ISSUE: Public hearings are to be conducted on July 1, 1987 to consider the
applications for refuse collection rate increases submitted by the three refuse
collection companies franchised by the District.
BACKGROUND: Applications for increases in refuse collection rates effective July 1,
1987 were submitted by Valley Disposal Service, Inc., Orinda-Moraga Disposal
Service, Inc. and Pleasant Hill Bay Shore Disposal, franchise holders for Zones 2, 4
and 5, Zones 1 and lA, and Zone 3, respectively. Significant increases in refuse
collection rates have been requested, based primarily on a 118 percent increase in
landfill disposal fees scheduled for implementation on July 1, 1987 by Acme Fill
Corporation. Because of the magnitude of the effect of the disposal fee increase on
the refuse collection rate applications, the Board of Directors authorized a review
of the allowabi.lity of the scheduled increase for collection rate-setting by Price
Waterhouse, Certified PUblic Accountants. Five central county cities, which al so
franchise refuse collectors who are the owners of Acme Fill Corporation,
participated in providing funding for, and determining the scope and direction of,
the review. These cities are: Walnut Creek; Concord; Martinez; Pleasant Hill; and
San Ramon.
District staff reviewed the rate increase applications submitted by the three refuse
collectors, and prepared a staff analysis of each application. The staff analyses,
and the Price Waterhouse report on the results of its review of the disposal fee
increase, were presented to the Board on June 18, 1987. Copies of the applicable
staff analysis and the Price Waterhouse report were al so provided to the refuse
'collectors, and the cities of Orinda and Lafayette and the towns of Moraga and
Danville, which are served by the District's franchised collectors. Written
comments from these affected cities were requested by June 30, 1987, or public
comments were solicited for presentation at the public hearing on July 1, 1987.
On June 23, 1987, the staffs of the District and the cities, which co-sponsored the
review of the disposal fee increase, met to seek common positions on fee-determining
policy matters and accounting-related recommendations presented for consideration by
Price Waterhouse. The refuse collection rate analyses to be submitted by the staffs
to thei r respective governi ng board and counci 1 s woul d thereby refl ect consi stency
regarding the disposal fee considered acceptable for inclusion in the refuse
collection rate-setting. Additionally, it was considered desirable that a uniform
program of procedural requi rements rel ated to acceptabl e costs, schedul ed report
submissions, and an annual review of disposal fees should be recommended to the
refuse collection rate-setting bodies. The staffs of the sponsoring agencies have
achieved a commonality of views on these matters which are summarized in

In the District staff's analyses submitted to the Board on June 18, 1987, the
incremental effect of the disposal fee increase on refuse collection rates was
presented based on four di sposal fee al ternatives determined by Price Waterhouse.
The resulting refuse collection rates for each of the District's franchised
collectors is resubmitted for reference in this Position Paper as Attachments II,
III and IV. The sponsoring agencies' staffs concurred that a recalculation of the
disposal fee alternatives based on the elimination of the profit margin on closure
and post-closure costs should be provided for policy consideration. A summary of
the disposal fee increment for each of the District's franchised collectors,
computed on the basis of the four alternative fees originally determined by Price
Waterhouse, reduced in each case to remove the profit margi n on closure and
post-closure costs, is shown on Attachments V, VI and VII. In the sponsoring
agencies' staffs' view, the disposal fee increment should be established for a two
year period, subject to adjustment following the first year, based on a review by
Price Waterhouse to determine the disposal fee required.
Notices of the public hearings were released for publication in the Contra Costa
Times on June 21 and 29, and in the Valley Pioneer and the Contra Costa Sun on June
24, 1987.
Written comments received from the publ ic to-date are appended to this Position
Paper.
RECOMMENDATION: Conduct publ ic hearings on July 1, 1987 to receive publ ic comment
on the applications by Valley Disposal Service, Inc., Orinda-Moraga Disposal
Service, Inc., and Pleasant Hill Bay Shore Disposal for refuse collection rate
increases, and establish such rates as are considered appropriate.

AUTHORIZE AWARD
ISSUE: On June 16, 1987, sealed bids were opened for installing approximately
8,100 feet of 42-inch diameter sewer pipe for the San Ramon Valley Interceptor
Sewer Proj ect. The Board of Di rectors must authorize award of the contract or
reject all bids within 60 days of bid opening.
BACKGROUND: The Di stri ct is pl anni ng to construct a new ll.5-mil e interceptor
sewer and force main to serve the San Ramon Valley (see Attachment 3-excerpt from
1987-88 Capital Budget). During 1987 approximately 7.5 miles of interceptor sewer
out of the total 11.5 miles will be constructed. Construction of the 7.5 miles of
sewer will be accomplished by a contract for 6 miles of sewer pipe (Phases lA and
2) and another contract for the remaining 1.5 miles (Phase IB). The contract for
Phase lA and 2 was awarded May 19, 1987, and the contractor was given notice to
proceed on June 2, 1987. Award of the Phase IB contract is the subject of this
position paper.
The specifications and bid documents for the Phase IB construction contract were
advertised May 18 and 24, 1987. Nine bids ranging from $1,895,900 to $2,328,400
were received on June 16, 1987. A tabulation of the bids is shown in
Attachment 1. The engineers' estimate for the installation of the sewer pipe is
$1,533,470. District staff, assisted by James M. Montgomery Consulting Engineers,
conducted a techni cal and commerci al eval uati on of the bi ds received and have
concluded that Mountain Cascade, Inc. of San Ramon, California, is the lowest
responsible bidder with a bid of $1,895,900.
The lowest bid received is 24 percent higher than the engineer's estimate which
was based on bids received on the Phase lA and 2 Contract in May, 1987. Staff has
concluded that the higher bids are due to a less competitive bidding climate for
the concrete sewer pipe than existed for the Phase lA and 2 Contract.
District Engineering staff will administer the construction contract. Engineering
services during construction, including shop drawing review, and materials testing
wi 11 be prov i ded by James M. Montgomery Consul ti ng Engi neers (JMM) and PSC
Associates. A preconstruction survey to record the condition of existing
facilities and structures within the immediate vicinity of the construction work
will be performed by Shapiro Okino Horn and Associates.

A total budget of $2,312,900 has been established for the construction contract,
consultant services, and administration of the construction contract. A summary
of the construction budget is included in Attachment 2.
To comply with the California Environmental Quality Act, the District prepared an
EIR for this project. The EIR was certified by the Board of Directors on
October 16, 1986.
Fundi ng for thi s proj ect has been authorized as part of the 1987-88 Capital
Improvement Budget. The estimated project authorization included in this budget
is $2,400,000. Additional project and cost information may be found on pages CS-9
- CS-12 of the Capital Improvement Budget.
RECOMMENDATION: Authorize award of the construction contract for Phase IB of the
San Ramon Valley Interceptor Sewer, Project 4224B, to Mountain Cascade, Inc.
as the lowest responsible bidder.

ISSUE: Construction has been completed on the Mechanical Maintenance and
Materials Control Building Project and the work is now ready for acceptance.
BACKGROUND: The contract work included the design and construction of a
prefabricated metal building to house the Materials Control and Mechanical
Maintenance facilities. The building provides approximately 12,000 square feet of
space at the first floor level and approximately 3,000 square feet of space at the
mezzanine level for new operations. A 1S-ton bridge crane has been installed in
the Mechanical Maintenance facility as a part of this contract.
W. A. Thomas Co. and West Coast Contractors, Inc./A Joint Venture, was issued a
Notice to Proceed on May 30, 1986. The origi nal contract compl etion date was
February 27, 1987. All work has been substantially completed by the Contractor
and beneficial occupancy of the new facility was taken on May 18, 1987.
Appropriate time extensions were negotiated with the Contractor as a result of
change orders, extra work, late delivery of certain items and related issues. It
is appropriate to accept the contract work at this time. A detailed accounting of
the project costs will be provided to the Board at the time of project closeout.
RECOMMENDATION: Accept the contract work for the Mechanical Maintenance and
Materi al s Control Bull di ng Project CDi strict Project 20027) and authorize the
filing of the Notice of Completion.

ISSUE: All work has been completed on the Wastewater Treatment Pl ant Cathodic
Protection System - Phase I Project and this project can now be closed out.
BACKGROUND: This project completes Phase 1 of a two phase program to provide
adequate corrosion protection to buried piping at the Treatment Plant and Filter
Plant. Phase 1 included the design and construction of electrolysis test stations
(ETS's). Phase 2 will include data collection from the ETS's, design of the
corrosion protection system, and the installation of an appropriate corrosion
protection system.
The construction work on this project included the installation of anode systems,
pipeline isolation flange kits, electrical bonding of pipelines, and installation
of test ports and test stations at various locations inside the Treatment Plant
and Filter Plant.
The contractor, Harco Corporation, commenced work on August 5, 1986. The contract
completion date was November 20, 1986 and the work was completed on November 24,
1986. The project was accepted by the Board on December 4, 1986.
The Engineer's estimate for the construction contract was $203,000. Harco
Corporation's construction contract was for $196,190. There were three Change
Orders issued on the project totaling $1,389.00, resulting in a total payment of
$197,579.00 to Harco Corporation.
A $30,000.00 saving of project funds was realized by the District when a second
planned contract for interior bonding of certain pipes was not executed with
Miller Pipeline. Instead, the bonding work was performed by Harco on the exterior
of the pipes. Access to the bonding location was obtained using a vacuum
excavation technique. This technique was used by Harco Corporation throughout the
project duration and resulted in substantial savings of time and money to the
Contractor. The District benefited from this new excavation method as well.
Numerous buried pipes which could otherwise be possibly damaged from backhoe
operations were left undamaged by the use of this new excavation technique.

Buildings Project and this project can now be closed out.
BACKGROUND: This project was initiated to correct structural deficiencies in
selected structures for the purpose of improving safety and minimizing major
structural and equipment damage during an earthquake.
The construction work on this project included seismic bracing of selected
equipment and building elements in the Solids Conditioning Building, seismic
strengthening of roof connections and bu il ding el ements in the Pl ant Operations
Building, installation of new concrete walls in Substation 82, and seismic
strengthening of the roof to wall connection in the Inlet Building.
The contractor, S. J. Amoroso Construction Co., Inc. commenced work on February
10, 1986. The contract completion date was October 13, 1986. Appropriate time
extensions were granted by the District and the work was compl eted by the
Contractor on November 19, 1986. The project was accepted by the Board on
December 4, 1986.
The Engineer's estimate for the construction contract was $1,100,000. S. J.
Amoroso Construction Co. Inc. 's construction contract was for $596,000. There
were six Change Orders issued on the project total ing $4,931.00, resulting in a
total payment of $600,931.00 to S. J. Amoroso. The total budget for the project
was $1,007,100. The total completed project cost is $869,100 which is $138,000
less than the budget. Staff is closing out the project which will result in
$138,000 being returned to the Sewer Construction Fund.

BACKGROUND: The subject easements were dedicated to this District when the map of
Subdivision 5467 was filed in 1979. Lots 72 and 73 of Subdivision 5467 have been
resubdivided into Subdivisions 6647 and 6648 (filed April 17, 1987). The alignment
of the sewer has been adjusted to conform to the requirements of the new
subdivisions. New easements have been granted for the revised sewer alignment. The
subject easements are no longer needed.

BACKGROUND: The District's 66-inch trunk sewer system is being installed through
a Corps of Engineers project in easements which were purchased from Contra Costa
County in the former Southern Pacific Railroad CS.P.R.R.) right of way. However,
in the area where Mt. Diablo Boulevard crosses the San Ramon Creek bypass channel,
a siphon is required. Parts of the siphon system are outside of the S.P.R.R.
right of way strip. The subject easement is needed from the property owners,
Horst G. Schakat and Horst Auschill, for the downstream portion of the siphon
system. Funds for easement aquisition for this project were previously
authorized by the District's Board of Directors.
RECOM\1ENDATION: Approve and accept Grant of Easement, authorize payment of
$1,250.00 to the grantors, authorize the President of the District Board of
Directors and the Secretary of the District to accept said Grant of Easement, and
authorize the recording of said Grant of Easement.

ISSUE: Authorization from the Board of Directors is required to execute common
use agreements involving real property.
BACKGROUND: The San Ramon Valley Interceptor Sewer will be constructed in
easements located within the former Southern Pacific Railroad right-of-way through
the San Ramon Valley. The sewer will be located adjacent to an easement for an
existing petroleum products pipeline that is owned and operated by Southern
Pacific eSP) Pipelines, Inc. The District will encroach into the SP pipeline
easement during construction of the sewer during any future excavation for
maintenance and at four locations where the trunk sewer crosses under the SP
pipeline.
District and SP staff have negotiated a Common Use Agreement for the SP easement
to allow for construction, operation, and maintenance of the interceptor sewer.
This common use agreement does not require any monetary payment to SP for use of
their easement.
RECOMMENDATION: Authorize the General Manager-Chief Engi neer to execute and
authorize the recording of the Common Use Agreement with Southern Pacific
Pipelines, Inc. related to the San Ramon Valley Interceptor Sewer, Project 4224.
