ISSUE: Authorization of the Board is required for the General Manager to execute

RECOMMENDATION: Authorize the General Manager to execute a revocable license
agreement with East Bay Municipal Utility District.
FINANCIAL IMPACTS: The proposed license would be granted without fee.

BACKGROUND: At the June 20th Board of Directors' (Board) meeting, the Board awarded
a construction contract to Ranger Pipelines, Incorporated, for the Lafayette Sewer
Renovation Project, Phase 3B. The District's Phase 3B project will reconstruct the sewers
in sixteen (16) sites, eight (8) of which are easement sites. On one of these sites, Risa
Road, the proposed sewer main will cross over two (2) aqueducts operated by East Bay
Municipal Utility District ( EBMUD). See Attachment 1 for location. A revocable license
agreement with EBMUD will be required prior to start of construction.
At its June 20, 2002, meeting, the District Board of Directors approved the Lafayette
Sewer Renovation Project, Phase 313, and established its independent finding that the
project was exempt from CEQA.
RECOMMENDED BOARD ACTION: Authorize the General Manager to execute a revocable
license agreement with East Bay Municipal Utility District.

ISSUE: Construction has been completed on the Lafayette Sewer Renovation Project,
Phase 3A, District Project (DP) 5607, in Lafayette, and the work is now ready for
acceptance.
RECOMMENDATION- the contract work for the Lafayette Sewer Renovation
Project, Phase 3A, District Project (DP) 5607, and authorize the filing of the Notice of
Completion.
FINANCIAL IMPACTS: None related to this action.
ALTERNATIVES /CONSIDERATIONS: Not applicable. Filing the Notice of Completion is
advisable under the California Civil Code, Section 3093.
BACKGROUND: The Lafayette Sewer Renovation Project, Phase 3A, is part of the
ongoing sewer renovation program included in the Capital Improvement Budget and Plan.
In January 2002, the City of Lafayette informed the District of its plans to
repave /reconstruct in May -June 2002 several roads (Ortega and Perales Streets, Sibert
Court and Cerro Encantado) in which sewer lines with critical defects and high
maintenance costs are located. Once repaved, the City imposes a five year moratorium
on excavating within these streets. The District's Phase 3A project reconstructed the
sewers in these areas ahead of the City's street paving project. The sewers were
reconstructed using both open cut and pipe bursting methods. In addition, overflow
devices were installed on laterals to prevent sewage in the mains from backing up inside
homes. The total footage of sewer that was replaced or rehabilitated was approximately
1,500 LF (see Attachment 1 for map).

Subject: ACCEPT THE CONTRACT WORK FOR THE LAFAYETTE SEWER RENOVATION,
PROJECT, PHASE 3A, DISTRICT PROJECT NO. 5607, IN LAFAYETTE, AND
AUTHORIZE THE FILING OF THE NOTICE OF COMPLETION
On April 4, 2002, the Board of Directors (Board) authorized the award of a contract for
the construction of the project to Ranger Pipelines, Inc. of San Francisco. The Notice to
Proceed was issued on April 22, 2002. The work was substantially completed on
June 7, 2002. The remaining items of work consist of minor punchlist items which do
not affect the project acceptance.
The total authorized budget for the project is $238,000. The budget includes the cost of
District forces, testing services, geotechnical services, contractor services, etc. An
accounting of the project costs will be provided to the Board at the time of project close-
out. It is appropriate to accept the contract work at this time.
RECOMMENDED BOARD ACTION: Accept the contract work for the Lafayette Sewer
Renovation Project, Phase 3A, District Project (DP) 5607, and authorize the filing of the
Notice of Completion.

ISSUE: Owners of properties on Wayland Lane and Via Serena in Alamo are interested in
connecting their homes to the Central Contra Costa Sanitary District ( CCCSD) sewer
system and have requested formation of a Contractual Assessment District to finance an
extension of the public sewer system. Board approval is required for a Contractual
Assessment District (CAD).
RECOMMENDATION: Approve initiating the formation of Wayland Lane CAD No. 2002 -3.
FINANCIAL IMPACTS: There are minor administrative costs for initiating the formation of
a CAD. These costs eventually will be paid by the CAD participants if a CAD is actually
formed. This action does not establish an interest rate for the CAD financing. If the CAD
receives final approval from the Board in the future, the estimated CAD costs are
$95,000. Neighborhood representatives have been informed that the District is
concurrently processing other CAD requests and the final funding decision is subject to
budgetary constraints.
ALTERNATIVES /CONSIDERATIONS: Reject or defer initiating formation of the CAD - these
actions would halt or delay the CAD proceedings.
BACKGROUND: Owners of properties located on Wayland Lane and Via Serena in Alamo
have contacted District staff to obtain information regarding connecting their homes to
CCCSD's public sewer system. Signed forms expressing interest in investigating and
forming a CAD are on file from four the seven property owners that could be served by
Wayland Lane and Via Serena public sewers. The area where the CAD would be formed
is shown on Attachment 1.

The initial steps toward creation of Wayland Lane CAD No. 2002 -3 are for the Board of
Directors to adopt a resolution indicating CCCSD's intention to designate an area within
which contractual assessments are appropriate; briefly describing the proposed financing
for the project; establishing the boundaries of the CAD; setting the time, date, and place
for a public hearing at which interested persons may inquire about or object to the
proposed program; and directing staff to prepare an Engineer's Report describing the
project and financing arrangements. Additional resolutions are required to approve the
boundary of the assessment district and to request the consent of Contra Costa County
for CCCSD to conduct proceedings for Wayland Lane CAD No. 2002 -3.
The proposed Wayland Lane CAD No. 2002 -3 complies with the revised CAD policy
approved at the February 1, 2001 Board of Directors meeting. The CAD formation criteria
are listed below.

Staff has concluded that this project is exempt from CEQA under CEQA Guidelines
Section 15061(b)(3), since it can be "seen with certainty that there is no possibility that
the activity in question may have a significant adverse effect on the environment." This
certainty is based on CCCSD's past experience with numerous sewer construction
projects of this nature, the relatively short distance involved, and the impact - limiting
nature of CCCSD's construction specifications that would be required of the project.
Approval of this project will establish the Board of Directors' independent finding that this
project is exempt from CEQA.
RECOMMENDATION: Authorize formation of a CAD consisting of seven properties on
Wayland Lane and Via Serena by:
1. adopting a resolution of intention to create Wayland Lane Contractual Assessment
District No. 2002 -3 for the purpose of installing sewer improvements (Exhibit 1);
2. adopting a resolution approving the boundary of the assessment district (Exhibit 2);
and
3. adopting a resolution requesting consent from Contra Costa County for CCCSD to
conduct proceedings for Wayland Lane CAD No. 2002 -3 (Exhibit 3).

RESOLUTION NO. 2002-
RESOLUTION OF INTENTION TO CREATE
WAYLAND LANE CONTRACTUAL ASSESSMENT DISTRICT NO. 2002 -3
FOR THE PURPOSE OF INSTALLING SEWER IMPROVEMENTS
WHEREAS the public health and the environment will be best protected by the
expansion of the public sewer system;
WHEREAS the construction and installation of a sanitary sewer pipeline, together
with appurtenant work and facilities, in areas not presently connected to the sewer
system will facilitate the elimination of potential public health problems due to failing
septic systems; and
WHEREAS it would be convenient and advantageous to establish a boundary around
an area within which CCCSD and property owners may enter into contractual assessments
and make arrangements to finance public improvements to parcels which are developed
and where the costs and time delays involved in creating an assessment district pursuant
to alternative provisions in the law would be prohibitively large relative to the cost of the
improvement.
THEREFORE, the Board of Directors of the Central Contra Costa Sanitary District
resolves:
This Board intends to approve the following improvement under the authority of
the Municipal Improvement Act of 1911, as amended, to wit: construction and
installation of approximately 620 linear feet of sanitary sewer line, together with
appurtenant work and facilities located at Wayland Lane and Via Serena in
Alamo, California.
2. This Board finds that the parcels within the Contractual Assessment District are
shown within the boundaries of the map entitled, "Proposed Boundaries of
Wayland Lane Contractual Assessment District No. 2002 -3."
3. This Board intends to levy a special assessment upon participating parcels within
the described district in accordance with the special benefit to be received by
each parcel of land, respectively, from the improvement. The improvement
proposed will not confer any special benefit upon any publicly owned land.
Hence, there shall be omitted from special assessment all public streets, alleys,
and places and all land belonging to the United States, the State of California,
Contra Costa County, and Central Contra Costa Sanitary District now in use in
the performance of a public function.
4. CCCSD intends to provide loan financing for the improvements, subject to the
availability of funds and any limitation on the commitment or expenditure of
funds for the Contractual Assessment District Program as may be established
from time to time by CCCSD's Board of Directors. Loans shall be repaid by

assessments on the property of participating parcel owners. Assessments shall
be paid over a maximum period of ten (10) years with interest at a rate to be
fixed by CCCSD.
5. The procedure for the collection of assessments will be the placement of
assessments on participating parcel owners' tax bills. The first assessments
may be placed on owners' tax bills in fiscal year 2003 -2004.
6. This Board appoints Curtis Swanson, Environmental Services Division Manager,
as Engineer of Work for this project to prepare the report required by
Section 5898.22 of the Streets and Highways Code.
7. A public hearing shall be held on this matter at 2 p.m. on or about Thursday,
December 5, 2002 at CCCSD offices, 5019 Imhoff Place, Martinez. This date
is tentative and may be modified in the future.
8. The Board independently finds that this project is exempt from the California
Environmental Quality Act (CEQA) under CEQA Guidelines Section 15061(b)(3),
since it can be "seen with certainty that there is no possibility that the activity
in question may have a significant effect on the environment." This certainty is

WAYLAND LANE CONTRACTUAL ASSESSMENT DISTRICT NO. 2002 -3
The Board of Directors of the Central Contra Costa Sanitary District ( CCCSD)
resolves:
A map entitled "Proposed Boundaries of Wayland Lane Contractual Assessment
District No. 2002 -3" has been filed with the Secretary of the Central Contra Costa
Sanitary District.
This Board approves the map and adopts the boundaries shown on the map as
describing the extent of the territory included in a proposed assessment district to be
known as Wayland Lane Contractual Assessment District No. 2002 -3, Central Contra
Costa Sanitary District, County of Contra Costa, California.
This Board intends to levy a contractual assessment upon participating parcels
within the described District in accordance with the benefit to be received by each parcel
of land, respectively, from the improvement. There shall be omitted from assessment, all
public streets, alleys, and places and all land belonging to the United States, the State of
California, Contra Costa County, and CCCSD because it has been determined that no
special benefit will be conferred on any such land within the District.
This Board finds that the map is in the form and contains the matters prescribed by
Section 3110 of the California Streets and Highways Code.
This Board directs the Secretary of CCCSD to certify the adoption of this resolution
on the face of the map and to file a copy of the map with the County Recorder for
placement in the Book of Maps of Assessment and Community Facilities Districts.

CONDUCT ASSESSMENT PROCEEDINGS
WAYLAND LANE CONTRACTUAL ASSESSMENT DISTRICT NO. 2002 -3
The Board of Directors of the Central Contra Costa Sanitary District (CCCSD)
resolves:
On July 11, 2002, the Board adopted a Resolution of Intention, a copy of which is
attached hereto, marked Exhibit 1, and by reference incorporated herein as though fully
set forth.
All of the property proposed to be assessed lies within the County of Contra Costa.
All public streets, alleys, places, and all land belonging to the United States, the State of
California, Contra Costa County, and CCCSD shall be omitted from assessment because
it has been determined that no special benefit will be conferred on any such land within
the proposed Assessment District.
Contra Costa County will, in the opinion of the Board of Directors of CCCSD, be
benefitted by the improvements referred to in the Resolution of Intention, and the
purposes sought to be accomplished by the work can best be accomplished by a single,
comprehensive scheme of work.
The consent of Contra Costa County, through its Board of Supervisors, is hereby
requested to the formation of the Assessment District described in said Resolution of
Intention, to the improvement described, and to the assumption of jurisdiction by the
CCCSD Board of Directors for all purposes in connection with the formation of this

Assessment District, the improvements to be made and the assessment of property within
the boundaries of the proposed Assessment District.
The Secretary of CCCSD is hereby directed to transmit a certified copy of this
resolution with the Resolution of Intention attached and a certified copy of the map
showing the boundaries of the Assessment District to Contra Costa County.

CONDUCT PROCEEDINGS FOR THE CAD
The initial steps toward creation of Arbor Lane CAD No. 2002 -4 are for the Board of
Directors to adopt a resolution indicating CCCSD's intention to designate an area within
which contractual assessments are appropriate; briefly describing the proposed financing
for the project; establishing the boundaries of the CAD; setting the time, date, and place
for a public hearing at which interested persons may inquire about or object to the
proposed program; and directing staff to prepare an Engineer's Report describing the
project and financing arrangements. Additional resolutions are required to approve the
boundary of the assessment district and to request the consent of Contra Costa County
for CCCSD to conduct proceedings for Arbor Lane CAD No. 2002 -4.
The proposed Arbor Lane CAD No. 2002 -4 complies with the revised CAD policy
approved at the February 1, 2001 Board of Directors meeting. The CAD formation criteria
are listed below.

Staff has concluded that this project is exempt from CEQA under CEQA Guidelines
Section 15061(b)(3), since it can be "seen with certainty that there is no possibility that
the activity in question may have a significant adverse effect on the environment." This
certainty is based on CCCSD's past experience with numerous sewer construction
projects of this nature, the relatively short distance involved, and the impact - limiting
nature of CCCSD's construction specifications that would be required of the project.
Approval of this project will establish the Board of Directors' independent finding that this
project is exempt from CEQA.
RECOMMENDATION: Authorize formation of a CAD consisting of eight properties on
Arbor Lane and Bernie Lane by:
1. adopting a resolution of intention to create Arbor Lane Contractual Assessment
District No. 2002 -4 for the purpose of installing sewer improvements (Exhibit 1);
2. adopting a resolution approving the boundary of the assessment district (Exhibit 2);
and
3. adopting a resolution requesting consent from Contra Costa County for CCCSD to
conduct proceedings for Arbor Lane CAD No. 2002 -4 (Exhibit 3).

RESOLUTION OF INTENTION TO CREATE
ARBOR LANE CONTRACTUAL ASSESSMENT DISTRICT NO. 2002 -4
FOR THE PURPOSE OF INSTALLING SEWER IMPROVEMENTS
WHEREAS the public health and the environment will be best protected by the
expansion of the public sewer system;
WHEREAS the construction and installation of a sanitary sewer pipeline, together
with appurtenant work and facilities, in areas not presently connected to the sewer
system will facilitate the elimination of potential public health problems due to failing
septic systems; and
WHEREAS it would be convenient and advantageous to establish a boundary around
an area within which CCCSD and property owners may enter into contractual assessments
and make arrangements to finance public improvements to parcels which are developed
and where the costs and time delays involved in creating an assessment district pursuant
to alternative provisions in the law would be prohibitively large relative to the cost of the
improvement.
THEREFORE, the Board of Directors of the Central Contra Costa Sanitary District
resolves:
1. This Board intends to approve the following improvement under the authority of
the Municipal Improvement Act of 1911, as amended, to wit: construction and
installation of approximately 800 linear feet of sanitary sewer line, together with
appurtenant work and facilities located at Arbor Lane and Bernie Lane in Alamo,
California.
2. This Board finds that the parcels within the Contractual Assessment District are
shown within the boundaries of the map entitled, "Proposed Boundaries of Arbor
Lane Contractual Assessment District No. 2002 -4."
3. This Board intends to levy a special assessment upon participating parcels within
the described district in accordance with the special benefit to be received by
each parcel of land, respectively, from the improvement. The improvement
proposed will not confer any special benefit upon any publicly owned land.
Hence, there shall be omitted from special assessment all public streets, alleys,
and places and all land belonging to the United States, the State of California,
Contra Costa County, and Central Contra Costa Sanitary District now in use in
the performance of a public function.
4. CCCSD intends to provide loan financing for the improvements, subject to the
availability of funds and any limitation on the commitment or expenditure of
funds for the Contractual Assessment District Program as may be established
from time to time by CCCSD's Board of Directors. Loans shall be repaid by

assessments on the property of participating parcel owners. Assessments shall
be paid over a maximum period of ten (10) years with interest at a rate to be
fixed by CCCSD.
5. The procedure for the collection of assessments will be the placement of
assessments on participating parcel owners' tax bills. The first assessments
may be placed on owners' tax bills in fiscal year 2003 -2004.
6. This Board appoints Curtis Swanson, Environmental Services Division Manager,
as Engineer of Work for this project to prepare the report required by
Section 5898.22 of the Streets and Highways Code.
7. A public hearing shall be held on this matter at 2 p.m. on or about Thursday,
December 5, 2002 at CCCSD offices, 5019 Imhoff Place, Martinez. This date
is tentative and may be modified in the future.
8. The Board independently finds that this project is exempt from the California
Environmental Quality Act (CEQA) under CEQA Guidelines Section 15061(b)(3),

This Board approves the map and adopts the boundaries shown on the map as
describing the extent of the territory included in a proposed assessment district to be
known as Arbor Lane Contractual Assessment District No. 2002 -4, Central Contra Costa
Sanitary District, County of Contra Costa, California.
This Board intends to levy a contractual assessment upon participating parcels
within the described District in accordance with the benefit to be received by each parcel

The Board of Directors of the Central Contra Costa Sanitary District (CCCSD)
resolves:
On July 11, 2002, the Board adopted a Resolution of Intention, a copy of which is
attached hereto, marked Exhibit 1, and by reference incorporated herein as though fully
set forth.
All of the property proposed to be assessed lies within the County of Contra Costa.
All public streets, alleys, places, and all land belonging to the United States, the State of
California, Contra Costa County, and CCCSD shall be omitted from assessment because
it has been determined that no special benefit will be conferred on any such land within
the proposed Assessment District.
Contra Costa County will, in the opinion of the Board of Directors of CCCSD, be
benefitted by the improvements referred to in the Resolution of Intention, and the

ISSUE: Owners of properties on La Sonoma Way in Alamo are interested in connecting
their homes to the Central Contra Costa Sanitary District ( CCCSD) sewer system and have
requested formation of a Contractual Assessment District to finance an extension of the
public sewer system. Board approval is required for a Contractual Assessment District
(CAD).
RECOMMENDATION: Approve initiating the formation of La Sonoma Way CAD No. 2002-
5.
FINANCIAL IMPACTS: There are minor administrative costs for initiating the formation of
a CAD. These costs eventually will be paid by the CAD participants if a CAD is actually
formed. This action does not establish an interest rate for the CAD financing. If the CAD
receives final approval from the Board in the future, the estimated CAD costs are
$57,000. Neighborhood representatives have been informed that the District is
concurrently processing other CAD requests and the final funding decision is subject to
budgetary constraints.
ALTERNATIVES /CONSIDERATIONS: Reject or defer initiating formation of the CAD - these
actions would halt or delay the CAD proceedings.
BACKGROUND: Owners of properties located on La Sonoma Way in Alamo have
contacted District staff to obtain information regarding connecting their homes to
CCCSD's public sewer system. Signed forms expressing interest in investigating and
forming a CAD are on file from five of the six property owners that could be served by La
Sonoma Way public sewers. The area where the CAD would be formed is shown on
Attachment 1.

BACKGROUND: The furnace ash system is a critical component of the solids handling
process and must provide continual, uninterrupted removal of ash from the furnaces
to prevent sludge disposal upsets and potential air permit violations. Prior to
completion of the Ash Handling Improvements Project, the ash system had
experienced chronic problems with equipment breakdowns, ash pipe plugging, and a
lack of back -up equipment that made it increasingly difficult to keep the ash system
in service. The Ash Handling Improvements Project addressed these deficiencies with
the installation of new ash filtration (dust collection) equipment, vacuum blowers, ash
conveyance piping (designed to prevent plugging), and associated valving and
instrumentation. The project also included new furnace control panels and conversion
of the ash control system to programmable logic controllers (PLC's) to replace obsolete
equipment.
The contractor, Monterey Mechanical Co., commenced work on October 21, 1998,
and all contract work was completed and accepted by the Board on November 18,
1999. The original construction contract amount was $995,000. Eight construction
change orders were issued totaling $55,000.

During the construction phase, additional necessary reliability improvements for the ash
system were identified and added which were not part of the original project. These
included installation of special wear resistant elbows on the ash conveyance piping to
reduce wear from abrasion; improvements to the ash filter control system to help meet
air permit requirements on dust emissions; and installation of hand railing along the roof
of the Solids Building for safety purposes. Staff allocated an additional $167,000 to
cover the additional improvements. This increased the total project budget from
$1,644,000 established at the time of construction contract award to $1,811,000 at
closeout. The total project cost was $1,809,518. Therefore, the project closeout will
result in $1,482 being returned to the Treatment Plant Program.
RECOMMENDED BOARD ACTION: This item is presented to the Board of Directors
for information. No action is necessary.

BACKGROUND: The Central Contra Costa Sanitary District Code Title 2, Chapter 2.08,
relates to the chief executive officer of the District. Upon the announcement of the
retirement of the former General Manager -Chief Engineer, the Board hired the firm of
Shannon Associates to conduct an executive search. As part of that process, the title,
duties and requirements for the position were updated to reflect an emphasis on the
general management functions of the position. In March 1999, the Board of Directors
adopted the class description for the position of General Manager and adopted resolutions
appointing Charles W. Batts, Jr. to the position, and authorizing and empowering him to
fulfill the duties of the position of General Manager. Subsequently, in December 2001,
the Board adopted a resolution ratifying and confirming delegation of authority to the
General Manager. However, the District Code was not amended to reflect these changes
in title, qualifications, and duties.

A secondary issue is the delegation of authority from the General Manager to his
assistants and /or designees. It has long been a practice at the District for the General
Manager to delegate authority primarily to Department Directors, but occasionally to
Division Managers, to act on his behalf when he is absent from the District. California
Health and Safety Code Section 6487 provides that all contracts, deeds, warrants,
releases, receipts, and documents shall be signed in the name of the district by its
president, and countersigned by its secretary, except that the board may authorize the
district manager or other employees specified by the board to sign these and similar
documents in the name of the district. In accordance with the Health and Safety Code,
the Board of Directors has adopted various resolutions throughout the years delegating
authority to staff to execute documents and contracts for and on behalf of the District,
but that delegation of authority has not been incorporated into the District Code.
The proposed ordinance is attached for the Board's review and approval. Deletions are
shown in strikeout and additions are indicated in bold font.

ISSUE: On June 25, 2002, sealed bids were received and opened for construction of the
Headworks Bypassing Improvements, District Project 7203. The Board of Directors must
authorize award of the contract or reject bids within 50 days of bid opening.
RECOMMENDATION: Authorize award of a construction contract to N.E. Carlson
Construction, Inc.
FINANCIAL IMPACTS: Expenditure of approximately $325,000, including construction
contract, contingency and construction management, will be required to complete the
project.
ALTERNATIVES /CONSIDERATIONS: Reject all bids, which is not recommended.
BACKGROUND: The Headworks Facilities Improvement Project (DP 7069) installed five
new primary influent pumps, 3 - 700 hp and 2 - 400 hp. Four pumps are available for
directing flow to pre- aeration tanks. Pump 5 is dedicated to bypassing primary influent
flow to the storage ponds. Pump 5 and drive unit have very low hours of use because
of limited need to bypass primary influent.
The Headworks Bypassing Improvements will install new piping that will allow Number 5
(a 700 hp pump) to pump influent flow into the first pre- aeration tank (see Attachment
1 for Project Location and Attachment 2 for Flow Diagram). Adding this bypass would
allow the beneficial use of a $2,000,000 asset and increase the reliability of the primary
influent pumping system. It also allows the bypassing of the normal flow distribution
channel in the chemical feed building so it can be inspected for corrosion. Number 5 will
be used as a duty pump by adding a tee valving to the 78 inch bypass line as the line
passes adjacent to the first pre- aeration tank. Additional items of work include

is $235,000. The project was advertised on June 1 and 6, 2002. Eight (8) bids ranging
from $229,749 to $347,707 were received and publicly opened on June 25, 2002. A
summary of these bids is shown in Attachment 3. The Capital Projects Division
conducted a technical and commercial evaluation of these bids and has determined that
N.E. Carlson Construction, Inc. is the lowest responsible bidder with a bid amount of
$229,749.
Construction management, construction contract administration, and construction
inspection will be performed by District staff. Staff recommends retaining WK to provide
support services during construction for this project because WK prepared the plans and
specifications. Construction support services include reviewing shop drawings and
submittals, responding to design questions, evaluating change order requests, and
performing site visits to verify compliance with the design intent. A professional
engineering services agreement with a ceiling of $10,000 has been negotiated (this will
bring the total contract with WK to $37,200).
The allocation of funds required to complete this project, as shown in Attachment 4, is
$325,000. The Headworks Bypassing Improvements Project is included in the Fiscal Year
2001 -02 and 2002 -03 Capital Improvement Budget on pages TP -70 through TP -72. Staff
has determined that there are adequate funds in the Capital Improvement Budget and Plan
for the project.
Staff has concluded that this project is exempt from the California Environmental Quality
Act (CEQA) under District CEQA Guidelines Section 15301 since it involves minor
alterations to an existing public facility. Approval of this project will establish the Board
of Directors' independent finding that this project is exempt from CEQA.
RECOMMENDED BOARD ACTION: Authorize award of a construction contract in the
amount of $229,749 for the construction of the Headworks Bypassing Improvements,
District Project 7203, to N.E. Carlson Construction, Inc., the lowest responsible bidder.

waste collection events during the next fiscal year.
RECOMMENDATION: Authorize staff to conduct a third mobile household hazardous
waste collection (HHW) event during FY 2002 -03.
FINANCIAL IMPACTS: The incremental cost of conducting a third mobile HHW collection
event is $30,000 to $40,000 depending on the level of participation. This amount was
not included in the 2002 -03 Engineering Department budget.
ALTERNATIVES /CONSIDERATIONS: Conduct two mobile HHW collection events as
previously directed.
BACKGROUND: Since opening the permanent HHW Collection Facility in 1997, the District
has conducted three mobile household hazardous waste collections events in Lafayette,
Danville, and San Ramon each year. During the first year, the cost for the mobile HHW
collection events was funded by grants secured by the Central Contra Costa Solid Waste
Authority. Since the first year of operation, the District has paid for the cost of the mobile
collection events.
In light of the increase of customer participation at the permanent HHWCF, the Board of
Directors directed, as a cost saving measure, that one of the three mobile collection
events be eliminated during the upcoming fiscal year. Staff notified the Central Contra
Costa Solid Waste Authority and the City of San Ramon about the District's plan to
reduce the number of mobile collection events from three to two annually. The CCCSWA
Board of Directors considered the District's plan at it's meeting on May 30, 2002. The
outcome of this meeting was a request for the District to reconsider the reduction of
mobile collection events and to fund three mobile events during the next fiscal year.

subcontract agreement with GSE. Under California Public Contract Code, Section 4107,
substitution of a listed subcontractor is permitted when the subcontractor fails to sign a
subcontract agreement. The awarding authority must consent to the subcontractor
substitution to effect the change. In the present instance, consent by the District Board
of Directors is appropriate.

BACKGROUND: Recruitment is about to begin for the Supervising Engineering Assistant
vacancy occasioned by the resignation of Lesley Klein. As the first step in the process,
staff reviewed the current job classification description and has updated it to better reflect
the current duties to be assigned to positions in the Supervising Engineering Assistant
classification. The proposed revisions would clarify that incumbents may supervise one
or more of the District's Sewer Service Charge, Real Property /Right -of -Way, Plan Review,
Permit or other engineering functions. The proposed description is attached; deletions are
shown as "StFike and additions are shown as in bold print.
Staff has met and conferred with the Management Support /Confidential Group (MS /CG)
regarding the revised classification description. MS /CG concurs with the proposed
revisions and their letter so indicating is attached. Staff anticipates meeting with the
Board's Personnel Committee to discuss this matter as well as other issues prior to the
Board Meeting on July 11, 2002.

ISSUE: The District has been asked by the Treasurer's Office of the County of Contra
Costa to adopt a resolution delegating authority to the County Treasurer to invest and
reinvest the District's funds.
RECOMMENDATION: Approve a resolution delegating authority for investment of the
District's funds to the Treasurer of the County of Contra Costa.
ALTERNATIVES /CONSIDERATIONS: The Board could choose not to approve the
resolution.
BACKGROUND: Each year the Contra Costa County Board of Supervisors, under
Government Code Section 53607, delegates to the County Treasurer the authority to
invest and reinvest the funds of the County and the funds of other public agencies. The
District has used the County Treasurer for this purpose for many years.
County Counsel has recommended that the County Treasurer should also receive
delegation authority from each agency for whom the County Treasurer holds and invests
funds. The attached resolution delegates such authority in accordance with Government
Code Sections, 53601, 53607, 53635 and 53684.
RECOMMENDED BOARD ACTION: Approve a resolution delegating authority for

A RESOLUTION DELEGATING AUTHORITY
FOR INVESTMENT OF PUBLIC AGENCY FUNDS TO
THE TREASURER OF THE COUNTY OF CONTRA COSTA
WHEREAS, the Governing Board of the Central Contra Costa Sanitary District
(hereafter "Agency ") hereby delegates its authority to invest Agency funds to the
Treasurer of the County of Contra Costa ( "Treasurer ");
WHEREAS, this delegation is made pursuant to, and in accord with,
Government Code Sections 53601, 53607, 53635, and 53684 and other applicable
law (collectively, the "Applicable Law ") and shall operate to authorize and request the
Treasurer to take any and all actions contemplated by the Applicable Law with
respect to any and all Agency funds held by the Treasurer;
WHEREAS, all investments transacted by the Treasurer shall adhere to the
District's Investment Policy and will be transacted after receipt of written instructions
from appropriate District officers;
WHEREAS, unless Agency takes action to revoke this authorization and informs
Treasurer in writing of such action, Treasurer shall deem that Agency has taken
action to lawfully renew this delegation prior to the start of each new fiscal year.
Unless informed in writing that this delegation has been revoked, this Resolution shall
be deemed to have continuing effect and shall not expire;
NOW, THEREFORE, BE IT RESOLVED, by the Board of Directors of the Central
Contra Costa Sanitary District, that Agency hereby delegates its authority to invest
Agency funds to the Treasurer of the County of Contra Costa.
