BACKGROUND: A landslide has damaged about 230 feet of 8 inch'sewer. Periodic
temporary maintenance repairs have kept the line in service while the slide was
active.
.The sl ide now appears to have stabl ized. We plan to engage a soil~ engineer
to test and evaluate theslidearea, then.we will determine the extent,.'of.a
permanent repair or relocation. Additional rights of way may be required.
RECOMMENDATION: Authorize $5000 for investigation and preliminary design for
repair to damaged sewer 1 ine below Knox Drive, Lafayette.

ISSUE: The Town of Moraga is proposing to build a park called Moraga
Commons on District land at the intersection of St. Mary's Road and
Moraga Road.
BACKGROUND: The Town of Moraga proposes to construct park facilities
including a paved parking lot, asphalt walkways, landscaping, irri-
gation and similar improvements over and in a sixty foot wide strip
of land which the District owns in fee. The location of the proposed
work is shown on the attached map. Staff is preparing a permit for
the Town to execute which places the responsibility for damage to
existing District facilities on the Town and requires that the Town
pay for replacing park improvements should it be necessary for the
District to make repairs to its facilities within the park in the
future. A fee of $150 will be collected from the Town for process-
ing the permit.
It has been past practice for the District to cooperate with other
public agencies to the extent that no rent or yearly fee is
collected from those agencies who establish a permanent use on
District property. An example is the Lafayette - Moraga Trail
maintained by East Bay Regional Park District on the 30-foot wide
Sanitary District strip of land along St. Mary's Road. This District
does not charge the Park District for using the land for the trail.
It is intended that the same cooperative approach be taken with the
Town of Moraga in that the Town be allowed to use District property
through the issuance of a permit and that the Town will not be
required to pay rent to the District.
RECOMMENDATION: Reaffirm past practice by concurring that the Town
of Moraga will not be cha~gedrent for the use of District land
associated with Moraga Commons,

ISSUE: Additional funds are needed in the 52000.16 Account.
BACKGROUND: The funding of the 5A Phase I claims studies and litigation support
activities by Sanitary District personnel was authorized through Account No. 52000.16.
On December 6, 1979 this Account No. 52000.16 had received a total authorization of
$340,000. The total expenditures charged against this account through March 1981
amount to $570,393. There have also been additional charges of $41,592 through
June 30, 1981, for a total of $611,985 expended.
An additional $361,985 will be required to bring this account current and provide
$100,000 for ongoing 5A Phase I Sanitary District claims administration.
RECOMMENDATION: Authorization of an additional $361,985 to Account No. 52000.16
for Sanitary District expenses in connection with the 5A Phase I litigation.

BACKGROUND: The Orinda Senior Village Corporation forwarded the attached letter to
the District. In essence the letter contains a request for a reduction in
Environmental Quality (EQ) Charges for the Corporation's proposed development in
Orinda. Under the current EQ Charge structure, all residential units are charged
$124 per year.
A response (attached) has been prepared outlining the rationale behind the current
charge structure and stating the Board's position. It is requested that the Board
comment on the contents of the response letter.
RECOMMENDATION: Review and discuss the resp'onse letter and authorize the sending of

ISSUE: The Regional Board has required that all dischargers in the
San Francisco Bay Region develop pretreatment programs which will
reflect the new Federal pretreatment guidelines.
BACKGROUND: In 1974, this District adopted an Industrial Waste
Ordinance which is still in effect. In September, 1980, the Regional
Board adopted Board Order No. 80-44 which established new pretreatment
regulations for 30 bay area sewering agencies. Each of the affected
agencies is required to develop a Pretreatment Ordinance to reflect
the requirements contained in EPA's General Pretreatment Regulations.
The existing CCCSD Industrial Waste Ordinance has been revised to
incorporate the required changes. Some of the major additions or
modifications are high-lighted below:
1. Industrial users will be required to comply with applicable
Federal Pretreatment Standards as the Standards are pro-
mulgated.
2. A requirement will be included for each industrial user to
develop a compliance schedule where additional equipment or
measures are required to meet applicable Pretreatment
Standards.
3. Specific language will be added towards effectively eliminat-
ing discharge of pollutants to the treatment plant which may
present an imminent or substantial endangerment to the health
or welfare of persons to the environment, or cause inter-
ference with the operation of the treatment plant.
4. A procedure will be included for updating of the pretreatment
Ordinance to comply with evolving Federal Law.
5. The District will randomly sample and analyze effluent from
industrial users and conduct inspection activities.
6. The existing limitations or concentrations of heavy metals,
hydrocarbons and phenols are being relaxed to more appro-
priately reflect the limitations which other bay area
agencies have established.

7. A requirement for the installation of facilities to protect
against accidental discharge of prohibited materials will
be added.
8. The submission of periodic compliance reports by industrial
users to the District will be increased from once a year to
twi ce a year.
9. Penalties for non-compliance have been reduced from $6000
per day to a maximum of $1000 per day.
Copies of the draft pretreatment ordinance have been sent to each of
the industries currently included in the District~s source control
program, the Regional Water Qual ity Control Board, the City of
Concord, the Bay Area League of Industrial Associations and the
Naval Facilities Engineering Command (Concord \.Jeapons Station) for
comments. Any comments received to date have been incorporated
into the attached document. District counsel has also reviewed and
commented on the draft ordinance.
The new Pretreatment Ordinance is ready for Board consideration. It
is necessary to conduct a public hearing to provide interested and
affected persons the opportunity to provide comment on the new
ordinance.
RECOMMENDATION: Establish August 27, 1981, as the date for a public
hearing on the proposed Pretreatment Ordinance.

ISSUE: The Local Agency Formation Commission is requiring this District to
re-initiate our original appl ication for annexation of District Annexation
No. 73.
BACKGROUND: Recent State laws require that whenever properties are proposed
for annexation into a Special District which will provide a service not
previously provided, all affected agencies must negotiate to determine a
tax sharing plan. If they can't agree on a plan the Board of Supervisors
has the authority to determine the exchange of property tax revenue. .
The required negotiating meettng ~as been held and 30 day negotiation
period has' elapsed. The Executive Officer of L.A.F.Co. has now requested
this District to re-initiate our application for annexation of District
Annexat ion
RECOMMENDATION: Pass a Resolution Re-initiating application for annexation
of properties to CCCSD under District Annexation No. 73.

ISSUE: The above areas are part of a large backlog of properties that
have petitioned the District for annexation over the past two years.
Now that there is an agreement with the County to share tax revenues,
these parcels can be processed for formal annexation.
BACKGROUND: The Local Agency Formation Commission (LAFC) has requested
that the District submit no more than 10 separate areas under anyone
proceeding to avoid over-loading their schedule. This is the third
group of 10 parcels to be sent to LAFC for processing. LAFC has indi-
cated that they may add adjoining unannexed parcels to the separate
areas we submit, to eliminate islands or straighten boundary lines.
RECOMMENDATION: Pass a Resolution of Application for the annexation
of properties to CCCSD under District Annexation 76.

ISSUE: Parcel Map 51 P.M. 28 adjoins the southern line of Diablo View
Road. The subdivider is dedicating a IO-feet in width strip of land
to the County for future road widening. The 10-foot strip crosses
an existing District easement.
BACKGROUND: The County requires a Consent to Dedication whenever an
area dedicaded for public road purposes encroaches upon an existing
easement.
This is our standard consent document; the District retains prior
rights.
RECOMMENDATION: Approval, execute document and authorize its
recording by the County.

BACKGROUND: The Orinda Senior Village Corporation forwarded the attached letter to
the District. In essence the letter contains a request for a reduction in
Environmental Quality (EQ) Charges for the Corporation's proposed development in
Orinda. Under the current EQ Charge structure, all residential units are charged
$124 per year.
A response (attached) has been prepared outlining the rationale behind the current
charge structure and stating the Board's position. It is requested that the Board
comment on the contents of the response letter.
RECOMMENDATION: Review and discuss the response letter and authorize the sending af
siJid letter.
