C. Freitas / Jfusgraves *General Bat / n er ISSUE: Bob Roberts, Plant Operator III, has filed a grievance at Step Four of the grievance procedure. According to the Memorandum of Understanding between Local One and the District, Article III, Section 2.5, "the Board of Directors shall employ a neutral third party to hear the matter and recommend action to the Board." RECOMMENDATION: Direct staff to appoint an arbitrator to hear the grievance. FINANCIAL IMPACTS: The District and the Union share the costs of the grievance equally. The cost to the District for the arbitrator and court reporter should be approximately $ 1500. ALTERNATIVES /CONSIDERATIONS: None. BACKGROUND: Mr. Roberts filed a grievance concerning his shift assignment. Operations Department Director James Kelly heard the grievance at Step Two and denied the grievance. General Manager Charles Batts appointed Director of Administration Randall Musgraves to hear the grievance at Step Three and he similarly denied the grievance. Mr. Roberts is now appealing to the Board for a Step Four hearing with an arbitrator. The arbitrator's decision will be advisory to the Board. The Board may adopt, reject or modify the arbitrator's recommendation. The details of the grievance have been provided to the Board under separate cover. RECOMMENDATION: Reject the claim. FINANCIAL IMPACTS: There are no immediate financial impacts for rejection of the claim. ALTERNATIVES /CONSIDERATIONS: The alternative to this action is to negotiate a settlement with the claimant. District staff has already offered $500 which was refused. BACKGROUND: The District contracted with Mountain Cascade to install the Pleasant Hill Relief Interceptor Phase IV. The claimant alleges that the construction activity damaged their home. No vibration or acoustical studies were done. A pre- construction survey was completed. No post- construction survey was done because the Muller's had removed the mastik (concrete filler) from their driveway rendering any post- construction photos useless. Up until the government code claim form was filed by Paragon Subrogation Services, the Mullers had only alleged damage to their driveway. District staff has evaluated the alleged damages and had offered the Mullers $500 to settle. The Muller's insurance carrier, Century National, advised them not to sign a release form. The Mullers have received $38,588.95 in repairs to their home from their insurance company. Century National has admitted pre- existing damage to the home. The claim has been tendered to Mountain Cascade. The Travelers Insurance Company is investigating the alleged damages, but is expected to deny the claim. FINANCIAL IMPACTS: None related to this action. ALTERNATIVES /CONSIDERATIONS: Not applicable. Filing the Notice of Completion is advisable under the California Civil Code, Section 3093. BACKGROUND: The Concord Industrial Pumping Station (CIPS) serves a portion of the City of Concord and an area of unincorporated Contra Costa County including the town of Clyde. The station receives flow from the local collection system as well as from the Clyde Pumping Station and the Concord Naval Weapons Station. In the dry weather season, Bates Avenue Pumping Station is shut down and its flow is diverted to CIPS. Before this project, the CIPS was served by one 10 -inch plastic force main, and no backup capacity was available in the event that this force main was damaged. The Concord Industrial Force Main Project installed approximately 4,300 feet of 14 -inch force main (See Attachment 1 for project location). This new force main provides increased capacity as well as redundancy in the CIPS force main system. The new force main crosses over three (3) aqueducts on Bates Avenue owned and operated by East Bay Municipal Utility District (EBMUD). On May 23, 2002, the Board of Directors (Board) authorized the award of a contract for the construction of the project to McGuire and Hester of Oakland, California. The Notice to Proceed was issued on June 18, 2002. RECOMMENDATION: Authorize a $40,000 amendment to the current cost ceiling and a six month extension in the term of the agreement with WRMS Engineering (WRMS) for collection system development and repair inspection services. FINANCIAL IMPACTS: An additional $40,000 would be authorized for consultant - provided collection system development and repair inspection services. ALTERNATIVES /CONSIDERATIONS: An alternative to the recommended action would be to allow the current inspection services agreement to lapse. This alternative is not recommended since demand for inspection services has increased. A second alternative would be to fill the fourth authorized (Engineering Assistant III) position in the developer inspection group. The Engineering Department is evaluating long -term staffing for the group and may move to fill the position following the evaluation. BACKGROUND: The Environmental Services Division provides inspection for construction and repair of public sewer main extensions and side sewers (laterals) installed by developers and homeowners. In the late 1980's and early 1990's, the level of sewer construction in the District declined significantly. During that time, the size of the sewer inspection group was reduced through attrition and reassignment of personnel. Over the last five years, the rate of developer and homeowner sewer construction and repair has increased significantly due to strong demand for housing and favorable economic conditions. As the demand for inspection increased, the Environmental Services Division responded in two ways: 1) a substantial amount of Inspector overtime was authorized; and 2) in January 2000, a fourth regular Inspector (Engineering Assistant III) position was authorized for the Inspection Work Group. The fourth Inspector position was filled briefly but has been vacant since June 2001 due to the retirements of three Inspectors and the untimely death of another. In July 2002, WRMS was engaged to provide a temporary Inspector to fill this authorized position. The authorized regular staffing for the group now includes one Inspection Supervisor and four Inspector positions, one of which is currently filled by the contract employee from WRMS. These efforts have been successful in providing timely inspection of ongoing work, but the current $35,000 WRMS cost ceiling will be reached in the near future. Amending the current agreement with WRMS to add $40,000 to the cost ceiling (for a total cost ceiling of $75,000), and six months to the term will provide continued timely, high quality field inspection services, facilitate the Department's evaluation of long -term staffing needs, and provide needed vacation relief for regular staff. RECOMMENDATION: Authorize the General Manager to allocate $175,000 from the Collection System contingency account to the Pumping Station Corrosion Project, District Project No. 5922, and authorize the General Manager to execute an agreement for an amount not to exceed $115,000 with Brown and Caldwell for the Martinez Transmission Line Corrosion Study. FINANCIAL IMPACTS: The $175,000 allocation would supplement a previous $25,000 contingency allocation for a total of $200,000 for the project, which would cover the cost of the proposed study as well as staff time. ALTERNATIVES /CONSIDERATIONS: Use an alternate consultant; defer or cancel the study. Brown and Caldwell was selected by competitive process and offers the best combination of experience, capabilities, and price. Deferring or canceling preparation of the corrosion study would limit the District's ability to develop appropriate projects to mitigate the corrosion problems believed to be generated by the presence of hydrogen sulfides in the Martinez Transmission Line. BACKGROUND: As a result of the Collection System Corrosion Evaluation Phase 2 Project, DP 4988, some forcemain junction structures and large diameter RCP gravity lines in the collection system with significant hydrogen sulfide corrosion have been identified. Information gathered in the proposed study will be used to develop operational changes, including chemical treatment for the three Martinez pumping stations (Martinez, Fairview and Maltby), develop a prevention program to minimize hydrogen sulfide corrosion, and schedule pumping station modifications in the District's 10 -year Capital Improvement Plan. A formal selection process was used to solicit and evaluate proposals from qualified engineering firms for the proposed study. The Request for Proposals was sent to eleven firms. Four proposals were received and three firms participated in presentation interviews on September 20, 2002. Brown and Caldwell was selected due to their well- reasoned approach and competitive cost. Staff has negotiated with Brown and Caldwell a cost reimbursement -type agreement with a cost ceiling of $115,000. This project is not included in either the Capital Improvement Budget (CIB) and 2001 Capital Improvement Plan or the Fiscal Year 2002 -2003 Capital Improvement Budget Addendum. An initial $25,000 allocation of contingency funds has been made by the General Manager to begin the project. A supplemental allocation of $175,000 is needed at this time to complete the study. Board authorization is required for the GM to make contingency allocations for more than $25,000 per project. A subsequent request for funds to address other pumping stations, if needed, will be made as part of the next Capital Improvement Budget cycle. Staff has concluded that the proposed agreement with Brown and Caldwell is exempt from the California Environmental Quality Act (CEQA) under District CEQA Guidelines Section 15262 since it involves planning activities for possible future actions which the District has not approved, adopted, or funded, and the outcome of these tasks will not have a legally binding effect on later activities. Approval of this agreement will establish the Board of Directors' independent finding that this project is exempt from CEQA. The District will conduct an environmental evaluation of any capital project which is proposed in the future as a result of these studies to determine the appropriate CEQA compliance documentation.
