ISSUE: The property owner desires to construct a wooden deck (with
a hinged section over an existing manhole), a brick barbecue with
concrete decking area and a concrete swimming pool deck within and
adjacent to an existing District sewer easement.
BACKGROUND: The owner has cooperated with District staff in modi-
fying his plans to meet with our approval. The owner has signed
an Agreement Relating to Real Property and has assumed responsi-
bil ity for future problems which may result from the installation
of the proposed improvements.
Staff has determined that the improvements do not interfere with
the present use of our sewer. However, if it should become an
interference, the Agreement requires the property owner to remove
the structure within 30 days of notice to do so.
RECOMMENDATION: Approval, execute "Agreementl! and authorize its
recording.

ISSUE: The property owners, Mr. and Mrs. Bowers, have constructed a
brick patio over an existing District easement and also intend to
construct a concrete patio and pool deck over said easement.
BACKGROUND: The property owners have supplied the District with their
plans. District staff has reviewed the plans and the existing on-site
improvements.
Staff has determined that the existing patio and the planned new
construction will not interfere with the present use of our sewer.
However, if they become an interference, the agreement requires the
property owner to remove the structure within 30 days of notice to
do so.
RECOMMENDATION: Approval, execute "Agreement" and authorize its
recording.

ISSUE: BROOK STREET, a City of Lafayette street, is being widened 5 feet
by dedication to the City on the map of Subdivision 5668.
This 5 foot widening crosses an existing 10 feet wide District sewer
easement.
BACKGROUND: District consent is requIred whenever a roadway widening
encroaches upon an existing District easement.
RECOMMENDATION: Approval, execute document and authorize its recording
by the City.

BACKGROUND: On April 23, 1981, the Board authorized staff to advertise
for bids for the subject project. Bids were received May 19, 1981 and
are summarized on the attached tabulation. The low bid was by Power-
Anderson, Inc., at $52,500 (138% of the Engineer's estimate).
The District sent information to 20 possible bidders when authorization
to advertise was received. Since there is a lot of similar work in
the Bay Area, and the amount of work is small, only two contractors bid
on the Project. The Engineer determined the difference between his
estimate and the low bidder is for the reasons given.
The construction of this project is required prior to construction of the
Headquarters Office Building, which is estimated at approximately $4 million.
The delay and impact costs to the Headquarters Office Building Project would
be more than the $14,560 difference between the Engineer's estimate and
the low bid if the contract is not awarded.
A post bid preconstruction cost estimate is attached. Total project cost
at this estimate is $80,375. The amount previously authorized is $15,000.
The additional amount required to complete the project is $65,375.
RECOMMENDATION: Award contract to Power Anderson,Inc., and authorize
an additional $65,375 to complete the project.
