RECOMMENDATION: Award the contract for installation of the
composite sewage samplers, DSP 3346, to McCrary Construction Co.
in the amount of $35,500 and establish a sewer construction fund
account in the amount of $41,600 to cover the cost of construction.

BACKGROUND: The proposed agreement between MWM and the District
has been previously discussed. Changes have been made on pages 2
and 12 as reflected in the attached draft agreement. By separate
letter, clarification has been made that the Architect's scope of
work will include providing parking, landscaping, fencing and
irrigation with the building. Also, the contractor for the
building will be required to supply data necessary to prepare
Ilas-built" drawings. A new compensation for basic architectural
services curve has been received and is attached.
Based on a preliminary total building cost of $3,635,000 ($66 per
square foot basic building cost, site preparation costs, 15%
contractor overhead and profit, 10% contingency and 20% for
inflation), MWM1s maximum fee would be 6.5% or $236,275.
The present scope of work includes (in addition to the costs in
the previous paragraph) renovation of existing plant operations
offices at an estimated cost of $600,000 including allowances for
overhead, profit, contingency and inflation. Based on Curve A in
the proposed agreement (renovation services), MWM's maximum fee
would be 10.7% of $600,000 or $64,200.
The total estimated maximum fee at this time is $300,475 and is
provided for Board information. The final architect's fee will be
based on actual charged hourly rates with a ceiling calculated in
accordance with the proposed agreement. As indicated in paragraph
3.2.2. of the proposed agreement, a fixed limit of Construction
Cost will be establ ished prior to taking bids. The fixed limit
may be increased as provided in paragraph 3.2.4.
MWM has indicated that the cost ceiling could be further lowered
by changing the basis for the agreement from hourly rates with a
fixed maximum to a straight percentage of construction cost.
Previous experience has indicated that the straight percentage
concept requires more time being spent by District staff to control
the work done by the Architect. The straight percentage concept
is feasible, may result in a lower fee, will result in more time
expended by staff and would not be expected to achieve a reduction
in overall project costs. see page 2

RECOMMENDATION: Staff recommends that the Board approve the agreement
with MWM as presented and authorize its execution by the President
of the Board.
If it is the Board's feeling that it would prefer to authorize a
lower fee as a percentage of construction cost, it is recommended
that staff be authorized to negotiate a new fee curve as a fixed
percentage rather than hourly charges with a maximum.

BACKGROUND: Based on the approval of the agreement with MWM and instructions
given to MWM to proceed with the Schematic Design Phase of the agreement,
it is necessary to authorize funds for the ensuing work. It is anticipated
the cost of producing schematic designs and completing the Design Development
Phase as identified in the agreement, will be approximately $100,000 and that
amount is herein requested.
RECOMMENDATION: Authorize $100,000 for MWM services and related costs in
conjunction with the new office building, District Sewering Project 3000.

BACKGROUND: The treatment plant conveys the sludge solids to trucks
for offhaul and disposal through the use of a single cake pump
while the furnaces are not in operation. This mode of operation has
continued for three years and has created many operational and main-
tenance problems.
The proposed backup cake pump would provide reliability and, during
times of peak solids production, it would provide adequate capacity.
The proposed installation is temporary and would. be replaced to per-
manent facilities to be constructed in two years. The permanent
facilities would be funded under the Clean Water Grant Program.
This project is included in the Stage 5B Expansion concept as a
permanent installation. As such, it was considered in the final
Environmental Impact Report for the Stage 5B Expansion.
The preliminary Engineets Estimate for this project is $45,000. This
estimate is currently being finalized.
RECOMMENDATION: Approve the plans and specifications and authorize
the solicitation of bids for the installation of a backup cake pump.

BACKGROUND: The existing Dechlorination facilities at the treatment
plant have been an ongoing source of operational problems. The
Board of Directors authorized the design of improvements to the
existing dechlorination facilities on June 7, 1979. That design
has been completed and is ready to bid.
This project is included in the Stage 5B expansion concept and, as
such, it was considered in the final Environmental Impact Report for
the Stage 5B project.
The preliminary Engineer's Estimate for this project is $180,300.
This project is funded under the Clean Water Grant Program and it is
eligible for up to 87~% reimbursement of construction costs. Approval
of the plans and specifications has been received from the California
State Water Resources Control Board.
RECOMMENDATION: Approve the plans and specifications and authorize
the solicitation of bids for the Dechlorination Facility Improvements
Project, DSP 3272.

ISSUE: Additional office space is required for the Construction Division
personnel.
BACKGROUND: There is a severe shortage of office space at the Treatment Plant.
This problem has been previously recognized by the Board, and to remedy
the problem, the Board previously authorized MWM to design and prepare
the specifications for this facility.
The plans, specifications and Contract for the Construction Services
Building are now complete and the Board of Directors' approval is hereby
requested in order that bids might be sol icited for this Project. The
Project will be awarded on the basis of competitive bidding and will be
a firm price lump sum quote.
RECOMMENDATION: Approve the Plans and Specifications for the Construction
Services Building and also approve bid solicitation for the construction
of the building.

ISSUE: The owners of Lot 50 of Subdivision 4366, Ronald G. Dennis,
et ux, have requested that the District quitclaim the existing sewer
easement within their property.
BACKGROUND: The subject easement was created to serve property to
the northwest of said Lot 50. This upstream property is presently
served in a different direction; therefore, the subject easement is
no longer required.
A sewer main and rodding inlet were installed within a portion of this
easement to serve said Lot 50. The Dennis' have paid our processing fee and
are granting a replacement easement to cover existing facilities.
Quitclaiming the existing easement will permit the property owners to
construct a swimming pool and deck in this area without having to execute
a "Real Property Agreement".
RECOMMENDATION: Approval, execute Quitclaim Deed and authorize its
recording.

ISSUE: The Local Agency Formation Commission (LAFCO) is required by
Government Code Section 54774, et seq., to establish spheres of
influence (SOl) for each local governmental agency within the County.
LAFCO has requested this District to provide it with any changes we would
like to have made in our present SOl.
BACKGROUND: Our present SOl was established several years ago. It was
intended to include all territories that could be served by this District.
Since the adoption of our present SOl, the District has annexed a few
parcels outside of our SOl. Each of these annexations were completed
after the property owner requested and received permission from LAFCO for
a change in the SOl.
District staff is satisfied with our present SOl and the ability to change
the SOl when required, with LAFCO approval.
RECOMMENDATION: Make no changes in the present SOl. Inform LAFCO the
District is satisfied with the present SOl and the ability to modify the
SOl when required for particular situations.

ISSUE: Contra Costa County Public Works Department requires a Joint
Exercise of Powers Agreement with the District to cover the work of
seal coating the District yard, Walnut Creek; Rahn Court, Walnut Creek;
a portion of Diablo Road, Danville; and a portion of Scenic Drive,
Orinda. As part of the agreement, the District is required to deposit
$12,500 with the county to cover the estimated cost.
BACKGROUND: The District requested that the county include necessary
District work with their annual scheduled seal coating program. The
request has been approved by the county with the condition that the
District enter into a Joint Exercise of Powers Agreement and deposit
$12,500 to cover costs. District Counsel has reviewed the agreement.
RECOMMENDATION: Execute agreement and authorize $12,500 to be deposited
with the Contra Costa County, Public Works Department.

ISSUE: Mr. McEvoy owned a residence at 199 Canon Drive, Orinda destroyed
in a slide on January 13, 1980.
BACKGROUND: The claimant alleges that sewers among other things were
negligently installed above his house causing rain and surface water to
accumulate on his property causing the sl ide that destroyed his property.
The District's sewer installations could not have contributed to this
problem as they are too far removed.
RECOMMENDATION: Deny Mr. McEvoy's claim for $250,000.00 in property
damage.

causing rain and surface waters to accumulate and be discharged
upon claimant's real property; that said rain and surface waters
accumulated and were discharged upon said real property in suc~
amounts, in such fashion and with such force as to cause large
amounts of dirt, mud,. debris and trees to fall upon claimant's
real property on January 13, 1980 thereby causing damage in the
amount of $250,000 to said real property, the residence located
thereon and the personal property located in and abou.t claimant's
residence.
