ISSUE: The county requires a "Consent to Dedication" whenever an area dedicated for public
road purposes encroaches upon an existing easement.
BACKGROUND: A portion of Parcel A of Minor Subdivision M.S. 73-86 is being dedicated to
the county for widening the public road known as Cherry Lane. An existing public sewer
easement is located within the dedicated area. Since the easement precedes the dedication of
the public roads, a consent to dedication is needed. A standard consent document will be used
in which the District retains prior rights.
This project has been evaluated by staff and determined to be exempt from the California
Environmental Quality Act (CEQA) under District CEQA Guidelines Section 18.6, since it involves
a minor alteration in land use limitations.

RECOMMENDATION: Approve the Consent to Dedication to Contra Costa County, M.S. 73-86,
Job No. 2976, authorize the President of the District Board of Directors and the Secretary of the
District to execute said document and authorize its recording by Contra Costa County.

ISSUE: Construction has been completed on the Hall Drive Sewer Improvement Project, Phase
2A (D.P. 24331) and the work is now ready for acceptance.
BACKGROUND: The Hall Drive Sewer Improvement Project, Phase 2A, consists of constructing
approximately 220 lineal feet of 8-inch diameter sewer in a private road at Queensbrook Place and
the installation of approximately 9,500 square yards of asphalt concrete overlay on Hall Drive
between Donald Drive and Moraga Way (Attachment 1). The sewer work is intended to reduce
flow to existing deteriorated easement sewers. The overlay work is part of a previous agreement
between the District and the City of Orinda to repair the roadway, which was damaged during
construction of the Hall Drive Sewer Improvement Project, Phase 1.
On August 15, 1991, the Board authorized the award of a $246,351 contract to Ranger Pipelines,
Inc., to construct the project. Notice to Proceed was issued on September 16, 1991. The
contract completion date was November 15, 1991. The contract work was substantially
completed on November 12, 1991. The remaining work consists of punch list items which do not
affect the project acceptance.
The total authorized budget for the project, including the cost of engineering design, consultant
services, District forces, testing services, etc., is $383,000. A detailed accounting of the project
cost will be provided to the Board at the time of project closeout. It is appropriate to accept the
contract work at this time.
RECOMMENDATION: Accept the contract work for construction of the Hall Drive Sewer
Improvement Project, Phase 2A (D.P. 24331) and authorize the filing of the Notice of Completion.

Improvements Project (D.P. 4615A) and the work is now ready for acceptance.
BACKGROUND: The Country Gardens/Third Avenue Sewer Improvements Project is the first
phase of a series of projects to replace deteriorated portions of the existing sewer system. Phase
I includes construction of approximately 15,000 lineal feet of 8-inch to 24-inch diameter sanitary
sewers in public streets. The location of the project is shown on Attachment 1.
On January 3, 1991, the Board authorized the award of a $2,040,790 contract to Ranger'
Pipelines, Inc., to construct the project. Notice to Proceed was issued on February 19, 1991.
The contract completion date was November 8, 1991. The contract work was substantially
completed on October 25, 1991, and the new sewers were under full operation as of that date.
The remaining work consists of punch list items which do not affect the project acceptance.
The total authorized budget for the project, including the cost of engineering design, consultant
services, District forces, testing services, etc., is $3,361,600. A detailed accounting of the
project cost will be provided to the Board at the time of project closeout. It is appropriate to
accept the contract work at this time.
RECOMMENDATION: Accept the contract work for construction of the Country Gardens/Third
Avenue Sewer Improvements Project (D.P. 4615A) and authorize the filing of the Notice of
Completion.

(D.P. 4539) and the work is now ready for acceptance.
BACKGROUND: The Arlene Drive Sewer Improvement Project consists of replacing approximately
3,200 feet of existing 6- and 8-inch sewer mains in Arlene Drive between Newell Avenue and
Orchard Lane in Walnut Creek. The sewers had insufficient capacity under wet weather
conditions and have had numerous maintenance problems. Attachment 1 shows the location of
the project.
On March 21, 1 991 , the Board authorized the award of a $ 531 ,21 8 contract to Fee Construction,
Inc. to construct the project. Notice to Proceed was issued on May 13, 1991. The contract
completion date was November 1, 1991. The contract work was substantially completed on
October 25, 1991, and the new sewers were under full operation as of that date. The remaining
work consists of punch list items which do not affect the project acceptance.
The total authorized budget for the project, including the cost of engineering design, consultant
services, District forces, testing services, etc., is $1,069,400. A detailed accounting of the
project cost will be provided to the Board at the time of project closeout. It is appropriate to
accept the contract work at this time.
RECOMMENDATION: Accept the contract work for construction of the Arlene Drive Sewer
Improvement Project (D.P. 4539) and authorize the filing of the Notice of Completion.

ISSUE: The Board of Directors must conduct a public hearing to establish equalization charges.
BACKGROUND: Local Improvement District (LID) No. 54 included four separate areas identified
as Schedule Nos. 1, 2, 3, and 4. A breakdown of these schedules follows:

Most of the original properties were as~igned one unit of assessment. Some of the original
properties were assigned more than one unit of assessment because the zoning at that time
permitted more than one building site on these properties.
One of the original parcels in LID 54, Schedule 2, is being subdivided into two parcels. Each of
the two parcels will have direct access to the public sewer main which was installed in
conjunction with LID 54. Staff proposes that one of the parcels be assigned the original, full
assessment which will be paid yearly through tax collections; the other parcel will be required
to pay an equalization charge. The assigning of the original assessment is the subject of a
separate position paper in this agenda.
Equalization charges are intended to equalize the investment in, and fairly and equitably distribute
the cost of capital improvements among all properties which benefit from the improvements.
The equalization charge, after it is collected, will be distributed equally to the current assessment
district participants to reduce their assessments. Equalization charges will be established for
each of the four schedules of LID 54. The charges will include the original assessment amount
plus an interest component equivalent to the average yearly interest over the bond term.

Staff has calculated equalization charges for all 20 years of the assessment district's four
schedules. These charges appear on Attachment Nos. 1 through 4. Equalization charges will
be collected during the term of the assessment district bonds and only at the time of connection
of structures to the public main. When the assessment district bonds mature, equalization
charges will not be collected for any connection to the LID sewer. Staff proposes adoption of
the schedule of equalization charges now.
Section 6.16.020 of the District Code provides for the Board establishing equalization charges
after conducting a properly noticed public hearing. The Notice of Public Hearing was published
in the Contra Costa Times on November 22 and 27, 1991. It is appropriate to conduct a public
hearing to establish equalization charges for LID 54.
RECOMMENDATION: Establish equalization charges for LID 54, Schedule Nos. 1 through 4, in
accordance with the amounts shown in Attachment No.1.

ISSUE: The Contra Costa County Auditor's office has requested this District to apportion the
bond which is outstanding on a parcel of land in Local Improvement District (LID) 54-1.
BACKGROUND: The original parcel in LID 54-1 was assigned Assessment No. 54-1-3-21 and
has recently been split into two parcels. The new parcels are shown on the attached amended
assessment diagram and are assigned Assessment Nos. 54-1-3-27 and 54-1-3-28. In
accordance with Section 8730 of the Streets and Highways Code, the District is required to
apportion the LID bond amount on the original parcel to the newly created parcels. The County
Auditor can then prepare a tax bill for each new parcel.
The original parcel of land was assessed as one unit. Since the original parcel has been split into
two new parcels, one of the new parcels can receive one unit of assessment and the remaining
parcel can receive a $0.00 assessment as requested by the owner.
It is intended the zero assessment parcel will be assessed an "equalization fee" upon connection
to the public sewer. This fee will be deposited in the Assessment District Improvement Fund,
thereby ensuring that all connectors to the assessment District sewer pay their fair share of the
public sewer cost.

equalization fee established at the hearing earlier in this agenda will be applied to the parcel with

amounts and authorize the recording of said diagram.

ISSUE: On November 26, 1991, sealed bids were received and publicly opened for the
purchase of one sewage pump, motor, variable-frequency drive (speed controller), and services
for the Orinda/Moraga Pumping Station Improvements-Near Term, District Project No. 4667.
The Board must authorize award of the purchase order or reject bids within 45 days of the
opening date.
BACKGROUND: In 1989, the District completed a Pumping Station Master Plan which
identified the need to rehabilitate the Orinda and Moraga Pumping Stations to meet long-term
operating goals. In March 1991, the predesign of phased improvements was completed. The
predesign identified a near term project to improve efficiency, safety, and dry weather
reliability at the Orinda/Moraga Pumping Stations.
The design of the near term project is scheduled to be completed in January 1992 with the
construction starting in March 1992. Because of a long delivery time (up to 20 weeks), staff
recommends that the sewage pump with motor and variable-frequency drive (VFD) be
prepurchased. The bid specifications include one specified brand item, which is the VFD
manufactured by Emerson Electric Company. The District operates three identical size VFD's
in its treatment plant and has had reliable performances from such VFD's. The requirement
that the VFD be purchased from Emerson is in accordance with Section 3400 of the Public
Contracts Code and will provide for standardization of the VFD equipment, improve the
efficiency of maintenance and operation, and reduce inventory of spare parts. The District
staff has negotiated a price for the VFD directly with Emerson and included the firm quote for
the VFD in the bid request. Thus, all submitted bids will contain the same price for the VFD.
The bid request was advertised on November 14 and 19, 1991. One bid was received at
$53,042.50 on November 26, 1991. A bid tabulation is presented in Attachment 1. The
engineer's pre bid estimate was $70,000. The construction cost for the Orinda/Moraga
Pumping Stations Improvements-Near Term, including this equipment purchase, is estimated
to be $600,000. The Orinda/Moraga Pumping Stations Improvements-Near Term is included
in the 1991-92 Capital Improvement Budget beginning on page CS-74.

The Engineering and Purchasing staff have conducted a technical and commercial evaluation
of the bids and concluded that the lowest responsible bidder is Shape Inc. with a bid price of
$53,042.50.
Staff has determined that this project is exempt from the California Environmental Quality Act
(CEQA) under District CEOA Guidelines Section 18.2 since it involves minor alternations to an
existing sewer facility with negligible or no expansion of capacity. Board of Directors' approval
of this project will constitute a finding of an agreement with this determination unless
otherwise indicated.
RECOMMENDATION: Authorize award of the purchase order to Shape Inc., the lowest
responsible bidder, in the amount of $53,042.50 for furnishing the sewage pump, motor, VFD
and services.
