McCoy S stem SUBMITTED BY ISSUE: The City of Martinez is constructing baseball fields on their waterfront pro- perty in Martinez. The City has requested permission to encroach upon the District's existing 30-feet in width sewer easement. BACKGROUND: Because of space limitations, there are two backstops and two dugouts which must encroach upon the District's easement to provide space for tournament size baseball fields. This is our standard "Agreement". Staff has determined that the im- provements do not interfere with the present use of our easement. However if they become an interference, the agreement requires the property owner to remove the improve- ments within 30 days of written notice to do so. RECOMMENDATION: Approval, pass Resolution, execute "Agreement" and authorize its recording. BACKGROUND: The subject easement was created in 1969 to provide for sewer service to Lots 7, 8 and 15 of Subdivision 2925. After the easement was created, Lots 7 & 8 were served in another location. Staff has determined that Lot 15 can now be served by a private side sewer crossing Lot 14. A private sewer easement has been created which will provide rights for the owner of Lot 15 to cross Lot 14 with a 4-inch side sewer. RECOMMENDATION: Approval, execute Quitclaim Deed and authorize its recording. BACKGROUND: The subject easements were created to provide public service into said Lot 8. The developer has to construct a wooden deck over the easement within Lot 9. District staff has determined that the existing sewer main should be abandoned and that a private 4-inch sewer lateral be installed as a replacement. This private sewer will eliminate the need for an "Agreement Relating to Real Property", and still provide adequate service to Lot 8. The pump station to be built on this site is required to serve the Concord Industrial Park deve lopment. BACKGROUND: The new pump station will be constructed by the developer of the industrial park. The District has an ultimate plan to up-grade the new pump station and retire two existing pump stations in this area. When the final upgrading has been completed, it should reduce maintenance and operating costs (one station as opposed to two stations), and will provide sufficient capacity to handle the projected flow from this watershed. RECOMMENDATION: Approval, accept Grant Deed and forward same to Founders Title Company with instructions for them to record the deed after they issue a title insurance policy in the amount of $20,000 and show clear title vested in the District. DOLAN General Manager-Chief Engineer DATE August 4, 1980 SUBJECT AMENDMENTS TO THE METCALF & EDDY CONTRACTS DATED MARCH 18, 1980 TYPE OF ACTION CONTRACT AMENDMENT SUBMITTED BY SPECIAL PROJECTS ENGINEERING DIVISION BACKGROUND: Three contracts, all dated March 18, 1980, were negotiated with Metcalf & Eddy to cover the initial work in defining the projects at CCCSD. The intent was that the scope of work would be amended as necessary to allow the work to proceed. Amendments are appropriate for all three contracts at this time: TASK A - STAGE 5A IIFIX AND FINISHI1 The SWRCB has given prior approval for $81,700 to include the work on Exhibit I. TASK B - STAGE 5BI HYDRAULIC CAPACITY EXPANSION There are adequate funds in the existing Step 2 Grant to cover the increased scope of work. The SWRCB has approved doing the work under this grant. The scope of the work is shown on Exhibit I. TASK C AND D - FACILITIES PLANNING The SWRCB has indicated that an amendment of this size will receive approval. The scope of the change is shown on Exhibit I. RECOMMENDATION: Authorize the General Manager/Chief Engineer to negotiate amendments to the three Metcalf & Eddy contracts covering the scope of work outlined in Exhibit I at a total cost not to exceed $207,030. Engineering/Collection System BACKGROUND: The proposed project consists of the construction of a 30,000 ft2, two-story above parking, steel frame office building with associated util ities and adjacent parking areas. The building will be designed for possible construc- tion of one additional story for future expansion. The project also includes the modification of roadways north and south of the existing plant administration building, a revision in the access to existing plant offices and improvements to plant security. The new building would connect to the south wall of the existing plant administration building, thereby requiring the modification of some of the existing office space areas. The use of three existing trailers (located immedi- ately east of the new building site) as temporary offices for District staff will be discontinued upon completion of the new building. One additional item of work involves the possible construction of a new District Board Room to be tentatively connected to the existing plant adminis- tration building in an area along the west wall. If approved, the existing, small, two story wood frame District office building in Walnut Creek would be used either by District Maintenance personnel exclusively, or they would participate in a possible sharing of the available office space with another District department or outs i de.tenant. The proposed District office building construction project has been determined to be in conformance with the County1s General Plan as well as current zoning for the site. In response to the District's inquiry, Sonoma State University has determined that the project site is not considered to be archaeologically sensitive and therefore no special mitigation measures are warranted. The Central Contra Costa Sanitary District is the lead agency in the mandated environmental review process since it is the publ ic agency proposing the project. Consequently, District staff have prepared an initial study, solicited comments and arranged for legal notices. Based on all available information, District staff concluded that the project will not have a significant effect on the environ- ment and that a Negative Declaration would be the appropriate document for the project. The lowest bidder is Ferrante Construction at $462,134.55 as per attached tabulation of bids. On July 17, 1980, the Board likewise authorized its President to award the contract to the lowest bidder and such award was made to Ferrante Construction on July 30, 1980. District staff estimates the total cost of the project at $600,000 as per attached post bid-preconstruct ion estimate. An amount of $60,000 has been previously authorized to-date, requiring $540,000 additional funds to complete the project. RECOMMENDATION: Acknowledge award of the contract to Ferrante Construction made by the President of the Board of Directors and authorize the amount of $540,000 to cover the balance required for the contract, construction contingencies and incidentals. McCoy Engineering/Collection System BACKGROUND: On July 3, 1980, the Board authorized staff to advertise for bids for the subject project for which 2 bids were received on August 6, 1980. A low bid of $94,603.00 was submitted by Mountain Construction, Inc., per the attached tabulation of bids. The low bid is $23,003.00 over the District staff's original estimate of $71,600. The high cost is attributed to the extended length of the contract (completion date is October 31, 1981) and the additional time required to coordinate with the State and its contractors. The total project cost authorized by the revised State Utilities Agree- ment No. 106. 75.2 dated June 10, 1980 is $92,400. District staff's reu:ised total estimated cost of the project is $121,000.00. An amount of $15,000.00 has been authorized to date. An additional authorization of $106,000.00 is required to complete the project. RECOMMENDATION: Award the contract for construction to Mountain Con- struction, Inc., subject to concurrence by the State and authorize the amount of $106,000.00 for contract, contingencies and incidentals.
