JSSUE: The owner of the property at 1076 Leland Drive, Lafayette, has requested this District to quitclaim
the subject easements.
BACKGROUND: One of the easements was created in 1946 when the map of Sun Valley Estates was filed;
the other easements were created in 1948 and 1970. The pipelines which were located within these
easements were relocated at the time Highway 24 was widened in the 1970's. The subject easements are
not needed for present or future District purposes; therefore, they may now be quitclaimed. The property
owner is granting a new easement to this District for a small portion of a public sewer that lies within an
area that is between the existing eastern right-of-way line of Leland Drive and the eastern line of the
abandoned portion of old Leland Drive. The District's quitclaim processing fee has been paid.
Staff has concluded that this project (the proposed quitclaim) is exempt from the California Environmental
Quality Act (CEQA) under District CECA Guidelines, Section 18.6, since it involves a minor alteration in land-
use limitations. Board of Directors' approval of this quitclaim will constitute an independent finding that this
project is exempt from CECA.
RECOMMENDATION: Approve Quitclaim Deed to Remedios Ferrer, Job No. 1374, Parcel 5, and Job
No. 1552, Parcels 76 and 84; authorize the President of the District Board of Directors and the Secretary
of the District to execute said Quitclaim Deed; and authorize the Quitclaim Deed to be recorded.

ISSUE: Authorization by the Board of Directors is required for emergency withdrawal of funds from the
Deferred Compensation Plan.
BACKGROUND: Richard Powell, Maintenance Crew Leader, has requested an emergency withdrawal from
the Deferred Compensation Plan based on extreme financial hardship. The Deferred Compensation Plan
Advisory Committee, with assistance from our labor attorneys, has reviewed the request and determined
that it meets the requirements for emergency withdrawal in the amount of $3,200, after taxes.
RECOMMENDATION: Approve the request by Richard Powell for an emergency withdrawal of $3,200, after
taxes, from the Deferred Compensation Plan, as recommended by the Deferred Compensation Plan Advisory
Committee.

ISSUE: On November 14, 1996, a sealed bid was received and opened for Fabrication and Installation of
Lightweight Roof Structure for Substation 73, D. P. 9523. The Board of Directors must authorize award of
contract or reject the bid within 60 days.
BACKGROUND: Substation 73D was constructed to provide circuit switching and protection for the Standby
Power and Cogeneration Systems. To ensure isolation of the feeders and to perform maintenance, it is
necessary to access the inside of this switch. To provide safe working conditions and access during all
weather conditions, it is necessary to install a roof structure over this area.
The Bid Request was sent to nine contractors and publicly advertised. There was one response received and
publicly opened on November 14, 1996, as follows:
NRA Construction Co., Inc.(NRA)
$28,463
Technical evaluation revealed that NRA took major material exceptions to the technical specifications and
therefore its bid should be considered non-responsive and therefore "no bid." Specifically, NRA submitted a
price proposal of $28,463 for an "alternate roof deck which would include skylights," which was not as
specified. NRA included two other options which identified materials costs only.
POD engineering staff has informed NRA that its bid is considered by staff to be non-responsive because of
technical exceptions. Furthermore, NRA has been informed that they have a right to a variance hearing at the
Board meeting of December 5, 1996 to show cause as to why the Board should not declare its bid non-
responsive. NRA has verbally indicated that they will not challenge staff's recommendation to the Board to
declare its bid non-responsive.
Staff is requesting that the Board declare NRA's bid non-responsive. The California Public Contract Code,
Section 20805, allows the District to proceed with the project without further bidding when no bids are
received. Staff is requesting that the Board authorize staff to proceed with completion of the project by
negotiating directly with one or more suppliers/contractors. Staff believes it is in the best interest of the District
to negotiate a contract for completion of the project, because readvertising would not produce any advantage
and would be unavailing as affecting the final result, since no responsive bids were received.

Construction of the improvements to Substation 73 is included in the fiscal year 1996-97 Capital
Improvement Budget on pages TP-80 and 81. Staff has conducted a cash flow analysis of the Sewer
Construction Fund and concluded that adequate funds are available for this project.
Staff has concludeq that this project is exempt from the California Environmental Quality Act (CEOAl under
District CEOA Guidelines, Section 18.2, since it involves only minor alterations to an existing facility with
negligible or no expansion of capacity. Board of Directors' approval of this project will constitute an
independent finding that the project is exempt from CEOA.
RECOMMENDATION: Declare NRA's bid non-responsive and authorize staff to negotiate a contract for the
completion of the project.
