Staff is researching the issue of terminal compensation and will bring
information back to the Committee at the nexf meeting.
COMMITTEE ACTION: The Committee recommends the purchase of
two Segways based on the cost analysis provided. The Committee
accepted staff's response to the other questions.

There were no new claims.
COMMITTEE ACTION: The Committee asked staff to provide a report
summarizing all costs fo date associated with the Kramer lawsuit.-

SUBJECT: MEDICARE WITHOLDING FOR BOARD MEMBERS
This matter was presented to the Budget and Finance Committee at the June 29, 2009 meeting.
Staff presented and discussed the memo outlining the options for the Committee and Board. The
Board has received a copy of the memo. Staff presented an option, Option 1, indicating that the
District could pay the previous three years of unpaid Medicare taxes for the Board members.
Unfortunately ,this is wrong. Staff misinterpreted District Counsel's opinion. District Counsel
states in his memo that payment by the District would violate compensation law. (See the last
two paragraph's of Mr. Alm's memo, also provided to the Board.) Staff is embarrassed by the
error and expresses our apology for it.
To comply with IRS reporting requirements, repayment by the Board members must be
addressed by July 30, 2009. A Position Paper will be submitted to the Board for final action at
the July 16, 2009 meeting.
