Central Contra Costa Sanitary District November 24, 2010 TO: BOARD BUDGET AND FINANCE COMMITTEE FROM: RANDALL MUSGRAVES DEBBIE RATCLIFF SUBJECT: NOVEMBER 15, 2010 COMMITTEE MEETING There were three outstanding questions from the last Board Budget and Finance Committee meeting which required additional staff research. The questions and answers are provided below: 1. 182682 Bob Murray & Associates — What are the details for the. $10,000 charge? Mr. Murray's practice is to charge $5,000 per executive performance review. He reviewed the Secretary of the District, General Manager and District Counsel. Because he only made one visit to the District and has performed the reviews before, he discounted the total price from $15,000 to $10,000. There is no other detailed breakdown of the charges. The District received one invoice for $10,000. 2. What are the components of the retirement contribution the District makes to CCCERA and what components are included in the footnote in the Audited Financial Statements on page 29? There are four components that make up the total contribution paid to CCCERA (See Below). The District pays both employer components and picks up the employee basic. By law, the employees must pay the employee COLA piece. For Fiscal Year 2009 -2010, the District and employees paid the following: Employer Basic $4,892,196 (20.34 %) Employee COLA $939,388 Employer COLA $2,412,422 (10.03 %) (3.81%) Employee Basic $1,499,509 (6.48 %) Total District $8,804,127 ' (36.85 %) The footnote in the audited financial statements shows the total contribution broken down by total employer contribution ($8,804,127) and employee contribution ($939,388).. 3. Must the Actuary use the same assumptions in the GASB 45 actuarial study that is used in the CCCERA actuarial pension study? GASB 45 says that the actuarial evaluation should use the same demographic assumptions as used by the retirement system. The exception to this rule is the discount rate that can be used. The discount rate can be estimated based on where the source of District funds to pay the future benefits, is invested. If we use the pay -as- you -go approach, most of the District's funds are in the LAIF account and the discount rate used would mirror LAIF with an average rate of return over 20 years. If the District funds are held in a GASB 45 Ttrust which has much broader investment vehicles, the discount rate can be set closer to the expected investment returns. The District's GASB 45 Actuary assumed an 8% rate of return. N N SUBJECT: CONNECTION FEES FOR SMALL BUSINESSES In keeping with general Board direction to work with distressed customers to mitigate the impact of capacity and other commercial connection fees during the economic recession and recovery, staff has recently accommodated a few new businesses with installment payment plans. The following agreements are currently in effect: Loard's Ice Cream in Moraqa — Connection fees were approximately $6,800, and the business owners have made regular monthly payments since February, 2010, on a one - year agreement. Wizzbangz Burgers in Danville — Connection Fees were approximately $10,800. The business owners made a down payment of $7,200 and have made regular monthly payments on the balance ($3,600.00) since August, 2010, on a one -year agreement. The following proposal has been made by a new customer: Iron Horse Deli and Go Team Spirit Store in Danville — Connection Fees are approximately $6,900. The business owners are proposing to pay this in three monthly installments of $2,300 each, starting in February, 2011. The business is scheduled to open in December or January. If continuing this approach is deemed appropriate, staff could develop an ordinance to amend the District Code to provide for a broadened "Capacity Use Charge" program that would be available to more businesses and would have more flexible terms and conditions.
