BOARD ACTION:, Said Pledge of Allegiance. b. Introductions. • Introduce newly-hired Plant Operator I, Nick Hansen. • Recognize Alan Weer on his promotion to Associate Engineer. BOARD ACTION: Welcomed newly-hired employee and recognized promoted employee. 2. PUBLIC COMMENTS None. 3. CONSENT CALENDAR a. Approve expenditures dated July 16, 2009. Reviewed by Budget and Finance Committee. b. Approve minutes of June 18, 2009 Board meeting. c. Approve registration differential salary merit increase for Mark Wenslawski, Staff Engineer, effective April 18, 2009. Approval recommended by Human Resources Committee. Recycled Paper July 16, 2009 Board Agenda Page 2 d. Accept the contract work for the Auxiliary Boiler Improvements, District Project 7231, completed by R.F. MacDonald, Inc., and authorize filing of the Notice of Completion. e. Adopt Resolution 2009-043 accepting grants of easements from property owners of the Oakland Boulevard, Shuey Avenue, and Buena Vista Avenue neighborhoods in Walnut Creek, District Project 5972 -Parcels 2, 3, 4, 6, and 7, and authorize staff to record documents with the Contra Costa County Recorder. f. Adopt Resolution 2009-044 accepting an offer of dedication from David C. Ziegler and Susan D. Ziegler of the Ziegler Family Trust for an easement in the unincorporated area of Walnut Creek shown on the minor subdivision map of MS 99-0006, Job 5784, Parcel 2, and authorize staff to record documents with the Contra Costa County Recorder. g. Adopt Resolution 2009-045 resolution accepting an offer of dedication from Armand Butticci, III, for an easement in the unincorporated area of Walnut Creek shown on the minor subdivision map of MS 03-0036, Job 5835, Parcel 3, and authorize staff to record documents with the Contra Costa County Recorder. BOARD ACTION: Adopted the Consent Calendar as recommended. 4. CALL FOR REQUESTS TO CONSIDER ITEMS OUT OF ORDER None. 5. REPORTS a. General Manager 1) Allowable Costs for Reimbursement Fees. BOARD ACTION: Received the report. Staff will implement new procedure which will include setup fees and transaction fees in reimbursement charges for Reimbursement Accounts. 2) Follow-up report on Vacaville NPDES Litigation. BOARD ACTION: Received the report and concurred with staff recommendation to send a letter to CASA noting that the District has contributed funds in support of this in the past, and is currently contributing funds for the appeal through BACWA. 3) Announcements a) Pleasant Hill Sewer Renovation Project Workshop July 16, 2009 Board Agenda Page 3 b) City of Walnut Creek Clean Water Program Withdrawal c) Orinda City Council presentation for Miner Road Sewer Renovation Project BOARD ACTION: Received the announcements. b. Counsel for the District District Counsel Kent Alm stated that the City of Walnut Creek will no longer be part of the Clean Water Program and has requested that the District provide some transitional help to them, which may require an agreement with regard to associated costs. c. Secretary of the District No reports. d. Board Members 1) Board Member reports on future meetings or conferences for which they will receive the stipend or for which the District will pay their expenses; recent meetings for which they received the stipend; and meetings or conferences for which the District paid their expenses. Member Hockett • July 2, 2009 -Contra Costa County Mayors' Conference -Member Hockett (expenses). • July 7, 2009 -Recycled Water Committee meeting -Member Hockett (stipend) and Member McGill (stipend). BOARD ACTION: Received the reports. Member Lucey • July 13, 2009 -Budget and Finance Committee meeting -Member Lucey (stipend) and President Nejedly (stipend). BOARD ACTION: Received the report. BOARD ACTION: Received the report.. Member McGill • July 2, 2009 -Contra Costa County Mayors' Conference -Member McGill (expenses). BOARD ACTION: Received the report. 2) Announcements Member Menesini announced that Members Hockett and McGill, General Manager James Kelly and he recently attended Mountain View Sanitary District General Manager Dave Contreras' retirement dinner. BOARD ACTION: Received the announcement. 6. ADMINISTRATIVE a. Consideration of setting a public hearing to review Board Member compensation. If yes, establish August 6, 2009 at 2:00 p.m. as the date and time for a public hearing. BOARD ACTION: Set August 6, 2009 at 2:00 p.m. as the date and time for a public hearing. 7. ENGINEERING a. Approve and authorize the General Manager to amend the agreement with the City of Walriut Creek to continue the Pharmaceutical Collection Program. Approval recommended by Household Hazardous Waste Committee. BOARD ACTION: Approved and authorized the General Manager to amend the agreement with the City of Walnut Creek to continue the Pharmaceutical Collection Program (4-1; Lucey, No). July 16, 2009 Board Agenda Page 5 8. EMERGENCY SITUATIONS REQUIRING BOARD ACTION a. Receive report on emergency declared on May 21, 2009 and authorize the General Manager under Public Contract Code 22050(b) to continue with emergency repairs on the recycled water pipeline at Grayson Creek in Martinez, if work has not been completed. BOARD ACTION: Received report and continued authorization for emergency repairs. 9. SUGGESTIONS FOR FUTURE AGENDA ITEMS Member McGill requested information regarding pyrethroid pesticides in the effluent from the District's treatment plant. Member McGill has seen some information indicating that one factor in the collapse of the Delta may be pesticide contamination, and in particular pyrethroids. He had also heard that wastewater treatment plants could be a significant source of pyrethroids in the Delta and was interested to see if the District's treatment plan is a potential source. 10.
