Sullivan, Assistant Engineer Engineering Department, Planning Division ISSUE: The Board of Directors' approval is required to formally accept Grants of Easements and other right-of-way documents. BACKGROUND: The District has purchased approximately 1 5 miles of a 1 O-inch diameter steel pipeline and associated easements and rights-of-way from the Shell Pipe Line Corporation for one dollar ($1.00). The pipeline and associated easements and other rights-of-way are located between the intersection of Pleasant Hill Road and Highway 4 in Martinez and the Alameda/Contra Costa County line just west of Moraga (Exhibit 1). Staff is recommending that the District utilize the pipeline in the future as a recycled water transmission main. After obtaining authorization from the Board of Directors on April 7, 1994, District staff entered into a Purchase and Sale Agreement that states the terms and conditions of the District's purchase of the Shell pipeline. The Agreement allowed the District time to review all the right-of-way documents to the District's satisfaction. The Closing Date of the Agreement and signing of the Bill of Sale occurred on December 22, 1994. Upon closing, the District accepted the transfer and assignment of necessary right-of-way documents from Shell Pipe Line Corporation ( Exhibit 2). Four minor property issues involving property owners other than Shell remain, and are nearing finality. Due to existing easement language which was not in accordance with the District's standard easement agreement, District staff has negotiated a new easement with Pacific New Wave Development Company. RECOMMENDATIONS: Accept the transferral of easements and other right-of-way documents from Shell Pipe Line Corporation and Grant of Easement from Pacific New Wave Corporation; and authorize staff to record appropriate documents with the Contra Costa County Recorder. D I I:nglneenng epartment Planning Division ISSUE: Approval by the Board of Directors is required for unscheduled travel which exceeds $500. BACKGROUND: The Planning Division Manager has historically attended the California Association of Sanitation Agencies (C~SA) conferences. This is primarily due to the Planning Division's involvement with regulatory and legislative issues. CASA's technical committee meetings provide discussions on current issues affecting the District. The Planning Division Manager's position was vacant at the time of the 1994-95 O&M budget preparation; therefore, attendance at CASA meetings was not included in the training budget. Adequate funds, however, are available in the training budget for CASA attendance. These funds were previously designated for Doug Craig's training needs in the Plant Engineering Division. RECOMMENDATION: Authorize the attendance of Douglas J. Craig, Planning Division Manager, at the winter and spring 1995 CASA conferences. SUBJECT DATE December 22, 1994 DIRECT STAFF TO SECURE THE SERVICES OF AN ARBITRATOR IN ACCORDANCE WITH THE APPROPRIATE DISCIPLINARY APPEAL PROCEDURES TYPE OF ACTION PERSONNEL SUBMITTED BY INITIATING DEPT.IDIV. Paul Morsen, Deputy General Manager Administrative ISSUE: In accordance with the Memorandum of Understanding (M.O.U.) between the District and the Central Contra Costa Sanitary District Employees' Association, Public Employees' Union, Local No. One, the Board shall employ an arbitrator to render a recommendation when disciplinary actions are appealed to the Board level. BACKGROUND: Mr. David Rolley, Accounting Technician III, has appealed the discipline levied against him to the Board. Deputy General Manager Paul Morsen has recommended a three-day suspension without pay for Mr. David Rolley, Accounting Technician III for violation of the Memorandum of Understanding between the Central Contra Costa Sanitary District and the Employees' Association, Public Employees' Union, Local No.1, Article III, Section 3.1.B.1 Discourteous Treatment of the Public or Fellow Employee including Discrimination and Harassment that is Detrimental to the Function of the District; Section 3.1.B.7 Insubordination; Section 3.1.B.1 0 Failure to Perform Duties; and Section 3.1.B.11 Misconduct. In this instance, Mr. Rolley used the voice mail system to send an offensive message to various employees. Details of this matter have been provided to the Board previously. In matters that are appealed to the Board, the M.O.U. reads as follows: A. "An employee,...may appeal the Hearing Officer's decision by appealing to the Board via filing a written request for hearing with the Secretary of the District within ten (10) working days of receipt of the Hearing Officer's decision. The Secretary shall calendar the matter at the next regularly scheduled Board Meeting in keeping with established guidelines for calendaring an agenda item." B. "The Board shall employ a neutral third party to hear the appeal and to recommend action to the Board." C. "The Board may adopt, reject, or modify the recommendation of the Board-appointed neutral third party. The decision of the Board is the final action of the District." RECOMMENDATION: Authorize staff to secure the services of an arbitrator in accordance with the appeal procedures for suspension of employees in the matter of Accounting Technician 1\1 David Rolley.
