Hazard, District Counsel INITIATING DEPTJDIV. Administrative ISSUE: The Board of Directors scheduled a public hearing on May 29, 1986, to consider revisions to Title 2, Chapter 2.24 of the District Code relating to environmental guidelines by ordinance and to consider the adoption of an ordinance incorporating by reference the currently applicable CEQA guidelines as promulgated by the California Secretary for Resources. BACKGROUND: In recent court decisions and changes promulgated in CEQA guidelines by the California Secretary of Resources required that both our District Code and the District's environmental guidelines be revised to conform with the current law. All public agencies within California are statutorily required to adopt local procedures for evaluating projects under the California Environmental Quality Act (CEQA). The local procedures must be consistent with the state law and the CEQA guidelines adopted by the State Resources Agency. The state has adopted comprehensive guidelines which specifically set forth the procedures to be followed in implementation of the CEQA act. The state guidelines are periodically supplemented and amended. The most recent comprehensive set of amendments occurred effective 1984. These comprehensive amendments have required District staff and District Counsel to review the adequacy of the existing local guidelines and procedures. Purpose of local CEQA guidelines or procedures is to incorporate the requirements of the state law into the District's decision-making process. In the past, the District has adopted Local Guidelines to accomplish this integration. These local guidelines have been a reflection of the CEQA law and state guidelines at the time of their adoption. As amendments and additions occur to the state statute and guidelines, the local guidelines have accordingly become outdated or inconsistent unless specific changes to those guidelines have been adopted by the District Board. Accordingly, a process of periodic review of the local guidelines is necessary. Pursuant to a review of our local guidelines, staff and District Counsel have been prompted to adopt by reference the entirety of the applicable state promulgated guidelines as the prevailing local guidelines. District Counsel's staff has reviewed the entirety of the current state guidelines and incorporated each section of those guidelines in its entirety which is applicable to a sanitary district. Only those sections of the state guidelines which have no applicability to the circumstances of this District have been eliminated from the document. The remaining sections have been renumbered so as to eliminate the appearance of missing sections within the document. This is expected to facilitate the convenient reference to the specific state guidelines to assure counsel and staff in the future that amendments to the state guidelines are incorporated into the District procedures. Notice of public hearing has been published in the Contra Costa Times on May 19 and 28, 1986. Upon approval of the ordinances for the adoption by reference of the applicable state CEQA guidelines by the Board of Directors and the amendment to the District Code, the ordinanceswill be published once in the Contra Costa Times and will be effective upon expiration of the week of publication. RECOMMENDATION: To conduct a public hearing on May 29, 1986, to receive public comment: 1. On the proposed revisions to Title 2, Chapter 2.24 of the District Code, and to adopt by ordinance such revisions as are considered appropriate, and 2. McMillan Secretary of the District INITIATING DEPT./DIV. Administrative ISSUE: Board authorization is required for staff attendance at seminars when the cost exceeds $500. BACKGROUND: For many years the need for a systematic records management program for District records from their creation through their active lives, inactive storage, and eventual disposition has been apparent. An up-to-date, responsive records management program is the most important tool for maintaining control of information and for reducing unnecessary legal exposure. The benefits and dollar savings realized from a well constructed and employed records management program should be considerable and will include reduction in the volume of records and the prime floor space needed to house those records and more expedient handling of daily tasks. During recent months research into current records management technology and systems in place at other agencies has been conducted. Attendance at this seminar would be timely and valuable at this point in the development and implementation of a program tailored to the needs of the District. The seminar will address the elements of a comprehens i.ve records management program i nc1 udi ng records retenti on schedu1 i ng, vital records protection, compliance with federal and state statutes, and technical advances in the records management field. It is appropriate that both the Secretary of the District and the Administrative Aide attend this seminar since a major portion of their time will be devoted to the development, implementation, and maintenance of the District records management program, the success of which will depend on a thorough working knowledge of records management techniques. The cost of the three-day seminar is $750 per person. Although funds were not budgeted in the 1985-1986 Central Services budget, there are currently sufficient funds in the Administrative Department budget to cover this expense. RECOMMENDATION: Authorize Joyce McMillan and Julie Lopez to attend the seminar entitled "Establishing and Improving a Records Management Program" on July 21-23, 1986, in San Francisco at a cost of $1500. Engineering Dept./Planning Division ISSUE: Board authorization is required for staff attendance at seminars when the cost exceeds $500. BACKGROUND: In February 1986, Mr. Hans Bleiker conducted a three-day seminar at the District entitled "Systematic Development of Informed Consent." At this seminar, Mr. Bleiker presented an approach developed over 20 years for successfully implementing complex public works projects and programs. The seminar was attended by District management and engineering staff, including Board Director Parke Boneysteele. The seminar was well received by all who attended. District staff have applied some of the principles presented by Mr. Bleiker on the San Ramon Vall ey trunk sewer proj ect, incl udi ng actively seeki ng out interest groups to discuss the impacts of the sewer project and working with local newspapers on articles about the project. These actions have identified issues about the project that are of concern to local residents and businessmen. The February seminar emphasized the principles of citizen participation on projects, but only briefly described the methods and techniques for designing and implementing a citizen participation program. Mr. Bleiker also conducts a seminar entitled "Citizen Participation by Objectives" that complements the seminar presented earl ier at the District. This seminar will address in detail over 40 citizen participation techniques for implementing the principles discussed by Mr. Bleiker. The techniques learned at the seminar will be useful on current projects such as the San Ramon Vall ey trunk sewer and future proj ects such as rates and charges rev i si ons, treatment pl ant wet weather facil iti es, and the Contra Costa Blvd. trunk sewer parallel. Staff proposes that Jacqueline Zayac, Planning/Grants Technician, attend this seminar. Mrs. Zayac is currently working on the San Ramon Valley trunk sewer project and the comprehensive sewer service charge revision. Both of these are projects where citizen participation and acceptance are necessary for successful proj ect impl ementati on. The two-and-one-hal f-day seminar will be hel d June 4 through 6 in Los Angel es. The cost to attend the course is estimated to be $800, including airfare and lodging. BACKGROUND: On October 17, 1985, the Board of Directors adopted the present District Board meeting procedures and agenda format. At that time a new item entitled "Public Comments" was added to the agenda format. Plant Operations Department ISSUE: It woul d be cost-effective for the Di stri ct to purchase the 125 kw di esel generator that it is now renting for the furnace shaft cool ing air fan standby service. BACKGROUND: During the District's multiple-hearth furnace project it was determined that an emergency power system was needed for the Solids Conditioning Building to protect vital equipment and for operator safety in case a power outage occurs. An initial engineer's study indicated that the best solution to this problem of providing emergency power was a small engine generator located in the Solids Conditioning Building with installation after the motor control center modifications of the District 5-B project were completed. As an interim measure a rental 125 kw diesel generator was used to provide emergency power to the furnaces' center shaft cooling fans to prevent damage during a power failure. In a review of the rental cost of the generator and the proj ected schedul e of the permanent Solids Conditioning Building emergency power installation, it would be cost-effective for the District to purchase the existing rental unit. This unit is in good condition and operated for only short periods with low "run" times. The acquisition cost of a similar new generator is approximately $25,000, while the price of the existing rental unit is $14,000 from the supplier. This is the cost to the District if the unit were rented for the additional year before the permanent installation is completed. The diesel generator unit would then be utilized by the District Pumping Stations and Collection System Operations for off-site power requirements after it is no longer utilized at the Treatment Plant. RECOMMENDATION: Authorize $14,000 from the sewer construction fund for the purchase of the diesel driven 125 kw generator currently being rented. BACKGROUND: The 1986-1987 O&M Budget expenses total $19,258,942 which exceed the 1985-1986 budgeted expenses of $18,477,188 by $781,754, or 4.2 percent, and are higher than the 1985-1986 projected actual expenses of $18,653,928 by $605,014, or 3.2 percent. Explanations of departmental expense increases, or decreases, between 1986-1987 budgeted expenses and 1985-1986 projected actual expenses are provided following each departmental expense summary within the attached budget document. The 1986-1987 O&M Budget revenues of $20,065,295 are composed of Sewer Service Charge revenues of $14,838,200, City of Concord service charge revenues of $3,625,000, and other revenues of $1,602,095. The budgeted Sewer Service Charge revenues are based on the present annual rate of $124, and projected increases in residential connections and increased usage volumes for commercial and industrial users during 1986-1987. The 1986-1987 budgeted revenues exceed 1985-1986 projected actual revenues of $19,399,162 by $666,133, or 3.4 percent. The following operational change is reflected in the 1986-1987 O&M Budget: The Board of Directors authorized the establishment of a Self Insurance Fund for payment of property and li ability cl aims and rel ated expenses effective July 1, 1986. Premiums formerly recorded in the O&M Budget for commercial property and liability insurance coverages have been repl aced by a Sel f Insurance expense representi ng the 1986-1987 fundi ng by the O&M Budget of the Self Insurance Fund. Claims and legal expenses, and other associ ated expenses have been removed from the 1986-1987 O&M Budget, and are budgeted in the new Self Insurance Fund, as follows: Legal Services Technical Services Claims Adjusting Services Minor Claims Settlements $100,000 50,000 4,000 18,300 $172,300 REVIEWED AND RECOMMENDED FOR BOARD ACTION INITIATING DEPT./DIV. ~~- 1302A-9/85 WF PM SUBJECT RECEIVE 1986-1987 OPERATIONS AND MAINTENANCE BUDGET FOR REVIEW POSITION PAPER PAGE DATE 2 OF 8 Mav 20, 1986 The foll ow ing extraordi nary charge to operati ons and maintenance expenses is included in the projected actual expenses for the 1985-1986 fiscal year: The total amount expended to complete the Solid Waste Management Project was $253,424. The project was completed by the Engineering Department in 1985-1986, and included preparation of a Solid Waste Management Plan, and a comprehensive public landfill site screening to identify potential sites throughout the county. A Solid Waste Management Project Report was published and public participation workshops were conducted. Additionally, a white paper was submitted that presented the District's recommendations to the County on solid waste management. As it is unlikely that the project will lead to the District's operating or contracting for a solid waste landfill, it is appropriate to charge the cost of the project to operations and maintenance expenses of the Engineering Department in the 1985-1986 fiscal year. A summary of actual, projected actual and budgeted expenses, revenues, and reserves for the six fiscal years 1981-1982 through 1986-1987 is shown on Attachment I, with a presentation of Sewer Service Charge rates and Sewer Service Charge equivalent units for each fiscal year. Attachment II is a graph which shows the major expense categories of labor, chemicals and utilities in relation to total budgeted expenses for each of the six fiscal years. The capital projects for which District labor charges are budgeted to be expended and capitalized during the 1986-1987 fiscal year are summarized on Attachment III. Any adjustments to the 1986-1987 O&M Budget which may be determined at the May 29, 1986 Board Meeting will be incorporated in the budget to be submitted for approval at the June 5, 1986 Board Meeting, at which the following actions are scheduled: o Approve the 1986-1987 O&M Budget. o Conduct a public hearing for the establ ishment of the 1986-1987 Sewer Service Charge rate. o Establish the 1986-1987 Sewer Service Charge rate. o Conduct a publ ic hearing for the collection of the 1986-1987 Sewer Service Charge rate on the County tax rolls.
