AND PLEASANT HILL BAY SHORE DISPOSAL, AND ESTABLISH NEW COLLECTION RATES EFFECTIVE AUGUST 1, 1987 DATE August 25, 1987 TYPE OF ACTION ESTABLISH REFUSE COLLECTION RATES SUBMITTED BY INITIA TING DEPT.lDIV. Funasaki, Finance Officer Administrative/Finance & Accounting ISSUE: The Board of Directors scheduled an adjourned Board Meeting on August 27, 1987 for the purpose of determining the amount of the Acme Fill Corporation (Acme) disposal fee increase allowable for inclusion in the refuse collection rates to be established for the District's three franchised refuse collectors. BAa<GROUND: The Board has reviewed and considered staff analyses of each of the appl ications for rate increase submitted by the three franchised refuse collectors, and a report by Price Waterhouse on its review of the Acme Fill Corporation disposal fee increase. Written comments were submitted to the Board by each of the councils of the cities for which the District franchises refuse collection. Public hearings were conducted on July 1, 1987 and July 16, 1987, during which public comment was received from the refuse collectors and the general public. On August 20, 1987, the Board received a report of its subcommittee's efforts to pursue the lowering of the disposal fee to a level allowable for inclusion in the refuse collection rates. Legal counsel was obtained on the legal issues related to courses of action being considered by the Board on the disposal fee increase. Following its del iberation of this matter, the Board expressed an intention to establish the following collection rate increases, exclusive of the effect of any increase in disposal fee charges, and to defer to August 27, 1987 the setting of a total collection rate increase: Valley Disposal Service, Inc., 11.88%; Orinda-Moraga Disposal Service, Inc., none; and Pleasant Hill Bay Shore Disposal, 8.00%. The Board indicated an interest in applying the percentage increase in revenue required to the service categories in the proportion requested by the refuse collectors; however, the 8.00% increase in revenue required for Pleasant Hill Bay Shore Disposal was considered to be appropriately applied to the residential, mobile home, and commercial single can rates, in keeping with the concept established during last year's rate-setting process under which these rates would require a graduated increase over multiple years. The Board's subcommittee expressed support for a disposal fee of $3.69 per cubic yard. This tipping fee rate excludes from Acme's $5.84 per cubic yard rate, adjustments made by Price Waterhouse to projected landfill operating expenses and the cost of transfer station vans and planning. The refuse collectors were provided an opportunity to submit written comments to the Board by August 25, 1987. Written comments which have been received are bei ng transmitted with this Position Paper. After considering the information requested and due deliberation, the Board is scheduled to act on the following: o Determine the total collection rate increase to be granted each refuse collector, including the disposal fee increase allowable for inclusion in the collection rates, and the implementation date for the collection rate increase. o Schedul e a subsequent rev iew by Price Waterhouse of the Acme Fill Corporation closure plan and revenue and expense projections for compl eti on in time for use in the next refuse coll ecti on rate-setti ng process. o In its report to the Board, Price Waterhouse provided guidel ines for procedures to assure that the funds obtained for closure and post-closure maintenance are adequately accounted for. These guidelines are presented in Attachment IV. An avenue for impl ementi ng these guidelines is by amendment to the County Solid Waste Commission's Solid Waste Master Plan. The guidelines should be made applicable to the Acme landfill, as well as any future landfills in the county. o The amount of closure and post-closure costs should be separately identified on the collection ratepayer's billing statement as "landfill closure cost,,, and be subject to review during subsequent refuse collection rate-setting processes to determine its continued appl icabil ity. --------. 13028-9/85 SUBJECT CONSIDER THE APPLICATIONS FOR REFUSE COLLECTION RATE INCREASES BY VALLEY DISPOSAL SERVICE, INC., ORINDA-MORAGA DISPOSAL SERVICE, INC. AND PLEASANT HILL BAY SHORE DISPOSAL, AND ESTABLISH NEW COLLECTION RATES EFFECTIVE AUGUST 1, 1987 POSITION PAPER PAGE 3 DATE OF 14 Auoust 25, 1987 RECOMtENDATION: Consider further information provided by District staff and legal counsel's Findings of Fact and establish the refuse collection rates, and their implementation date, for Valley Disposal Service, Inc., Orinda-Moraga Disposal Service, Inc. and Pleasant Hill Bay Shore Disposal.
