexation of each property in Annexation Areas 179 -1 through 179 -10 (inclusive) is exempt from CEQA under District CEQA Guidelines Section 15319 and rescind Resolution 2010 -027.
