Plant Operations Department ISSUE: On August 26, 1988, sealed bids for District Project No. 10044, Chlorine Mixing System, were received and opened. The Board of Di rectors must award the contract or reject the bids within 60 days of the opening of bids. BACKGROUND: Plans and specifications for the project were completed by James M. Montgomery Consulting Engineers, and the project was advertised on August 10, 1988. A tabulation of the bids is shown in Attachment I. Plant Operations Department and Purchasing staffs conducted an evaluation of the bids and concluded that the lowest responsible bidder is Monterey Mechanical with a bid price of $26,400. The engi neer' s estimate for constructi on was $30,000. The budget to compl ete th i s project is shown on Attachment II. A description of this project is provided in the fiscal year 1988 - 1989 Capital Improvement Budget, page TP-24. This project will consist of the installation of a prepurchased pump and a di ffuser system so as to improve the mixi ng of the chlorine solution and final effluent. This project has been evaluated by staff and determined to be exempt from the California Environmental Quality Act (CEQA) under District CEQA Guidelines, Section 18.2 since it involves a minor alteration of an existing sewer facility with negligible or no expansion of capacity. RECOMMENDATION: Authorize award of contract to Monterey Mechanical for $26,900 for the construction of District Project No. 10044, Chlorine Mixing System. Engineering Department/ Construction Division ISSUE: Retail Property Development Corp., owner-developer of property at the end of Alamo Glen Drive in Alamo, has requested the District to quitclaim the subject easement. BACKGROUND: The subject easement was created when a Minor Subdivision Map was filed on May 21, 1985. At that time, four lots were going to be created out of a 14.25 acre parcel of land. The developer has now received approval for a 20 lot major subdivision of the same parcel. Sewers were never constructed in the subj ect easement and the al i gnment of the subject easement conflicts with the new development plans. Therefore, the subject easement is no longer needed for publ ic purposes and can be quitclaimed. The owner-developer has paid the District's processing fee. Thi s project has been eval uated by staff and determined to be exempt fran the California Environmental Quality Act (CEQA) under District CEQA Guidelines Section 18.6, since it involves a minor alteration in land use limitations. RECOMMENDATION: Approve Quitclaim Deed to Retail Property Development Corp., Job 3581, authorize the President of the District Board of Directors and the Secretary of the Di strict to execute sai d Quitcl aim Deed, and authorize the Quitcl aim Deed to be recorded. U.) between the Di stri ct and the Central Contra Costa Sani tary Di stri ct Employees' Associ ati on, Publ ic Employees Uni on, Local No. One (Local #1), the Board must employ an arbitrator to render a recommendation when disciplinary actions are appealed to the Board level. BAa<GR<lJND: Mr. Mark Lowery, Assistant Engineer, Construction Division, has refused to shave hi s beard and be fit tested for respi rator use as requi red by District Safety Directive 7.1. The matter was handled under the discipline prov i si ons of the current Memorandum of Understandi ng between the pa rti es. Mr. Lowery has exercised his appeal rights and was dissatisfied with the Hearing Officer's decision. Accordingly, he has appealed to the Board of Directors under Article III, Section 3.3.B and 3.4.B of the current M.O.U. which reads, in part, as foll OtIs: "B. Appeal to Board of Di rectors Permanent employees dissatisfied with the Hearing Officer's decision, only in matters relating to suspension, reduction in rank or payor dismissal, may appeal to the Board of Directors pursuant to the procedures set forth herein. 3 .4 APPEAl A. General An employee, except as provided in Sections 4-410,4-411,4-412, and 4-415 in Chapter 4 of the Di stri ct Ordi nance Code, may appeal the Hearing Officer's decision by appealing to the Board via filing a written request for hearing with the Secretary of the District within five (5) working days of receipt of the Hearing Officer's decision. The Secretary shall cal endar the matter at the next regul arly schedul ed Board Meeting in keeping with established guidelines for calendaring an agenda item. B. Board Shall Designate Representative to Hear Appeal The Board shall anploy a neutral thi rd party to hear the appeal and to recommend action to the Board. DEPT./QIV. ~nglneerlng Department Engineering Division ISSUE: Authorization by the Board of Directors is required for the General Manager-Chief Engineer to execute an agreement and/or amendment to a consulting engineering agreement when the amount exceeds $50,000. BACKGROUND: In June 1987, the Board of Directors authorized the preparation of a Facilities Plan to define the improvements needed to upgrade both the main and trunk sewers in the Country Gardens area of Pleasant Hill. Country Gardens covers the area south of Oak Park Boulevard and north of Geary Road between Putnam Boulevard on the east and Pleasant Hill Road on the west. The sewer deficiencies in Country Gardens were first identified by the District's Wastewater Collection System Master Plan. The sewers in the area are typically more than 30 years old and are among the most maintenance prone in the District. The goal of this project is to correct the hydraulic deficiencies, minimize maintenance requirements, and reduce the probability of future overflows in a cost-effective manner. The Faci lities Plan recommends the replacement of approximately 11,000 linear feet of sewer as shown in Exhibit A. Winzler & Kelly Consulting Engineers was retained to prepare the Facilities Plan for this project. Staff recommends retaining Winzler & Kelly as the design consultant because of their successful completion of the Facilities Plan and their experience with sewer design. An hourly rate contract with a cost ceiling of $71,755 has been negotiated with Winzler & Kelly. The design phase is scheduled to start in September 1988. Construction is anticipated in the summer of 1989. The project has been included in the FY 1988-1989 Capital Improvement Budget and is described beginning on page CS-19. The cost of the design phase of the project, including consultant fees, is estimated at $162,000 as detailed in Exhibit B. The total project cost estimate is now $1,936,000 which is $340,000 more than the $1,596,000 estimate shown in the FY 1988-1989 Capital Improvement Budget. This is a result of additional deficiencies identified during the facility planning phase. The design of this project has been determined to be exempt from the California Environmental Quality Act (CEQA) under District CEQA Guidelines Section 17.3, since it involves a continuation of the planning study for the Country Gardens Sewer Improvement Project.
