Engineering/Collection System ISSUE: The subject easements are 5 of the total of 14 easements required for DSP 2695. BACKGROUND: The District Board previously authorized staff to proceed with easement acquisition for this District Sewering Project. All easements must be obtained before sewer construction may begin. Construction has been tentatively scheduled to begin in the Spring of 1981. McCoy INITIATING DEPT./DIV. Engineering/Collection System ISSUE: The Bond Counsel for the above-referenced assessment district has forwarded an agreement for approval by the District. BACKGROUND: County Assessment District 1979-4 is located on the north and south sides of Crow Canyon Road, West of Interstate 680. The area is being developed as commercial and light industrial and the instal- lation of public sewers is included in the work. It is necessary to enter into this agreement pursuant to the provisions of Sections 10109-10111, inclusive of the Municipal Improvement Act of 1913. RECOMMENDATION: Approve agreement with Contra Costa County for instal- lation of sewers under Assessment District No. 1979-4 and authorize execution of agreement. Engineering/Collection System ISSUE: A total of $149,219 has previously been authorized for expendi- ture for architect services and District{staff) time associated with the new District Office Building. These funds have now been exhausted. Additional funding is being requested to cover both the allowable architect's fee (based on the current project estimate), as well as applicable staff salary costs associated with architect coordination and District design of the north parking lot. Based on the following anticipated cost breakdown, approximately $220,500 will be required to cover future architect fees and staff costs up to the time building construction commences(probably early April 1981) : $182,000 Future Architect Services + 38,500 Staff survey, design and coordination costs (Salary & OH) $220,500 Total additional funds required RECOMMENDATION: Approve $220,500 additional funding authorization for DSP 3000. II -,d- 0 - vI) DATE November 20, 1980 SUBJECT EAST BAY FORD TRUCK SALES, INC. REQUEST TO CORRECT BID TYPE OF ACTION Vehicle Bids SUBMITTED BY Robert H. Hinkson INITIATING DEPT./DIV. Collection System Operations ISSUE: East Bay Ford Truck Sales, Inc. were awarded the bid, $23,259.40, to furnish the District four small pickups (Couriers). They subsequently notified the District that they had made a pricing error and that their corrected bid should be $24,813.00 making them second low bidder. BACKGROUND: Because of the rather large spread between low and second bidder for these trucks, several phone calls were made to the agency to verify the accuracy of their bid. They stood firm on it until November 10, 1980 when they notified us that they had indeed made a pricing error of $390.55 per unit. The attached letter arrived at the District office November 13, 1980. We asked for more specific data that would explain the error. They submitted a mailgram that indicated a 25% tariff increase would apply to the trucks to be supplied to the District and that they had not figured it in their price. The mailgram is dated Sept. 30, 1980, our bids went out October 28, 1980 and were received on November 5, 1980. Because of the time lapse we have doubts as to this being the basis of the mistake. If we add sales tax to the $23,259.40 bid, the figure is $24,771.26, only $41.74 under their revised quote. We believe his mistake is the sales tax. Unless East Bay Ford Truck Sales, Inc. can produce more substansive evidence of their mistake, I believe they should be held to their price. Engineering/Collection System ISSUE: The property owners desire to maintain in place two concrete block retaining walls constructed over a District easement and public sewer main. BACKGROUND: The subject retaining walls were constructed to prevent soil erosion and protect the building sites. District staff has determined that the retaining walls do not interfere with the present use of our sewer, however, if they become an interference, the agreement requires the property owner to remove the wall or walls within 30 days of notice to do so.
