The questions and . answers are provided below: 1. Page 6, 161191 SWEA Club- What does this stand for? This was a typo. This should have been CWEA which stands for California Water Environmental Association. CWEA meets monthly to discuss issues of importance to the clean water and waste water community. 2. Page 6, 161192- Provide information on the four travel reimbursements which were paid out of petty cash. Don Rhoads $55.91 - California Collaborative Benchmarking Group Meeting at Orange County Sanitation District. Paul Louis $53.86 - Inspected new rodder at a factory in Hammond, Indiana prior to delivery. Enick Wright $40.26 - 15~ Annual Technical Training Seminar for Fleets in Alameda County Corp Yard, Dublin. Don Rhoads and Rich Boylan $50 - Public Fleet Supervisors Association Meeting in Dublin, Ca. 3. Page 7, 161205 Department of Consumer Affairs- What was this payment for? This payment of $125 was to renew Tom Godsey's Civil Engineering license which is required every two years. c~ = ~ ~ 4. Page 10, 161233 Recall - Total Information Management- What is this monthly payment for? This monthly payment is for off site tape back-up storage services in Sacramento for all computer data of the District. This would include the HTE financial system, the Plant Operating system, CSO data, the network, etc. 5. Page 12, 161255 Bently Nevada Corporation- What is a proximitor? This is an instrument that is used to measure the vibration of the turbines. 6. Page 14, 161276 David Deutscher Company- What does REPR stand for on the invoice? This is an abbreviation for "repair". The invoice was for repair work at the old animal shelter. 7. Page 33, 28766 Schell and Martin, Inc. What was this $700 payment for? The developer of the Las Lomitas Subdivision - Unit No. 1 constructed a private sanitary sewer and sewage disposal system in 1949, to which a side sewer from the house on each lot was connected. The sewers generally run through the lots behind the homes and parallel to the streets. The Las Lomitas sewers were subsequently connected to the DistricYs collection system in 1955, the disposal system was abandoned, and the District assumed responsibility for maintaining and operating the sewer main system within the various lots under unrecorded, implied or prescriptive rights. In 1977, the Board of Directors adopted Resolution No. 77-15 making an easement declaration in regard to rights to maintain and operate the sewer main system. Recording of this document, however, referenced only the subdivision in general rather than individual parcels, and apparently property owners were not notified. Tom and Cydney Richardson purchased the property at 1171 Camino Tassajara (Las Lomitas Lot 5) in 2005. Unfortunately, the seller did not disclose the presence of the public sewer on the property, and may not have been aware of its existence. Further, the title search for the Richardson 's purchase did not identify the DistricYs easement declaration. Subsequently, when the Richardson's came to the Permit Counter to inquire about fees for a planned addition and the location of their sewer connection, staff determined that at some time in the past, a previous owner constructed an addition to the house over a portion of the public sewer as shown on the attached map. ~t • * ~ District staff and legal counsel negotiated a fair resolution to the situation with the Richardsons to establish permanent easement rights for CCCSD. The Richardsons agreed to grant an easement to the District, if the district would provide the required legal description and plat (map exhibit). The civil engineering and surveying firm, Schell & Martin of Lafayette was engaged to perform prepare the description and plat. The Grant of Easement offered by the Richardsons and accepted by the Board provides a ten-foot wide sanitary sewer easement, centered on the existing sewer, permits the house to remain, and to be replaced in kind in the future if destroyed by fire, flood or seismic event.
