ISSUE: Board approval is required to accept offers of dedication.
RECOMMENDATION: Accept work and offers of dedication, approve the twenty
resolutions accepting offers of dedication at no cost to the District, and authorize
recording.
FINANCIAL IMPACTS: None.
ALTERNATIVES /CONSIDERATIONS: None.
BACKGROUND: The District routinely accepts easements and public sewer improvements
through Board approval of resolutions to that effect. The resolutions presented here are
for the purpose of accepting several easements that are required as a result of recent
construction. The easements and public sewer improvements have been reviewed by
District staff and deemed in compliance with District standards. The offers of dedication
requiring resolutions are listed in Attachment 1.

ISSUE: The Board must authorize quitclaiming of easements
RECOMMENDATION: Authorize quitclaiming of an easement in Walnut Creek.
FINANCIAL IMPACTS: None.
ALTERNATIVES /CONSIDERATIONS: None.
BACKGROUND: The easement shown on the attached map was dedicated for public use
for sanitary sewers on the final map for Subdivision 3522 which was filed in 1967. The
easement was never used and will not be needed for future sanitary sewer purposes.
Hence the easement may be quitclaimed. The District's processing fee has been paid.
Staff concluded that this transaction is exempt from the California Environmental Quality
Act (CEQA) under District CEQA Guidelines Section 18.6, since it involves a minor
alteration in land use limitations. Authorizing of this quitclaim will establish the Board of
Director's independent finding that this action is exempt from CEQA.
RECOMMENDED BOARD ACTION: Authorize the President of the Board of Directors and
the Secretary of the District to execute a Quitclaim Deed to John and Rhonda
Montgomery, and authorize staff to record the Quitclaim Deed with the Contra Costa
County Recorder.

been relocated at the cost of the developer. A portion of the easement is no longer
needed and may be quitclaimed. The District's processing fee has been paid.

ISSUE: Authorization in the form of a resolution by the Board of Directors is needed to
place assessments on the County tax roll.
RECOMMENDATION: Adopt a resolution directing that the 2000 -2001 yearly installments
of assessments for contractual assessment districts be collected on the County tax roll.
FINANCIAL IMPACTS: Collection of assessments by placing them on the County tax roll
requires minimal work by District staff and is the most economical method of collection.
ALTERNATIVES /CONSIDERATIONS: Have assessments billed annually by District
accounting staff.
BACKGROUND: The owners of twelve properties on Gary Way (CAD 97 -1), four
properties on Leona Court (CAD 97 -2), and seven properties on Alhambra Way (CAD 98-
1) have agreed to pay for sewer improvements installed in conjunction with contractual
assessment districts by paying assessments over a ten year period. The payments are to
be collected from the owners by placing the assessments on the owner's tax bills. A
resolution by the Board is needed to place their assessments on the appropriate tax bills.
RECOMMENDED BOARD ACTION: Adopt a resolution directing that the 2000 -2001 yearly
installments of assessments for contractual assessment districts be collected on the
County tax roll.

A RESOLUTION DIRECTING THAT THE 2000 -2001
YEARLY INSTALLMENT OF ASSESSMENTS FOR
CONTRACTUAL ASSESSMENTS DISTRICTS BE
COLLECTED ON THE COUNTY TAX ROLL
WHEREAS, the Board of Directors of the CCCSD has previously taken action to establish the
final assessments for Contractual Assessment Districts No. 97 -1, 97 -2, and 98 -1; and
WHEREAS, the District has given proper notice to the affected owners of the final
assessments; and
WHEREAS, the affected owners have elected to pay the assessments in yearly installments
of principal and interest over a period of ten years; and
WHEREAS, the District Code provides that the District may elect to collect current charges on
the tax rolls as provided by Section 5470 and following of the Health and Safety Code; and
WHEREAS, it is considered economical and efficient to collect the assessments for the 2000-
2001 fiscal year on the County tax roll;
NOW, therefore, be it resolved by the Board of Directors of the CCCSD that the 2000 -2001
Assessments for Contractual Assessment Districts No. 97 -1, 97 -2, and 98 -1 are to be collected on
the County Contra Costa Tax Roll.

ISSUE: The Central Contra Costa Sanitary District is required to establish its appropriations
limit in accordance with Article XIII B of the California Constitution.

ALTERNATIVES /CONSIDERATIONS: The appropriations limit could be calculated using the
California per capita personal income percentage change of 4.91 as opposed to the local
assessment roll due to local non - residential construction of 7.1 percent.
BACKGROUND: Proposition 4 was approved on November 6, 1979, and was incorporated
in the California Constitution as Article XIII B. As amended, Article XIII B imposes a limit on
the rate of growth in governmental spending. It limits appropriations of state and local
governments to the appropriations of the 1978 - 1979 base year adjusted in each subsequent
year for changes in the California per capita personal income from the preceding year or the
percentage change in the local assessment roll from the preceding year due to the addition
of local nonresidential new construction.
Article XIII B requires government agencies to establish their appropriations limit by resolution
each year at a regularly scheduled meeting. Notice to the public of availability of
documentation in support of the appropriations limit must be given fifteen days prior to
adoption. The appropriations limit is open to challenge within 45 days of the effective date
of the resolution.

The change in the local assessment roll for the 2000 -2001 fiscal year has been
reported by the County Assessor to be 7.1 percent. The California per capita personal
income percentage change is 4.91. The change in the local assessment roll is being
used in the calculation of the 2000 -2001 appropriations limit. Last fiscal year's
appropriations limit was calculated to be $39,804,402. The appropriations limit for
2000 -2001 is calculated to be $42,890,560.

ISSUE: On July 11, 2000, sealed bids were received and opened for construction of the
No. 11 Lost Valley Drive Slide Repair Project, District Project No. X5453. The Board of
Directors must authorize award of the contract or reject bids within 60 days of bid
opening.
RECOMMENDATION: Authorize award of a construction contract.
FINANCIAL IMPACTS: Approximately $279,000 including construction, contingency, and
construction management.
ALTERNATIVES /CONSIDERATIONS: Reject all bids, which is not recommended.
BACKGROUND: The District initially became aware of land movement at No. 11 Lost
Valley Drive, Orinda, in early 1995, and became aware of additional movement during the
winter of 1997 -1998. Early in 1998 the District retained a geotechnical engineer,
Woodward Clyde Consultants (now URS Greiner Woodward Clyde), to evaluate the
landslide and to provide recommendations. Although Woodward Clyde Consultants did
not find any evidence that the District's facilities caused or contributed to the landslide
condition, the consultant did recommend that a repair be undertaken to protect the long-
term integrity of the District's sewer and sewer manhole (Attachment 1). Accordingly,
plans have been prepared to repair the hillside. The District has gained concurrence of the
various regulatory agencies for the planned sewer protection project.
The plans and specifications were prepared by District staff with the assistance of URS
Greiner. The Engineer's estimate for construction is $150,000. This project was

advertised on June 20, and 26, 2000. One sealed bid for $190,190 was received and
publicly opened on July 11, 2000. A summary of bids received is shown in Attachment
2. Only one bid was received which is reflective of the current bidding climate. The
District and other agencies have experienced a significant reduction in the number of bids
received for construction projects. Schedule conflicts with other slide projects, time
constraints, and access /construction complexities limited the number of qualified
contractors submitting bids. The Capital Projects Division staff conducted a technical and
commercial review of the bids and determined that the bid submitted by McGuire and
Hester Construction Company is the lowest responsible bid.
The District will administer the construction contract and will provide contract
administration, inspection, survey, office engineering, and shop drawing review. URS
Greiner will be doing periodic site inspections and soils testing. The funds required to
complete this project, as shown in Attachment 3, are $279,000.
Construction of the slide repair is included in the fiscal year 1999 -2000 and 2000 -01
Capital Improvement Budget (CIB) on pages CS -70 through CS -72. Staff has conducted
a cash flow analysis of the Sewer Construction Fund and concluded that adequate funds
are available for this project. Reimbursement for the costs expended in the slide repair will
be sought through assertion of a cross - complaint in the existing litigation concerning this
property.
Staff has concluded that this project is exempt form the California Environmental Quality
Act (CEQA) under District CEQA Guidelines, Section 18.2, since it involves the repair of
an existing facility with no expansion of capacity. Authorization of the construction
contract for this project will establish the Board of Directors' independent finding that the
project is exempt from CEQA.
RECOMMENDED BOARD ACTION: Authorize award of a construction contract in the
amount of $190,190 for construction of the No. 11 Lost Valley Drive Slide Repair Project,
D.P. X5453, to McGuire and Hester Construction Company, the lowest responsible bidder.

FINANCIAL IMPACTS: The potholing services will cost an estimated $185,250 over a
two -year period. The contract has been bid on a unit cost basis and it is possible that the
contract may be expanded, if additional work is identified.
ALTERNATIVES /CONSIDERATIONS: Individual contracts could be issued for each
potholing service instead of using a blanket contract.
BACKGROUND: The Capital Projects Division will perform approximately 400 potholes
in the next two years as part of the design of various capital projects. The purpose of
potholing is to expose underground utilities along the proposed sewer alignments at points

will minimize change orders during construction.

BACKGROUND: The Capital Projects Division will televise approximately 170,000 feet
of sewer pipeline in the next two years as part of the design of various capital projects.

root intrusion, grease build -up, corrosion, and to locate lateral connections. The results

allow staff to meet upcoming peaks in right of way work and to deal with a backlog of
property rights issues caused by recent staff retirements and recruitment and training of
replacement staff. Anticipated peaks in workload are a result of already approved and
scheduled capital projects.
BACKGROUND: Associated Right of Way Services, Inc., was selected through a formal
proposal and interview process as the consultant for this contract based on the experience
of it's staff, extensive knowledge of the District's service area, familiarity with the
District's procedures and standards, and availability of required resources (including
certified appraisers, right of way agents, licensed real estate brokers, right of way
technicians) to meet the unique requirements of this scope of work.
The purpose of the subject Technical Consulting Services Agreement is to meet existing
and anticipated demands for specific and specialized property rights services. Through

right of way for capital projects, mitigation of easement encroachments, and perfecting
of easement rights for existing sewers. Some of the right of way acquisitions may have
to be acquired through the eminent domain process.
There are a number of scheduled capital projects that will require some degree of right of
way acquisition work. Among these are the A -Line Easement Acquisition Project, Lower
Orinda Pump Station Renovation Project, Martinez Transmission Sewer Project, South
Orinda Phase II, Lafayette Sewer Renovation ll, Walnut Creek Sewer Renovations, and
other renovation /replacement projects.
Perfecting easement rights is required at locations where sewers exist without recorded
easements or where the existing rights are less than what is currently needed to
effectively maintain or repair certain sewer segments. Many sewers now owned and
maintained by the District were originally built without proper rights being acquired. In
some cases, additional or expanded access rights are needed to allow our crews to
maintain sewers using truck mounted equipment. Additionally, there exist numerous
encroachments onto District easements that interfere with maintenance /repair of sewers.
Some of these encroachments consist of fences, sheds, utilities, paving, and other
improvements. Staff has compiled a list of encroachment locations where enforcement
of the Districts easement rights is needed to facilitate maintenance and future repair of
the sewers.
RECOMMENDED BOARD ACTION: Authorize the General Manager to execute an
amendment to add $75,000 in cost ceiling (for a total of $110,000), and one year term
to the current agreement with Associated Right of Way Services, Inc., for real property
rights consulting services.

requested formation of a Contractual Assessment District to finance an extension of the
public sewer system. Board approval is required for a Contractual Assessment District.
RECOMMENDATION: Approve initiating the formation of Via Cerrada CAD No. 2000 -6

FINANCIAL IMPACTS: There are minor administrative costs for initiating the formation of
a CAD. These costs will be paid by the CAD participants if a CAD is actually formed. If
the CAD receives final approval from the Board in the future, the estimated CAD costs are
$56,000. Neighborhood representatives have been informed that the District is
concurrently processing other CAD requests and the final funding decision is subject to
budgetary constraints.

The initial steps toward creation of Via Cerrada CAD No. 2000 -6 are for the Board of
Directors to adopt a resolution indicating CCCSD's intention to designate an area within
which contractual assessments are appropriate; briefly describing the proposed financing
for the project; establishing the boundaries of the CAD; setting the time, date, and place
for a public hearing at which interested persons may inquire about or object to the
proposed program; and directing staff to prepare an Engineer's Report describing the
project and financing arrangements.
Additional resolutions are required to approve the boundary of the assessment district and
to request the consent of Contra Costa County for CCCSD to conduct proceedings for Via
Cerrada CAD No. 2000 -6.
Staff has concluded that this project is exempt from CEQA under District CEQA Guidelines
Section 5.2(b)(3), since it can be "seen with certainty that there is no possibility that the
activity in question may have a significant adverse effect on the environment." This
certainty is based on the District's past experience with numerous sewer construction
projects of this nature, the relatively short distance involved, and the impact - limiting
nature of the District's construction specifications that would be required of the project.
Approval of this project will establish the Board of Directors' independent finding that this
project is exempt from CEQA.
RECOMMENDATION: Authorize formation of a CAD consisting of 3 properties on Via
Cerrada without establishing precedent for an exception to the "five property minimum"
rule by:
1. adopting a resolution of intention to create Via Cerrada Contractual Assessment

WHEREAS the public health and the environment will be best protected by the
expansion of the public sewer system;
WHEREAS the construction and installation of a sanitary sewer pipeline, together
with appurtenant work and facilities, in areas not presently connected to the sewer
system will facilitate the elimination of potential public health problems due to failing
septic systems; and
WHEREAS it would be convenient and advantageous to establish a boundary around
an area within which the District and property owners may enter into contractual
assessments and make arrangements to finance public improvements to parcels which are
developed and where the costs and time delays involved in creating an assessment district
pursuant to alternative provisions in the law would be prohibitively large relative to the
cost of the improvement.
WHEREAS the District's CAD policy states that the "minimum number of properties
directly tributary to the proposed facilities that are needed to form a CAD will be five," but
the Board of Directors is permitted to allow an exception to this rule on a case -by -case
basis without establishing precedent.
THEREFORE, the Board of Directors of the Central Contra Costa Sanitary District
resolves:
1. This Board intends to approve the following improvement under the authority of
the Municipal Improvement Act of 1911, as amended, to wit: construction and
installation of approximately 400 linear feet of sanitary sewer line, together with
appurtenant work and facilities located at Via Cerrada in Alamo, California.
2. This Board finds that the parcels within the Contractual Assessment District are
shown within the boundaries of the map entitled, "Proposed Boundary of Via
Cerrada Contractual Assessment District No. 2000 -6."
3. This Board intends to levy a special assessment upon participating parcels within
the described district in accordance with the special benefit to be received by
each parcel of land, respectively, from the improvement. The improvement
proposed will not confer any special benefit upon any publicly owned land.
Hence, there shall be omitted from special assessment all public streets, alleys,
and places and all land belonging to the United States, the State of California,
the County of Contra Costa, and Central Contra Costa Sanitary District now in
use in the performance of a public function.

4. This District intends to provide loan financing for the improvements to be repaid
by assessments on the property of participating parcel owners. Assessments
shall be paid over a maximum period of ten (10) years with interest at a rate to

may be placed on owners' tax bills in fiscal year 2001 -2002.
6. This Board appoints Curtis Swanson, Environmental Services Division Manager,

All of the property proposed to be assessed lies within the County of Contra Costa.
All public streets, alleys, places, and all land belonging to the United States, the State of
California, the County of Contra Costa, and CCCSD shall be omitted from assessment
because it has been determined that no special benefit will be conferred on any such land

The County of Contra Costa will, in the opinion of the Board of Directors of CCCSD,

RESOLUTION APPROVING BOUNDARY MAP
CORWIN DRIVE /LA SONOMA /LOS ALAMOS
CONTRACTUAL ASSESSMENT DISTRICT NO. 2000 -4
The Board of Directors of the Central Contra Costa Sanitary District resolves:
A map entitled "Proposed Boundary of Corwin Drive /La Sonoma /Los Alamos
Contractual Assessment District No. 2000 -4" has been filed with the Secretary of the
Central Contra Costa Sanitary District.
This Board approves the map and adopts the boundaries shown on the map as
describing the extent of the territory included in a proposed assessment district to be
known as Corwin Drive /La Sonoma /Los Alamos Contractual Assessment District
No. 2000 -4, Central Contra Costa Sanitary District, County of Contra Costa, California.
This Board intends to levy a contractual assessment upon participating parcels within
the described District in accordance with the benefit to be received by each parcel of land,
respectively, from the improvement. There shall be omitted from assessment, all public
streets, alleys, and places and all land belonging to the United States, the State of
California, the County of Contra Costa, and the District because it has been determined
that no special benefit will be conferred on any such land within the District.
This Board finds that the map is in the form and contains the matters prescribed by
Section 3110 of the California Streets and Highways Code.

This Board directs the Secretary of the District to certify the adoption of this
resolution on the face of the map and to file a copy of the map with the County Recorder
for placement in the Book of Maps of Assessment and Community Facilities Districts.

RESOLUTION REQUESTING CONSENT TO
CONDUCT ASSESSMENT PROCEEDINGS
CORWIN DRIVE /LA SONOMA /LOS ALAMOS
CONTRACTUAL ASSESSMENT DISTRICT NO. 2000 -4
The Board of Directors of the Central Contra Costa Sanitary District (CCCSD)
resolves:
On July 20, 2000, the Board adopted a Resolution of Intention, a copy of which is
attached hereto, marked Exhibit 1, and by reference incorporated herein as though fully
set forth.
All of the property proposed to be assessed lies within the County of Contra Costa.
All public streets, alleys, places, and all land belonging to the United States, the State of
California, the County of Contra Costa, and CCCSD shall be omitted from assessment
because it has been determined that no special benefit will be conferred on any such land
within the proposed Assessment District.
The County of Contra Costa will, in the opinion of the Board of Directors of CCCSD,
be benefitted by the improvements referred to in the Resolution of Intention, and the
purposes sought to be accomplished by the work can best be accomplished by a single,
comprehensive scheme of work.
The consent of the County of Contra Costa, through its Board of Supervisors, is
hereby requested to the formation of the Assessment District described in said Resolution

of Intention, to the improvement described, and to the assumption of jurisdiction by the
CCCSD Board of Directors for all purposes in connection with the formation of this
Assessment District, the improvements to be made and the assessment of property within
the boundaries of the proposed Assessment District.
The Secretary of CCCSD is hereby directed to transmit a certified copy of this
resolution with the Resolution of Intention attached and a certified copy of the map
showing the boundaries of the Assessment District to the County of Contra Costa.
