ISSUE: Easements must be accepted by the Board of Directors.
BACKGROUND: The Contra Costa County Public Facilities Corporation (Corporation) is a non-
profit public corporation established in 1981 to provide financial assistance to Contra Costa
County by financing the acquisition, construction, improvement and remodeling of public
buildings and facilities. The Corporation owns the land in Danville where the Hap McGee Park
is located. An equestrian/pedestrian bridge has been installed across San Ramon Creek on the
west side of the park. The District's original sewer main which crossed the creek at this
location has been relocated as a part of the installation of the bridge and is now suspended
under the bridge.
A new easement for the relocated sewer has been prepared for the District's approval. The
terms and conditions of the new easement, which have been modified at the request of District
staff, are relatively standard in easements currently granted by public entities. The easement
grants typical access rights for District operations, and requires that the District indemnify the
Corporation for damages resulting from the District's negligence or willful misconduct in the
use of the easement. An encroachment permit with reasonable conditions must be issued prior
to the District's construction or installation in the easement area; however, such an occurrence
appears unlikely, since the sewer is in place.
This project (the proposed easement) has been evaluated by staff and determined to be exempt
from the California Environmental Quality Act (CEOA) under District CEOA Guidelines Section
18.6, since it involves a minor alteration in land use limitations.
RECOMMENDATION: Approve and execute Grant of Easement from Contra Costa County
Public Facilities Corporation, Job No. 4943, Parcel 1, and authorize the Grant of Easement to
be recorded.

ISSUE: The property owners have requested the District's approval to allow the
encroachment of a portion of a concrete pool patio over a District easement.
BACKGROUND: The work proposed in the easement area is part of a comprehensive
relandscaping project of the owners' property. The pool deck will be made of reinforced
concrete covered with decorative stepping stones.
Staff has determined that the improvements will not interfere with the present use of our
sewer. If a need arises to excavate and repair this sewer, the agreement requires the
property owners to remove the subject improvements. The agreement limits what may
be installed by the owners in the easement in the future. The property owners accept the
liability for damages to District's facilities caused by their improvements and for additional
costs to the District for maintenance and replacement of the sewer in the area of the
encroachment. The property owners hold the District free from all claims and liability for
injury to persons or to their property caused by District operations within the easement
area. The property owners agree not to impede the District's access to the property. The
agreement provides for the District's emergency access. The Grodins have paid our fee
for processing the subject agreement.
This project (the proposed agreement) has been evaluated by staff and determined to be
exempt from the California Environment Quality Act (CEQA) under District CEQA
Guidelines Section 18.6, since it involves a minor alteration in land use limitations.
RECOMMENDATION: Approve the Agreement Relating to Real Property with Marshall
Grodin, et ux, Job No. 3299 and authorize the President of the Board of Directors and the
Secretary of the District to execute said agreement, and authorize the agreement to be
recorded.

ISSUE: Approval by the Board of Directors is required for travel outside of California or if the
expense will exceed $500.
BACKGROUND: Lynne B. Putnam, Senior Engineer in the Planning Division, has been invited
by the Water Environment Federation's (WEF) Research Foundation (WERF) to present the
POTW perspective on ultraviolet (UV) disinfection research recently undertaken by WERF. The
WERF seminar will be held as part of the WEF Annual Conference to be held in Chicago on
October 15-19, 1994. Lynne was Project Manager of the District's Disinfection Facilities Plan
and subsequent UV Disinfection Pilot Study. She is a member of the WEF Disinfection
Committee, a co-chair of the Disinfection Specialty Conference, and has participated in the
WERF sponsored workshops on UV disinfection.
The UV Disinfection Project design is currently at 85 percent complete. Attendance at the
WERF seminar, the Disinfection Committee meeting, and other technical sessions will enable
Lynne to obtain the most recent information regarding UV disinfection which could be included
in the final design and construction of the project. Since participation in this conference was
not anticipated at the time the training budget was completed, staff requests permission to
overexpend the Planning Division's account by the amount of this authorization.
RECOMMENDATIONS: Authorize the attendance of Lynne B. Putnam, Senior Engineer for the
Planning Division, at the October 15- 19, 1994, WEF annual conference in Chicago, at a cost
of $1,350.

ISSUE: District staff has identified 75 commercial parcels that had underbilled Sewer Service
Charges for fiscal years 1991-92, 1992-93, and 1993-94.
BACKGROUND: The ongoing review effort by District staff to update the District's Sewer
Service Charge records has identified 75 commercial parcels that were underbilled for one or
more of the fiscal years 1991-92, 1992-93, and 1993-94. The total underbilled amount is
$415,600. The underbilled amounts range from a minimum of $259.56 per customer to a
maximum of $64,107.33, with 11 of the largest accounts making up $211,128.15 or 51
percent. The underbillings were primarily the result of incorrect water consumption data
received on a computer tape from one of the water utility districts. The water utility district
has corrected the computer error and provided corrected consumption data for the three years.
District staff used the corrected consumption data to recalculate Sewer Service Charges for the
affected accounts resulting in the following underbilled accounts:

$153,100 for 65 parcels
199,000 for 72 parcels
63,500 for 31 parcels
In October, 1992 District staff informed the Board about 50 commercial accounts with unbilled
Sewer Service Charges. At that time, the Board directed staff to collect all prior years' charges
allowed by law and to allow the customers to pay over three years if they so chose.
On the basis of the previous action, staff has prepared a draft letter to the owners of the 75
parcels explaining the situation. The draft letter informs them of the amount due the District,
indicating the additional charge will be added to the 1994-95 Sewer Service Charge to be
collected on the property tax bill, and offering the option to spread the payments on amounts
due over four years, due to the magnitude of several of the accounts.
RECOMMENDATION: Approve the collection of past underbilled Sewer Service Charges for
fiscal years 1991-92, 1992-93, and 1993-94 and provide direction to staff on the draft letter
to affected owners.

NOTIFICATION OF UNDERBILLED SEWER SERVICE CHARGE FOR PARCEL 4 -, 5-
Central Contra Costa Sanitary District relies on the water utility districts to provide water
consumption data for the calculation of our Sewer Service Charge. The District has
recently learned that the water consumption information provided by your water supplier
was incorrect. This resulted in an underbilling (under-assessment on the county property
tax bill) for Sewer Service Charges on the above referenced property as follows:

The District is providing you with the option of paying these amounts over time.
Accordingly, the District is willing to accept annual payments of one-fourth (1/4) of the
amount due for each of the next four years with no imposition of penalties or interest on
the unpaid balance.
Since the District collects Sewer Service Charges on the County's annual property tax bill,
if you agree to the above payment plan option, one-fourth (1/4) of the above amount due
will be added to the Sewer Service Charge on each of your next four annual property tax
bills.

However, if you prefer, you can request that the total amount due above be charged as
part of your 1994-1995 property taxes and will be set forth in a corrected tax bill. The
District, in addition, reserves all rights to collect these amounts in any other manner
authorized by law.
Since under the single payment or four payment option, the amounts are collected as part
of the property tax bill, such amounts will constitute a lien against the lot or parcel of land
described above if not paid within the time specified in the Notice of Tax Bill or Notice of
Corrected Tax Bill.
Enclosed, is an agreement setting forth the above installment payment option. If the
agreement is acceptable to you and you wish to pay the amounts in installments, please
sign and return the agreement to the District by . If the agreement is not
received by this due date, the entire amount will be added to your 1994-1995 property
taxes as described above. Please note that the enclosed agreement needs to be signed
before a Notary Public by all owners of record of the property. This is necessary in order
to record the agreement and collect the above amounts in four equal annual payments.
A copy of the completed agreement will be returned for your records.

AGREEMENT FOR INSTALLMENT PAYMENTS
The undersigned, as owners ("Owner") of the property ("Property") described below and
CENTRAL CONTRA COSTA SANITARY DISTRICT ("CCCSD") agree that 6- is currently
due CCCSD for under-assessment for sewer service charges concerning the Property.
The Property is described as follows: Assessor's Parcel Number 7-
The charges involved cover under-assessments for any or all of the fiscal years 1991-92
through 1993-94.
CCCSD is willing to accept, and owner desires to pay these amounts in four (4) equal
annual installments, said amounts to be added to the Sewer Service Charge on the annual
property tax bills over the next four (4) years.
If the annual amounts are not paid when due with each annual property tax bill, CCCSD
may submit a request for Corrected Property Tax Bill to the Tax Assessor for the total
amount due, and Owner agrees not to contest said procedure.
The undersigned, as Owner, agrees to comply with the terms set forth herein.
