ISSUE: Construction has been completed on the Lafayette Sewer Renovation Project,
Phase 3B, District Project 5611, and the work is now ready for acceptance.
RECOMMENDATION: Accept the contract work for the Lafayette Sewer Renovation
Project, Phase 313, District Project 5611, authorize the filing of the Notice of Completion,
and authorize the General Manager to make payment to the City of Lafayette for street
slurry sealing.
FINANCIAL IMPACTS: None related to this action.
ALTERNATIVES /CONSIDERATIONS: Not applicable. Filing the Notice of Completion is
advisable under the California Civil Code, Section 3093.
BACKGROUND: The Lafayette Sewer Renovation Project, Phase 3B, is part of the
ongoing sewer renovation program included in the Capital Improvement Budget and
Plan. The project involved replacement/rehabilitation of sewers ranging in size from six
(6) to fifteen (15) inches in diameter and using both open cut and pipe bursting
methods. The contract included construction at sixteen (16) sites, however one (1)
site, 316 Glorietta Boulevard, was deleted due to homeowner concerns. Project
construction occurred at fifteen (15) separate sites, of which ten (10) sites required work
within easements in residential areas. Phase 3B contained a higher percentage of
sewer work within easements than previous phases, requiring greater staff time and
effort to coordinate easement access and property restoration. The approximate
footage of sewer pipe that was replaced/ rehabilitated in the streets and in the
easements are 5,500 LF and 3,200 LF, respectively (see attachment 1 for site
locations). The project originally included slurry sealing of streets where new sewers

were installed, however due to winter weather conditions this work was deleted from the
contract. Staff negotiated an agreement for street slurry sealing with the City of
Lafayette and the City will complete the slurry seal as part of their annual pavement
restoration program this summer. The District will contribute $25,000 to the City, the
cost of the slurry seal had the District completed the work.
On June 20, 2002, the Board of Directors (Board) authorized the award of a contract for the
construction of the project to Ranger Pipelines, Incorporated, of San Francisco, California.
The Notice to Proceed was issued on July 24, 2002. The work was substantially completed
on January 3, 2003. The remaining items of work consist of minor punch -list items, which
do not affect the project acceptance.
The total authorized budget for the project is $1,368,000. The budget includes the cost of
engineering design, District forces, consultant services, testing services, geotechnical
services, contractor services, etc. An accounting of the project costs will be provided to the
Board at the time of project closeout.
RECOMMENDED BOARD ACTION: Accept the contract work for the Lafayette Sewer
Renovation Project, Phase 3B, District Project 5611, authorize the filing of the Notice of
Completion, and authorize the General Manager to make payment to the City of Lafayette
for street slurry sealing.

ISSUE: A public hearing is required to establish the Camille Court Contractual Assessment
District (CAD) No. 2002 -1. A public hearing is also required to create an assessment
district pursuant to the procedure adopted under Proposition 218, which amended the
California Constitution, Article XIII D, Section 4.
RECOMMENDATION: Establish February 20, 2003, as the date for a public hearing
regarding Camille Court CAD No. 2002 -1 pursuant to California Constitution, Article XIII
D, Section 4, and Streets and Highways Code, Sections 5898.20 and 5898.24.
FINANCIAL IMPACTS: There are minor costs for publishing a legal notice advertising the
public hearing and for staff preparation and attendance. These costs eventually will be
paid by the CAD participants.
ALTERNATIVES /CONSIDERATIONS:
1. Select a later date for the public meeting - This would delay the CAD proceedings
since the holding of a public hearing is required by law.
2. No action by the Board - No action will delay the CAD proceedings until a different
public hearing date is set since the holding of a public hearing is required by law.
BACKGROUND: On March 7, 2002, the Board of Directors adopted a resolution of
intention to create Camille Court CAD No. 2002 -1 for the purpose of installing sewer
improvements on Camille Court in Alamo (see Attachment 1). The proposed Camille Court
CAD No. 2002 -1 complies with the revised CAD policy approved at the February 1, 2001
Board of Directors meeting. Nineteen properties could be served by a Camille Court public
sewer. As required by Proposition 218, an Engineer's Report estimating assessments for
properties within the CAD is being prepared. It is now appropriate to schedule a public
hearing to offer interested parties the opportunity to comment on the proposed

RESOLUTION SETTING HEARING OF PROTESTS ON
CAMILLE COURT CONTRACTUAL ASSESSMENT DISTRICT
(CAD NO. 2002 -1)
WHEREAS, on March 7, 2002, this Board of Directors adopted Resolution
2002-011 expressing the intent of the District to proceed with Camille Court
Contractual Assessment District (CAD) No. 2002 -1 for the purpose of installing sewer
improvements on Camille Court in Alamo; and
WHEREAS, at the direction of this Board of Directors, Curtis W. Swanson,
Environmental Services Division Manager, as Engineer of Work for improvement
proceedings for Camille Court CAD No. 2002 -1, Central Contra Costa Sanitary District,
Contra Costa County, California, has prepared a report described in Section 5898.22
of the Streets and Highways Code (Municipal Improvement Act of 1911); and
WHEREAS owners of each affected parcel will be provided written notice of the
proposed assessment and ballot to indicate approval or opposition of the assessment
pursuant to the procedures required by California Constitution Article XIII D, Section 4,
as amended by Proposition 218;
NOW, THEREFORE, the Board of Directors of the Central Contra Costa Sanitary
District resolves:
This Board sets 2 p.m. on February 20, 2003, at the Meeting Room of
the Board of Directors, 5019 Imhoff Place, Martinez, California, as the
time and place for hearing protests to the proposed improvements and
the creation of the proposed Contractual Assessment District and
assessment.

2. The Secretary of the District is directed to publish, post, and mail the
notices of improvement required by the Municipal Improvement Act of
1911, and to file an affidavit of compliance. The notice shall be
published in the CONTRA COSTA TIMES not later than twenty (20) days
before the date of the hearing.

ISSUE: Easements for a proposed gravity sewer to serve the Wendt Ranch development
are needed to avoid construction and operation of an additional pumping station. The
District may exercise the power of eminent domain to acquire public easements only if the
Board of Directors adopts a Resolution of Necessity that meets the requirements of
California eminent domain laws. Prior to adoption of such a Resolution, the Board must
first hold a properly noticed hearing to allow affected property owners to appear and be
heard.
The Board opened the required hearing at its regular meeting on January 9, 2003, and
continued it to the regular Board meeting on January 23, 2003 to receive input from one
affected property owner.
RECOMMENDATION: Conduct the continued hearing to receive input from one affected
property owner regarding the staff - proposed Resolution of Necessity for the Acquisition
of Public Easements for Sanitary Sewer Purposes and Authorizing Eminent Domain
Proceedings for the Wendt Ranch Offsite Sewer, District Project No. 5436. The proposed
resolution revised to reflect the continuance of the hearing is presented as Attachment 1.
After concluding the hearing and considering all evidence presented, adopt the proposed
Resolution of Necessity authorizing the acquisition of temporary construction easements
and permanent easements for sanitary sewer purposes by eminent domain, filing of the
eminent domain action, deposit of the amount of probable compensation, and the
application for an Order of Possession.
FINANCIAL IMPACTS: The compensation to be paid to property owners for the acquisition
of the proposed easements is not a matter to be considered by the Board of Directors at

FINANCIAL IMPACTS: The compensation to be paid to property owners for the acquisition
of the proposed easements is not a matter to be considered by the Board of Directors at
the hearing. An agreement between the District and Shapell Industries of Northern
California ( Shapell), developer of the Wendt Ranch project, requires that Shapell reimburse
the District for all of the costs incurred to acquire the easements.
ALTERNATIVES /CONSIDERATIONS: The Board could elect not to adopt the proposed
Resolution of Necessity, could continue the hearing, could conclude the hearing and defer
its decision to a future date, or could direct staff to pursue another sewer route. If
easements for a feasible sewer alignment are not acquired by the District, however, a new
pumping station and forcemain to Camino Tassajara would be required to serve the Wendt
Ranch development. This would be contrary to the District's policy to avoid the
proliferation of additional pumping stations and their associated environmental and
economic costs.
BACKGROUND: The background for this item was included in the Position Paper on the
subject submitted for the January 9, 2003 Board Meeting.
On January 6, 2003, a letter was received from Mr. Thomas Nagle, an attorney
representing the property owners of one affected property, Howard and Lettie Siu (1465
Lawrence Road, Danville - APN 206 - 160 -017). In the letter, Mr. Nagle requested that the
hearing be continued to the regular Board meeting on January 23, 2003. After receiving
the staff report, and hearing those individuals who appeared to speak, the Board
continued the hearing as requested.
RECOMMENDED BOARD ACTION: Conduct the continued hearing to receive comments
from the property owners of one affected property regarding the staff - proposed Resolution
of Necessity for the Acquisition of Public Easements for Sanitary Sewer Purposes and
Authorizing Eminent Domain Proceedings for the Wendt Ranch Offsite Sewer, District
Project No. 5436. The following issues must be addressed in the hearing:
1. Whether the public interest and necessity require the proposed project;
2. Whether the proposed project is planned and located in the manner that will be
most compatible with the greatest public good and the least private injury;

3. Whether the easements sought to be acquired by eminent domain and described
in Exhibit "A" and Exhibit "B" of the proposed Resolution of Necessity (Attachment
1) are necessary for the proposed project;
4. Whether the offers suggested by Government Code section 7267 together with
accompanying statements and summaries of the basis for the amount established
as just compensation, were actually made to the affected property owners and
whether said offers and statements /summaries were in the form and contained all
of the factual information listed in Government Code section 7267.2(a) and (b).
5. Whether the District has complied with all conditions and statutory requirements
necessary to exercise the power of eminent domain (the "right to take ") to acquire
the easements described in Exhibit "A" and Exhibit "B" of the proposed Resolution
of Necessity (Attachment 1), as well as any other matters regarding the right to
take said easements by eminent domain; and
6. Whether the District has the statutory authority to acquire the property by eminent
domain.
After concluding the hearing and considering all evidence presented take the following
actions:
Make the independent finding that a subsequent EIR or other additional CEQA
compliance document is not required for the Wendt Ranch Offsite Sewer, District
Project No. 5436, since 1) there have been no substantial changes or additions
proposed for the project that will require major revisions to the 1996 EIR; 2) there
have been no substantial changes to the circumstances under which the project is
being undertaken that will require major revisions to the 1996 EIR; and 3) no new
information of substantial importance to the project has become available which
was not known and could not have been known at the time the 1996 EIR was
certified.
2. Adopt the proposed Resolution of Necessity authorizing the acquisition of
temporary construction easements and permanent easements for sanitary sewer
purposes by eminent domain, filing of the eminent domain action, deposit of the
amount of probable compensation, and the application for an Order of Possession.

RESOLUTION NO.
A RESOLUTION OF NECESSITY FOR THE ACQUISITION OF PUBLIC EASEMENTS
FOR SANITARY SEWER PURPOSES AND AUTHORIZING EMINENT DOMAIN
PROCEEDINGS FOR THE WENDT RANCH OFFSITE SEWER,
DISTRICT PROJECT NO. 5436
WHEREAS, the territory generally known as the Wendt Ranch development in the
unincorporated area of Contra Costa County has been annexed to the Central Contra
Costa Sanitary District ( "District ") and the Contra Costa County Local Agency Formation
Commission filed a Certificate of Completion which was recorded on March 4, 1998 as
Document #98 -44261 in the office of the Contra Costa County Recorder; and
WHEREAS, the Wendt Ranch development project was approved and its
Environmental Impact Report was certified by the Contra Costa County Board of
Supervisors in 1996; and
WHEREAS, early planning for wastewater utility service to potential development
in the Wendt Ranch area was documented in the "Public Facilities" chapter of the
Lawrence/Leenna Road Specific Plan (September 1992) adopted by the Town of Danville
wherein "possible locations for sanitary sewer connections to accommodate potential
development out of the plan area" including the route that is the subject of this Resolution
of Necessity were shown on Figure 11, the "Utility Plan" exhibit of said Specific Plan; and
WHEREAS, the "Specific Facilities Plan for Wastewater Utility Service to Dougherty
Valley and Tributary Properties" approved by the District Board of Directors in September
1997 envisioned gravity service from the Wendt Ranch and neighboring developments via
Lawrence Road to the planned Dougherty Valley public sewer system to avoid the
proliferation of additional pumping stations and their associated environmental and
economic costs (use of electrical energy, materials, equipment, vehicle trips and staff labor
required for operations and maintenance; noise and odor impact mitigation; and the
additional risk of wastewater overflow associated with the potential failure of mechanical,
electrical, and control system equipment); and
WHEREAS, the District intends to require construction of, own, operate and
maintain public sewers, together with related improvements, for the principal purpose of
providing wastewater utility service, a public use, to future residents in the Wendt Ranch
development and to cant' out and make effective this principal purpose and function of the
District pursuant to Code of Civil Procedures section 1240.120(a), and, in connection with
such principal use, acquire interests in certain real property; and
WHEREAS, the District has identified the need to acquire permanent easements
and temporary construction easements for said purposes, which permanent and temporary
construction easements are described in Exhibit "A" and Exhibit "B" hereto and by this
reference made a part hereof; and
A Resolution of Necessity for the Acquisition of Public Easements
for Sanitary Sewer Purposes and Authorizing Eminent Domain
Proceedings for the Wendt Ranch Offsite Sewer, District Project No. 5436

WHEREAS, the District is authorized to acquire the easements described in Exhibit
"A" and Exhibit "B" herein and exercise the power of eminent domain for the public use set
forth herein in accordance with the California Constitution and eminent domain laws, Code
of Civil Procedure section 1230.010 et seq., and pursuant to California Health and Safety
Code Sections 6512 and 6514; and
WHEREAS, the easements to be acquired consist of two (2) permanent easements
and two (2) temporary construction easements on Contra Costa County Assessor's Parcel
No. 206- 160 -017, and one (1) permanent easement and two (2) temporary construction
easements on Contra Costa County Assessor's Parcel No. 206 - 160 -019, all located within
the boundaries of the District in the Lawrence Road area of the Town of Danville, Contra
Costa County, State of California; and
WHEREAS, on November 5, 2002 (for APN 206- 160 -017), and on November 27,
2002 (for APN 206- 160 -019), the District mailed Offers to Purchase Easements, in the form
suggested by section 7267 of the California Government Code, together with
accompanying summaries of the basis for the amount established as just compensation,
to the owners of record for each affected property, which offers and accompanying
summaries were in a form and contained all of the factual disclosures listed in Government
Code section 7267.2(a) and (b). Proof of Service for said notices, are attached hereto as
Exhibit "C" and Exhibit "D ", and are by this reference made a part hereof; and
WHEREAS, on December 20, 2002 (for APN 206- 160 -019), and on December 21,
2002 (for APN 206 -160 -017), the District mailed notice that the Board of Directors would
conduct a Hearing to consider adoption of a Resolution of Necessity to acquire the
easements described in Exhibit "A" and Exhibit "B" by eminent domain ( "Notice of
Hearing ") to all persons whose names appear on the last equalized Contra Costa County
Assessment Roll as having an interest in the property described in Exhibit "A" or Exhibit
"B" at the addresses appearing on said Roll. Said Notice of Hearing advised said persons
of their right to be heard on the matters referred to therein on January 9, 2003 at 2:00 p.m.,
or as soon thereafter as the matter may be heard, in the District Board of Directors Meeting
Room, 5019 Imhoff Place, Martinez, California. Proof of Service for said notices, are
attached hereto as Exhibit "E" and Exhibit "F ", and are by this reference made a part
hereof; and
WHEREAS, the hearing referred to in said Notice of Hearing was opened by the
District Board of Directors on January 9, 2003, was continued to January 23, 2003, all
interested parties were given an opportunity to be heard, and thereupon, the hearing was
closed; and
A Resolution of Necessity for the Acquisition of Public Easements
for Sanitary Sewer Purposes and Authorizing Eminent Domain
Proceedings for the Wendt Ranch Offsite Sewer, District Project No. 5436

WHEREAS, all oral and documentary evidence has been duly considered.
NOW, THEREFORE, based upon the evidence presented, the Board of Directors
of the Central Contra Costa Sanitary District does FIND, DETERMINE AND RESOLVE as
follows:
The public interest and necessity require the proposed project.
2. The proposed project is planned and located in the manner that will be most
compatible with the greatest public good and the least private injury.
3. The easements described herein in Exhibit "A" and Exhibit °B" are necessary
for the proposed project.
4. While not required for acquisition of easements for subsurface sewers,
nonetheless, offers in the form suggested by section 7267 of the California
Government Code, together with accompanying summaries of the basis for
the amount established as just compensation, were made to the owners of
record for each affected property, which offers and accompanying
summaries were in a form and contained all of the factual disclosures listed
in Government Code section 7267.2(a) and (b).
5. All conditions and statutory requirements necessary to exercise the power
of eminent domain ( "the right to take ") to acquire the property described
herein have been complied with by the District.
6. The District has the statutory authority to acquire easements by eminent
domain in accordance with California Health and Safety Code sections 6512
and 6514.
BE IT FURTHER RESOLVED THAT:
The Counsel for the District, Kenton L. Alm, is hereby authorized and empowered:
To acquire in the name of the Central Contra Costa Sanitary District, by
condemnation, the property (easements) described in Exhibit "A" and Exhibit
"B" in accordance with the provisions of the California Eminent Domain Law
and the Constitution of California.
2. To prepare or have prepared and to prosecute or to retain counsel to
prosecute in the name of the Central Contra Costa Sanitary District such

ISSUE: On December 4, 2002, sealed bids were received and opened for the Steam
Turbine Systems Upgrade Project, District Project No. 6158. The Board of Directors must
authorize award of the contract or reject bids within 50 days of the bid opening.
Authorization of the Board is required for the General Manager to execute a professional
services agreement in an amount greater than $50,000.
RECOMMENDATION: Authorize award of a construction contract to Kaweah Construction
Company. Authorize the General Manager to execute a professional services agreement
with WRMS Engineering (WRMS) for construction support services and specialty
construction inspection.
FINANCIAL IMPACTS: Approximately $2,741,000, including bid price, contingency, and
construction management. To date, the District has invested $1,691,000 into the project.
ALTERNATIVES /CONSIDERATIONS: Reject all bids.
BACKGROUND: The Steam Turbine Systems Upgrade Project is part of the Treatment
Plant Aeration System Improvements Project. This project renovates the steam turbines
and improves the operational efficiency, performance, and reliability of the steam turbines
and blowers for the aeration system. The aeration system supplies the large quantities of
air that are critical for the secondary process and essential to meet permit requirements.
The turbines and blowers are over 25 years old and had been reliable and required little
maintenance until last year. The steam turbines had over 50 outages early last year; this
led to an internal inspection of both turbines. The turbine inspection revealed the need for
immediate short -term repairs and a major renovation. The short -term repairs were made
last year, and this contract is the last step of the major renovations. This complete upgrade

In June 2002, the Board of Directors authorized the sole- source purchase of replacement
turbine parts for $1,050,000. These parts are scheduled for delivery at the end of this
month. In October of 2002, the Board authorized execution of a sole- source installation
contract for the installation of the parts. This construction contract completes the overall
project.
Plans and specifications for this project were prepared by WRMS and District staff. The
engineering estimate for construction costs to install the parts was $1,000,000. The project
was advertised on October 21 and 28, 2002. Five (5) bids, ranging from $575,988 to
$832,015 were received and publicly opened on December 4, 2002. A summary of these
bids is shown in Attachment 2. Staff conducted a commercial and technical evaluation of
these bids and has determined that Kaweah Construction Company is the lowest
responsible bidder with a bid amount of $575,988.
Construction management and construction contract administration will be performed by
District staff. District staff is also performing integration of the new control system with the
treatment plant's control system. This includes PLC upgrades and programming, user
interface programming, system testing, and other work. Staff recommends retaining
WRMS Engineering to provide support services during construction for this project because
WRMS Engineering prepared the plans and specifications. Construction support services
include reviewing shop drawings and submittals, responding to design questions,
evaluating change order requests, and performing site visits to verify compliance with the
design intent. In addition, it is recommended that WRMS Engineering conduct specialized
inspection during the construction phase. A professional services agreement in the amount
of $80,000 has been negotiated with WRMS Engineering.
The Steam Turbine Systems Upgrade Project is included in the fiscal year 2002 -2003
Capital Improvement Budget (CIB) on pages TP -57 through TP -59 and Addendum page 2.
Staff has determined that there are adequate funds in the CIB and Plan for this project. A
detailed breakdown of overall project costs is presented in Attachment 3.
Staff has concluded that this project is exempt from the California Environmental Quality
Act (CEQA) under District CEQA Guidelines, Section 15302, since it involves minor

ISSUE: Board authorization is required to authorize a contract in excess of $50,000
with ECS Imaging, Inc. for an Electronic Document Imaging and Management System.
RECOMMENDATION: Authorize the General Manager to execute a contract with ECS
Imaging, Inc. to design, purchase and implement an Electronic Document Imaging and
Management System.
FINANCIAL IMPACTS: The total estimated cost of this contract is $90,000, which
includes design, planning, purchase and installation of hardware and software, training,
first year support and a 10% contingency reserve. Additional costs totaling $19,000
with separate vendors will be required to complete the project. Full project costs are
itemized in Attachment 1.
This investment delivers several offsetting financial benefits, both direct and indirect.
Direct labor savings are estimated to be $30,000 per year or more. Over $10,000 in
additional storage costs will also be eliminated. Indirect savings refer to eliminating
potential losses that could accrue if critical documents are lost. Document imaging
minimizes the likelihood of incurring those losses. Attachment 2 lists major examples of
those potential losses.
ALTERNATIVES /CONSIDERATIONS: Alternatives to this contract include continuing
to store and work with paper documents; expanded use of microfiche; or custom
programming of imaging solutions. None of these alternatives provide the required
combination of cost - effective disaster recovery and space conservation. The
alternatives also do not support the long term District goals of being a high - performance
organization and providing exceptional customer service.
BACKGROUND: The Permit and Sewer Billing section maintains an extensive library
of maps, plans and other documents for use in project planning, permit processing and
other daily activities. Some of these documents date back to the District's initial

inception. Although many of the documents are stored in halon vaults for fire
protection, those vaults are filled to capacity and don't protect against water damage or
accidental loss. Additionally, routine daily handling of maps and plans results in
continuing, irreversible deterioration. Permit counter filing space is also filled to
capacity, with new documents being added daily.
The Secretary of the District is required to maintain and store a variety of written
records, including meeting agendas and minutes, Board action summaries, position
papers, staff reports, ordinances, resolutions, FPPC filings, claims against the District
and others. All of these are open for public access. Mandated retention policies dictate
meticulous, time - consuming document management procedures.
Electronic document imaging provides a comprehensive, cost - effective solution for
these needs. The proposed project provides the following major benefits:
Data Protection (Disaster Recovery) — greater protection of documents and records
against loss or damage.
Staff Access — enhanced ability to organize and find documents and records.
Improved Efficiency — more reliable and timely business processes. An immediate
improvement in customer service will result from reduced processing time at the
permit counter.
Space Saving — less physical space needed for document storage.
Public Access — availability of documents and records to the public via the Internet.
An RFP was issued in September 2002. Staff selected the LaserFiche proposal from
ECS Imaging as the most cost - effective solution, based on product features, cost and
vendor experience.
This project will provide a complete system encompassing the Permits and Sewer
Billing section and the Secretary of the District office. Additional District operations can
be easily added as needs are defined.
This project was identified in the MIS Five -Year Master Plan, in the Intranet section on
page 54, and was part of the Capital Improvement Budget with an estimated cost of
$134,000. Staff time in implementation and operation will be considered part of normal
operating costs as the system is established for various District activities.
