ISSUE: Certain points were raised by Counsel for Sharon Grace during the
condemnation hearing which needed clarification.
BACKGROUND: Sharon Grace's attorney proposed a new route for the IS-inch
trunk sewer which would result in the sewer being on the west side of the
subject property (see attached map). The extra cost associated with the
change is:

The proposed route is not justified because:
1. There is no benefit gained from the added $15,000 cost.
2. Two additional right angle turns in the horizontal alignment
will be added which will decrease the flow carrying capability
of the pipe 1 i ne.
3. There is a garage at the extreme north end of Madsen Lane
which the sewer will have to be routed around.
4. Additional sewer easements would have to be acquired which were
not planned for,
5. There is no advantage to the District to modify the alignment
as designed.
A question was raised concerning any physical constraints or problems
which might make the proposed route impossible. There are no such
constraints or problems other than the garage mentioned above. Another
questioned centered around enhancement that the proposed sewer would
have on the Grace property. If said Grace property were to be developed
today, a public sewer main would have to be extended some 300 feet at
an approximate cost of $6000. If the District installs the proposed
trunk sewer, the public sewer main would not be needed. Thus the
Grace property could be enhanced by some $6000 as a result of the pro-
posed trunk sewer. If the Grace property were to develop such that
connections could be made into the existing sewer on Madsen Lane, the
proposed trunk sewer would provide little enhancement to the Grace pro-
perty.

The issue' of severance was raised. There is no severance in this in-
stance because the p~oposed easement is totally adjacent to the east
side of the panhandle property owned by Grace. The smaller property
east of the proposed sewer is a separate lot owned by Grace but is
already severed from the panhandle lot by a property line.
Values of previ6usly purchased easements were based on the market value
of land in the surrounding area as is the Grace easement. It would
not be appropriate to arbitraily increase the $5900 offer to Sharon
Grace as this action would be outside of the precedent set when the
other easements for this project were acquired.
RECOMMENDATION: 1. Authorize District Counsel to proceed with con"'"
demnationof property owned by Sharon A. Grace, Parcel 12, Job 2695.
2. Authorize $5900 as the approximate cost of the easement.

ISSIIF: The subject easement is one of the total of 14 easements required
for DSP 2695.
BACKGROUND: The District Board previously authorized staff to proceed
with easement acquisition for this District Sewering Project. All
easements must be obtained before sewer construction may begin.
Construction has been scheduled to begin in the Spring of 1982.
The Cost of the above easement is $3,500.
RECOMMENDATION: Accept easement, authorize payment as specified above
and authorize recording of said easement.

ISSUE: Edward J. Lazzarini Construction Company, Inc, owners of the
property which is encumbered by the subject easement, have requested
this District to quitclaim said easement.
BACKGROUND: The subject easement was created with the filing of the map
of Subdivision 5139, on December 22, 1977. This easement straddles the
line between Lots 16 and 17, which is against District standards. A
replacement easement has been created within the western 10 feet of Lot
17. This replacement easement will provide future service to property
located north of Subdivision 5139.
RECOMMENDATION: Approval, execute quitclaim deed and authorize its
recording.

ISSUE: An initial environmental study and Negative Declaration for
the Buttner Road Sewer project has been prepared.
BACKGROUND:
On March 18, 1982, the Board established April 1, 1982 as the date for
the hearing and consideration of the Negative Declaration of the subject
sewer project.
An initial environmental study has been prepared. for the project and
based on this study it was found that the project will not have a
significant effect on the environment. A I'Notice of Intent to issue
Negative Declaration" was sent to all property owners fronting the
proposed sewer main, and other responsible agencies. Sufficient time
has now elapsed for comments from these responsible parties, so that
the Final Negative Declaration can be considered for adoption.
Attached is the initial study for the subject project which includes
the following mitigation measures to avoid potentially significant
effects:
(a) Paving of trench area to be done as soon as practical after sewer
main is installed.
(b) Trench shoring will be required according to OSHA safety orders
and accepted construction practices.
(c) All trench material will be compacted to District standards.
(d) Limit construction to normal daytime hours of operation (8:00 A.M.
to 5:00 P.M., Weekdays only).
Use properly muffled trucks and equipment.
RECOMMENDATION: Adopt Negative Declaration

BACKGROUND: There are three holding basins at the treatment plant pro-
viding storage for flows that are bypassed during peak storm flows and
emergencies. The District has embarked on a three-year program to
return all three holding basins to their original operating condition.
Holding Basin ^ was renovated in 1979 and Holding Basin B was renovated
in 1980.
Holding Basin C was used between 1975 and August 1980 to store alum
sludge accepted from CCCWD. During the last construction season the
alum sludge was turned to facilitate drying and a portion of the alum
sludge was removed. Holding Basin C is now ready for the renovation
work.
In November 1981 the Board of Directors authorized $15,000 for design
of the Holding Basin "C11 Renovation project (removal of alum sludge
deposits, reconturing the basin interior for proper drainage,
improvements to the drain-back structure, and improvements to the
dechlorination facility piping). Since that time, several items of
work have been added to the project scope. These include:
(1) A small pump station for complete dewatering and optimal use of
Basin IIC", including necessary electrical work;
(2) Removal of alum sludge from the Alum Sludge Basin
I'

(3) Additional work at the 'IDrainback Structure" to assure proper
flow measurement.
In addition, installation of vacuum relief valves for protection of
the 72-inch outfall will now be included as part of the Basin "C"
work (funding for design of this item was approved by the Board in
Februa ry 1982).
The renovated basin will provide approximately 30 million gallons of
additional storage capacity (20 hours at current dry weather flow).
Completion of project design including all items in the current scope
of work will require an additi.onal authorization of $7tOOO.

Metcalf & Eddy (M&E) is currently under contract to provide engineering
services for the Stage 5A Project Completion work. During Phase I of the
precast wall panel investigation, M&E's subconsultant (H. J. Degenkolb,
Associates) verified that some of the panel anchorages were deficient.
This finding was based upon a review of the design drawings and calcula-
tions and visual observations made during a walk through of the plant.
Phase II of the precast wall panel investigation involved the X-ray
investigation work to define the as-built conditions of the panel
anchorages. The X-ray shots showed that some of the panels were not
constructed or installed as designed.
Under this proposed contract amendment, M&E and their subconsultant will
perform some additional field work and will util ize their field findings
and the results of the Phase I and II effort to design the precast wall
panel anchorage modifications for major structures. The budget cost for
this amendment is $73,040. It should be stressed that this is a budget
amount and not a total price. During the field work portion of the
proposed work, some unknowns may be encountered that would affect the
level of effort required. The total price will be set. after a determina-
tion can be made on the level of effort. M&E will not exceed the above
budget cost without previous authorization.
The cost for this proposed contract amendment will be considered for
eligibility by the State Water Resources Control Board under the Clean
Water Grant Program; however, grant funding cannot be guaranteed at this
time.
RECOMMENDATION
Authorize GM-CE to execute Amendment No. 11 to the Metcalf & Eddy Task A
Agreement. Authorize $73,040 in Sewer Construction Funds to cover this
work.

ISSUE: With the approval of the Final negative declaration, the
proposed sewer project on Buttner Road can now be considered for
approva 1 .
BACKGROUND: The proposed project consists of a sewer main extension
from the existing manhole located in Buttner Road opposite APN 164-
052-004 (Be~kowitz). The sewer main+will extend northerly from said
manhole 500- feet, and southerly+800-1 to the Swan & Cox parcels. A
sewer main will also extend 360'- westerly of Buttner Road between the
common property line of the Knapp and Berkowitz parcels.
There are 15 existing residences which are presently on'.septic systems
which willlbe served by this sewer main extension. The negative
declaration has adequately addressed environmental issues. The project
is needed to correct health problems in the Buttner Road area.
The pub 1 i c may appear before the Board to present the i r v'iews dur i ng
the consideration of approval or dissapproval of the project.
RECOMMENDATION: Approve the project as proposed.
