Manager, Plant Operations SUBJECT: Approval of agreement with Richard Pine Engineering and expenditure of sewer construction funds to provide for environmental upgrading of microprocessor system. Background: The treatment plant computer system has twenty field microprocessors which act as intermediaries between the computer and field sensors/equipment. Due to design/construction errors these microprocessors are being exposed to extremes of heat, dust, and corrosive gases and, consequently, have become increasingly unrel iable. This Position Paper will authorize a project to upgrade the environmental conditions of the microprocessors by seal ing the equipment cabinets and install ing air conditioners. Professional engineering services will be required for preparation of specifications for the microprocessor corrections, bid assistance, and construction coordination. District staff has negotiated an agreement with Richard Pine Engineering for these design and construction coordination services. The estimated cost of these services is $18,000. It is estimated that the cost of construction (sheet metal work, materials, electrical work, etc.) will be $6,,000. In order to expedite this project, the five microprocessors which are most sensitive to heat damage have been separated out so that they can be upgraded before the warmest summer months. The Plant Operations Department has purchas~d five air conditioners for these microprocessors with General Manager-Chief Engineer approval. The Plant Operations Department budget will be reimbursed for this purchase via this authorization. District staff will attempt to obtain grant funding as part of the fix and finish work under the Stage 5A project with State Water Resources Control Board staff. Recommendation: Authorize the District Manager-Chief Engineer to execute the agreement with Richard Pine Engineering for design and construction inspectIon related to correction of MUX deficiencies. Authorize the expenditure of $80,000 of sewer construction funds for installatIon of such work. The amendments will require State and Regional Water Quality Control Boards to follow more complete and equitable hearing procedures. EN 7 I ISSUE: The proponent of a proposed annexation has requested that a letter be prepared indicating that the Board of Directors will annex properties in the future. BACKGROUND: Mr. Brian Williams has an eleven lot subdivision in San Ramon presently outside of the District boundary. There is a sale pending on the subdivision subject to the property being annexed to CCCSD and subsequent recordation of the subdivision final map. If action on annexing the property is not taken until after the tax sharing problem with the County is. resolved, Mr. Williams believes he will lose the sale. Mr. Williams has indicated the County may approve the recording of the final map if they receive a "consent" letter from the District stating that the property will be annexed after the tax sharing problem is resolved. Such a letter is attached for Board consideration. It is proposed that this letter be made available to all proponents of cmnexations. The contract work included some minor improve- ments to CCCWD properties which, by separate agreement, were paid for by the Water District. The Contractor completed all Contract construction work on March 5,1981. RECOMMENDATIONS: The following Board actions are recommended: 1. Acceptance of the Contract Work for Project No. 3338 2. Authorization for filing a Notice of Completion with the Contra Costa County Recorder. 3. Authorization to make final payment to the Contractor 35 days after the Notice filing date if no claims are received. Special Projects Engineering Division BACKGROUND: Metcalf & Eddy (M&E) is under contract to provide professional engineering services for evaluation of alternative reclamation strategies (Task C) at the District Water Reclamation Plant. Under the first phase of the evaluation (Task I-C), M&E compared several different treatment process alternatives to the present lime treatment process. M&E concluded that the present process is no longer cost-effective and should be modified. The second phase of the evaluation is to prepare an amendment to the Stage 5B Facilities Plan. As part of this phase, M&E will perform a detailed evaluation of several treatment process alternatives, and determine the most cost-effective Stage 5B project. The alternative evaluation and a description of the cost-effective project will be included in the Stage 5B Facilities Plan amendment which consists of a project report, revenue program and EIR. The District staff has negotiated a contract amendment with M&E for preparation of the Stage 5B Facilities Plan amendment. The estimated cost of this contract amendment is $184,145. This cost is eligible for reimbursement under the Clean Water Grant Program. The draft Facilities Plan amendment will be completed within 6 months. Since the cost of this contract amendment is more than $100,000, the State Water Resources Control Board (SWRCB) must approve the amendment before it can be executed by the District. SWRCB is reviewing the contract amendment now. RECOMMENDATION: Authorize the General Manager-Chief Engineer to execute Amendment No. 3 to the Task C Agreement for preparation of a Stage 5B Facilities Plan amendment after approval from the State Water Resources Control Board. Authorize the expenditure of sewer construction funds for this work. C. Robert A. Baker Manager, Plant Operations Issue: Payment for the major overhaul of primary influent engine No.4 exceeds the original Board authorization by $3,817. Background: Previously the Board authorized $42,000 for a major overhaul of primary influent engine No.4. This work was formally bid and awarded to the King Knight Co. for a low bid of $39,906. As part of the contract,agreed prices for skilled and unskilled labor were included in order to correct any unforeseen work outside the scope of the original contract. Unforeseen repairs were necessary and were encountered during the course of the work. This work included pol ishing the crank and cam shaft, replacing the oil pump and all appurtenances, and rebuilding the governor gear drive system. This work was necessary in order to have a reliable, functioning piece of equipment. The addition of this work exceeded the original Board authorization by $3,817. Recommendation: Authorization of $3,817 for Account No. 51010.3 to balance and close the account. ENGINEERING/COLLECTION SYSTEM ISSUE: There is an existing sewer across the property which the Lavine's now own but a sewer easement was never required. BACKGROUND: A trunk sewer was installed across the subject property in 1963. The property was then owned by Contra Costa County and no easement was acquired for the sewer installation. The Lavine's bought the property from the County approximately two years ago through a public sale. There was no easement established when the property ownership was transferred. The Lavine's had a house designed for their property and came to the District office in 1980 to check on sewer requirements. The house was designed over the top of the e~isting sewer and Mr. Lavine was told that the house could not be built over the existing sewer. The Lavine's had the house redesigned (at their cost) and it is now under construction. The Lavine's incurred additional survey expenses in establishing the final location of the house off of the existing sewer. The Lavine's initial request for granting the easement included compensation for the redesign of the house and surveying, the connection of the new and future houses to the sewer by the District and waiver of fees. The cost of the ease- ment has been negotiated and District staff and the Lavine~ have agreed to a $1500 figure. The LavineB have been straight forward and cooperative during the negotiation process. Surveying for the easement has not been completed. The Lavine.~s will not be paid the $1500 until the signed easement is received. RECOMMENDATION: Authorize the payment of $1500 to Nancy and Larry Lavine for a sanitary sewer easement over an existing pipeline in Lafayette. RECOMMENDATION: Appoint the firm of Corbett Kane & Berk as Special Counsel to the District to represent the District from time to time as requested in personnel-related matters.and to act as authorized District Board Representatives as required.
