Plant Operations Department ISSUE: On February 15, 1990, sealed bids for the Ash Storage Basin I Improvements and Hol ding Basin Levee Roads Pavement Projects, District Project Nos. 10066 and 10067, respectively, were received and publicly opened. The Board of Directors must award the contract to the lowest responsible bidder or reject bids within 60 days of the opening date. BACKGROUND: The District wastewater treatment plant produces an average 12 tons per day (24 cubic yards per day) of incinerator ash and 2 tons per day (1.5 cubic yards per day) of dewatered grit. Presently, the ash is transported to both Redwood Sanitary Land Fill, Inc. and the Colusa County Landfill for disposal. Grit is transported and disposed of only at Redwood Sanitary Land Fill, Inc. The purpose of District Project No. 10066 is to provide temporary on-site storage of ash and dewatered grit in the event that off-site disposal is not available. The ash or grit stored on site will be removed after the disposal crises ends and will ultimately be disposed of off site in an approved manner. The treatment plant has three basins north of the plant that store wet weather flow. One of the levee roads is the major artery to the plant's dechlorination facility at the north end of the holding basin, and another levee road provides access to the plant's main electrical station. The levee roads will also provide access to the on-site ash and grit storage basin. During winter, these gravel roads deteriorate forming potholes and washboard ridges in the roadway. District Project No. 10067 was desi gned to 'pave these 1 evee roads with asphal t concrete to provi de safe, year-around access to maj or process facil iti es. These two proj ects have been combined for ease of bidding, cost savings, and construction coordination. Pl ans and speci f i cati ons for these proj ects were compl eted by the Pl ant Operati ons Department staff and were publ icly advertised on January 29, 1990, and February 5, 1990. A total of 14 bids were received and opened on February 15, 1990. A summary of the bids is shown in Attachment I. An evaluation of the bids, conducted by Plant Operati ons Department staff, concl uded that the lowest responsi bl e bi dder isLes McDonald Construction Company with a bid price of $154,000. The favorable bid price reflects an aggressive bidding climate. The engineer's estimate was $225,000. These projects are included in the 1989 - 1990 Capital Improvement Budget, pages TP-30, Sludge/Ash Handling Project, and TP-63, Pave Holding Basin Levee Roads. The total amount budgeted for the contracted work was $300,000. The budget to complete this project is $250.500. as shown in Attachment II. Engineering Department/ Construction Division ISSUE: Changes are requi red to the Di stri ct Code regardi ng insurance requirements for private sewer contractors. BACKGROUND: It is the policy of the District to require private sewer contractors to provide certificates of insurance as a part of the registration process for these contractors. In addition, the District takes an active role in monitoring and ensuring that updated certificates of insurance are on file prior to i ssui ng permi ts to regi stered contractors. The Di stri ct performs these functions voluntarily and has no mandatory duty to perform the functions. Staff has reviewed its role relative to insurance certificates and has determined that if the District takes a less active role in monitoring these certificates, the potential for the creation of a mandatory duty to monitor and maintain updated certificates will be lessened. If the District does not impose on itself a mandatory' duty through its policies, the liability of the District for an injury caused by a District permitted contractor who was uninsured at the time of injury will be lessened. It is prudent to make changes to the District Code to clarify the role of the District and to decrease the involvement of the District in requiring and monitoring certificates of insurance so as to prevent the creation of a mandatory duty. This proposed change coincides nicely with the implementation of the new procedures for processing of irrevocable offers of dedication. The District will reduce its liability through the use of I.O.D.s. The District can further reduce its liability by adopting the proposed changes to insurance requirements. The insurance changes wi II be phased in such that contractors who work on private sewer projects where easements have been granted to the District will be required to have insurance. District staff will continue to monitor the insurance of these contractors as needed. Eventually al 1 easements rel ated to private sewer projects will be conveyed to the District through LO.D.s. At that time the District will cease all monitoring of insurance requirements for private sewer contractors. These contractors will no longer have to submit insurance certificates to the District. However the District will continue to require contractors who work on District projects to submit certificates and staff will monitor these certificates. The changes to the Code will be publ ished after the public hearing as required by law.
