ISSUE: This District must initiate the annexation proceedings with the Local Agency
Formation Commission (LAFC) before the annexation process can be officially
completed.
BACKGROUND: The LAFC has requested that the District submit no more than 10 separate
areas under anyone proceeding to avoid overloading/their schedule. The subject
areas are generally located in Orinda, Pleasant Hill, and Danville. LAFC has
indicated that they may add adjoining unannexed parcels to the separate areas we
submit to el iminate islands or straighten boundary lines. The District will have to
hold a publ ic hearing to consider the annexation of any parcel added by LAFC.
RECOMMENDATION: Pass a Resolution of Application for the annexation of properties
to CCCSD under District Annexation 88.

ISSUE: Authorization is required for the General Manager-Chief Engineer
to execute a contract with Wegman-Carollo to provide an update of the
1982 Central Contra Costa County Waste-to-Energy Study.
BACKGROUND: On June 28, 1984, the Board authorized $190,000 in Sewer
Construction Funds to conduct the District Solid Waste Management
Project. One element of this project is to have Wegman-Carollo provide an
update of the 1982 Central Contra Costa County Waste-to-Energy Study. An
update is required to reflect changed economic predictions and landfill
disposal assumptions. The update will develop three to six candidate
economic and disposal scenarios, and will prepare a cash flow analysis
for each scenario to determine the present economic viability of the
recommended alternative in the 1982 report.
District staff has prepared scope of work and has concluded contract
negotiations with Wegman-Carollo. The contract with Wegman-Carollo is
on a per diem basis with an $8,300 cost ceiling. No additional Sewer
Construction funds are needed as the $8,300 was part of the original
$190,000 authorization.
RECOMMENDATIONS: Authorize General Manager-Chief Engineer to execute
contract with Wegman-Carollo to update the 1982 Central Contra Costa
County Waste-to-Energy StUdy. The contract will be on a per diem basis
with an $8,300 cost ceiling. No funds are requested in this
authorization.

ISSUE: Before the property owner (Peter B. Bedford) proceeds with his
development plans, he has requested that the Board approve annexation into
the D i s t r i C t.
BACKGROUND: This parcel was scheduled for Board consideration on August 2, 1984.
Shortly before the meeting, Bedford Properties requested that the matter be
continued to the August 23, 1984 meeting.
During Board discussion of the matter, staff was directed to research previous
appl icable Board pol icy. Board Resolution No. 76-200 relates to mutual annexations
with the City of Concord and is appl icable to this matter.
RECOMMENDATION: Consider authorization of P.A. 84-13 to be included in a future
formal annexation to the District.

ISSUE: As part settlement of the law suit of Ronald V. Gross and Beverly K. Gross
vs. Central Contra Costa Sanitary District, et aI, the subject easement must be
quitclaimed.
BACKGROUND: The subject easement was dedicated on the map of Subdivision 4881.
Subsequently, the route of the sewer was changed, and new easements were granted to
the District by Tappan Terrace Ltd. It was later determined that Tappan Terrace
owned all lots in Subdivision 4881 except the lot which was retained by the
Grosses (Lot 7) who were the original developers. Therefore, the District's
easement was not valid, and our use of the easement was a trespass situation. The
Grosses filed suit against the District, Tappan Terrace, et aI, to stop the
trespass and to recover other alledged damages. The Grosses have agreed to
execute a new easement in exchange for our Quitclaim Deed and a monetary settlement
of $1,000.
RECOMMENDATION: Approve and execute Quitclaim Deed and authorize its recording.

LAS TRAMPAS CREEK P.G.& E. EASEMENT
Earth slides occurred along Las Trampas Creek during the heavy creek
flows of several winters ago. These affected both the District and
P.G.& E. easements as well as several homeowners in the area. The
City of Lafayette and Contra Costa County are supposed to take the
lead in developing a long-range solution to the Las Trampas Creek flood
problem and the District desires to maintain a low profile during expected
disputes between those public agencies and the affected property owners.
Because the P.G.& E. natural gas pipeline easement lies between the
District's easement and the creek, the District does have a possible
action against P.G.& E. for failure to properly maintain their easement.
District Counsel has obtained an Agreement to Toll the Statute of Limita-
tions from P.G.& E. in order to protect the District's position while the
Las Trampas Creek problem is being resolved. The staff and Counsel request
Board approval of this Statute Agreement.
If additional information is needed, Counsel and I will be happy to provide
it but this should be done in closed session since potential litigation is
involved.
