ISSUE: Easements must be accepted by the Board of Directors by resolution.
RECOMMENDATION: Adopt a resolution accepting the Grant of Easement, and authorizing
recording with the Contra Costa County Recorder.
FINANCIAL IMPACTS: None.
ALTERNATIVES /CONSIDERATIONS: None.
BACKGROUND: The Board routinely accepts easements by resolution. The resolution
presented here will accept an easement over a sewer at the new Coyote Creek Elementary
School from the San Ramon Valley Unified School District. The easement area and public
sewer improvements have been reviewed and recently inspected by District staff and
deemed in compliance with District standards.
RECOMMENDED BOARD ACTION: Adopt a resolution accepting an easement from the
San Ramon Valley Unified School District, Job Numbers 5289 (Parcel 2), and 5315 (Parcel
1), Coyote Creek Elementary School, San Ramon, and authorizing recording with the
Contra Costa County Recorder.

ISSUE: Board action is required on the following listed properties to initiate the annexation
process.
RECOMMENDATION: Authorize Proposed Annexations 02 -01, 02 -02, 02 -03, 02 -04,
02 -05 and 02 -06 to be included in future formal annexations.
FINANCIAL IMPACTS: None related to this action.
ALTERNATIVES /CONSIDERATIONS: Not applicable.
BACKGROUND: Existing houses with failed septic systems on the properties included in
PA 02 -03 and 02 -04 paid connection fees in 1992 and 1995, and were connected to the
District's sewer system prior to the properties being annexed to the District. The owners
of the remaining properties listed in the table below have petitioned for their properties to
be annexed to the District.
RECOMMENDED BOARD ACTION: Authorize Proposed Annexations 02 -01, 02 -02, 02 -03,
02 -04, 02 -05 and 02 -06 to be included in future formal annexations.

ISSUE: When reimbursement fees are proposed for projects which could directly connect
to a "standard facility and /or indirectly to special facilities," the District Code requires that
a public hearing be held prior to the Board of Directors' consideration of the fees for
adoption.
RECOMMENDATION: Conduct a public hearing to receive comments on the proposed
Ordinance to amend District Code Section 6.20.300 Schedule of Reimbursement Fees, to
establish reimbursement fees applicable to property which could directly and /or indirectly
connect to Project 5183, 5357, 5377, 5409, 5432, and 5485 facilities. Adopt the
Ordinance.
FINANCIAL IMPACTS: An administrative charge to recover District costs is paid by the
installer for each fee collection transaction.
ALTERNATIVES /CONSIDERATIONS: Not applicable.
BACKGROUND: Project sewers listed in the subject are "standard facilities, and special
facilities" as defined in the District Code. Certain individual property owners within the
boundaries of each project area are the installers of these facilities. To fairly and equitably
distribute the costs for these facilities, the District code provides for the installers to be
reimbursed for the proportion of costs allocable to other properties which connect to the
sewers within 20 years of project acceptance by the District. Staff has drafted a
proposed Ordinance (Attachment 1) to establish reimbursement fees for properties which
connect to these projects' sewers. Exhibits A -1 through A -6 of Attachment 1 shows the
locations of the projects and the boundaries of properties which could directly and /or
indirectly connect to the projects' sewers. The proposed reimbursement fees will be

collected from property owners within the boundaries of these areas, if and when they
connect their property to the sewer system. The collected fees will be held in separate
accounts, and disbursed to the installer of the projects.
The calculation of the proposed reimbursement fees is summarized in Exhibits B -1 to B -6.
of Attachment 1. These fees would be charged in addition to Facilities Capacity and
Pumped Zone Fees (now $3,360 per Residential Unit Equivalent) RUE and $710 per RUE,
respectively, and other District charges, such as those for permits, inspection and sewer
service.
The District Code requires that reimbursement fees be adjusted at least annually to
account for the increase or decrease in value of the facilities due to inflation and
depreciation. These fees may also be adjusted to account for differences between
estimated and actual costs, and increases or decreases in the number of connections
which may connect to the facilities. However, once a particular property has connected
to the public sewer, and the fees have been paid, the District will not collect any
additional reimbursement fees for that connection, nor refund any excess reimbursement
fees which might otherwise be occasioned by these adjustments.
Appropriate notices have been posted, and published in the Contra Costa Times. In
addition, individual letter notices were mailed to the owners of all affected properties, as
required by the District Code.
After receiving individual letter notices, the installer for Project 5183 and the property
owner, who has the remaining potential connections, informed District staff that they
have recently reached an agreement on sharing the cost for the sanitary sewer, other
utilities and earth work. A copy of the agreement will be furnished to District staff as
soon as it has been executed. Therefore, they have requested that the District not
establish a reimbursement account. In accordance with their request, Project 5183 is not
included in the recommendation to establish reimbursement fees.
RECOMMENDED BOARD ACTION: Conduct a public hearing to receive comments on the
proposed Ordinance to amend District Code Section 6.20.300 Schedule of Reimbursement
Fees, to establish reimbursement fees applicable to property which could directly and /or
indirectly connect to Project 5357, 5377, 5409, 5432, and 5485 facilities. Adopt the
Ordinance.

CENTRAL CONTRA COSTA SANITARY DISTRICT
TO AMEND DISTRICT CODE SECTION 6.20.300 SCHEDULE OF
REIMBURSEMENT FEES TO ESTABLISH REIMBURSEMENT FEES
APPLICABLE TO PROPERTIES WHICH COULD DIRECTLY AND /OR INDIRECTLY
CONNECT TO PROJECT 5357, 5377, 5409, 5432, AND 5485
WHEREAS, the Central Contra Costa Sanitary District (District) Code Chapter 6.20
provides for reimbursement to installers of standard and special facilities from fees
charged property owners when they apply to connect their property to the public sewer
system; and
WHEREAS, District Code Chapter 6.20 provides for the establishment of reimbursement
accounts for constructed standard and special facilities; and
WHEREAS, Project 5357, 5377, 5409, 5432, and 5485 facilities, the location of which
are shown on Exhibits A -1 to A -6 of this Ordinance, incorporated in full herein by
reference, are standard and special facilities as defined in District Code Chapter 6.20; and
WHEREAS, reimbursement fees have been calculated by the method specified in District
Code Chapter 6.20, which calculation is summarized in Exhibits B -1 through B -6 of this
Ordinance, incorporated in full herein by this reference; and
WHEREAS, a properly noticed public hearing to receive comments on the proposed
reimbursement fees was conducted at the Board of Directors' regularly scheduled meeting
on January 10, 2002.
NOW, THEREFORE, the Board of Directors of the Central Contra Costa Sanitary District
does ordain as follows:

Reimbursement fees applicable to properties which connect directly and /or
indirectly to Project 5357, 5377, 5409,'5432, and 5485 facilities designated on
Exhibits A -1, A -2, A -3, A -4, A -5 and A -6 are hereby established. Said
reimbursement fees, which shall be consecutively added to District Code Section
6.20.300 Schedule of Reimbursement Fees, have been calculated in the manner
set forth in District Code Chapter 6.20 and shown in Exhibits B -1, B -2, B -3 B -4, B-
5 and B -6 of this Ordinance. Reimbursement fees for properties which directly
and /or indirectly connect to Projects 5357, 5377, 5409, 5432, and 5485 shall be

The reimbursement fees setforth herein shall be administered, adjusted and
collected to the terms of Chapter 6.20.
Section 3
Exhibits A -1 through A -6, and B -1 through B -6, hereto shall not be incorporated
into the District Code; however, copies of same shall be maintained in the District
offices and made available for inspection during the periods where the subject
reimbursement fees are in effect.
Section 4
This Ordinance shall be a general regulation of the District and shall be published
once in the Contra Costa Times, a newspaper of general circulation within the
District, and shall be effective on the eighth calendar day following such
publication.

ISSUE: On December 19, 2001, sealed bids were received and opened for the Filter Plant
Rotary Wash and Drain -Back Channel Piping Upgrades, Project DP 7183C. The Board of
Directors must authorize award of the contract or reject bids within 50 days of the bid
opening.
RECOMMENDATION: Authorize award of a construction contract to Kaweah Construction
Company.
FINANCIAL IMPACTS: Approximately $258,000, including bid price, contingency, and
construction management.
ALTERNATIVES /CONSIDERATIONS: Reject all bids.
BACKGROUND: This project will upgrade the rotary wash piping at the Filter Plant and
provide wash -down hydrants at the drain -back channel. The Filter Plant rotary wash
piping was identified as needing replacement during the recent Filter Plant Enhancements
Project, DP 7196. The partially immersed rotary wash header piping is severely corroded
and was repaired at that time with a short-term fix. The rotary wash piping system is a
critical component of the Filter Plant operation and needs to be fully repaired before this
summer, when there is high demand on the Filter Plant. The new piping system will be
corrosion - resistant stainless steel, and it will be relocated out of the immersion area and
provide for a long -term reliable system.
The drain -back channel was installed with the Headworks project in the early 1990's.
This is a concrete -lined channel near the Filter Plant north of Imhoff Drive. During some

rain events plant flows exceed the capacity of the primaries or secondaries, and raw or
primary- treated sewage is bypassed to this channel. After the plant has processed this
bypassed flow and the channel is drained, a high potential for odors is created if the
channel is not washed down immediately. The current wash -down procedure is labor
intensive and time consuming. The project will provide wash -down hydrants at
convenient locations along the channel, reducing the time and manpower required to clean
the channel. The project sites are shown on Attachment 1.
The project was advertised on November 13 and 19, 2001. Bids, ranging from a low of
$181,400 to a high of $259,655, were received and publically opened on December 19,
2001. A summary of these bids is shown on Attachment 2. Operations Department staff
conducted a commercial and technical evaluation of these bids, and has determined that
Kaweah Construction Company is the lowest responsible bidder with a bid amount of
$181,400, which is higher than the engineer's estimate of $150,000. An analysis of
current conditions indicates that there has been an increase in the cost of stainless steel
pipe. Also, due to several local refinery repair projects, the bidders cited a lack of labor
and subcontractors as reasons for their bid costs.
Construction management services will be provided by District staff, in conjunction with
WRMS Engineering, Inc. WRMS Engineering has previously provided successful
inspection and construction management services on recent projects.
The project is included in the fiscal year 2001 -2002 Capital Improvement Budget on
pages TP -104 and TP -105. The project manager has reviewed the expenditure
requirements for this allocation with the CIB /CIP Program Coordinator and has determined
that they are consistent with the Capital Improvement Budget and Plan.
Staff has also concluded that this project is exempt from the California Environmental
Quality Act (CEQA) under District CEQA Guidelines, Section 15302, since it involves
minor replacement of existing sewage facilities on the same site with no increase in
capacity. Approval of this project will establish the Board of Directors' independent
finding that this project is exempt from CEQA.

that the District pay the reimbursement fee for the public sewer that he installed.
RECOMMENDATION: Deny the request for the District to pay the reimbursement fee.
Direct staff to prepare a letter advising Mr. Costa of the District decision.
FINANCIAL IMPACTS: The amount of the reimbursement fee is $6944.64.
ALTERNATIVES /CONSIDERATIONS: The Board of Directors could approve payment of all
or a portion of the requested reimbursement fee based on consideration of project specific
circumstances.
BACKGROUND: The District's sewer service policy requires property owners to extend
the public sewer to serve their property. In 1998, Mr. and Mrs. Walter Costa extended
the public sewer to serve their home located at 1264 Redwood Road in Lafayette (see
Attachment A). The Costa's installed 92 feet of 8 -inch ductile iron sewer. The District
accepted the project in October 1998. As this sewer could possibly serve the existing
house located at 1265 Redwood Road, Mr. Costa requested that a reimbursement fee be
established in accordance with the District Code. In October 1999, the District
established a reimbursement fee of $6,944.64 for 1265 Redwood Road should that
property ever directly connect to the public sewer installed by Mr. Costa under District
Project No. 5288 (see Attachment B).
Reimbursement fees are established by the District at the request of sewer installers in
accordance with the District Code Chapter 6.20. The District collects reimbursement fees
from properties that physically connect directly to a public sewer extension for which a
reimbursement fee has been established. The District then distributes the collected
reimbursement fees minus an administrative fee to the sewer installer. Per the District

Code Chapter 6.20.240, the reimbursement fee program is a convenience for the installers
and the District is not liable to any person for failure to establish or collect
reimbursements.
Subsequently, Mr. William McKee of 1271 Redwood Road extended the public sewer
under District Project No. 5430 to serve his and other properties located further up
Redwood Road. The sewer extension started at the end of the Costa sewer extension and
continued 425 feet up Redwood Road. The District accepted this sewer extension in
March 2000. Mr. McKee apparently reached separate agreements for sharing the sewer
extension costs with his neighbors and elected not to request that reimbursement fees be
established for McKee sewer extension (Project 5430). Under the District Code, the
installer must request establishment of reimbursement fees within six months of sewer
acceptance by the District.
In October 2001, the owners of 1265 Redwood Road, Mr. and Mrs. Quinn, decided to
connect to the public sewer. Based on topography, a sewer lateral was connected
directly to the McKee sewer extension (Project 5430). The Quinns paid all of the required
fees. A reimbursement fee was not charged because such a fee had not been established
for the McKee sewer extension. The Quinn's lateral connects directly to the McKee sewer
extension at a point approximately 63 feet upstream from the end of the Costa sewer
extension (Project 5288).
Mr. Costa feels that the Quinn's expected to pay the reimbursement fee and that the
District should have collected such a reimbursement fee from the Quinn's at the time of
connection. Staff informed Mr. Costa that under the District Code, the Quinn's are not
required to pay the reimbursement fee established by the District because they did not
directly connect their lateral to the sewer installed by Mr. Costa. The Quinn's lateral
connects directly to the McKee sewer extension. The District Code, specifically chapter
6.20.040, allows District staff to collect reimbursement fees only from properties that
physically connect directly to a public sewer extension for which a reimbursement fee has
been established by the District Board of Directors. Staff does not have the authority to
collect reimbursement fees where there is not a direct connection.
On December 22, 2001, Mr. Costa sent a letter to the District stating that the District
misinformed him about the possible reimbursement fee and requesting that the District pay
the reimbursement fee to him (see Attachment C).
RECOMMENDED BOARD ACTION: Deny the request for the District to pay the
reimbursement fee. Direct staff to prepare a letter advising Mr. Costa of the District
decision.

Using the figures in Exhibit B -2, your potential maximum recovery from properties which
connect within 20 years of project acceptance by the District is $6,944.64. This Project
was accepted on October 19, 1999. The initial reimbursement fee is $6,944.64 per
Residential Unit Equivalent (RUE). The reimbursement fee is due when property connects
to the project sewer.
Reimbursement fees and potential maximum recovery may be adjusted by the District to
account for the increase or decrease in the value of the facilities due to inflation and
depreciation. These fees may also be adjusted to account for differences between
estimated and actual costs, and increases or decreases in the number of connections
tributary to the facilities. However, once a particular property has connected to the public
sewer, _and the fees have been paid, the District will not collect any additional
reimbursement fees, nor refund any excess reimbursement fees which might otherwise
be occasioned by these adjustments.
