ISSUE: Board action is required on the following listed properties to initiate the
annexation process.
RECOMMENDATION: Authorize Proposed Annexations 03 -01, 03 -02, 03 -07, 03 -08,
03 -09, 03 -10, 03 -11, 03 -12, 03 -13, 03 -14, 03 -15, 03 -16, 03 -17, and 03 -18 to be
included in future formal annexations.
FINANCIAL IMPACTS: None related to this action.
ALTERNATIVES /CONSIDERATIONS: Not applicable.
BACKGROUND: The owners (marked in bold type) of the properties listed in
Attachment 1 have petitioned for their properties to be annexed to the District and are
planning new connections or have abandoned their existing septic systems and
connected to public sewer. Proposed annexation is the first step for preliminary Board
approval and comments prior to formal annexation.
Additionally, to avoid creating any new "islands" inside the District boundaries,
neighboring properties were identified as potential "fill- ins ", necessary to complete the
District annexation boundary. Potentially, both PA 03 -10 and PA 03 -13, would have
created unacceptable "islands ". Therefore, staff sent letters inviting owners of the
identified "fill -in" properties to complete petitions of annexation in order to participate in
the District annexation process. Several owners subsequently complied and are

included in Attachment 1. Upon advice from the Local Agency Formation Commission,
other significant properties not returning petitions have been included in the listing and
on the proposed annexation maps so that the Board may approve their inclusion as a
proposed annexation. They are noted as "fill -in" properties.
The initiating petition for P.A. 03 -10 was submitted by Ashley V. Partners, for their
planned, five -lot Subdivision 7647. The lead agency for the Negative Declaration is
Contra Costa County. Subsequently, several adjacent homeowners completed the
annexation petitions mailed to them on July 16, 2003, as having interest in connecting
their properties, as they will be served by the new sewer main extension.
RECOMMENDED BOARD ACTION: Authorize Proposed Annexations 03 -01, 03 -02,
03 -07, 03 -08, 03 -09, 03 -10, 03 -11, 03 -12, 03 -13, 03 -14, 03 -15, 03 -16, 03 -17 and 03 -18
to be included in future formal annexations.

ISSUE: Board approval is required to accept offers of dedication, and to record
easement acceptances.
RECOMMENDATION: Adopt a resolution accepting public sewer improvements and
an offer of dedication at no cost to the District, and authorize recording.
FINANCIAL IMPACTS: None.
ALTERNATIVES /CONSIDERATIONS: None.
BACKGROUND: The District routinely accepts easements and public sewer
improvements through Board approval of resolutions to that effect. The recommended
resolution presented here will accept easements (as shown on Attachment 1) that are
required for a recent Contractual Assessment District (00 -03) sewer extension at
Angelo Street and El Sombro in the Lafayette area. The easements and public sewer

motors, and spare parts for an amount not to exceed $325,000.
RECOMMENDATION: 1) Exempt this purchase from public bidding requirements;
2) Authorize the General Manager to execute a purchase of three Cornell pumps for
Orinda Crossroads Pumping Station including motors, spare parts, and 10 percent
contingency for an amount not to exceed $162,500; 3) Authorize the General Manager
to execute a purchase of three Cornell pumps for Moraga Pumping Station, if the test
pump is successful in meeting vibration requirements, including motors, spare parts,
and 10 percent contingency for an amount not to exceed $162,500; and 4) Allocate
funds from the sewer construction fund for this purchase.
FINANCIAL IMPACTS: A maximum of $325,000 will be spent for the purchase of up to
six pumps, motors, spare parts, and contingency. As part of a Board authorized
settlement agreement with GSE, the general contractor for the Moraga and Orinda
Crossroads Pumping Stations Renovation Project (DP 5237), the District has agreed to
pay GSE $67,500 for the installation of the pumps. This will make the estimated total
cost of this installation $392,500. Staff will attempt to recover cost from Morris Pumps.
ALTERNATIVES /CONSIDERATIONS: Do not approve the purchase. This is not
recommended as the Morris pumps installed as part of the Moraga and Orinda
Crossroads Pumping Stations Renovation Project (DP 5237) have not met the vibration
specifications and have already exhibited unacceptable wear and premature failures.
BACKGROUND: As part of the Moraga and Orinda Crossroads Pumping Stations
Renovation Project (DP 5237), six new pumps and motors were installed (three at each

pumping station). These pumps and motors were supplied by Morris Pumps. These
pumps have not met the specified vibration criteria (despite numerous modifications by
Morris Pumps).
At the December 5, 2002 Board meeting, the Board authorized the General Manager to
purchase two pumps and motors for the purpose of a field test for an amount not to
exceed $150,000 to verify their suitability for long term operation at the Moraga and
Orinda Crossroads Pumping Stations. Cornell Pumps provided a "loaner" test pump for
the cost of shipping. This pump has performed successfully at the Orinda Crossroads
Pumping Station.
Based upon the successful performance of Cornell at the Orinda Crossroads Pumping
Station, staff requests authorization to purchase three pumps, motors, and spare parts.
Pending successful performance of Cornell at the Moraga Pumping Station, staff
requests authorization to purchase three pumps, motors, and spare parts for that
pumping station.
Staff is strongly recommending a sole source purchase of the pumps from Cornell as
being both appropriate and necessary in order to meet the District's needs. This
recommendation is based on the substantial experience, testing, and analysis which
have occurred concerning the existing application of the Morris pumps conducted by
District engineering staff and several groups of experts employed by the District. The
evaluation that has been ongoing for over a year indicates that the pump application in
both Orinda and Moraga is demanding in terms of both the space and performance
specifications. Of the various pump manufacturers contacted, only Cornell has
indicated an ability to meet the space configuration requirements, the high speed
design requirements, and the proven ability to meet the performance specifications,
including the vibration specifications for this application. The only other pump
manufacturer that expressed an interest in providing pumps for this application has
proposed a pump which is not a high speed pump and, therefore, would require further
modification to accommodate its installation and would increase the cost of the pump
replacement substantially. Cornell pump design and configuration being tested is
proprietary and, hence, can only be obtained through a sole source purchase from a
Cornell manufacturer's representative assigned to this area. Staff and District Counsel
have concluded that based on the substantial efforts undertaken to address the current
pump performance problems that it would clearly be in the best interest of the District to
enter into a sole source purchase of Cornell pumps, and any attempt to publicly bid the

ISSUE: Authorization by the Board of Directors is required for the addition of funds to
Program Budgets from the Sewer Construction Fund.
RECOMMENDATION: Authorize an additional $220,000 from the Sewer Construction
Fund to the General Improvements Program of the 2003 -04 Capital Improvement
Budget (CIB).
FINANCIAL IMPACTS: The authorization of additional funds will allow budgeted
projects to continue as presented in the FY 2003 -04 CIB. It is anticipated that the
overall Capital Improvement Budget will be under spent as presented during the Board
CIB Workshop.
ALTERNATIVES /CONSIDERATIONS: If this supplemental authorization is not
approved, the CSOD Fuel System Modifications project (DP 8201) will be delayed or
eliminated and other alternatives found for the fueling of District vehicles.
BACKGROUND: Each year as part of the CIB adoption process, the Board of
Directors authorizes funding levels for each of the four capital programs: Treatment
Plant, Collection System, General Improvements, and Recycled Water. The Board
authorized $1,617,000 for the General Improvements program for FY 2003 -04. This
program funds the District's Equipment Budget, Management Information Systems
projects, and general facilities improvement projects for the District. The CSOD Fuel
System Modifications project (pages GI -33 through GI -35) is a project to upgrade the
fueling facilities at the District's corporation yard in Walnut Creek and bring them into
compliance with current regulations and to make it possible to obtain an air permit.
The CSOD Fuel System consists of two fuel tanks, underground piping, and a fuel
dispensing system. During a recent annual inspection deficiencies were found in the
underground storage tanks and piping. These deficiencies would make it difficult for
the District to obtain an air permit for the existing fuel tanks and dispensing system.

This project would also enable the system to meet upcoming regulations for December
2003 that require the District provide under - dispenser containment.
This project would replace the two underground storage tanks, the existing fuel pumps
and associated piping, all of which will conform to current regulations. Above ground
tanks were considered, but space constraints made this option infeasible. Staff
recommends maintaining a fueling facility at CSO for convenience, efficiency, and
productivity. Equally important, is to provide reliability in acquiring fuels for the District's
fleet and equipment to comply with anticipated regulations and in the event of
emergency. Additionally, a considerable cost saving is also realized due to lower bulk
rates for gasoline and diesel.
The budget allocation for this project in the 2003 -04 CIB is $140,000, which was a
placeholder for the intended project. However, the detailed cost estimated for the final
configuration of the project is estimated at $360,000. The reason for the cost difference
is that the full impact and cost of meeting the regulations was not anticipated in the
initial project discussions. The current design includes features that will meet current
and proposed regulations.
Staff proposes that the Board of Directors approve a supplemental authorization of
$220,000 for the General Improvements Program in order to proceed with the bidding
and construction of the CSOD Fuel System Modifications project (DP 8201). This
additional authorization will allow construction of the new fuel dispensing facilities, but
does not include monies for cleanup if significant contamination should be discovered
during excavation. If site cleanup should be required, staff will evaluate cleanup options
and come back to the Board if significant additional expenditures are required.
RECOMMENDED BOARD ACTION: Authorize an additional $220,000 from the Sewer
Construction Fund to the General Improvements Program of the 2003 -04 Capital
Improvement Budget.
