The questions and answers are provided below: Page 26, 163376 Pacific Lock and Door - Where was the lock work performed? The $838 charge was for re-keying all of the pump station facilities to ensure the DistricYs security. Historically, PG&E had keys to enter after hours to read the power meters. This worked well for years until we had some erroneous visits to the San Ramon facility to use the restroom. PG&E must now coordinate entry when an operator is present. 2. Page 30, 29410 City of Lafayette - What were these charges for? These charges were for encroachment permits to the City of Lafayette for construction work that CCCSD is doing on city streets. 3. Page 30, 29420 Zentner and Zentner - What work was done for the Wet Weather Bypass Improvement Project? The Wet Weather Bypass Improvements Project will install a gravity overflow structure and new culvert that will discharge directly to Walnut Creek. The existing discharge to Pacheco Slough was found to be hydraulically deficient under wet weather conditions. In order to install the proposed new Wet Weather Bypass to Walnut Creek, the District needs to complete an Initial Study (CEQA). The Initial Study is needed to apply for the various permits (Army Corp of Engineers, Fish and Game, Flood Control District, etc) required for installation of the bypass. The firm of Zentne[ and Zentner was retained to conduct the Initial Study; the Initial Study includes biological, horticultural and other assessments. Alm Attorney at Law 510.808.2000 A ques6on has been raised as to the appropriateness of the District reimbursing myself for attendance at certain CASA conferences. When this concem was brought to my attention I requested that I be able to provide a memo which provides a little background concerning this issue, although I certainly agree that the Board may wish to review and modify past practice. The practice of the District reimbursing its District Counsel for attendance at CASA meetings dates back before my tenure into at least the early 1980s. When the Sellar Hazard frm applied for fhe Districi Counsel position back in 1985, one of the requirements of fhe Board at that time was that the DisVict Counsel would be an active participant in CASA and attend CASA meetings without receiving addi5onal compensation from the District for the hourly time spent in those activities. The Board at that time indicated that direct costs of attendance would be reimbursed a~d a specific budget item was set up for travel and con(erence reimbursement (or the District Counsel. Due to the initial direction of the Boarci and the value of CASA attendance to my waste water practice area, I have attended viRually every CASA conference for nearly 20 years. Unlike most of the CASA agency attomeys, I attempt to go a day before the CASA attorneys' meeting in order to attend the technicai meetings to stay abreast of the industry technical issues. This typicaliy requires me to be out of the office for at least two days to attend most CASA conferences. Additionally, over the last several years I have served as a representative of this District on the CASA Legislative Committee. This occurred after a Board decision and direction to do so. For that reason, I consistently make arrangements fo be present in time for 7:30 Friday moming meetings. I have also consistently attended the Legislative Committee meetings held several times a year in Sacramento. ' Recently, I have become aware that an issue has been raised regarding expense reimbursement for these CASA conferences perhaps should be reconsidered based on the fact that I represent a number of CASA agencies. Nm, Distnct Counsel Re: Reimbursement for Atlendance at CASA Meetlngs Date: October 27, 2006 Page: 2 requested expense reimbursement from lhe District for i or 2 CASA Conferences per year. i have taken that action without request or direciion from any staff or Board member. Over the last few years, I have also attended the National NACWA lawyers' conference; and with the exception of the first year I have never requested any reimhursement. Those conferences are specificaily directed toward public agency iawyers dealing with Clean Water Act issues and require about 3 days out of the office. Several years ago the attomeys group performed an informal survey as to what sort of compensation was provided to agency district counsel for attendance at CASA. At that time most district counsel present indicated that they were provided reimbursement of expenses. A few district counsel also received some adtlitional payment for their attendance of the Attomeys Committee meeting. I have not undertaken any recent follow up on this issue and expect there remains some difference in practice between CASA agencies. SUMMARY Recognizing that the Board policy has not been revisited for many years, I acknowledge that it may be ripe for Board consideration. Clearly, the Dislrict and I have benefited over the years from my active involvement in CASA. Nonetheless, the Board may reasonably conciude that the District should discontinue these reimbursements; I will continue to attend these meetings, wifh or without, reimbursement from the District.
