ISSUE: It is necessary to hold public hearings on the matter of placing
charges on the tax roll.
BACKGROUND: In past years, the District has held two separate hearings
on the subject matters to allow the public to speak to the proprosed
actions. One hearing has dealt, with the collection of Environmental
Quality Charges on the tax roll. The other hearing has dealt with the
collection of delinquent sewer service charges on the tax roll. To be
in strict compliance with the law, there will be two separate hearings
this year. The hearings are being held on the same night and this one
position paper covers the two hearings.
EQ CHARGES
Environmental Quality (EQ) Charges have been collected on the
County tax roll since their inception in 1976. Collection on the roll
provides the most economical and effective means for the District to
bill and collect the majority of its 90,000 plus accounts. The alter-
nate of direct billing would be an unwarranted expense.
The law requires that the District hold a public hearing each year
before EQ Charges can be placed on the tax roll. In past years there
have been no protests filed on this subject and it is anticipated that
it will not be controversial this year.
DELINQUENT SERVICE CHARGES
In addition to the use of the tax roll for collection of charges,
the District bills certain property owners directly. During 1981-82
fiscal year, two owners did not pay District charges which were billed
directly to them. Information regarding the delinquent accounts is
contained on the attached report.
Staff proposes to have these delinquent charges collected on the
County tax roll. To do this, it is necessary to hold a public hearing.
Notice of this publ ic hearing has been published in the newspaper. The
two del inquent charges should be placed on the tax roll unless there are
valid protests.

1. Authorize the collection of the 1982-1983 Environmental
Quality Charges on "the County Tax roll.
2. Adopt a resolution overruling protests and adopting the
attached report pursuant to Section 5473, Health and
Safety Code for collection of~1981-1982 service charges
. on the County tax roll.

BACKGROUND: On April 15, 1982 the Board of Directors authorized funds
for engineering design of storm damage repairs to the collection system.
The first of several projects will be ,the repair of the 30-inch trunk
parallel in Walnut Creek. Erosion caused the pipe to be exposed and
displaced.
Plans and specifications for the project (DP 3636): 1982 Storm Damage
Repair to Ex (30"-X1618) Lincoln Ave/Carmel Ct., Walnut Creek were
completed and advertisements inviting submission of sealed bids were
placed on July 2, 1982.
On July 13, 1982 sealed bids were received and opened. District staff
is now reviewing the bids and will recommend award of the contract or
rejection of bids at the July 15, 1982 meeting.
The Engineering Division has estimated the contract cost of the work at
$40,700.00.

ISSUE: The Board of Directors must award a contract or reject proposals
within 30 days of the opening of sealed bids.
BACKGROUND: On April 15, 1982 the Board of Directors authorized funds
for engineering design of storm damage repairs to the collection system.
The first of several projects will be the repair of the 30-inch trunk
parallel in Walnut Creek. Erosion caused the pipe to be exposed and
displaced.
Plans and specifications for the project (DP 3636): 1982 Storm Damage
Repai r to Ex (30"-X1618) Lincoln Ave/Carmel Ct., Walnut Creek were completed
and advertisements invitfng submission of sealed bids were placed on
July 2, 1982.
On July 13, 1982 sealed bids were received and opened. Three bids were
submitted ranging from $38,870.00 to $54,640.00 (see attached tabulation).
The apparent low bidder was: Kenneth Barker, General Engineering
Contractor of Alamo, California. The Engineer's Estimate was $40,790.00.
The California Department of Fish and Game has notified District staff that
work may not proceed until its requirements have been incorporated into the
project (see attached letter). To date staff has been unsuccessful in
obtaining the Fish and Game requirements. Since these requirements may
impact the work, it is inapproprfate to award a contract until further
information is received.
RECOMMENDATION: Defer action on award of a contract for District Project
No. 3636: 1981-1982 Storm Damage Repair of Ex (30"-XI618) - Lincoln Ave/
Carmel Ct., Walnut Creek pending receipt of further information from the
California Department of Fish and Game.

portion of the above Lots 3 and 9. A replacement easement has been granted and a

ISSUE: The above areas are part of a large backlog of prop-
erties that have petitioned the District for annexation over
the past two years. Now that there is an agreement with the
County to share tax revenues. these parcels can be processed
for formal annexation.
BACKGROUND: The Local Agency Formation Commission (LAFC) has
requested that the District submit no more than 10 separate
areas under anyone proceeding to avoid over-loading their
schedule. The subject areas are generally located in
Martinez, Lafayette, Walnut Creek, Danville and San Ramon.
This is the seventh group of 10 parcels to be sent to LAFC
for processing. LAFC has indicated that they may add ad-
joining unannexed parcels to the separate areas we submit,
to eliminate islands or straighten boundary lines.
RECOMMENDATION: Pass a Resolution of Application for the
annexation of properties to CCCSD under District Annexation
80.

ISSUE: Appointment of the auditing firm to perform the annual examination of the
District's financial statements and accounts for the fiscal year ended June 30, 1982
is required at this time.
BACKGROUND: The firm of Laventhol & Horwath, Certified Public Accountants, has
performed the annual examination of the District's financial statements for the
1978-1979, 1979-1980, and 1980-1981 fiscal years. The scope of the auditors~ work
has included the preparation of the Annual Report of Financial Transactions to the
State Controller's Office which is required to be filed by September 30.
The auditors' maximum fee for each fiscal year subsequent to 1978-1979 is contractually
established based on the fee for 1978-1979 of $7,250 increased by an inflation factor.
The maximum fee for the 1981-1982 audit is $11,400.
District staff recommends that the Board of Directors follow the practice of rotating
auditors every three to four years. Because of the demands of the Financial Management
Information System conversion at this time, it is considered preferable to retain
the present auditors for 198'1-1982 to fOl'1estall the additional involvement by the
Accounting staff which would be required with a new auditing firm less famil iar with
the District's operations, accounting systems and financial records. The appointment
of Laventhol and Horwath will also insure completion of the report to the State
Controller's Office by the required due date.
RECOMMENDATION: Appoint Laventhol & Horwath as the District's auditors to perform the
examination of the financial statements for the fiscal year ended June 30, 1982.

BACKGROUND: Geotechnical engineering services are required on the Moraga
Trunk Sewer Storm Damage project and the Outfall Thrust Block project.
See the attached schedule for status of these projects.
MORAGA TRUNK SEWER PROJECT
Creek bed erosion caused a landslide during the severe storm of January
1982 which damaged a portion of the Moraga Trunk Sewer adjacent to Las
Trampas Creek at Wallabi Ct. in Moraga. CSO Department has taken all
necessary measures required to keep the trunk in service. In April 1982
the Board of Directors authorized funds for design of permanent repair of
the system. Included in that authorization were funds for retention of a
geotechnical engineering consultant. The consultant will make a geologic/
geotechnical field reconnaisance of the site, review available aerial
photo stereo pairs and review data files for similar sites in the area in
order to identify the extent of potential ground movement and instability
of the site. The consultant will develop and report recommendations and
criteria for remedial work from this data. A cost ceiling of $7,000 is
appropriate for the consultant's work. (See attached cost breakdown).
OUTFALL THRUST BLOCKS PROJECT
In February 1982 the Board of Directors authorized funds for design of
Outfall Thrust Blocks. Included in that authorization were funds for
retention of a geotechnical consultant. Preliminary Engineering has
been completed, however, soils information is required to proceed with
final design. The consultant will perform six exploratory borings, soil
sampling and laboratory testing. Based on the results of these tests
the consultant will develop and report recommendations for: (1) the type
of thrust blocks to be used, (2) load bearing capacity of soils, (3) esti-
mated settlements, (4) potential construction problems and (5) shoring
design criteria. A cost ceil ing of $11,800 is appropriate for the
consultantls work. (See attached cost breakdown).
RECOMMENDATION: Authorize the General Manager-Chief Engineer to execute
contracts with Woodward-Clyde Consultants for Geotechnical Engineering
Services not to exceed $18,800.

ISSUE: Capital projects which are overexpended as of June 30, 1982 require
supplemental funds to be authorized by the Board of Directors.
BACKGROUND: A review of capital projects as of June 30, 1982 has been performed
to determine those projects for which expenditures exceed the funding authoriza-
tion. A summary of these projects which indicates the authorized amount,
expenditures as of May 31, 1982, excess expenditures anticipated as of June 30,
1982, supplemental funds required, the project status and an explanation for
the overexpenditure of each project is presented in an attachment to this
position paper.
RECOMMENDATION: Authorize additional funds in the amount of $55,226 for the
overexpended capital projects identified in this position paper.

ENGINEERING
Phosphorus Removal Pilot Study
A minor overexpenditure of $68 over the $209,000 authorized was
incurred for this completed project.
Treatment Plant Fuel Modifications
The original authorization of $15,000 was intended to modify the
Treatment Plant natural gas and L.P. gas systems to provide reliable
operation. Modifications to the influent pump engine and engine generator
fuel systems were completed at a cost of $7,500. The modifications have
proven successful. Several leaks developed due to corrosion in the natural
gas system and this account was used to start design of the corrosion
protection system with the intent that an additional authorization would
fo 11 ow.
At this time, construction is complete and the corrosion protection
system is working. No new leaks have developed. All of the design,
construction management, performance testing, and grants management has
been charged to this account causing the $13,508 overrun. The reason for
proceeding in this manner was to expedite the work so as not to impact
the work of the new office building contractor.
Line M Martinez Watershed
The original authorization of $2,600 in April 1976 was intended to
cover ongoing engineering studies on capacity and facility requirements.
During the last six years the $2,600 was used in routine planning activities.
A $787 overrun exists at this time due to a recent evaluation of a gravity
flow option. An additional authorization of $1,000 would cover the overrun
and provide minimal funds to start the forthcoming watershed plan update.

PLANT OPERATIONS
King Knight Co. - Influent Engine No.4
Previously the Board authorized $42,000 for a major overhaul of primary
influent engine No.4. This work was fOfmally bid and awarded to the King
Knight Co. for a low bid of $39,906. As part of the contract, agreed prices
for skilled and unskilled labor were included in order to correct any
unforeseen work outside the scope of the original contract.
Unforeseen repairs were necessary a~d were encountered during the
course of the work. This work included polishing the crank and cam shaft,
replacing the oil pump and all appurtenances, and rebuilding the governor
gear drive system. This work was necessary in order to have a reliable,
functioning piece of equipment. The addltion of this work exceeded the
original Board authorization by $3,817. I
Emergency Standby Pump
An authorization for $10,000 was granted to purchase an engine generator
to provide emergency power for one of the pump stations. A surplus N.A.S.A.
generator was purchased for this purpose. The work required to overhaul this
generator caused the total cost of the project to exceed the authorization
by $ 1 ,91 5.
Chlorine Control System
An authorization of $28,000 was granted in December 1969 for modification
to the Treatment Plant Chlorine Control System. The project authorization was
increased by $86 to cover an overexpendi~ure as of May 1979; however, a late
invoice for parts in the amount of $907 resulted in an overexpenditure in that
amount for this completed project.
Cast Iron Drain - Manhole No.3
Authorization for installation of a three-inch cast iron drain from
Manhole No.3 at the Treatment Plant to an existing sump located at the
diversion structure was granted in December 1980. The cost of construction
quoted by contractors was $4,000. During construction, however, the contractor
encountered groundwater and the final cost exceeded the authorization by $400.

Claims administration costs rel,ated to the Fred J. Early matter
totaled $78,477 as of May 31, 1982, which exceeded the $56,715
authorization by $21,762. The major costs incurred were direct
labor charges of the former Claims Administration Section within the
Construction Division. Although the Fred J. Early matter has been
settled by negotiation, this account will be kept active for the next
six months and the $6,000 requested in addition to the $21,762 over-
expenditure is required to complete .the District's files and to
assemble records required for a grant reimbursement request.

ISSUE: On June 11, 1982, Price Waterhouse, Certified Public Accountants was
selected as the firm with which to develop, an agreed scope of the managerial
review of Valley Disposal Service Inc., and was requested to submit a work plan
for consideration by the Board of Directors.
BACKGROUND: The firm of Price Waterhouse Was selected after considering proposals
for performing a managerial review of Va11~y Disposal Service Inc. submitted by
three consulting firms. Price Waterhouse was requested to prepare a work plan for
the managerial review and to submit a fee estimate for the Board's consideration
before a professional services agreement would be executed.
Attached is Price Waterhouse's corresponde~ce dated July 9, 1982, which comp1 ies
with the Board's request.
RECOMMENDATION: Consider the work plan supmitted by Price Waterhouse and determine
its acceptability, or whether revisions are necessary before executing a profession-
al services agreement.
