Engineering Department ISSUE: The Board of Directors' approval is required for accepting Grants of Easements. BACKGROUND: The subject easement is required as part of the Los Arabis Drive Sewer Upgrade project located within the City of Lafayette. The sewers in the Los Arabis Drive project area require improvements as the result of capacity, operation and maintenance problems. The plans for this project include extending the existing sewer on Rancho Road westerly about 100 feet to Upper Happy Valley Road. Rancho Road is a private road and, therefore, an easement is required from the owner of the property underlying the private road. The owner has executed a Grant of Easement Deed and has been paid a nominal fee of $300 for granting the easement. In accordance with the California Environmental Quality Act (CEQA), a Notice of Exemption for the Los Arabis Drive Project has been filed with the Contra Costa County Clerk. RECOMMENDATION: Accept the Grant of Easement from Mr. Chester R. Bender and authorize staff to record said document with the Contra Costa County Recorder. Engineering Departmentl Plant Engineering Division ISSUE: Construction has been completed on the Filter Plant Rehabilitation Project, District Project No. 20095, and the work is now ready for acceptance. BACKGROUND: The contract work included the installation of new filter effluent piping with valves and meters, modifications of the backwash system, installation of filtered water bypass pipe, new alum polymer tank, application of protective coating on filter walls and troughs and placement of additional filter media. The work also included upgrading of the instrumentation and control system using new control panels, programmable logic controllers and an operator interface unit. See Attachment 1 for the location of the work completed under this project. Details of the project are also included on pages TP-106 to TP-108 of the 1993-94 Capital Improvement Budget. The construction contract was awarded to Auburn Constructors, Inc. of Sacramento, California, on September 16, 1992, by the District Board of Directors. The contractor was issued a Notice to Proceed on October 8, 1992. The contract completion date was July 9, 1993. The contract work was completed ahead of schedule, with the District taking beneficial use of the new facilities on June 23, 1993. It is appropriate to accept the contract work at this time. The total authorized budget for this project was $1,936,350. A detailed accounting of project costs will be provided to the Board at the time of project close out. RECOMMENDATION: Accept the contract work for the Filter Plant Rehabilitation Project, District Project No. 20095, and authorize the filing of the Notice of Completion. BACKGROUND: Harry E. Winston, Instrument Technician, has requested an emergency withdrawal from the Deferred Compensation Plan based on extreme financial hardship caused by a medical disability. The Deferred Compensation Plan Advisory Committee has reviewed the request and determined that it meets the requirements for emergency withdrawal in the amount of $10,000. RECOMMENDATION: Approve the request by Harry E. Debbie Ratcliff, Controller Administrative/Finance & Accounting ISSUE: The District Codes and State law require holding a Public Hearing for placing delinquent 1992-93 Sewer Service Charges on the 1993-94 County tax roll. BACKGROUND: As approved by the District's Board of Directors on May 20, 1993, collection letters were sent in June to owners of 760 residential parcels for the 1992-93 unbilled Sewer Service Charge. These letters stated that if the 1992-93 Sewer Service Charge was not paid by June 30, 1993, the charge plus interest at 6.5 percent and a ten percent processing fee would be collected on the 1993-94 County tax roll. As a result of the initial letters, 474 owners paid, and 27 owners are being rebilled due to incorrect addresses or changes in ownership, leaving. the 259 parcels listed in Exhibit "A" to the attached resolution with unpaid 1992-93 Sewer Service Charges. The delinquent property owners were notified of the July 15, 1 993 Public Hearing by Certified mail. RECOMMENDATION: Conduct a Public Hearing, consider any protest and, if appropriate, approve a resolution adopting the attached report pursuant to Section 5473, Health and Safety Code, for collection of delinquent Sewer Service Charges on the County tax roll. A RESOLUTION COLLECTING CERTAIN SEWER SERVICE CHARGE FEES FOR 1992-1993 ON THE TAX ROLLS AND ASSESSING PENAL TV WHEREAS, this Board, by resolution, elected to collect unbilled sewer service charges from parcels which had previously been connected to the District sewage system, but not assessed or billed over the past several years; and WHEREAS, by Resolution No. 93-041, adopted at the Board meeting of May 20, 1993, the Board elected to promptly collect these sewer service charges for the Fiscal year 1992- 1993; and WHEREAS, the Board finds that notice of the above charges and provision for payment within thirty (30) days was sent to the owners of each affected parcel; and WHEREAS, the Board herein has determined that the 1992-1993 Sewer Service Charges are delinquent and subject to penalty as provided by District Code if not paid within thirty (30) days; and WHEREAS, the owners whose parcels are listed in Exhibit" A" attached hereto have been notified of charges for 1992-1993 and billed previously therefore and are currently delinquent for said year; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District as follows: 1. A delinquent penalty, as authorized by Section 1.08.080 of the Central Contra Costa Sanitary District Code, of ten (10) percent of the Fiscal Year 1992-1993 Sewer Service Charge plus interest at the rate of 6.5 percent per annum from this date is assessed and added to each outstanding charge for the parcels listed in Exhibit" A" if not paid within the thirty (30) days specified in the above mentioned notice. 2. The Sewer Service Charge for those parcels listed in Exhibit" A", if not paid within the above mentioned thirty (30) days, plus penalties and interest are to be collected on the county tax roll. 3. The Board finds that less than a majority of the owners of the parcels listed in Exhibit "A" have objected to collection of these charges on the tax rolls, and that all objections have been considered and overruled. Engineering Departmentl Plant Engineering Division ISSUE: On June 30, 1993, sealed proposals were received and opened for construction of the Preaeration Odor Control Project, District Project No. 20108. The Board of Directors must authorize award of the contract or reject bids within 50 days of the bid opening. BACKGROUND: The Preaeration Odor Control Project, District Project No. 20108, will provide odor control for the preaeration tanks and flow distribution channels. The tanks and channels will be covered with flat aluminum covers and the foul air beneath the covers will be collected and conveyed to an odor scrubber for treatment. The project location is shown in Attachment I. This project was advertised on June 10 and 16, 1993. Eight (8) bids ranging from $850,000 to $1,164,125 were received and publicly opened on June 30, 1993. A summary of these bids is shown in Attachment II. The Plant Engineering Division conducted a technical and commercial review of the bids and determined that Monterey Mechanical Company is the lowest responsible bidder with an amount of $850,000. The engineer's estimate for the construction contract was $963,000. District staff will administer the construction contract and will provide resident engineering and inspection services. John Carollo Engineers (JCE) prepared the project drawings and technical specifications and has been selected to provide construction engineering services. These services include evaluation of contractor submittals and preparation of design clarifications. The allocation of funds required to complete the project, as shown in Attachment III, is $1,142,000. The current total estimated project cost is $1,343,000. The project is included in the 1993-94 Capital Improvement Budget (CIS) on pages TP-112 through TP-114. The current balance of the sewer construction fund, less unspent allocations, plus projected dependable revenue will be adequate to fund this project. A funding summary is presented in Attachment IV. The Board of Directors previously determined that the Preaeration Odor Control Project is exempt from the California Environmental Quality Act (CEQA) under District CEQA Guidelines, Section 18.2, since the project involves a minor alteration to an existing sewer facility with negligible or no expansion of capacity. Bonnie Allen, Risk Manager Administrative/Risk Management ISSUE: Robert Thompson has filed a claim for $84,000 alleging medical problems resulting from his water supply being contaminated by sewage. Claim denials require action by the Board of Directors. BACKGROUND: Mr. Thompson, at 5 Buena Vista, Orinda, claims sewage has leaked into his water supply line. He believes the water line may have been damaged when a sewer main was installed approximately six years ago. The District's collection system maintenance records give no indications that our sewer line has caused damage to or contamination of the water line. RECOMMENDATION: Deny the claim of Robert Thompson and refer to staff for further action as required. KLA
