ISSUE: At the September 15, 1983 Board Meeting, a Public Hearing was
scheduled on October 6, 1983 to consider increases in drop box and
commercial garbage rates applied for by Valley Disposal Service, Inc.
BACKGROUND: A garbage rate increase application was submitted by Valley
Disposal Service, Inc. and its divisions, Diablo Disposal Service, Inc.
and Lafayette Garbage Disposal Service, Inc. which are franchise holders
for Zones 4, 5 and 2, respectively. The rate increases requested in the
application were:
1. To increase drop box rates in all three zones from $4.25 to $4.60
per cubic yard, representing an 8.24% increase.
2. To increase commercial rates for Zones 4 and 5 (Valley Disposal
and Diablo Disposal) to the same rates charged in Zone 2 (Lafayette
Disposal) since April 1, 1981. These rates would increase an
average 6.67%.
3. To increase residential rates in Zones 4 and 5 (Valley Disposal
and Diablo Disposal) by 2.53%, with no increase in residential
rates in Zone 2 (Lafayette Disposal).
District staff's analysis of the rate increase application was submitted
for consideration by the Board of Directors on September 15, 1983.
As a result of the deliberations of the Board of Directors on September 15,
1983, the franchise holders revised the rate increase appl ication to be
considered at the October 6, 1983 Publ ic Hearing to include the requested
increases in drop box and commercial rates only. A rate increase appli-
cation for residential rates which is anticipated to be for the period
January 1, 1984 through March 31, 1985 is to be submitted during the week
of October 10, 1983 for consideration by the Board in November or December
1983. It is proposed by the franchise holders that the Board consider
additional increases in drop box and commercial rates if additional revenue
which may be required cannot be raised reasonably by the increased residential
rates. A letter from S. Skaggs confirming the applicants' understanding of
the revisions is appended as Attachment 1.

A staff analysis based on projected expenses for the twelve months
beginning October 1, 1983, and revenues which are projected to be
realized during that period at the requested increased drop box and
commercial rates is presented in Attachments 2-7.
A reevaluation of officers' compensation is presented on Attachment 8.
RECOMMEN'DATION: Conduct a Public Hearing on October 6, 1983 to consider
the application for increases in drop box and commercial rates by Valley
Disposal Service, and establish such rates at appropriate levels.

Dear Roger:
As I leave town I am dictating this letter to confirm my
understanding of the action taken by the Board during its
meeting last night.
I understand that the commercial and drop box rates have been
set for hearing at the meeting of the Board to be held on
Thursday, October 6, 1983.
I understand that the Board accepted my suggestion that Valley
prepare a revised proposal for a residential rate increase
which proposal will be submitted to your staff during the week
of October 10, 1983. It is anticipated that a hearing on
the revised residential rate proposal will be conducted in
November or early December with a target date for enactment
of a residential rate increase of January 1, 1984. It is also
anticipated that such residential rate would remain in effect
through March 31, 1985. If additional revenues are needed
which cannot be raised reasonably by the increased residential
rate, the Board will consider an additional increase in commercial
and/or drop box rates during calendar year 1984.
If any of the above is substantially in error, please communicate
with my secretary, Kris Scammell, who will pass the message along
to the appropriate people at Valley.

The requested rate increase of 8.24% in drop box service for all three zones and increases to
commercial rates for Zones 4 and 5 to the rates charged in Zone 2 will result in projected
revenues of $5,050,424, which is within the $5,135,022 revenue required to produce a 95%
operating ratio during the period October 1, 1983 - September 30, 1984.

ISSUE: Three small pickup trucks, 3,800 lbs. and one 3/4 ton, 8,600-lb. pickup were
authorized for purchase in the 1983/84 Equipment Budget. Staff work has been
completed and we hereby recommend to the Board that the purchase be approved.
BACKGROUND: The Request for Bids was publicly advertised on August 30, 1983, and
bids were publ icly opened on September 23, 1983. Four bids were received.
A technical and commercial evaluation was conducted by CSO and Purchasing (see
Attachment #1) which shows that Sun Valley FQrd-lsuzu was the lowest responsive and
responsible bidder. All bids received were below the equipment budget amount of
$31,000.00.
Parker-Robb Chevrolet is the apparent low bidder based upon accepting the factory
rebates, however, they are considered non-responsive to the technical specifications
because of their failure to meet the required specifications in the areas of paint,
rear axle, 6-foot bed, payload, and tires.
RECOMMENDAT I ON: Awa rd. purchase order to Sun Va 11 ey Ford-I suzu for three sma 11
pickups and one 3/4-ton pickup for a total cost of $28,563.95.

ISSUE: District staff requested the execution of the subject document to establish
public sewer rights in a private road known as Spring Lane.
BACKGROUND: The public sewer designed to serve #33 Spring Lane (owned by Linda
Johnson), crosses property owned by Marguerite O'Steen. Ms. O'Steen is demanding
a very high price for the easement which Johnson is unwilling to pay. Attorneys
for Johnson pointed out that there is an existing easement appurtenant to Johnson's
property over 0'Steen1s property which includes sewer rights. They requested that
we permit the sewer construction pursuant to this easement.
District Counsel reviewed the situation and agreed that the existing easement is
adequate and the sewer may be constructed if the existing sewer easement rights
are assigned to the District.
RECOMMENDATION: Accept Assignment of Easement Rights and authorize its recording.

ISSUE: The attached resolution is recommended for Board consideration and approval.
BACKGROl.J'iD: The Physical Science Scholarship Committee is a non-profit organization
whose program is intended to encourage well-qualified high school students to choose an
academic career in education, the physical sciences, or mathematics. The Physical Science
Scholarship Program provides book scholarships of $500 to some 25 to 30 outstanding students
each year in Contra Costa County who enroll in qualifying courses in Diablo Valley College or
Los Medanos College. The supporters of this program come from industry, government, and the
educational institutions who recognize an increasing demand for technically educated people.
The Physical Science Scholarship Committee has requested government agencies within Contra
Costa County to indicate their support for the committee's efforts by the adoption of
Resolution No. 83-
William C. Dalton, President of the Central Contra Costa Sanitary District Board of Directors,
and Vic Sauer, a former General Manager-Chief Engineer of the District are both committee
members of this organization. Gail Koff, Personnel Officer, has been actively involved in this
program for the past seven years serving as both Vice Chairperson as well as Chairperson of the
organization. Since 1971, the Physical Science Scholarship Committee has awarded over 350
scholarships. Throughout the year, the committee solicits financial support for these
scholarships which culminates in an annual awards dinner each October. Nationally and
internationally known speakers have been guest speakers at this dinner which is attended by
over 400 guests.
RECOMMENDATION: Approve Resolution No. 83-
supporting the Physical Scholarship Fund.

ISSUE: The subject hearing is required so that all affected property owners may
comment on the proposed annexation.
BACKGROUND: Some of the territory included within the subject annexation is presently
outside of the District Sphere of Influence (SOl) boundary. The Local Agency
Formation Commission (LAFC) received a petition for annexation to this District and
the amendment of the District SOl.
LAFC approved the petitioned property for annexation and added other properties to
the annexation. LAFC also approved amendment of the SOl of the District to include
the subject annexation and additional territory.
All affected property owners will be notified 15 days prior to the publ ic hearing.
RECOMMENDATION: Approve the establishment of a hearing date of November 3, 1983,
to consider the annexation of territory included in District Annexation No. 85.

Issue: The National Electric Code is being revised for 1984. The
electrical section of the plant Maintenance Division must be kept
abreast of such revisions.
Background: The electrical section of plant Maintenance is frequently
consulted as "experts" in detennining code canpl iance of electrical
install at ions wi th i n the Di stri ct and, in many cases, acts as the
District's inspection authorities. Bill Hammett, Electrical Supervisor,
has 20 years of construction experience; this experience has given him a
thorough knowledge of the current National Electric Code and its
applications. The changes in the 1984 National Electric Code are far
reach i ng and close 1 y app 1 i cab 1 e to ou r f ac i 1 i t Y . The D i s t r i ct wi 1 1
benefit by having its personnel keep current with the new Code and its
application within the District. A copy of the course outline is
attached to th i s Pos i t i on Paper. The course wi 11 not be presented
locally. This course is being given by the Educational Section of the
Electrical Construction and Maintenance Magazine staff.
The two-day course provides 16 hours of instruction, training, and
discussion. The cost for the course is $125.
Recommendation: Authorization of $625 for Bill

ISSUE: The Central Contra Costa Sanitary District is required to establish its
appropriations limit in accordance with Article XIII B of the California
Constitution.
BACKGROUND:
General Requirements: Proposition 4 was approved on November 6, 1979, and was
incorporated in the California Constitution as Article XIII B. Article
XIII B, as implemented by Senate Bill 1352, limits appropriations of State
and local governments to the appropriations of the 1978-1979 base year
adjusted in each s~bsequent year for changes in the consumer price index or
California per capita personal income, whichever is lower, and population.
SB 1352 requires government agencies to establish their appropriations
limit by resolution each year at a regularly scheduled meeting or a noticed
sp~cial meeting beginning with the 1980-1981 fiscal year. Notice to the
public of the availability of documentation in support of the appropriation
limit must be given fifteen days prior to adoption. For 1980-1981, the
appropriation limit was open to challenge within 60 days of the effective
date of the resolution; for 1981-1982, and each fiscal year thereafter,
the period in which a challenge can be commenced is 45 days of the
effective date of the resolution.
Key Assumptions: The following key assumptions have been used in interpreting
the provisions of Article XIII B:
o The District accounts for its activities in three separate funds:
Running Expense Fund (General Fund); Sewer Construction Fund (Capital
Fund); Debt Service Fund. The Running Expense Fund is considered to
be an Enterprise Fund and is not subject to limitation under Propo-
sition 4. Enterprise Funds are generally used to acc~unt for operations
that are financed and operated in a manner similar to private business
enterprises where i~ is Intended that costs of provfdlng good~ or'
services to the public on a contlnulng basls be tlnanced or recovered
primarily through user charges.
o Article XIII B defines "proceeds of taxes" as including, but not
restricted to, all tax revenues, income from investment of tax
proceeds, and the proceeds of regulatory licenses, user charges and
fees to the extent that such proceeds exceed the reasonable cost of

providing the regulation, product or service. "Proceeds of taxes"
also include State subventions, other than those for mandated
programs for which the state reimburses the local agency.
SB 1352 further defined state subventions to include only money
received by a local agency from the State, the use of which is
unrestricted by the statute Droviding the subvention. Grant
funds recei ved from the State for capital projects are restri cted
to specific uses and are, therefore, not "proceeds of taxes".
o Fund balances carried over into fiscal year 1980-1981 are generally
subject to limitation unless they were appropriated into a reserve
account prior to July I, 1980; however, as the Sewer Construction
Fund is a single purpose fund, the fund balance at June 30, 1981,
can be construed ~s having been a~propriated into reserves and,
therefore, not subject to limitation.

computed on the following attachment:
