ISSUE: The subject easement must be accepted by the District prior to recording.
The easement is for the existing Sleepy Hollow Pump Station.
BACKGROUND: On September 7, 1982, this District and the School District executed
an agreement which modified the November 15, 1951, agreement between the two
Districts.
The new agreement changed and clarified responsibilities of both parties for the
sanitary sewer faci1 ities at the Sleepy Hollow School Site. The subject easement is
a requirement of the new agreement.
RECOMMENDATION: Approve and execute a resolution accepting the subject Grant of
Easement and authorize its recording.

ISSUE: The contract for renovation of Lower Orinda and Martinez Pump Stations is
ready for acceptance.
BACKGROUND: Dalzell corporation started work on the project in September 1982. The
work on the Lower Orinda and Martinez Pump Stations was substantially complete in
September 1983. Outstanding items of work have been completed, and it is appropriate
to accept the project.
RECOMMENDATION: Accept the contract for renovation of Lower Orinda and Martinez
Pump Stations and authorize the fil ing of the Notice of Completion.

ISSUE: This District must initiate the annexation proceedings with the Local Agency
Formation Commission (LAFC) before the annexation process can be officially completed.
BACKGROUND: The LAFC has requested that the District submit no more than 10 separate
areas under anyone proceeding to avoid overloading their schedule. The subject areas
are generally located in Martinez, Walnut Creek, Alamo, and Danville. LAFC has
indicated that they may add adjoining unannexed parcels to the separate areas we
submit to el iminate islands or straighten boundary 1 ines. The District will have to
hold a publ ic hearing to consider the annexation of any parcel added by LAFC.
RECOMMENDATION: Pass a Resolution of Appl ication for the annexation of properties
to CCCSD under District Annexation 86.

ISSUE: Further funds are required to continue the District's security and
loss prevention effort.
BACKGROUND: At the October 6, 1983, Board Meeting, the Board was advised as to
the steps staff had taken to date on improving District's security and
loss prevention. Additional capital funds are required at this time to
address potential problems which may exist outside of' the Martinez
facility where previous efforts have been focused.
It is vitally necessary that a security survey of the Collection System
Operations facilities be completed prior to remodeling, and a survey of
District Pump Station facilities be performed. The cost of this additional
survey is estimated to be $2,500 and is anticipated to produce recommenda-
tions for the installation of physical security safeguards such as alarm
systems and barriers. Requests for capital funds to implement the
consultant's recommendations will be submitted to the Board at a future
date.
Due to the amount of this request being under five thousand dollars, this
item is calendared on the CQ~sent agenda as is the present procedure.
RECOMMENDATION: Authorize $2,500 in Sewer Construction Funds for Buckman &
Associates to undertake further security and loss prevention surveys for
the District.

ISSUE: The District-wide PBX System which was installed in the new Headquarters Office
Building on a leased basis is now being offered for purchase or lease-purchase.
BACKGROUND: Funds were authorized by the Board of Directors in November 1981 for a
comprehensive review of the District's telecommunications requirements upon relocation
to the new Headquarters Office Building, and preparation of system specifications by staff
members of the Administrative and Engineering Departments. On September 30, 1982, the
Board of Directors accepted the staff recommendation to select the Dimension 400 PBX
System proposed by Pacific Telephone and Telegraph Company as a replacement for the
District's existing system. The Board was advised that while Pacific Telephone was then
prohibited, under its tariffs, from offering its system for sale, changes in marketing
policies were anticipated in 1983 as a result of the American Telephone and Telegraph
Company divestiture agreement.
Funds for design and installation costs in the amount of $49,500 were authorized by the
Board, of which $35,000 were actually incurred.
Lease, Purchase or Lease-Purchase Options
The PBX System is currently leased for $2,004 per month, which includes lease of software
and maintenance service. The system is now being offered on a purchase or lease-purchase
basis by AT & T Information Systems, a new entity resulting from the divestiture
agreement. A comparison of the cost of the three options available, i.e. continuing to
lease the system, or acquiring ownership rights to the system by purchase or lease-
purchase, is presented on Attachment I.
Assessment of PBX System Performance
The following major features of the Dimension 400 System were identified during
assessment of the competing systems which were proposed: future flexibility; supplier
reliability; cost effectiveness; maintenance support; and training. During the period since
installation in January 1983, District staff has evaluated the system's performance based
on the above criteria. The following summarizes the results of the evaluation:
Future Flexibility - As proposed, the system's modular design was described as one
permitting a variety of line and trunk combinations which would simplify future
expansion, and which would easily accommodate the addition or removal of equipment
features and stations.

The District's experience with the Dimension 400 System confirms its flexibility. Two
District employees were trained to program the telephone features of each station
initially, and to perform reprogramming to change classes of service, call pick-up
groups, night bells, and extension locations. The telecommunications requirements of
the Collection System Operations Department which may be necessary following
remodeling of the Springbrook Road facility will be accommodated by the Dimension
System.
Supplier Reliability - As proposed, all specifications and requirements under Pacific
Telephone's proposal were to be assumed by the successor company following AT & T's
divestiture.
The successor entity, AT & T Information Systems, has assumed all of the specifica-
tions and requirements under the Pacific Telephone proposal.
Cost Effectiveness - As proposed, the system was described as having expense
reduction features including selection of optional long distance modes, providing
accountability and control, and permitting changes to the system by trained District
personnel, thereby avoiding service call charges.
The system has provided improved accountability and control through itemized billing
statements for each station. Changes to the system are routinely made by trained
District personnel. The automatic route selection feature of the system automatically
selects the least costly mode for long distance calls.
Maintenance Support - As proposed, the preventive and remedial maintenance program
was described as being based on an extensive support organization providing continuous
internal routine maintenance within the system, remote diagnostics and disaster
recovery.
While no major problems with the system have been experienced, minor problems
which were reported were quickly and effectively resolved.
Training - As proposed, complete training before and after installation of the system
was to be provided to all District personnel, and special in-depth training was to be
provided to two District employees.
All District personnel received training on the use of the new system. The special
training received by the two District employees has enabled them to provide the
District with the ability to respond to change requests from employees, serve as
trainers for new employees, and provide in-house expertise for the system.
The assessment of the District staff that the Dimension 400 System has performed
successfully in each of the criteria used in its selection is reflected in the high level of
satisfaction with the system expressed by the District's employees.

Conclusion: The comparison of cost of the three options presented on Attachment I on a
present value basis shows that the purchase of the system is least costly, followed by the
lease-purchase option; the continuation of the present lease arrangement is the most costly
option. While it is recognized that a primary risk attendant to purchase is technological
obsolescence, it has been concluded that the Dimension 400 System will serve the District's
telecommunications requirements far beyond the five year period used in the cost
comparison.
A critical consideration in assessing whether the Dimension 400 System should be acquired
has been its performance in the District's environment. The results of staff's evaluation of
the features which were considered paramount during selection of the new system indicate
that the Dimension 400 System provides reliable, cost effective service to meet the
District's present requirements, and has flexibility to meet future requirements.
An unexpended balance of $14,500 from the original $49,500 authorized when the system
was installed exists because of lower installation costs charged by the telephone company.
Therefore, funds requested in this Position Paper are net of the unexpended balance:

ISSUE: In accordance with the contract documents for District Project 2553,
Flushkleen Pump Station Capacity Improvement, Board approval is requi~ed
before the contractor can substitute a subcontractor for one already 1 isted in
the bid proposal.
BACKGROUND: W. R. Thomason's bid for District Project 2553 listed W.S.B. Electric
as the electrical subcontractor for the job. In accordance with Section 4104 of the
Cal ifornia Government Code, the bidder is required to list all subcontractors perform-
ing work in excess of one half of one percent (1/2%) of the total bid price. The
electrical portion of the bid constituted approximately ten percent (10%) of the
total bid price. When the electrical portion of the work commenced, it was noted
that Diablo Controls, and not W.S.B. Electric, was being used.
District staff notified W. R. Thomason that, in accordance with Section 4107 of
the Cal ifornia Government Code, written justification for such a substitution is
required. Additionally, Board approval of the substitution is also required.
W. R. Thomason submitted a letter stating that W.S.B. Electric would have failed
to perform the electrical work per the time schedule presented in the contract
documents; therefore, Diablo Controls was substituted.
RECOMMENDATION: Since failure to perform the work within the project schedule is
a val id reason for substitution of a subcontractor per Section 4107 of the
Cal ifornia Government Code, it is recommended that the Board approve the
substitution of Diablo Controls for W.S.B. Electric for District Project 2553.
