Engineering Department/Planning Division ISSUE: In accordance with the California Environmental Quality Act (CEQA) and the District CEQA Guidelines, the Final EIR for the proposed Pleasant Hill Sewer Overflow Protection Project must be certified as being legally adequate before the Board of Directors can consider approval of the project. BACKGROUND: The District proposes to obtain right of way and construct a new relief interceptor sewer parallel to the existing Contra Costa Boulevard interceptor. The proposed Pleasant Hill Relief interceptor, to be constructed between the years 1 993 and 1997, would extend approximately six miles through Pleasant Hill and Pacheco to the District's wastewater treatment plant. The purpose of constructing this interceptor is to minimize the potential for sewer overflows in Pleasant Hill and Pacheco during wet weather events. Certification of Final EIR As part of the planning process for any new facility which may have a significant environmental impact, the District must prepare an EIR that conforms to guidelines established by the District pursuant to CEQA. Before approving a project, the Board of Directors must first certify that the EIR is legally adequate. The Final EIR for the project consists of two documents: the Draft EIR dated March 1991, and the Final EIR Response to Comments Addendum dated July 1991. Both documents were prepared by Environmental Science Associates based on CEQA and District EIR guidelines. Although the Final EIR addressed both the Pleasant Hill and A-Line relief interceptors, this action deals only with the Pleasant Hill project. The Draft EIR was distributed to state and local government agencies that might be affected by the project. Draft EIRs were also sent to individuals and to community and special interest groups that expressed an interest in the project. Summaries of the EIR were distributed to individuals who were active in the public participation portion of the project planning process. A public hearing to receive comments was held in Pleasant Hill on May 13, 1991. A transcript was made of the hearing and is included in the Final EIR. Written comments were received from 22 agencies, groups, businesses, or citizens during the comment period for the Draft EIR. These comments, along with responses, appear in the Final EIR. Following the hearing, it is requested that the Board consider certification of the Final EIR. A resolution of certification is attached for the Board's review (Attachment 1). Leavitt, Planning Assistant Engineering Department, Planning Division ISSUE: In accordance with the California Environmental Quality Act (CEQA) and the District Code, it is appropriate for the Board of Directors to approve the project and adopt Conditions of Approval, Findings of Fact, a Statement of Overriding Considerations, and a Mitigation Monitoring and Reporting Program for the Pleasant Hill Sewer Overflow Protection Project. BACKGROUND: The District proposes to obtain right of way and construct a new relief interceptor sewer parallel to the existing Contra Costa Boulevard interceptor. The proposed Pleasant Hill Relief Interceptor, to be construction between the years 1993 and 1997, would extend approximately six miles through Pleasant Hill and Pacheco to the District's wastewater treatment plant. The purpose of constructing this interceptor is to minimize the potential for sewer overflows in Pleasant Hill and Pacheco during wet weather events. Route Selection The EIR for this project addresses in thorough detail the environmental impacts of constructing the proposed Pleasant Hill relief interceptor along anyone of 18 route segments. It has been the intention of the District to eventually narrow these 1 8 segments down to one continuous pipeline route based on the results of the EIR analysis, public participation process, right-of-way negotiations, and further design work. At this time District staff recommends that the Board remove from consideration the following route segments as identified in the EIR: 8, 9, 10, 11, 16, and 19B. These routes are being eliminated from further consideration because each has worse environmental impacts, less public support, and less favorable constructability factors than its competing, alternative route(s). District staff further recommends proceeding with right-of-way negotiations and additional design work before eliminating any of the remaining alternative route segments (14 vs. 13 and 15; 17 vs. 18). Prior to District Board consideration of the final pipeline route, District staff will examine the final, preferred route for conformance with the EIR analysis, and the public will be notified of the proposed preferred route. A resolution approving the project is attached for the Board's consideration (Attachment 1). Recommended Conditions of Approval, Findings of Fact, a Statement of Overriding Considerations, and a draft Mitigation Monitoring and Reporting Program have been prepared for Board review (Attachments 2, 3, and 4). Project letters received from the public since distribution of the Final EIR are presented in Attachment 5.
