ISSUE: A resolution of the Board of Directors is required to accept offers of dedication
and public sewer improvements, and to authorize staff to record documents.
RECOMMENDATION: Adopt a resolution accepting an offer of dedication and public
sewer improvements, and authorizing staff to record the resolution with the Contra
Costa County Recorder.
FINANCIAL IMPACTS: This easement was acquired with no cost to the District.
ALTERNATIVES /CONSIDERATIONS: None.
BACKGROUND: The Board of Directors regularly accepts easements and public
sewer improvements by resolution. The recommended resolution will accept an
easement and sewers installed during a recent renovation of Danville Square shopping
center that required a new trash enclosure (as shown on Attachment 1). Staff has
reviewed the easement documents and inspected the public sewer improvements, and
determined that they are in compliance with District standards.
RECOMMENDED BOARD ACTION: Adopt a resolution accepting an easement from
the Trustees of the Edward Ageno 1992 Trust, accepting Job 5576 accepting public
sewer improvements constructed within the easement, and authorizing recording of the
resolution with the Contra Costa County Recorder.

ISSUE: Board approval of the North Orinda Sewer Renovations, Phase 3, District
Project 5963, is required prior to the filing of a Notice of Exception under the District's
California Environmental Quality Act (CEQA) Guidelines.
RECOMMENDATION: Approve the North Orinda Sewer Renovations, Phase 3, District
Project 5963.
FINANCIAL IMPACTS: The total project cost is anticipated to be $1,960,000; however,
this position paper only approves the project for CEQA and Permitting and does not
award a construction contract.
ALTERNATIVES /CONSIDERATIONS: The Board of Directors may delay or decline to
approve the project. If these renovations are not constructed, the condition of these
sewers will continue to decline and may result in continued overflow and maintenance
issues.
BACKGROUND: This project is the third of four phases of sewer renovations in North
Orinda. The project will reconstruct approximately 7,500 linear feet of 6- through
15 -inch sewer lines within public right -of -way, private streets, and easements. Both
open -cut and pipe -burst methods will be utilized. One of these sites is a crossing over
San Pablo Creek. Collection System Operations (CSO) staff discovered a small hole in
the pipe in April, which has been temporarily repaired. Since the entire crossing is
experiencing interior /exterior corrosion, CSO installed a CIPP liner in April to prevent
any further leakage into the creek. To address sags and long -term reliability, staff is
exploring replacement of this creek crossing as part of the North Orinda Sewer
Renovations, Phase 3.
Approval of a project and direction to file a Notice of Exemption is normally considered
by the Board at the time of award of a construction contract. New permitting

requirements from agencies, such as Fish and Game, require that completed CEQA
documentation be submitted with the permit application. Since this permit application
process can be time - consuming, Board approval of the project and direction to file a
Notice of Exemption is needed at this time.
The improvements to the North Orinda Sewer Renovations, Phase 3, are included in
the fiscal year 2006 -07 Capital Improvement Budget (CIB) on page CS -36. Staff has
conducted a cash -flow analysis of the Collection System Program budget and
concluded that adequate funds are available for this project.
Staff has concluded that this project is exempt from the California Environmental
Quality Act (CEQA) under District CEQA Guidelines Section 15302 since it involves
replacement of existing facilities at the same location and with substantially the same
purpose and level of activity as the facility being replaced. Approval of this project will
establish the Board of Directors' independent finding that this project is exempt from
CEQA.
RECOMMENDED BOARD ACTION: Approve the North Orinda Sewer Renovations,
Phase 3, District Project 5963, and direct staff to file a Notice of Exemption with the
Contra Costa County Clerk.

ISSUE: Board approval is required for real property licenses.
RECOMMENDATION: Authorize the President of the Board and Secretary of the
District to execute the License Agreement with Saint Mary's College.
FINANCIAL IMPACTS: Historically, the District has granted Saint Mary's College a
license at no cost. For this license renewal, staff charged a $5,000 processing fee.
ALTERNATIVES /CONSIDERATIONS: The Board could decide not to grant the
license.
BACKGROUND: In 1998 the District granted a license to Saint Mary's College for
construction and operation of a softball field over District right -of -way, which is owned in
fee. The recommended License Agreement will extend the term of the original license
for an additional ten years with an option for the college to extend for another five years.
A map depicting the license area is attached. Area 1 on the map is the area
encumbered by the softball field; Area 2 will be used for access and overflow parking.
After inspecting the site, CSO and Engineering staff have determined that the continued
use by the college will not affect District operations. The license requires the college to
maintain the affected land.
RECOMMENDED BOARD ACTION: Authorize the President of the Board and
Secretary of the District to execute the License Agreement, entitled First Amended
License Agreement, with Saint Mary's College.

ISSUE: The District's draft FY 2007 -08 Capital Improvement Budget (CIB) and 2007
Ten -Year Capital Improvement Plan (CIP) has been prepared by staff. A date for a
public hearing to receive comments on the document should be set.
RECOMMENDATION: Set date for public hearing on May 24, 2007 to receive public
comment on the draft CIB /CIP document.
FINANCIAL IMPACTS: None related to this action.
ALTERNATIVES /CONSIDERATIONS: Not applicable.
BACKGROUND: The FY 2007 -08 CIB will establish project priorities and authorize
budgets for the Treatment Plant, Collection System, General Improvements, and
Recycled Water Programs. Detailed information for projects that are anticipated to be
active in FY 2007 -08 is presented in the CIB document. The 2007 Ten -Year CIP will
provide the basis for policy decisions concerning the District's Capital Improvement
Program and management of the Sewer Construction Fund.
On April 12, 2007, the Board of Directors met with District staff in a special meeting to
review the draft CIB /CIP. It is appropriate to receive comments in a formal public
hearing prior to consideration of the CIB /CIP for approval. This public hearing is
proposed to be scheduled for the Board's regular meeting on May 24, 2007. A staff
presentation will be made at that time.
RECOMMENDED BOARD ACTION: Set date for public hearing on May 24, 2007 to
receive public comments on the draft CIB /CIP document.

ISSUE: The District Code and State of California law require holding Public Hearings
for placing the Fiscal Year 2007 -2008 Sewer Service Charges and prior year delinquent
charges on the County tax roll for collection. A public hearing is also being scheduled
to receive comment on the amount of Sewer Service Charge to be imposed for Fiscal
Year 2007 -2008 and Fiscal Year 2008 -2009 and to receive public comment on the
Fiscal Year 2007 -2008 Operations and Maintenance, Debt Service and Self- Insurance
Fund Budgets.
RECOMMENDATION: Authorize a public notice to set public hearings on June 7,
2007, to receive public comment on the Sewer Service Charge rates to be imposed for
Fiscal Year 2007 -2008 and Fiscal Year 2008 -2009, the collection of Sewer Service
Charges and prior year delinquent charges on the County tax roll, and the Fiscal Year
2007 -2008 Operations and Maintenance, Debt Service and Self- Insurance Fund
Budgets.
FINANCIAL IMPACTS: At the June 7, 2007, Public Hearing, the Board will be asked to
consider a Sewer Service Charge rate increase of up to $13 per year for Fiscal Year
2007 -2008 and Fiscal Year 2008 -2009. Total additional revenues for Fiscal Year 2007-
2008 would be approximately $1.8 million if the staff proposed budget rate increase of
$11 is implemented.
ALTERNATIVES /CONSIDERATIONS: The Board could choose not to increase the
Sewer Service Charge for Fiscal Year 2007 -2008 or an alternative amount other than
the $11 assumed in the budget, up to $13 per year which was stated in the Public

DELINQUENT CHARGES BY PLACING THEM ON THE COUNTY TAX ROLL
In regard to the collection of Sewer Service Charges, the Sewer Service Charge could
be collected through direct billings by the District. However, this would require
additional labor and benefit costs. The Sewer Service Charge has been collected on
the County tax roll since the inception of the service charge in 1976. Staff believes that
collection on the tax roll provides the most economical and efficient means for the
District to collect these charges.
BACKGROUND: At the Board Financial Planning and Policy Workshop in January,
staff reviewed the financial prudence of imposing a Sewer Service Charge rate increase
of $11 for a charge of $300 annually to cover inflationary increases in the budget,
increased spending in the District's Capital Improvement Plan, and to have annual
modest rate increases in future years. The Operations and Maintenance Budget, which
will be submitted for initial review by the Board of Directors on May 24, 2007, has
assumed a Sewer Service Charge increase of $11 for a total charge of $300. The
Board approved a Proposition 218 Notice amount of up to $13 for Fiscal Year
2007 -2008 and Fiscal Year 2008 -2009 to allow for unexpected increases in expense.
A public hearing is required to receive public comments on collecting Sewer Service
Charges and prior year delinquent charges on the County tax roll. A hearing is also
being set to receive comment on selecting the Sewer Service Charge rate to be
imposed for Fiscal Year 2007 -2008 and Fiscal Year 2008 -2009. The Board will review
and consider the District's proposed budget in the Spring of 2008 to determine whether
the Board approved increase for Fiscal Year 2008 -2009 will continue to be necessary.
These hearings are typically held during the Board Meeting at which the Operations and
Maintenance Budget is presented for approval. Approval of the Fiscal Year 2007 -2008
Operations and Maintenance Budget, Debt Service Fund Budget and Self- Insurance
Fund Budget is scheduled for the Board meeting on June 7, 2007.
RECOMMENDED BOARD ACTION: Authorize a public notice to set public hearings
on June 7, 2007, to receive public comment on the amount of the Sewer Service
Charge rates for Fiscal Year 2007 -2008 and Fiscal Year 2008 -2009, the collection of

ISSUE: On April 11, 2007, six sealed bids were received and opened for the
construction of the Walnut Creek Sewer Renovations, Phase 5, District Project 5964.
The Board of Directors must award the contract or reject bids within 50 days of the bid
opening.
RECOMMENDATION: Award a construction contract and authorize the General
Manager to execute the Contract Documents.
FINANCIAL IMPACTS: Approximately $1,800,000 including design, bid price,
contingency, and construction management.
ALTERNATIVES /CONSIDERATIONS: Reject all bids, which is not recommended.
BACKGROUND: This project is the fifth of fifteen phases of sewer renovations in
Walnut Creek (see Attachment 1). The project will renovate approximately 6,500 feet of
6- through 12 -inch sewer pipe at six sites (one site is in Lafayette), replace the pipe
across Civic Park Bridge that is one of the sites identified in the 2006 Storm Damage
Project, and install seven spot repairs. Work will be done primarily in streets, with some
work in easements, and will utilize open -cut and pipe -burst methods.
The sewer crossing at the Civic Park Bridge was damaged during a storm that was
declared a federal and state disaster event. Disaster relief funds are available for a
portion of the costs to repair facilities damaged during the storm. The District applied
for and has received funding approval for $36,520 of the estimated $50,000 cost to
repair the damaged sewer.

District staff prepared the plans and specifications for the project. The Engineer's
estimate for construction of Walnut Creek Sewer Renovations, Phase 5, was
$1,600,000. This project was advertised on March 26 and 31, 2007. Six (6) sealed
bids ranging from $1,256,089 to $1,586,290 were received and publicly opened on
April 11, 2007. The Engineering Department conducted a technical and commercial
review of the bids and determined that California Trenchless, Inc. is the lowest
responsive bidder with a bid amount of $1,256,089. A summary of bids received is
shown in Attachment 2.
The District will administer the construction contract and will provide contract
administration, inspection, survey, office engineering, and submittal review. The funds
required to complete this project, as shown in Attachment 3, are $1,623,000. The total
cost of the Walnut Creek Sewer Renovations, Phase 5, is anticipated to be $1,800,000.
This project is included in the fiscal year (FY) 2006 -07 Capital Improvement Budget
(CIB) on page CS -30. Staff has conducted a cash -flow analysis of the Collection
System Program budget and concluded that adequate funds are available for this
project.
At its January 11, 2007 meeting, the CCCSD Board of Directors independently found
that this project is exempt from the California Quality Act (CEQA) under CCCSD CEQA
Guidelines Section 15301 since it involves only alterations to existing sewer facilities
with negligible or no expansion of capacity. A Notice of Exemption has been filed with
the County Clerk.
RECOMMENDED BOARD ACTION: Award a construction contract in the amount of
$1,256,089 for the construction of the Walnut Creek Sewer Renovations, Phase 5,
District Project 5964, to California Trenchless, Inc., the lowest responsive bidder, and
authorize the General Manager to execute the Contract Documents.

a) Recent Bay Area Air Quality Management District ( BAAQMD) Actions
BAAQMD issued a $250.00 settlement offer to the District on April 19, 2007, to
resolve Notice of Violation No. A48606, which was issued on November 26,
2006. The Board was previously informed of the NOV at the Board Meeting on
December 7, 2006. The NOV was issued for operating the multiple - hearth
furnace at less than 1,000 degrees Fahrenheit while burning landfill gas. The
temperature drop occurred during the annual switch from one furnace to another.
Staff has accepted the offer and mailed a check for $250 to BAAQMD.
Also, the District received a Notice of Violation on April 18, 2007, for failure to
report an inoperable monitor. On April 11, 2007, the BAAQMD Inspector and
District Associate Control Systems Engineer Bill McEachen discovered a "stuck"
high- temperature reading on an auxiliary boiler while reviewing treatment plant
data. A loose wire on the temperature sensor was identified as the problem and
was immediately corrected. However, because the inoperable monitor was not
identified earlier, a Notice of Violation was issued.
The Operations shift supervisors, the Plant Operations Superintendent, and the
Associate Control Systems Engineer review compliance data daily. Because
these reviews were focused on compliance, which is a minimum temperature
value of 770 degrees Fahrenheit, they did not detect the stuck high- temperature
reading. An alarm was added to notify the shift supervisors when the temperature
value is high.
b) Participation in Earth Day
The District was one of 50 exhibitors at the Saturday, April 21 st celebration at
John Muir National Park in Martinez. In spite of cool weather, more than 2,000
people attended the day -long celebration. Various division employees worked
the District booth with a display focused on the Household Hazardous Waste
Collection Facility and Pollution Prevention. Several boxes of literature on
pesticide -free gardening and household cleaning tips along with HHW magnets
and children's puzzles were distributed during the day.
One of the most popular elements of the entire fair was the "Construction Zone"
which included a photo backdrop of a bulldozer, actual construction signs, pieces
of sewer pipe, hardhats, work vests and a 90 -pound jackhammer. These were
used as props by Collection System Operations Maintenance Crew Leader Don
Turk while he took over 200 Polaroid photos of children and their families
throughout the day. Don's daughter spent the day on site to help her Dad.
c) Certificate of Achievement for Excellence in Financial Reporting
The Government Finance Officers Association sent a letter of notification on April
4th that the District's comprehensive Annual Financial Report for Fiscal Year
ending June 30, 2006 qualified for the Certificate of Achievement for Excellence
in Financial Reporting Award. This award is the highest form of recognition in
governmental accounting and financial reporting, and its attainment represents a
significant accomplishment by a government and its management. The award
plaque will be shipped to Controller Debbie Ratcliff towards the end of May.
d) Employee Attendance at WEF Conference on Collection Systems Issues
Associate Engineer. Gail Chesler of the Environmental Services Division in
Engineering will be attending the Water Environment Federation (WEF) Specialty
Conference on Collection System Issues from Saturday, May 12th through
Wednesday, May 16th. The training will take place in Portland, Oregon. Her
attendance at this conference is a specific line item in the Training budget for the
division.
e) Recognition in the Contra Costa Times by Bay Area Green Business Program
The Districts Fleet Services has been recognized again by the Bay Area Green
Business Program as a government agency that meets their standards for
pollution prevention, reduction of solid waste, and conservation of resources. The
Green Business Program recognized more than 250 businesses and agencies in
Contra Costa County in an ad in the Contra Costa Times on Monday, April 23rd.
(See attached).
f) San Ramon Mobile Household Hazardous Waste Collection Event
The District conducted a mobile household hazardous waste collection event in
San Ramon on Saturday, April 28th. The event took place from 9:00 a.m to 2:00
p.m. There was a total of 352 residents who participated in the event. Of this
total, 238 residents were from San Ramon, 94 from Danville, and 18 from the
unincorporated areas (Alamo, Diablo, etc.). Also, there were 2 residents from
outside our service area (Pleasanton). The District will not be conducting a
mobile collection event next fiscal year.
g) Television Inspection of Sanitary Sewers (Phase 5), DP 5547
Staff intends to advertise for the Television Inspection of Sanitary Sewers on May
11, 2007 and May 21, 2007 with bid opening on May 25, 2007. The position
paper for award is planned for June 7, 2007. The work is a 1 -year service
contract that provides sewer TV inspection services for the District wide
assessment of sewers with an option to add a second year. The estimated
quantity of TV inspection is 1,500,000 feet within Martinez and Danville.
h) Status of easement negotiations for North Orinda Sewer Renovations (Phase
2 1 Tarry Lane/Van Tassel Lane), DP 5968
Of the six properties that were covered by the "Resolution of Necessity" for
eminent domain, current status is as follows:
- Four have been settled with signed documents in hand;
- One is considering the District's current offer; and
- One has been transferred and a tentative settlement has been discussed with
the "successor trustees ".
A "Complaint in Eminent Domain" and a "Notice of Hearing for Order of
Possession" have been filed for the last two properties in the case that settlement
cannot be reached in a timely manner.
i) Public Bidding of Martinez Sewer Renovations (Phase 1), DP 5975
The project will renovate 2,600 feet of 6 and 8 -inch sewer pipe in Marina Vista,
and in easements on Ulfinian Way and Green Street by use of open cut and
pipeburst methods. This project will be advertised on May 24 and May 29, 2007.
The bids will be opened on June 7, 2007. The construction cost is currently
estimated at $920,000. More information will be presented at the Board Meeting.
j) Alhambra Valley Trunk Sewer Project
On May 2, 2007, the National Park Service (NPS) held a public meeting at the
John Swett Elementary School in Martinez to receive comments on the draft
Environmental Assessment (EA) report. A copy of the EA was provided to the
Board at the April 19th meeting. The District prepared display boards and
provided copies of the EA for the attendees. There were 15 attendees, all
residents and property owners within Alhambra Valley. The majority of questions
centered on how the potential sewer routes were determined and when project
construction would be completed but there was no opposition. The public review
period will end on May 18th, and public comments and responses will be
incorporated into the final report.
When the EA process is completed, provided the NPS Regional Director finds
there are no significant impacts resulting from the project (and there are none
thus far), the District and the NPS will enter into a License Agreement for
construction and maintenance of the trunk sewer across the NPS property. Staff
expects the Agreement will be completed in time to allow the construction of the
trunk sewer this summer.
k) Proposition 218 Sewer Service Charge
CCCSD mailed over 107,000 notices of the proposed increase in Annual Sewer
Service Charges. To date, we have received 7 letters, 52 telephone calls, and
14 a -mails in response to this notice. Twenty -four (24) of the responses were
general questions about the method of collection and the rate category applied to
them. Nineteen (19) of the responses were to relay that the property was on
septic tank and not connected to the sanitary sewer. Fourteen (14) of the
responses were opposed to the increase citing that it was more than the inflation
rate. Some of the responses were from senior citizens that expressed a desire
for a senior rate, and a few more suggested a metered approach to billing for
sewer service. There were also a couple of responses that were not opposed to
the increase and praised the District for it's service and reasonable rates.
Staff will continue to monitor the Sewer Service Charge rates hotline and e-mail,
and provide responses to any inquiries. A full report will be presented at the
public hearing scheduled for the June 7th Board Meeting.
1) Plant Wet Weather Protection Protect
Staff met with the Flood Control District (FCD) on April 30th to go over the
recently completed Corp Of Engineers (COE) hydraulic analysis of Walnut Creek.
The preliminary results show that only a small portion of District property, just
north of Basin B, is flooded during a 100 -year storm event. The model also
indicates that there is anywhere from 1 to 3 feet of freeboard along the levees
fronting District property. Staff will be meeting with FCD staff on May 9th to
further review the results, compare them to the water surface elevations
observed on December 31, 2005, and to discuss near term flood protection
measures. A full report on the meetings and results will be provided to the Board
at the May 24th Board Meeting.
m) Discussions with East Bay Regional Park District ( EBRPD)
Staff met with Trails Development Program Manager Jim Townsend on April 13th
to look at the general vicinity of the Shell Pipeline in Moraga. The Park District
continues to be interested in pursuing development of a trail over an approximate
4 mile long corridor at the end of the portion that is own by the District. Each
year, Jim Townsend does a presentation to the EBRPD Board to update them on
recent trail developments. He will include information on the Shell Pipeline
opportunity as part of his presentation at their May 17th Capital Trails Board
Workshop. At this time, their Board will have an opportunity to indicate their
interest in pursuing the development of a trail.
n) Marketing Effort to Pipeline Operators & Telecommunication Companies
Staff mailed out letters on March 14th soliciting interest in the District pipeline.
Advertisements were subsequently run in the Contra Costa Times, San
Francisco Chronicle, San Francisco Business Journal, and the San Jose
Business Journal. No letters of interest have been received to date; however,
staff has received 5 follow -up calls from potentially interested parties. The
deadline for receiving Letters of Interest is May 10, 2007.

Commission ( LAFCO) to exclude properties from a previously submitted annexation
application.
RECOMMENDATION: Adopt a resolution requesting LAFCO to exclude 9 properties
that are located outside the Urban Limit Line from the District application to annex 253
properties in the Alhambra Valley (District Annexation No. 168).
FINANCIAL IMPACTS: Minor staff costs to prepare and discuss the request with
LAFCO staff.
ALTERNATIVES /CONSIDERATIONS: The Board could decide not to request
exclusion of the 9 properties from the original application to LAFCO and pursue
annexation of all 253 properties. LAFCO would consider the County's concerns about
serving properties outside the Urban Limit Line and make a decision whether or not to
annex the 9 properties in question. Also, the Board could decide to withdraw the
original application and resubmit a new application without the 9 properties outside the
Urban Limit Line. This would result in a delay of several months for the annexation
proceedings and would delay connection of properties that are in need of sewer service.
BACKGROUND: At its July 6, 2006 meeting, the Board adopted Resolution of
Application 2006 -047 to initiate formal LAFCO proceedings to annex the anticipated
near -term service area of the planned Alhambra Valley Trunk Sewer (District
Annexation No. 168). The annexation request was for 253 separate properties. This
action was taken to ensure the District's jurisdictional authority to provide wastewater
utility service in Alhambra Valley and to avoid the inefficient, piecemeal processing of
annexation applications from properties that are expected to obtain sewer connection
permits in the near future.

253 PROPERTIES IN THE ALHAMBRA VALLEY, DISTRICT ANNEXATION NO. 168
After a review of the District's annexation application to LAFCO, the County Community
Development staff identified 9 of the requested parcels as being outside the County's
Urban Limit Line. These parcels are on the outer edges of the District's proposed
annexation area and are identified on the attached map by the letters "A" through "I ".
Information on the parcels is included in the attached table. County policy strongly
opposes extension of urban services (and the necessary annexations) beyond the
Urban Limit Line. County Community Development Department staff have expressed
opposition to annexing these and requested that the District exclude these 9 parcels
from the annexation application submitted to LAFCO.
LAFCO is an independent agency and is not legally bound to comply with the County
policies. However, LAFCO generally will enforce these policies as part of any
annexation decision.
At the request of the Board, District staff consulted with both the County Community
Development and LAFCO about annexation of the properties outside the Urban Limit
Line. Based on these discussions, staff recommends that the Board direct staff to
submit a letter to LAFCO requesting exclusion of the 9 parcels that are outside the
Urban Limit Line from the annexation. It will adversely affect the 9 parcels outside of
the Urban Limit Line and those property owners may choose to make their concerns
known to the Board and LAFCO.
The 9 affected property owners can install or continue to use septic tank systems or
other individual on -site wastewater systems that are approved by the County
Environmental Health Division. If the property owners wish to pursue public sewer
service and /or if any of the individual wastewater systems fail, the property owners
would have to request the County to change the Urban Limit Line. County policy is that
for requests involving less than 30 acres total, the Board of Supervisors may approve a
change to the Urban Limit Line. If the change involves properties totaling more than 30
acres, the Urban Limit Line change would have to be approved by County voters.
Alternatively, the property owner may request LAFCO to allow service by the District by
way of an "Out of Agency Service Agreement ". Approval of this option is discretionary.
Staff notified the owners of the 9 affected properties about the Board meeting today and
the upcoming LAFCO meeting in June.
RECOMMENDED BOARD ACTION: Adopt a resolution requesting LAFCO to exclude
9 properties that are located outside the Urban Limit Line from the District application to
annex 253 properties in the Alhambra Valley (District Annexation No. 168).

BE IT RESOLVED by the Board of Directors of the Central Contra Costa
Sanitary District ( "District ") as follows:
WHEREAS the District, through District Annexation No. 168, requested the Local
Agency Formation Commission ( LAFCO) to annex 253 properties in the Alhambra
Valley to the District service area; and
WHEREAS nine (9) of the 253 properties, although within the District sphere of
influence, are situated outside the Contra Costa County Urban Limit Line; and
WHEREAS the policy of Contra Costa County is to discourage the extension of
public utility services, such as sewers, to the properties outside the Urban Limit Line;
and
WHEREAS County staff has requested the District to withdraw the annexation
request for the nine properties outside the Urban Limit Line;
THAT District staff is directed to request LAFCO to exclude the nine properties
outside the Urban Limit Line when LAFCO considers District Annexation No. 168.

scheduled to consider the annexation of Alhambra Valley properties to CCCSD at a meeting

provide you with sewer service unless you qualify for an "Out of Agency Service Agreement'

request involves fewer than 30 acres total, the Board of Supervisors may approve a change to
the Urban Limit Line. If the change involves properties totaling more than 30 acres, the Urban
Limit Line change would have to be approved by County voters. If you would like more

ISSUE: The Board reviewed the personnel needs of the District for Fiscal Year 2007-
2008 at its April 5, 2007, meeting. Accordingly, staff is submitting the Staffing Plan for
Board approval.
RECOMMENDATION: Approve the Staffing Plan for Fiscal Year 2007 -2008.
FINANCIAL IMPACTS: The proposed Staffing Plan would increase annual salary
costs by $472,371.
ALTERNATIVES /CONSIDERATIONS: Modify or reject the proposed Staffing Plan.
BACKGROUND: Each department has reviewed its staffing requirements for Fiscal
Year 2007 — 2008. The Staffing Plan was provided to the Board at its April 5, 2007,
meeting which included departmental overviews, personnel actions taken during Fiscal
Year 2006 — 2007 to -date, requested changes and their justifications, new job
classification descriptions, and organizational charts reflecting proposed changes.
There were fifty -two personnel actions during Fiscal Year 2006 — 2007.
The attached summary sheet highlights the effect of each department's staffing
requests on the number of total authorized positions in the District and the costs in
salaries and benefits. As shown in the summary, the total number of authorized regular
positions. in the District will be three more than last year. Eight Co -op student positions
are requested which is two less than last year.
The salaries and wages in the 2007 — 2008 O & M Departmental Budgets will increase
from the previous year due to cost -of- living salary adjustments and any merit and
longevity increases scheduled in 2007 — 2008. Staff is recommending the salaries for
Co -ops be increased to $24.00 an hour.

ISSUE: The Self- Insurance Fund (SIF) is to be reviewed each year by the Board of
Directors with staff presenting funding recommendations for the upcoming fiscal year.
The Budget and Finance Committee will review this position paper at the May 7, 2007
Committee meeting and will provide the Board with their comments.
RECOMMENDATION: Receive the 2007 -08 SIF Budget and authorize the allocation
of $800,000 to the fund from the 2007 -08 Operations & Maintenance (O &M) Budget for
inclusion in the budget.
FINANCIAL IMPACTS: The impact of this action requires the allocation of $800,000
from the 2007 -08 O &M Budget to the SIF.
ALTERNATIVES /CONSIDERATIONS: The alternatives to this action are to provide
less funds than recommended, to not fund the SIF, decrease the fund balance, or to
increase the fund balance by transferring more than $800,000.
BACKGROUND: The Board has asked staff to obtain insurance premium quotes with
Self Insured Retention (SIR) levels of $500,000 and $1,000,000. The District's
insurance Broker, Alliant Insurance Services, is in the process of receiving that
information from insurance carriers, mid -May. Staff will be presenting the information at
the June 7, 2007 meeting for review, discussion and direction by the Board. The
impact of selecting a $1,000,000 SIR is that District insurance premiums would be
lowered and GASB 10 would require a larger reserve for Sub -fund A than the current
approximately $630,000. Again, this will be discussed with the Board at the June 7,

2007 meeting in order for the Board to consider all of the facts in determining the
appropriate SIR level.
The District has self- insured most of its liability and some of its property risks since July
1, 1986, when the Board approved the establishment of the Self- Insurance Fund. The
SIF has effectively funded District losses over its twenty -one year history.
In 1994, Government Accounting Standards Board Statement No. 10 (GASB -10) set
forth requirements on how public agencies must fund their self- insured risks. To assure
compliance with GASB -10 and to easily track and monitor revenues and expenses, the
District restructured the SIF into three sub - funds.
Each of the three (3) sub -funds was established for funding specific risks. Sub -fund A
was established to reflect general (sewer overflows and slip and falls) and automobile
liability losses. The loss information is used by the actuary to establish future estimated
losses in compliance with GASB 10 requirements. Sub -fund B was established to
reflect pollution and employment liability losses. GASB 10 requires funding for potential
claims but does not require an actuarial study. The District established Sub -fund C to
capture the budgeted and actual expenses for insurance premiums and for legal and
technical support in administering the Self Insurance Fund.
The Operations & Maintenance (O &M) Fund supports the Self Insurance Fund (Sub -
fund C) by transferring funds. In fiscal year 2006 -2007 the Operations & Maintenance
(O &M) Fund transferred $700,000 to the SIF. Staff is recommending that $800,000 be
transferred in fiscal year 2007 -2008. The District must keep a minimum of
approximately $630,000 in sub -fund A to comply with GASB 10. Sub -fund B reserve
was established at $2,450,000 and is for employment related and pollution related
risks. There have not been any claims against the reserve for several years. The
District is required to maintain an adequate reserve for any employment related and
pollution related claims as mandated by GASB 10. However, there is no specific
funding level required. Staff recommended to the Board at the Financial Planning and
Policy Workshops to increase the contribution from the General Fund to the Self
Insurance Fund from $250,000 in 2005 -2006 to $800,000 in fiscal year 2007 -2008 and
gradually increasing to $950,000 in 2013 -2014. Sub -fund C receives the 0 &M Fund
allocation. Funds are transferred from Sub -fund C to Sub -fund A, and Sub -fund B if
needed, to cover claims and losses against the District and to fund the GASB 10
reserve level. Sub -fund C reserve level is adjusted by Sub -fund A and B financial
needs. Prior to fiscal year 2006 -07, Sub -fund C reserve was reduced as the O &M Fund

allocation was increased in an effort to meet the funding needs of GASB 10 and the
Self Insurance Fund.
SUB -FUND A: GASB -10 actuarially based risks. These include general liability (sewer
overflow property damage and slip and falls) and automobile liability risks. Under the
requirements of GASB -10, risks that could be actuarially studied must be funded based
on an actuarial study that must be done every two years. General liability and
automobile liability are readily studied throughout the insurance and self- insurance
industry to determine funding levels for these liabilities. The District obtained an
actuarial review of its self- insured general liability and automobile liability in April 2007
that projected losses for these risks. The actuary, Advanced Risk Management
Techniques (ARM Tech) is recommending the Sub -Fund A reserve for future claims be
$629,820 based on insurance industry statistics and the District's actual claims
experience. Sub -Fund A was established to insure these risks based on the District
having a $10,000,000 excess liability policy with a $500,000 self- insured retention. The
Board is not limited to determine the appropriate Self Insured Retention (SIR) level by
approving the O &M Fund allocation and the SIF budget. Preliminary review of moving
from a $500,000 to $1,000,000 SIR would reduce the general liability insurance
premium and increase the GASB 10 reserve requirement by approximately $70,000.
The annual average expense for Sub -fund A over the past three fiscal years has been
approximately $280,000, offset by an average revenue of approximately $20,000 for a
net draw down of reserves of $260,000 annually. The projected 2006 -2007 revenue is
$46,000 and cost is $140,000 for a decrease in reserves of $94,000 for Sub -fund A.
This has depleted excess reserves. This assumes annual claims of approximately
$150,000. In order to fund the SIF operating expenses and claims while maintaining
reserves at approximately $630,000 for the General and Automobile Liability (Sub -fund
A) and $2,400,000 for the Employment and Pollution Liability (Sub -fund B) the O &M
Fund contribution must be increased.
SUB -FUND B: GASB -10 Non - actuarially -based risks. These include employment -
related and pollution - related risks. GASB -10 requires that all potential risks be
adequately and soundly funded even though these risks are not actuarially reviewed.
An actuarial study was not required for these risks since losses for employment - related
and pollution - related risks are often predicted with less accuracy because these types
of cases occur infrequently but may result in extremely high costs and losses. With
guidance from risk management and insurance specialists, the District originally
established Sub -Fund B at $2,450,000 to fund employment - related and pollution-

related risks. At times, the Sub -fund B reserve has been lowered to meet the GASB 10
Sub -fund A reserve requirement. However, the Sub -fund B reserve is now able to be
returned to $2,400,000 (fiscal year 2006 -07) and still meet the Sub -fund A GASB 10
requirement.
SUB -FUND C: Non -GASB 10 risks. This Sub -fund covers risk management program
insurance premiums, potential losses from uninsurable risks, and the costs of initiating
claims and lawsuits against others who have damaged the District. It also provides a
transfer to Sub -funds A and B as needed to meet legal or District requirements. The
District established this Sub -fund to finance non -GASB 10 risks under our risk
management program. Specific costs include: insurance premiums for a $10,000,000
excess liability policy and insurance premiums for insuring District properties for fire,
explosion, water damage, etc. for losses above $250,000. This Sub -fund has used its
reserves to offset the significant increases in premiums for the past five years. Staff is
anticipating an approximate increase in general liability insurance premiums of five
percent, and a ten percent increase in property insurance premiums.
Sub -Fund C reserves are projected to be at approximately $250,000 for this fiscal year
2006 -07 and $330,000 for 2007 -08. Increased contribution from the O &M Fund will be
required to meet the financial obligations of the SIF now and in the future.
FINANCIAL INFORMATION: Exhibit I presents a recent financial history and projection
of the SIF and shows the 2007 -08 SIF budget estimated total revenues of $1,000,000
and total expenses of $918,000, increasing the projected 2007 -08 total SIF reserves by
$82,000 to $3,360,000 as of June 30, 2008. The budgeted revenues include a
recommended allocation of $800,000 from the 2007 -08 O &M budget to the SIF.
Exhibits II, III & IV (attached) present the projected Sub -fund A, Sub -fund B and Sub -
fund C 2007 -08 budget summary.
In summary, the significant increase in insurance premiums to the District over the past
five years, and the settlement of a sewer overflow claim equaling the District's SIR has
depleted the excess reserve funding. The O &M Fund allocation will likely require an
increase from the 2007 -08 $800,000 budget proposal to a maximum contribution of
$950,000 starting in fiscal year 2013 -14 to meet SIF operating expenses and maintain
appropriate reserves as reported in the District's Ten Year Financial Plan presented to
the Board in January of each year.
