ISSUE: The long Flygt chain on primary sedimentation tanks Nos. 3 and 4 is worn
and must be replaced.
BACKGROUND: The chain on the main appliance for primary sedimentation tanks Nos.
3 and 4 is worn to the point that it must be replaced. Bids were formally advertised
for this chain with a bid opening date of July 7, 1980. Two bids were received. A
third supplier did not choose to bid on all of the items and is nonresponsive to the
bid request. The low bidder was King Bearing, Inc. with a bid of $43,565.74.
Engineering/Purchasing Division has recommended that King Bearing, Inc. be awarded
the lowest bid.
RECOMMENDATION: Acceptance of low bid in the amount of $43,565.74 for the purchase
of drive chain for sedimentation tanks Nos. 3 and 4 and award of bid to King Bearing,
Inc.

Purchasing J;lere):)y recommends that the purchase order, in the
amount of $43,565 .74be awarded to King Bearing, Inc. for the
subject goods based upon the facts that King Bearing is the lowest
bidder and meets all other requirements of the bid request.
Note:
!. Three (3) bids received by closing date/time, (7/7/80, 2: 30 pm)
2. King Bearing was low bidder by $774.12 (includes
payment discount).
3. Bearing Engineering did not bid all items and is non-
responsive to the bid request.
4. King Bearing has verbally stated that if the award is
made by July 11, 1980, delivery of the goods can be made
by July 31, 1980. Delivery thereafter will be three (3)
to four (4) weeks A.R.O.
Please proceed to obtain the necessary approvals.

BACKGROUND: The sealed bids for the Holding Basin Renovation Project
will be opened on July 28, 1980. The next Board meeting is scheduled for
Augus t 7, 1980.
Authorizing the President of the Board of Directors to award the
construction contract to the lowest bidder would allo~ the project to
proceed two weeks earlier, increasing the probability for completion
prior to the wet weather season.
This authorization would not include the right to waive irregularities
nor to award to anyone other than the lowest bidder.
RECOMMENDATION: Authorize the President of the Board of Directors to
award a contract to the lowest bidder on the Holding Basin Renovation
Project, DSP 3338, provided there are no complications in the bidding
procedure.

ISSUE: Additional funding is necessary to continue claims administration for
this project through June 30,1981.
BACKGROUND: The Construction Division is working on litigation support
activities for Project 5A-II.
We are continuing to supply, investigate, and file interrogatories for this
claim. It is anticipated that within this fiscal year, the lawsuit will go
to trial and the attorney will require additional assistance from the litiga-
tion support staff.
Expenditures have exceeded the previous cumulative authorizations of
$36,000.00. Therefore, a supplemental authorization is required.
RECOMMENDATION: Authorize an additional $20,715.00 for Claims Administration
on 5A-II (C-06-0804) for a total to date of $56,715.00.

ISSUE: Additional funds are necessary to complete the acquisition of the property
purchased from Contra Costa County for Construction Division Office site.
BACKGROUND: The District approved funding for the purchasing of the site and the
appraisal fee. In this original funding, the cost of the title insurance was not
included.
RECOMMENDATION: Authorize an additional $443.30 to cover the cost of the title
insurance, services performed by Western Title Company.

ISSUE: Additional office space is required for the activities of the Construction
Division.
BACKGROUND: There is an acute shortage of office space at the Treatment Plant.
This problem has been previously recognized by the Board of Directors and funds
were appropriated to construct a 6,000 sq. ft. Construction Division Services
Building at the Treatment Plant. However, due to anticipated construction costs
in excess of the budgeted amounts (i.e., the low bid for the building was $408,000
as opposed to the approved budget amount of $250,000), other alternatives have
been investigated and evaluated. For a number of reasons, the leasing of office
space has been determined to be the most attractive alternative for promptly filling
the office space requirements of the Construction Division. Accordingly, a search
for suitable office facilities was made. With the exception of one building (owned
by the Hoffman Company) no suitable facility is available in the Treatment Plant
area.
Negotiations with Hoffman Construction for 6,000 sq. ft. of office space
located in Concord have been conducted for office space which meets the requirements
of the Construction Division. Highlights of this lease agreement (copy attached) are:
(1) The Hoffman office is suitable for the Construction DivisionIs require-
ments and contains approximately 6,200 sq. ft. of office space.
(2) An initial 12-month lease is required with the building being rented
on a month-to-month basis after 12 months.
(3) Lease costs are $3,975/month (64~ per sq. ft. per month) Noteworthy
is that other, similar office space was priced at 75~ to $1.10 per sq. ft.
per month.
(4) District will pay for power, water, and janitorial costs.
(5) Hoffman Company will provide maintenance of the H.V.A.C. system and outside
maintenance costs.
RECOMMENDATION: Authorize the leasing of the Hoffman Company building for one
yearat $3,975/mo.; thereafter continued leasing to be on a month-to-month basis.
The total lease amount for the first year equals $47,700.

BACKGROUND: By law, the District is required to have a hearing for
the purpose of placing delinquent charges on tax bills. Notices
of this hearing were published in the newspaper. The report
containing the names of the owners who have not paid delinquent charges
is attached. Considering valid protests, the charges should be placed
on the tax roll for collection.
RECOMMENDATION: Adopt resolution overruling protests and adopting the
report pursuant to Section 5473, Health and Safety Code.

the County tax roll for collection. If a change in the EQC rate is desired, the
Board should rescind Resolution No. 80-90 and adopt a new resolution based on the
changed rate; if no change is determined, no action is required.

Background: In JanuaLY of 1980 concern was raised by the District staff over the
safety of using liquid chlorine at Central Contra Costa Sanitary District's Water
Pollution Control/Reclamation Plant. As a result of this concem, a :Eequest for
Proposal for an Alternative Disinfection Study was sent to selected consulting
finns in March, 1980. Of the responding canpanies, Kennedy/Jenks Engineers was
selected in May as the rrost qualified.
Prior to this, other agencies (notably East B3.y H.D.D. and the city of San Jose)
had expressed similar concerns and had initiated their 0NIl studies Q/ outside
consultants to evaluate the effectiveness of alternatives to chlorine. The study
for EBl4UD (also conducted by Kennedy/Jenks Engineers) recently recannended continued
use of liquid chlorine but with an upgraded facility to irrprove operation and safety.
In light of this decision, it became apparent to District staff that a reduction in
scope for the District's study was appropriate, and a revised scope was issued to
Kennedy/Jenks Engineers. The consultant has responded with a new proposal and agree-
ment for services to be negotiated with the General Manager-chi.ef Engineer. The
maximum fee for the revised scope of \vork has been established at $40,000.
Fecarmendation: Authorize the General Nanager-chief Engineer to negotiate and execute
an agreement for Professional Services with Kennedy/Jenks Engineers for the
Alternative Disinfection Study.

BACKGROUND: The Board authorized advertising for bids for DSP 3360 on May 15,
1980. Bids have been received and are tabulated on the attached sheet. The
low bid of $23,033.00 was submitted by Tony Goncalves. The Engineers Estimate
was $45,100.
Mr. Goncalves has submitted a request (copy attached) to be relieved of the
bid based on the fact he did not receive Addendum No. 1 which was a part of
the Bidder's Package. The second low bidder, J. Balanco, has also submitted
a letter (copy attached) protesting Mr. Goncalves' bid as being non-responsive.
The need for the new Construction Services Building is being evaluated. A
decision will be made on the building in later 1980. Based on the time constraints
in the bid documents and the above irregularity, it is appropriate to reject all
bids for this project.
RECOMMENDATION: Reject all bids for the Construction Services Building Sewer,
District Sewering Project 3360.

Subject: District Sewerlng Project #3360
Dear Sir:
Our firm was the second low bidder on the above project. as such we wish
to protest the bid of Antonio Gonsalves, General Engineering Contractor as
non responsive. Section 1.2f and Section 1.2I of the Project Manual requires
that all bids be responsive. Addendum #1 requires that the bidders sign and
acknowledge the attached Addendum.
Our firm has examined the bid of Mr. Gonsalves and found he did not sign or
acknowledge the Addendum. This failure clearly renders the bid of
Mr. Gonsalves non responsive. The District made acknowledgement of the
subsurface conditions a material condition of its bid. By his failure
to Sign the Addendum Mr. Gonsalves has not only failed to respond to the
terms of the bid but he has also railed to agree to be bound to the sub-
surface conditions. Such a failure obviously exposes the District to a
claim for changed conditions that could very well exceed the difference
between the apparent low bidder and the next low bidder.
Under these conditions the District not only has the duty to reject the
bid of Mr. Gonsalves as non responsive but also to protect itself against
the possibility of a changed condition claim by virtue of the subsurface
soil condition identified in Addendum #1.
It is our position that our firm submitted the lowest responsive bid and
therefore are the lowest responsible responsive bidder and should be
awarded the contract.
