MINUTES OF THE EMERGENCY MEETING
OF THE DISTRICT BOARD OF THE
CENTRAL CONTRA COSTA SANITARY DISTRICT
HELD ON JUNE 11, 1996
The District Board of the Central Contra Costa Sanitary District convened an emergency
meeting at 1250 Springbrook Road, Walnut Creek, County of Contra Costa, State of
California, at 11 :00 a.m. on June 11, 1996.
President Menesini called the meeting to order and requested that the Secretary call roll.

Member Hockett had advised staff that she would be unable to attend this meeting and
had requested to be excused. It was noted for the record that a signed waiver from
Member Hockett is on file, stating that she received written notification of this emergency
meeting, that she waived all further notice of said meeting, and that she consents to the
meeting taking place at 11 :00 a.m. on June 11, 1996 at 1250 Springbrook Road, Walnut
Creek, with or without her presence at said meeting.

3. EMERGENCY SITUATIONS REQUIRING BOARD ACTION
OBTAIN EMERGENCY AUTHORIZATION TO CONSTRUCT A BY-PASS SEWER
AROUND THE CAL TRANS CONSTRUCTION SITE AT THE NEWELL AVENUE
OVERPASS OF 1-680
Mr. Roger J. Dolan, General Manager-Chief Engineer, stated that the reason for the
meeting today is that under state law, staff is unable to expend more than $10,000 for
force account work without Board authorization. There is an issue that will require the
expenditure of more than $10,000 that staff is most anxious to inform the Board about
and to obtain Board authorization to move forward.
Mr. Dolan introduced Mr. John A. Larson, Collection System Operations Department
Manager, who reported that the District has a 27-inch trunk sewer serving the west side
of 1-680 near the Newell Avenue overpass of 1-680. This sewer was relocated at the
request of CalTrans to accommodate the 1-680 construction work. Last Friday, June 7,
1996, CalTrans advised the District that there was a problem with this sewer. When
District staff investigated, they found that the CalTrans contractor had driven a pile
through the relocated sewer line. Mr. Larson showed photographs of the situation. Mr.
Larson stated that it is very fortunate that there is very little flow in the line at this time,
that the break did not occur during wet weather, and that CalTrans stopped where they
did and did not drive further piles. Friday and Saturday, June 7 and 8, 1996, District
crews worked to determine the extent of the damage.
Mr. Tad Pilecki, Senior Engineer, stated that in 1990 the District line was shifted about
ten feet to the north as requested by CalTrans to take it outside the CalTrans construction
area. Mr. Pilecki described the relocation alignment of the District's line done in 1990 and
approved by CalTrans. Mr. Pilecki reported that CalTrans has now changed their
alignment, straightening it out in this area and moving their piles to the northwest directly
into the District's pipeline. It is proposed that the District's pipe be moved 15 feet to the
north under pavement rather than under an embankment. Mr. Pilecki described the
proposed new alignment to take the pipeline out of the current CalTrans construction area.
The estimated cost is $100,000. D' Arcy & Hardy and Ranger Pipeline will be doing the
work as a joint venture. By June 21, 1996, most of the flow should be diverted into the

new line. There is some uncertainty regarding tying active lines into the new pipeline.
The flow will be sandbagged and diverted during low flow while the tie-ins are done.
Mr. Kenton L. Aim, Counsel for the District, advised that the Board, by 4/5 vote, must
determine that an emergency exists. The basis for determining that an emergency exists,
as reported by staff, is that a major sewer line has been damaged and the threat of
sewage backups and leakage create health and public safety hazards. In addition, there
is a major work stoppage on the CalTrans 1-680 construction until the problem is
corrected.
It was moved by Member Boneysteele and seconded by Member Dalton, that in
accordance with Government Code Section 54954.2(b)(1), the Board of Directors of the
Central Contra Costa Sanitary District determines that an emergency situation exists as
defined in Section 54956.4 of the Government Code; and finds that emergency
construction of a by-pass sewer around the CalTrans construction site at the Newell
Avenue overpass of 1-680 is required to protect public health and the environment, and
to avoid a public calamity arising from the significant potential for overflows and raw
sewage backups if this break is not immediately repaired. Motion approved on the
following roll call vote:

ABSENT: Members: Hockett
It was moved by Member Boneysteele and seconded by Member Dalton, that to avoid
public calamity arising from damage to the environment and to protect the public health
and safety, exception to the public bidding standard is authorized to complete said
construction; the General Manager-Chief Engineer is authorized to take all appropriate
actions necessary to correct the situation including expenditure of funds; and that
Resolution No. 96-099 be adopted to that effect. Motion approved on the following roll
call vote: .

Discussion followed concerning CalTrans responsibility and .Iiability in this situation. Mr.
Aim, Counsel for the District, stated that a claim will be filed with CalTrans for recovery
of the costs of the repair.
President Menesini was joined by the full Board in commending Messrs. Bill Echols, Tom
Godsey, Bob Mowers, Tad Pilecki, Allen Robinson, Henry Thom, and all those who
assisted in this emergency situation.

5. ADJOURNMENT
There being no further business to come before the Board, President Menesini adjourned
the meeting at the hour of 11 :33 a.m. to visit the site.
