ISSUE: Section 6490 of the Health and Safety Code of the State of California provides
that District ordinances shall be published once in a newspaper of general circulation
within the District, and provides that an Order of the Board of Directors of the District to
the effect that the ordinance has been published shall constitute conclusive evidence that
publication has been properly made.
RECOMMENDATION: Adopt a resolution confirming the publication of District Ordinance
No. 223.
FINANCIAL IMPACTS: None related to this issue.
ALTERNATIVES /CONSIDERATIONS: Establishes presumption that the ordinance was
correctly published and therefore would be deemed procedurally valid by a court.
BACKGROUND: District Ordinance No. 223 which was adopted by the Board at the
meeting of July 11, 2002, and which revises Title 2, Chapter 2.08 and related references
pertaining to the position of General Manager of the Central Contra Costa Sanitary
District, was published in the Contra Costa Times on July 18, 2002. Proof of publication
is attached.
RECOMMENDED BOARD ACTION: Adopt a resolution confirming the publication of
District Ordinance No. 223.

ISSUE: On August 2, 2002, sealed bids were received and opened for a construction
contract for the Manzanita Creek Crossing Repair Project, District Project No. 5434. The
Board of Directors must authorize award of the contract or reject bids within 50 days of
bid opening.
RECOMMENDATION: Authorize award of a construction contract.
FINANCIAL IMPACTS: Approximately $172,000 including contingency and construction
management.
ALTERNATIVES /CONSIDERATIONS: Reject all bids, which is not recommended.
BACKGROUND: The Manzanita Creek Crossing is a sewer creek crossing carrying the
sewer flow for 60 homes in the Manzanita and Kittiwake Drive area of Orinda. Inspection
revealed that the pipe crossing has developed a sag due to bridge supports that have
shifted and settled. This creek crossing is one of the largest in the District in terms of
length (200 feet) and height (30 feet). The sewer was built in 1957. Engineering staff
contacted the nearest resident, Nancy Morris, when this project was initiated and
explained the issue. Nancy Morris inquired about relocating the creek crossing given its
visual impact on her home that was built in 1977. District staff investigated several
routing alternatives including adding a pumping station. The estimated cost to build a
pumping station was $477,000. All of the rerouting alternatives had significantly higher
life cycle costs. Engineering staff designed new supports that will strengthen the existing
structure and restore the sewer to proper grade; the structure will also be repainted.
The plans and specifications were prepared by District staff. The engineer's estimate for
construction is $90,000. Seven (7) sealed bids were received and publicly opened on
August 2, 2002, ranging from $81,000 to $158,369. A summary of bids received is

shown in Attachment 2. Capital Projects Division staff conducted a technical and
commercial review of the bids and determined that the bid submitted by Taber
Construction Company is the lowest responsible bid.
The District will administer the construction contract and will provide inspection, office
engineering, and shop drawing review. An initial allocation of $80,000 was made from
the Collection System Program Contingency Account. This project is included in the fiscal
year 2002 -2003 Capital Improvement Budget (CIB). The funds required to complete this
project, as shown in Attachment 3, are $92,000. The Project Manager has reviewed the
expenditure requirements for this allocation and has determined that they are consistent
with the Capital Improvements Budget and Plan.
Staff has concluded that this project is exempt from the California Environmental Quality
Act (CEQA) under District CEQA Guidelines, Section 18.2, since it involves the repair of
an existing facility with no expansion of capacity. Authorization of the construction
contract for this project will establish the Board of Directors' independent finding that the
project is exempt from CEQA.
RECOMMENDED BOARD ACTION: Authorize the award of a construction contract in the
amount of $81,000 for completion of the Manzanita Creek Crossing Repair Project,
District Project No. 5434 to Taber Construction Company, the lowest responsible bidder.

ISSUE: Board of Directors' authorization is required for the General Manager to execute
an amendment to a cost reimbursement agreement with other agencies.
RECOMMENDATION: Authorize the General Manager to execute an amendment to the
agreement with California Department of Transportation (Caltrans) for cost reimbursement
in the amount of $25,000.
FINANCIAL IMPACTS: The Board of Director's authorized the General Manager in a
previous position paper to execute the initial cost reimbursement agreement with Caltrans
for $32,520. The amendment to the cost reimbursement agreement, the subject of this
position paper, will add $25,000 to the agreement. Caltrans will reimburse the District
up to a total of $57,520 for design and construction related expenses. This money will
be credited to the DP 5410 budget.
ALTERNATIVES /CONSIDERATIONS: Alternatives would be to charge Caltrans related
work to the project budget and not seek reimbursement.
BACKGROUND: The sewage conveyance system from the City of Martinez to the
treatment plant consists of three pumping stations (Martinez, Fairview, and Maltby), three
pressure force mains (M6, M4, and M2), and three reinforced concrete gravity sewer
pipes (M5, M3, and M1). Please refer to Attachment 1 for project location. The M4
system is a pressurized force main and conveys the sewage from Fairview Pumping
Station to the M3 gravity line. The M4 force main system consists of two pipes: M4 -A
(built in 1975) and M4 -B (built in 1991).

In August 2001, Caltrans notified staff that proposed work for the Benicia - Martinez Bridge
would impact a portion of the M4 force main system. The Design Consultant and District
staff worked with Caltrans to establish protection for the M4 force main system during
construction. Design related work done by the consultant and District staff in connection
with the Caltrans work will be reimbursed by Caltrans under an agreement authorized by
the Board in a previous position paper. The amount of the original reimbursement
agreement was $32,520.
The Benicia - Martinez Bridge project has begun construction this summer. As part of the
agreement reached with Caltrans to protect the M4 force main system, Caltrans has
agreed to reimburse the District for construction related expenses. These expenses will
include District inspection during Caltrans construction in the vicinity of the M4 force
mains, additional staff time spent on Caltrans' portion of the work, and any consultant
review that may be necessary. Caltrans has agreed to reimburse the District up to
$25,000 for these construction inspection and monitoring expenses. This amount will be
added to the existing cost reimbursement agreement giving a new cost ceiling of
$57,520.
The environmental impacts of relocating utility lines as a result of the Benicia - Martinez
Bridge construction were addressed in the Final Environmental Impact
Statement /Environmental Impact Report (EIS /EIR), Benicia - Martinez Bridge Project, August
1997, prepared by the U.S. Department of Transportation, Federal Highway
Administration and Caltrans. The Final EIS /EIR concluded that the temporary,
construction - related environmental impacts of utility relocations are not expected to result
in substantial adverse impacts and will be minimized through implementation of the
mitigation measures identified for these impacts. Approval of this authorization will
establish the Board of Directors' independent findings that, as a Responsible Agency, it
has considered the environmental effects of the project as shown in the Final EIS /EIR and
that no significant effects would result from this action.
RECOMMENDED BOARD ACTION: Authorize the General Manager to execute an
amendment to the cost reimbursement agreement with California Department of
Transportation in the amount of $25,000.
