Engineering Department Infrastructure Division ISSUE: The property owner, John R. Tatum has requested that the District allow the encroachment of a portion of his existing garage and a roof overhang of a new home addition over a District sewer easement. BACKGROUND: The District's sewer easement was created in 1959. The 6-inch diameter vitrified clay pipe within the sewer easement was constructed many years earlier as a part of the Diablo Public Utilities District. The encroachment of the garage over the easement has existed for some time. The origin of the encroachment is unknown, but could predate the District's easement. The encroachment of the garage was first recognized when the owner's contractor brought plans of the new home addition to the District for review as a part of the building permit process. The rerouting of the existing sewer around the garage was evaluated and found to be impractical due to the closeness of the existing home and the existence of mature trees. The foundation of the new addition will be outside of the existing sewer easement. The roof eaves of the new addition will overhang the existing easement by approximately 3 feet. District staff has televised the existing sewer and has determined that it is in satisfactory condition in the area of the existing garage and proposed roof eaves. Staff has determined that the garage and eaves will not interfere with the present use of our sewer. Mr. Tatum has cooperated with the District and has executed an agreement which has been modified to include the right of the District to use a "no-dig" type of technology including a pipe bursting technique if the sewer needs to be renovated in the future. The agreement limits what may be installed in the easement in the future. The property owner accepts the liability for any damages to the District's facilities related to the encroachment and for additional costs to the District for maintenance, renovation, and/or replacement of the sewer in the area of the encroachment. The property owner also holds the District free from all claims and liability for injury to persons or to their property related to the encroachment. The property owner agrees not to impede the District's access to the property. The agreement provides for the District's emergency access. This project (the proposed agreement) has been evaluated by staff and determined to be exempt from the California Environmental Quality Act (CEOA) under District CEOA Guidelines Section 18.6, since it involves a minor alteration in land use limitations. DATE September 7, 1993 TYPE OF Ae~ CONTRACT WORK SUBJECT ISSUE: Construction has been completed on the Overlook Drive Sewer Replacement Project, DP 4871, in Walnut Creek, and the work is now ready for acceptance. BACKGROUND: The District was notified by the City of Walnut Creek in January 1992 that Overlook Drive was to be reconstructed due to ground failures. Since the existing sewer was in marginal condition and the road reconstruction work would jeopardize the pipe, the Board of Directors approved the City's offer on April 2, 1992 to replace the sewer in conjunction with the City's work. However, the City's project was later delayed due to funding and the City requested the sewer work be removed from its project because of lack of funding and staff to comply with the Joint Project Agreement. The District subsequently prepared the plans and specifications and bid the project independently so that the new sewer will clear the future road work by the City. The project consisted of replacing approximately 1 ,300 feet of 8-inch main line sewer pipe with 2 new manholes and reconnecting 11 existing house laterals. See Attachment 1 for project location. On May 20, 1993, the Board of Directors authorized the award of a contract for construction of the project to Rand E Construction Company, Inc., of Walnut Creek. The Notice to Proceed was issued on June 17, 1 993, with a specified completion date of August 1, 1 993. The contract completion date has been revised by change order to August 15, 1993, further time extensions are pending. The contract work was substantially completed on September 2, 1993. The remaining work consists of minor punch items which do not affect the project acceptance. The total authorized budget for the project including the cost of engineering design, District forces, and the contract work is $155,000. A detailed accounting of the project costs will be provided to the Board at the time of project close out. It is appropriate to accept the contract work at this time. RECOMMENDATION: Accept the contract work for the construction of the Overlook Drive Sewer Replacement Project, DP 4871, in Walnut Creek, and authorize the filing of the Notice of Completion. ~ '1'/ fif;5 REVIEWED AND RECOMMENDED FOR BOARD ACTION INITIATING DEPT.lDIV 1302A-9/85 TAT HT JSM RAB _.._____""_. .__,___.__...__._.____..___~_._..._____~__~__..._'_~_~ .__.._._.,"_'..., ,,___._...._.M__..___._._.._____M_.__ _____.-.-..n...._.._,_._, ) \ PROJECT LOCATION Central Contra Costa Sanitary District ~ OVERLOOK DRIVE EXHIBI SEWER REPLACEMENT " A" 2523-1/5 - Central Contra Costa Sanitary District BOARD OF DIRECTORS PAGE 1 OF 3 NO. DATE ADOPT A RESOLUTION ESTABLISHING THE 1993-1994 APPROPRIATIONS LIMIT IN ACCORDANCE WITH ARTICLE XIII B OF THE CALIFORNIA CONSTITUTION Au ust 20 1 993 TYPE OF ACTION ADOPT APPROPRIATIONS LIMIT SUBMITTED BY INITIATING DEPT./DIV. Debbie Ratcliff, Controller Administrative/Finance & Accounting ISSUE: The Central Contra Costa Sanitary District is required to establish its appropriations limit in accordance with Article XIII B of the California Constitution. BACKGROUND: On August 19, 1993, the Board of Directors authorized posting a public notice of the availability of documentation in support of the District's appropriations limit. As statutorily required, the public notice was made at least 15 days prior to the September 16, 1993 Board Meeting at which the adoption of the appropriations limit is recommended. Formerly, the appropriations limit was increased annually by a factor comprised of the change in population combined with either the change in California per capita personal income or the Consumer Price Index, whichever was lower. As amended by Proposition 111 in 1990, the Consumer Price Index was replaced by the percentage change in the local assessment roll from the preceding year due to local nonresidential construction. The Board is to select between the per capita personal income, or the change in the local assessment roll due to local nonresidential construction, by a recorded vote. Last year the Board selected the change in the local assessment roll, which was the larger of the two percentages, for the calculation of the 1992- 1993 appropriations limit. This approach allowed for a larger limit on the District's proceeds of taxes. The County Assessor has determined the nonresidential construction index for 1993-1994 to be 10.1 percent. The California per capita personal income percentage change is 2.72. The change in the local assessment roll of 10.1 percent is being used in the calculation of the 1993- 1994 appropriations limit, to allow for a larger limit on the District's proceeds of taxes. The computation of the 1993-1994 appropriations limit by application of the California per capita personal income and population percentage change factors to the 1986-1987 appropriations limit adjusted from that year forward to 1990-1991, and the nonresidential construction index for 1991-1992 through 1993-1994, was provided at the August 19, 1993 Board Meeting. The Sewer Construction Fund (Capital Fund) appropriations limit so computed is $16,366,166 for the 1993-1994 fiscal year. :/'0 / ~/~-c RE~EWEDANDRECOMMENDEDFORBOARDAcnON PM SUBJECT ADOPT A RESOLUTION ESTABLISHING THE 1993-1994 APPROPRIATIONS LIMIT IN ACCORDANCE WITH ARTICLE XIII B OF THE CALIFORNIA CONSTITUTION PAGE 2 DATE OF 3 August 20, 1993 RECOMMENDATION: Adopt a resolution establishing the Sewer Construction Fund appropriations limit in the amount of $16,366,166 for the 1993-1994 fiscal year, in accordance with Article XIII B of the California Constitution; select the change in the local assessment roll due to local nonresidential construction, for use in computing the appropriations limit. 13028-7/91 RESOLUTION NO. 93- A RESOLUTION ESTABLISHING THE APPROPRIATIONS LIMIT FOR FISCAL YEAR 1993-1994 WHEREAS, the Central Contra Costa Sanitary District is required under Article XIII B of the State of California Constitution to establish and adopt an Appropriations Limit for each fiscal year; and WHEREAS, the District has determined the Appropriations Limit of its Sewer Construction Fund (Capital Fund) for fiscal year 1993-1994 to be $16,366,166; and WHEREAS, the selection of the alternative growth factor between the per capita personal income or the change in the local assessment roll due to local nonresidential construction must be made by recorded vote; NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the Central Contra Costa Sanitary District does hereby adopt the Appropriations Limit for said Fund in the amount of $16,366,166 for the fiscal year ending June 30, 1994, based upon the selection of the change in the local assessment roll due to local nonresidential construction. DATE SUBJECT ADOPT A RESOLUTION AMENDING EXHIBIT A, DESIGNATED POSITIONS AND DISCLOSURE CATEGORIES OF THE DISTRICT CONFLICT OF INTEREST CODE S ADOPT RESOLUTION AMENDING CONRJCT OF INTEREST CODE SUBMITTED BY Joyce E. Murphy Secretary of the District INITIATING DEPT./DIV. Administrative ISSUE: A need exists to update the designated positions contained in Exhibit A of the District's Conflict of Interest Code. BACKGROUND: The Political Reform Act of 1974 and the Central Contra Costa Sanitary District Conflict of Interest Code require that the Board of Directors adopt a list of designated positions of officers and employees who make, or participate in making, decisions that could have a material effect on any personal financial interest. It has been the practice of the District to review the designated positions on an annual basis and to amend the District Conflict of Interest Code as necessitated by any changed circumstances, including the creation of new positions and relevant changes in the duties assigned to existing positions. Exhibit A, Designated Positions and Disclosure Categories of the District Conflict of Interest Code, was reviewed by staff and an amendment is proposed to reflect the current organizational structure of the District. It is recommended that the positions of Collection System Superintendent, Contract Administrator, Senior Accountant/Internal Auditor, Source Control Specialist, Survey Supervisor, and Wastewater Control Technician be deleted and that the newly created positions of Controller, land Surveyor, and Senior Source Control Inspector be added to the list of designated positions. After approval by the Board, the proposed amendment to Exhibit A of the District Conflict of Interest Code must then be submitted to the Board of Supervisors, the code reviewing body. The amendment takes effect upon its approval by the Board of Supervisors. RECOMMENDATION: Adopt the attached resolution amending Exhibit A, Designated Positions and Disclosure Categories of the Central Contra Costa Sanitary District Conflict of Interest Code, and authorize the Secretary of the District to submit a copy of said code amendment to the Contra Costa County Board of Supervisors for approval. HEARINGS a. ~Teptember 13, 1993 SUBJECT CONDUCT PUBLIC HEARING AND CONSIDER APPROVAL OF A NEGATIVE DECLARATION AND THE RECYCLED WATER PIPELINE PROJECT, DP 20105 TYPE OF ACTION PUBLIC HEARING; NEG.DEC.AND PROJECT APPROVAL ISSUE: Board approval of appropriate CEQA documentation is required prior to approval of the Recycled Water Pipeline Project. BACKGROUND: The District proposes to construct a recycled water pipeline system from the recycled water pumps at the District's Wastewater Treatment Plant, in unincorporated Martinez, south to Oak Park Boulevard, Pleasant Hill, in north central Contra Costa County. A transmission pipeline up to 24-inches in diameter would extend approximately six miles through portions of the unincorporated Town of Pacheco and the City of Pleasant Hill. Service mains (6- to 8-inches in diameter) would be extended to recycled water customers, which may include golf courses, schools, parks, other public facilities, and homeowners associations. The proposed recycled water pipeline would be sized to allow for potential system expansion in the future. All but about 7,500 feet of the transmission pipeline would be constructed in the same trench as the Pleasant Hill Relief Interceptor project (Interceptor); therefore, CCCSD would coordinate construction of the proposed recycled water pipeline with that of the Interceptor. Construction of the proposed recycled water pipeline would be phased to coincide with the overall construction of the Interceptor, scheduled to begin in December 1993, and be completed by December 1998. The remainder of the transmission pipeline and all its service mains and laterals would be constructed in their own trenches, tunneled, or installed within an existing pipeline or duct. If approved, installation of the recycled water pipeline from the District's Wastewater Treatment Plant south to Chilpancingo Parkway in Pleasant Hill will be included in the first phase of the Interceptor project. Bids for the first phase are scheduled to be received on September 30, 1993. The basis for the comparison of bids and award of a construction contract will be the grand total of the bid prices of the Interceptor work and the 18-inch diameter recycled water pipeline work. There will be an alternate bid for upsizing the 18-inch diameter recycled water pipeline to 24 inches. The upsizing of the recycled water pipeline will be at the discretion of the District. OF 13 DATE September 13, 1993 The project also includes purchase of about 70,000 feet of a Shell Oil Company fuel pipeline which runs between Martinez and the Orinda/Moraga area and is no longer in use. Following lining and rehabilitation, the Shell pipeline could be used eventually as part of a potential expansion of the recycled water distribution system to enable up to 4,600 acre feet per year of recycled water to be distributed to potential customers in Concord, Lafayette, Martinez, Moraga, Orinda and Walnut Creek, in addition to the Pleasant Hill/Pacheco area. Lining, rehabilitation, and use of the Shell pipeline are not included as part of the current project. As Lead Agency, the District has conducted an Initial Study of the proposed project to determine if the project may have a significant effect on the environment. Staff has concluded that the Initial Study adequately, accurately, and objectively evaluates the environmental impacts of the proposed project, and that a Negative Declaration is the appropriate document to address the environmental effects of the project. The Initial Study is included as part of the proposed Negative Declaration which has been distributed separately to the District Board of Directors. The proposed Negative Declaration finds that there is no substantial evidence before the District that the project may have a significant effect on the environment and that no mitigation measures are needed other than those measures already incorporated into the project description. These measures are discussed in the proposed Negative Declaration. Staff also has concluded that Public Resources Code Section 21081.6 regarding a mitigation monitoring program is not applicable to this project since no changes or conditions of project approval are required to mitigate potentially significant effects. In compliance with the District's CEOA Guidelines, a legal notice was published in the Contra Costa Times, a newspaper of general circulation in the area affected by the proposed project. The legal notice announced the District's intent to adopt a Negative Declaration and the availability of the document for a 30-day public review period. Additionally, notice of the proposed Negative Declaration was mailed to approporiate regulatory agencies, affected cities, and other interested parties. Before the proposed project can be approved, the Board must consider any comments received during the 30-day public review process and the public hearing, then consider approval of the appropriate CEOA documentation (a Negative Declaration is recommended in this case). Exhibit A contains the comment letters received and the District staff's responses. Any other comment letter received will be submitted to the Board of Directors at the September 16, 1993 meeting. 1302B-7/91 ---"_.,~--"--_._-~_._-----_._~_._..~--_."_.,--------_._.-,-_....._"."'""--_...__."--,,--"~.._"_.,--"~-,.."._..~+--+._.,_.,"~.,,*_.._,.__.,,"-----,----~",._._-_....,~_._,,---~-,-,,'-----"---""---'--- SUBJECT POSITION PAPER CONDUCT PUBLIC HEARING AND CONSIDER APPROVAL OF A NEGATIVE DECLARATION AND THE RECYCLED WATER PIPELINE PROJECT, DP 20105 PAGE ~ DATE OF 13 September 13, 1993 If the proposed Negative Declaration and the project are approved, a Notice of Determination will be filed with the County Clerk. AUGUST 16. 1993 No comments on the Negative Declaration; supports the project. No response necessary. JOHN B. LAMPE. DIRECTOR OF WATER PLANNING. EAST BAY MUNICIPAL UTILITY DISTRICT (EBMUDl. SEPTEMBER 3. 1993 Future environmental documentation should discuss risks and potential impacts of making recycled water available in the watershed of EBMUD's terminal water supply reservoirs. Comment noted; this issue will be addressed in the future if service is proposed within the watershed area. Furthermore, District staff already has offered to assist EBMUD in developing a recycled water use policy. Encroachment on EBMUD rights of way will require obtaining an easement or license from EBMUD, especially near EBMUD's aqueducts. EBMUD encroachment approval will be sought as needed. Encroachment near the aqueducts (such as between Oak Park Boulevard and Astrid Drive) is not proposed at this time. EBMUD is the recycled water purveyor within its service area. The District hopes to work cooperatively with EBMUD in purveying recycled water for this project. To what extent will the proposed project provide recycled water for users in EBMUD's service area? Who are the potential users? A potential demand for at least 1,500 AFY was identified in the December 1992 study. The potential users include golf courses, parks, schools, and homeowners' association common areas. The proposed project is not included in EBMUD's projection of savings from reclamation described in EBMUD's December 1992 Water Supply Management Program Draft EIR. EBMUD will evaluate the proposed project in conjunction with implementation of the EIR's final water reclamation alternatives. Comment noted; however, this project could be substituted for the portions of EIR Alternatives A-2 to A-5 which call for a satellite reclamation facility in Orinda as a future source of recycled water east of the Oakland/Berkeley hills. The East Bay Municipal District (EBMUD) has the following comments. The "Shell oil pipeline" would make reclaimed water available for irrigation in the watersheds of EBMUD's terminal water supply reservoirs. The future environmental documentation that is proposed for system expansion to make this pipeline usable should discuss and evaluate the risks and potential impacts ~n watershed lands. EBMUD is developing a recycled water use policy, due for completion in 1994, which will affect future uses of reclaimed water in is service area. The proposed alignment may encroach on EBMUD's aqueducts, particularly in the area between Oak Park Boulevard and Astrid Drive. Although the Negative Declarat~on refers to agency coordination required with CCWD and EBMUD for impacts on pipelines, it was not clear that aqueducts are considered to be pipelines. Any encroachment will require obtaining an easement or license from EBMUD, which would spell out the EBMUD requirements for construction within its rights of way. The Negative Declaration states on Page~ 3 and 14 that" "EBMUD may be" a major purveyor of recycled w"ater, " and that" EBMUD "has the discretion to purvey" recycled water in its service area. Per section 12818 of the Municipal utility District Act, EBMUD is the recycled water purveyor within its service area, and the Negative Declaration should clearly state this. In order for EBMUD to purvey reclaimed water, issues regarding ownership and operation of facilities which would provide such reclaimed water must first be addressed. The Negative Declaration does not address the extent to which the proposed project will provide recycled water for uses in 375 ELEVENTH STREET. OAKLANO . CA 94607-4240 . /5101 835-3000 P.O. It refers, on Page 4, to potential uses of 2,600 AFY as defined in a December, 1992 feasibility study, Recycled Water for Landscaoe Irriqation, and ultimate uses of 4,600 AFY projected to occur within the CCWD and EBMUD service areas as defined in the February, 1992 Recycled Water Master 'Plan. However, it is not clear how much demand is proposed to be served by each jurisdiction. The Negative Declaration should generally identify the potential users who would be served by both the "recycled water pipeline" and the "Shell oil pipeline" portions of the proposed project. Text on Page 37 states that the proposed project is included in EBMUD's "8,000 AFY projected savings from reclamation", per the Draft EIR/EIS EBMUD Uodated Water SuoolY Manaqement Proqram dated December, 1992. EBMUD has targeted over 17,000 AFY as its future reclamation sayings goal. Approximately half of this will be from existing and adopted reclamation programs, and half from projects which were identified in the EIR. The proposed project was not included as a potential alternative in EBMUD's EIR. EBMUD plans to evaluate the proposed project in conjunction with implementation of the EIR's final water reclamation alternatives. Dear Mr. Leavitt: NEGATIVE DECLARATION FOR'THE PROPOSED RECYCLED WATER PIPELINE PROJECT FOR CENTRAL CONTRA COSTA SANITARY DISTRICT (SCH NO. 93081025) Thank you for the opportunity to review the above document. As we discussed over the telephone, the State Water Resources Control Board, Division of Clean Water Programs (State Water Board) is responsible for administering low interest loans for water reclamation projects. If Central Contra Costa Sanitary District will be seeking one of these loans for any part of the project covered by the subject Negative Declaration, the State Water Board will be a responsible agency under CEQA, and will use the final Negative Declaration when deciding whether to issue the loan. In addition to the final Negative Declaration, please provide us with (1) all comments received during the review period and your responses to those comments, (2) a mitigation implementation and monitoring plan, (3) the Notice of Determination (filed with the State Office of Planning and Research), and (4) the State Department of Fish and Game1s Environmental Filing Fee receipt or exemption finding. In addition, we would appreciate notice of any meeting scheduled for adoption of the final document. In addition, to meet requirements for loans from the State Revolving Fund Loan Program (SRF), we must consult directly with agencies responsible for implementing federal environmental laws. You have already circuiated the draft Negative Declaration to several of these agencies and, if the project remains unchanged, we will not have to duplicate submittal to these agencies if you provide us with copies of the certified mail receipts and if you have circulated it to all the required agencies. Please provide us with the certified mail receipts well before the time you want loan approval so that we can do any additional consultation that may be necessary without delaying your loan application. In addition, while CEQA itself does not require formal public hearings at any stage of the environmental review process, at least one hearing is required for a SRF loan project. Notices need to be distributed 30 days in advance with a copy sent to us. In order to do this we must obtain clearance from the State Historic Preservation Office. This process takes approximately 45 days once the required information is submitted to the State Water Board. Please contact our cultural resources officer, Mr. Joe Pope, for further information on these requirements. Our only comment on the Negative Declaration is that additional CEQA documentation will be required prior to environmental approval of loan funds for service mains and laterals. Specific locations for the service mains and laterals evidently Rave not been determined at this, time and"we must have the specifi'c ,locations before we can determine"whather' theie ,:night be a significant impact to the environment. . Also, would you please send us a copy of Figure 3 from the Negative Declaration? We cannot read the copy in the Negative Declaration. Please call me at (916) 227-4525 if you have any questions. BIDS AND AWARDS a. AUTHORIZE AWARD OF A CONSTRUCTION CONTRACT TO MOUNTAIN CASCADE FOR THE 1-680/SR-24 SEWER RELOCATIONS, PHASE IV-A DISTRICT, PROJECT NO. 4824 DATE Se tember 10 1993 TYPE OF ACTION SUBJECT AUTHORIZE AWARD/ ALLOCATE FUNDS SUBMITTED BY INITIATING DEPT.lDIV. Rey I. Limjoco, Assistant Engineer Engineering Dept.llnfrastructure Div. ISSUE: On September 1, 1993, sealed bids for the construction of District Project No. 4824, 1-680/SR-24 Sewer Relocations, Phase IV-A, were opened. The Board of Directors must authorize award of the contract or reject bids within 50 days of the opening of bids. BACKGROUND: Caltrans' next phase of its 1-680/SR-24 freeway widening and interchange modification consists of construction of a new Ygnacio Valley Road north bound off ramp along Oakland Boulevard and the replacement of the Oakvale Road - Trinity Avenue bridge in Walnut Creek (see Attachment 1). To accommodate this Caltrans project, a temporary 8-inch diameter sewer bypass approximately 308 feet long will be installed at the downstream end (east side) of the bridge to intercept the flow to the Trinity Avenue sewer from the tributary area west of the 1-680 freeway. The permanent sewer replacement will be suspended under the new bridge as part of this Caltrans project. In addition, four (4) new manholes will be constructed, the house plumbing for an existing apartment building on Lacassie Avenue will be rerouted, and some segments of existing sewers and manholes on Oakland Boulevard and adjoining areas will be abandoned. To make room for replumbing of the apartment building, Pacific Gas and Electric will relocate its gas and electric service at a cost of $8,153 to be done under a separate contract. The Caltrans 1-680/SR-24 Project has been broken into several phases with completion of the final phase scheduled for 1995/96. Additional sewer relocations will be required under future phases. As in previous relocations, the District will handle all aspects of the relocations with Caltrans reimbursing the District for the total project cost. On October 9, 1991, the District executed a utility agreement with Caltrans to receive reimbursement for costs associated with the planning, design, and construction of the Phase IV-A relocation affected by the freeway widening. The adjusted pre-bid estimate for construction is $80,000. This estimate was reduced from the Engineer's estimate of $100,000 to reflect the current favorable bidding climate. The project was advertised on August 11 and 18, 1993. Eight bids ranging from $58,585.00 to $123,184.00 were publicly opened on September 1, 1993. A summary of bids is presented in Attachment 2. The Engineering Department conducted a technical and commercial evaluation of bids and concluded that the lowest responsible bidder is Mountain Cascade. The 1-680/SR-24 Sewer Relocation, Phase IV-A is included in the 1993-94 CIS at Page CS-39. A post bid pre- construction estimate is presented in Attachment 3. An allocation of $97,000.00 from the Collection System Program is needed to complete the project. The current balance of the Sewer Construction Fund, minus unspent authorizations, plus projected dependable revenue will be adequate to fund this project. A funding summary is presented in Attachment 4. Staff has determined that this project is exempt from the California Environmental Quality Act (CEQA) under District CEOA Guidelines, Section 18.2, since it involves minor alterations to existing sewage facilities with negligible or no expansion of use. The Board of Director's approval of this project will constitute a finding of agreement with this determination unless otherwise indicated. RECOMMENDATION: Authorize award of a contract to Mountain Cascade, the lowest responsible bidder in the amount of $58,585.00 for the construction of the 1-680/SR-24 Sewer Relocations, Phase IV-A, District Project No. 4824. Authorize the General Manager-Chief Engineer to allocate $97,000.00 from the Collection System Program for the project. 13028-7/91 ~----,--~--_...-~._-------~".._.._---~-~ Q Walnut Cree OAKLAND BLVDJ LACASSIE AVE.
