ISSUE: The Board of Directors' authorization by resolution is required to quitclaim
easements and record documents.
RECOMMENDATION: Adopt a resolution authorizing execution of Quitclaim Deeds to
Rhodora C. Quintans (APN 125 - 080 -120); Todd Darby (APN 125 - 080 -119); Arbor
Springs Homeowners Association (APN 125 - 080 -123); and Larry, Drake and
Janie Tarter (APN 125 - 080 -012), and authorize recording of the documents.
FINANCIAL IMPACTS: None.
ALTERNATIVES /CONSIDERATIONS: None.
BACKGROUND: In 1981, the District acquired an easement for an 8 -inch sewer main
over property, a portion of which was subsequently split into the subdivision now known
as Arbor Springs. The sewer main was relocated to a new alignment (new easement
dedicated to District on Subdivision Map 450 M48) as part of the new subdivision, and
the old sewer was abandoned. Staff has determined that the 1981 easement is not
needed. See Attachment 1 for a map showing the easement to be quitclaimed.
RECOMMENDED BOARD ACTION: Adopt a resolution authorizing the President of
the Board of Directors and the Secretary of the District to execute Quitclaim Deeds to
Rhodora C. Quintans, Todd Darby, Arbor Springs Homeowners Association, and Larry,
Drake and Janie Tarter, on behalf of the District, and authorize staff to record the
document.

ISSUE: A resolution of the Board of Directors is required to accept public sewer
improvements and offers of dedication, and to authorize staff to record documents.
RECOMMENDATION: Adopt a resolution accepting public sewer improvements and
an offer of dedication, and authorizing staff to record the easement acceptances with
the Contra Costa County Recorder.
FINANCIAL IMPACTS: None.
ALTERNATIVES /CONSIDERATIONS: None.
BACKGROUND: The Board of Directors regularly accepts easements and public
sewer improvements by resolution. The recommended resolution will accept an
easement shown on the recorded final map of Subdivision MS 805 -00 that is required
for a recent public sewer extension off Geary Road in the City of Walnut Creek (as
shown on Attachment 1). The final subdivision map and public sewer improvements
have been reviewed by District staff and deemed in compliance with District standards.
RECOMMENDED BOARD ACTION: Adopt a resolution accepting Job No. 5590,
public sewer improvements, and an offer of dedication from Hussan Ahmadzadeh,
Marian Safapay, and Masoud Olfati for an easement shown on the recorded final map
of MS 805 -00 in the City of Walnut Creek (Job No. 5590), and authorizing staff to
record the easement acceptances with the Contra Costa County Recorder.

ISSUE: Construction has been completed on the Piping Renovations and
Replacement Project, Phase 2, District Project 7208, and the work is now ready for
acceptance.
RECOMMENDATION: Accept the contract work for the Piping Renovations and
Replacement Project, Phase 2, District Project 7208, and authorize the filing of the
Notice of Completion.
FINANCIAL IMPACTS: None related to this action.
ALTERNATIVES /CONSIDERATIONS: Not Applicable. Filing the Notice of Completion
is advisable under the California Civil Code, Section 3090.
BACKGROUND: During the Water Reclamation Plant Project, Stage 5A, Phase 1
(DP 3760), numerous piping systems were installed throughout the treatment plant.
These pipes carry the processed wastewater, sludge, steam, air, and other utility
services between the various sections of the plant. These pipes have been in place for
almost thirty years. Some of these pipes are leaking due to corrosion. Failure of such
piping will adversely impact treatment plant operations.
Phase 1 of this project (DP 7183) renovated or replaced various piping systems,
including replacement of the service air line from the compressor to the air driers,
replacement of the main service air header, modification and replacement of piping
between the grit pumps and classifiers, replacement of return activated sludge (RAS)
suction header piping, modification of the scum piping to reduce blockages, and
downsizing the recycled water meter.
This Phase 2 project renovated or replaced deficient portions of the following piping
systems: leaking and corroded valves on the centrifuge feed pumps in the Solids
Conditioning Building; piping, flow meter, and valves at the sludge grinders in the

Sludge Control Building; seal water piping in the Primary Tank west gallery area; air and
seal water piping for Dissolved Air Flotation (DAF) Recycle Pumps; renovation of the
centrate pipelines in the Solids Conditioning Building; renovating sections of the
Standby Effluent Pump discharge piping; and replacing corroded sections of the
Northwest and South Sump Pump piping.
On June 3, 2004, the Board of Directors authorized the award of a contract for the
construction of the project to Kaweah Construction Company. The Notice to Proceed
was issued on June 28, 2004. The work was substantially completed on February 3,
2005. The remaining items of work consist of minor punch -list items, which do not
affect the project acceptance.
The total authorized budget for the project is $1,197,000. The budget includes the cost
of engineering design, District forces, testing services, contractor services, etc. An
accounting of the project costs will be provided to the Board at the time of project
closeout. It is appropriate to accept the contract work at this time.
RECOMMENDED BOARD ACTION: Accept the contract work for the Piping
Renovations and Replacement Project, Phase 2, District Project 7208, and authorize
the filing of the Notice of Completion.

ISSUE: Section 6490 of the Health and Safety Code of the State of California provides
that District ordinances shall be published once in a newspaper of general circulation
within the District, and provides that an Order of the Board of Directors of the District to
the effect that the ordinance has been published shall constitute conclusive evidence
that publication has been properly made.
RECOMMENDATION: Adopt a resolution confirming the publication or District
Ordinance No. 233.
FINANCIAL. IMPACTS: None rel "ated to this issue.
ALTERNATIVES /CONSIDERATIONS: Establishes presumption that the ordinance
was correctly published and therefore would be deemed procedurally valid by a court.
BACKGROUND: District Ordinance No. 233 which was adopted by the Board at the
meeting of December 16, 2004, and which amends District Code Section 6.20.300
Schedule of Reimbursement Fees to Establish Reimbursement Fees Applicable to
Properties that Directly Connect to Project 5694 (Winchester Lane, Martinez) or Project
5732 (Orchard Estates Drive, Walnut Creek) Standard Sewer Facilities, was published
in the Contra Costa Times on January 11, 2005. Proof of publication is attached.

funds from the Deferred Compensation Plan.
RECOMMENDATION: Approve the request by Elaine Jacobs for an emergency
withdrawal of $10,900 after taxes, from the Deferred Compensation Plan, as
recommended by the Deferred Compensation Plan Advisory Committee.
FINANCIAL IMPACTS: None
ALTERNATIVES /CONSIDERATIONS: This request could be denied, however, this is
not recommended as the request meets the requirements for emergency withdrawals
as set forth by the Internal Revenue Service.
BACKGROUND: Elaine Jacobs, Household Hazardous Waste Supervisor, has
requested an emergency withdrawal from the Deferred Compensation Plan based on
extreme financial hardship caused by a long -term illness over the past year. The
Deferred Compensation Plan Advisory Committee has reviewed the request and
determined that it meets the requirements for emergency withdrawal in the amount of
$10,900 after taxes.
RECOMMENDED BOARD ACTION: Approve the request by Elaine Jacobs for an
emergency withdrawal of $10,900 after taxes, from the Deferred Compensation Plan,
as recommended by the Deferred Compensation Plan Advisory Committee.

BACKGROUND: As a condition of accepting his employment, Staff Engineer
Nathaniel Morales requested an unpaid leave of absence to accommodate previously
made arrangements for an extended post - graduation trip. Nathaniel was a District
Co -op and one of the top candidates for the four Staff Engineer positions. Staff took
his planned absence into account when a decision was made to hire Nathaniel.
RECOMMENDED BOARD ACTION: Authorize a leave of absence without pay for
Nathaniel Morales, Staff Engineer, from March 22, 2005 to May 13, 2005.

SUBJECT: PROPOSED LETTER REGARDING THE PROCESS FOR PUBLIC
SEWER EXTENSION IN THE EL TOYONAL / ALTA VISTA /DOS OSOS /
CAMINO DEL MONTE AREA IN THE CITY OF ORINDA
Over the past year, the Development Services Section has received several inquiries
regarding CCCSD's requirements for extension of service from property owners and
prospective buyers of property in the El Toyonal / Alta Vista / Dos Osos / Camino del
Monte area of the City of Orinda. Because of this interest, we planned to conduct a
survey by letter to determine whether other area property owners were interested in
receiving sewer service in the first quarter of 2005.
We were recently informed by Orinda's City Attorney that a property owner had filed a
lawsuit against the City and Contra Costa County in U. S. District Court claiming that the
county's moratorium on new or expanded septic systems is unconstitutional and
discriminatory. The Federal Magistrate hearing the suit directed the litigants to meet
with CCCSD to investigate the process for extending public sewer to the plaintiffs
property.
I met with the litigants on February 7. As a result of that meeting, the plaintiff and the
City Attorney requested that CCCSD send a letter to other property owners in the area
who might benefit from sewer service. The content of the letter was to be similar to the
survey that staff was planning for the same time frame.
Attached to this memo is a draft of the letter we propose to send to area property
owners. This matter was discussed with the Board's Outreach Committee at its meeting
on February 24, 2005.

POTENTIAL SEWER PROJECT TO SERVE YOUR PROPERTY AT

Central Contra Costa Sanitary District (CCCSD) is the agency that provides wastewater
collection and treatment services for properties in the City of Orinda. Over the past year,
several property owners and prospective buyers of both vacant lots and existing homes
on septic tanks have contacted CCCSD to inquire about extending public sewer service
in the El Toyonal / Alta Vista / Dos Osos / Camino del Monte area of Orinda. In order for
CCCSD to provide public sewer service, one or more area property owners will need to
pay for design and construction of new main sewer extensions from the end of the
existing public system (near El Toyonal and Camino del Cielo) to their properties. I have
enclosed a map showing possible routes for public sewers to serve the area for your
information. One of these property owners and City of Orinda staff have asked CCCSD
to assist in identifying other owners of property in the area who may be interested in
receiving public wastewater utility (sewer) service.
In response to this request, we are sending this letter to you and other area property
owners with two purposes: 1) to suggest that you consider the benefits of public sewer
service for your property; and 2) to ask that you indicate your level of interest in a
project to extend service to your property and your willingness to attend a meeting on
the subject. If there is sufficient interest, CCCSD and the City will host a meeting in
Orinda to explain possible sewer routes, the process and estimated costs for extension
of public sewer and connection of individual properties to the public sewer system, and
the Reimbursement Program administered by CCCSD for property owners who choose
to initially pay for sewer extension projects.
Please note that if a public sewer extension project is undertaken, participation of
property owners along the project's route is voluntary. That is, each property owner may
choose whether to participate or not. Those who choose not to participate initially, but
later decide to connect to the sewer, will pay a "reimbursement fee" to the original
installers for their share of project costs.

Prospective buyers who consider purchasing property with existing septic systems
frequently ask CCCSD staff about the availability and cost of public sewer service. An
opportunity may now exist to work cooperatively with your neighbors, CCCSD and the
City of Orinda to plan for extension of public sewer service to your area, and thus solve
current and potential chronic or sudden septic system problems.
Please fill out the enclosed questionnaire, and return it to me in the addressed and
stamped envelope (also enclosed) by March 25, 2005. If we receive enough interest, we
will schedule an informational meeting shortly thereafter, and will notify you by mail of
the day, time and place.
