BACKGROUND: Kim Best and Don Cast are Construction Inspectors in the Private Developer Sewer Projects
Group of the Infrastructure Division. They are responsible for ensuring construction quality of the sewers
and related appurtenances installed by private developers throughout the District.
Attendance at the seminar, "Improving Construction Inspection Skills," sponsored by the University of
WISConsin and the University of Nevada, will provide Kim and Don with updated knowledge in construction
quality control and a variety of public works inspection techniques, including information on concrete,
underground inspection, and public relations. Funds are available for this seminar in the Infrastructure
Division's Technical Training, Conferences, and Meetings budget.
RECOMMENDAll0N: Authorize the attendance of Kim Best and Don Cast, Construction Inspectors, at the
December 3 through 4, 1996, seminar on "Improving Construction Inspection Skills" sponsored by the

COLLECTION SYSTEM OPERATIONS
ISSUE: Board approval is required for training where the cost will exceed $500 and the training is not listed
in the annual O&M Budget.
BACKGROUND: William Echols, Maintenance Supervisor is responsible for utility locating technology, and
Robert Brown, Maintenance Crew Leader is CSO's field locator. The Collection System Operations
Department is required by law to locate pressure lines prior to underground construction activities by outside
contractors. Mr. Brown also locates buried structures and District pipelines prior to repair by CCCSD
construction crews.
Attendance at the seminar will enable Mr. Echols and Mr. Brown an opportunity to learn the capabilities and
limitations of the technology used to locate and mark underground lines for excavators. They will also learn
about new advances in locating technology such as: global positioning, ground penetrating radar, new
regulations in locating in response to natural disasters, depth determination, training, and causes of
mislocations. The information gathered at this seminar will be beneficial to all of the field operations
construction section and staff.
The Locating Technology Seminar is sponsored by Underground Focus Magazine and California Polytechnic
University in San Luis Obispo. The expense for this training $650 per person. Funds are available in the
Collection System Operations overall budget, although there will be an overrun in the Technical Training and
Conference expense account for this activity.
RECOMMENDATION: Authorize the attendance of William Echols, Maintenance Supervisor and Robert
Brown, Maintenance Crew Leader, at the 1996 Locating Technology Seminar in San Luis Obispo, California,
November 14-15, 1996 at a cost of $1,300.

ISSUE: A need exists to update Exhibit A, Designated Positions and Disclosure Categories of the District's
Conflict of Interest Code.
BACKGROUND: The Political Reform Act of 1974 and the Central Contra Costa Sanitary District Conflict of
Interest Code require that the Board of Directors adopt a list of designated positions of officers and employees
who make, or participate in making, decisions that could have a material effect on any personal financial
interest. It has been the practice of the District to review the designated positions on an annual basis and to
amend the District Conflict of Interest Code as necessitated by any changed circumstances, including the
creation of new positions, deletion of positions, and relevant changes in the duties assigned to existing positions.
Exhibit A, Designated Positions and Disclosure Categories of the District Conflict of Interest Code, was reviewed
by staff and an amendment is proposed to reflect the current organizational structure of the District. It is
recommended that the newly created position of Pollution Prevention Program Superintendent be added to the
list of designated positions, and that the position of Operations Support Supervisor be deleted from the list of
designated positions. These changes reflect the current organizational structure of the District and the duties
assigned to each position. Amendment of the District's Conflict of Interest Code is also required to conform
to Regulation 18720 recently adopted by the Fair Political Practices Commission (FPPC). Regulation 18720
states that positions that meet the definition of "other public officials who manage public investments" are
covered under Section 89720 and are no longer considered designated positions for purposes of filing Form
730, Statement of Economic Interests, but instead must file Form 721. The FPPC has recommended that
Conflict of Interest Codes be amended to delete those positions, but that a footnote be added listing the
positions and indicating that they are required to file Statements of Economic Interests pursuant to Government
Code Section 87200. The positions of Director, General Manager-Chief Engineer, Deputy General Manager,
and Controller have been deleted from the list of designated positions and included in a separate section
following the list. In addition, a footnote was added to the "Consultant" designated position to indicate that
only those consultants who "act in a decision-making capacity" are required to file Statements of Economic
Interests. The phrase "act in a decision-making capacity" is language out of the law. From review of the
description of a consultant provided by the Fair Political Practices Commission, staff has interpreted this to mean
that consultants are those individuals empowered to make decisions that commit the agency for some future
obligation. This determination may be made on a case by case basis by the General Manager-Chief Engineer.

Finally, identification of disclosure categories has been changed from an alphabetic to a numeric designation
to avoid confusion with the Statement of Economic Interests schedules.
The above changes have been made and are reflected in Exhibit A, Designated Positions and Disclosure
Categories of the District Conflict of Interest Code, submitted for the Board's approval. After approval by
the Board, the proposed amendment to Exhibit A of the District Conflict of Interest Code will be submitted
to the Board of Supervisors, the code reviewing body. The amendment takes effect upon its approval by
the Board of Supervisors.
RECOMMENDATION: Adopt the attached resolution amending Exhibit A, Designated Positions and Disclosure
Categories of the Central Contra Costa Sanitary District Conflict of Interest Code, and authorize the Secretary
of the District to submit a copy of said code amendment to the Contra Costa County Board of Supervisors
for approval.

WHEREAS, Section 2.20.020 of the Central Contra Costa Sanitary District Code
provides that the Board of Directors shall from time to time establish by resolution
designated positions of officers and employees deemed to make, or participate in the
making of, decisions which may foreseeably have a material effect on a financial interest.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Central
Contra Costa Sanitary District as follows:
THAT Exhibit A, Designated Positions and Disclosure Categories of the Central
Contra Costa Sanitary District Conflict of Interest Code, a copy of which is attached, is
hereby approved and adopted for the District, subject to approval by the Board of
Supervisors of the County of Contra Costa; and
THAT the Secretary of the District is hereby authorized and instructed to submit a
copy of such Code amendment to the Board of Supervisors of the County of Contra Costa
and to request the Board of Supervisors to approve said Code amendment in accordance
with Government Code Section 87303.

Consultants shall be included in the list of designated employees and shall
disclose pursuant to the broadest disclosure category in the Code subject to
tbe following limitation:
The General Manager-Chief Engineer may determine in writing that a
particular consultant, although a "designated position," is hired to perform
a range of duties that is limited in scope and thus is not required to fully
comply with the disclosure requirements in this section. Such written
determination shall include a description of the consultant's duties and,
based upon that description, a statement of the extent of disclosure
requirements. The General Manager-Chief Engineer's determination is a
public record and shall be retained for public inspection in the same manner
and location as this Conflict of Interest Code.
Other Officials Who Manage Public Investments:
In accordance with Government Code Section 87200, certain District officers are
required to disclose - upon assuming and leaving office, and annually while in office
_ their investments, income, and interests in real property by way of Fair Political
Practices Commission (FPPC) Form 721. Those positions designated to file Form
721 are those "directing the investment of public monies, formulating or approving
investment policies, approving or establishing guidelines for asset allocations, or
approving investment transactions." It has been determined that the positions listed
below manage public investments and will file a Statement of Economic Interests
pursuant to Government Code Section 87200 (Form 721):

Consultants shall be included in the list of designated employees and shall
disclose pursuant to the broadest disclosure category in the Code subject

Regulation 18700(a)(2) defines "consultant" as an individual who, pursuant
to a contract with a state or local government agency:
(A) Makes a governmental decision whether to:
(i) Approve a rate, rule, or regulation;
(ii) Adopt or enforce a law;
(iii) Issue, deny, suspend, or revoke any permit, license,
application, certificate, approval, order, or similar authorization
or entitlement;
(iv) Authorize the agency to enter into, modify, or renew a
contract provided it is the type of contract which requires
agency approval;
(v) Grant agency approval to a contract which requires agency
approval and in which the agency is a party or to the
specifications for such a contract;
(vi) Grant agency approval to a plan, design, report, study, or
similar item;
(vii) Adopt, or grant agency approval of, policies, standards, or
guidelines for the agency, or for any subdivision thereof;
or
(8) Serves in a staff capacity with the agency and in that capacity
performs the same or substantially all the same duties for the agency
that would otherwise be performed by an individual holding a position
specified in the agency's Conflict of Interest Code.

~: Construction has been completed on the Rossmoor Sewer Improvements Project, Phase 2 (DP 5124),
and the work is now ready for acceptance.
BACKGROUND: The Rossmoor Sewer Improvements Project, Phase 2 (DP 5124), was implemented under
the terms of an agreement between Rossmoor and the District. This agreement provides for the District
constructing new manholes and repairing the existing sewer system in phases prior to taking over ownership,
operation, and maintenance of the sewer mains. The work is being financed by a portion of the capital
improvement fees paid by the Rossmoor developer (UDC Homes) and a portion of the sewer service charges
paid by the homeowners of Rossmoor.
Phase 2 of the project consisted of installing 81 manholes on the existing sewer mains, replacing
approximately 800 lineal feet of deficient sewer pipe, and making six spot repairs. Approximately
10,000 lineal feet of sewer mains were also cleaned and television inspected as part of this project. This
project is described in more detail on pages CS-69 through CS-71 of the 1996 - 97 Capital Improvement
Budget.
On May 2, 1996, the Board authorized the award of a contract for construction of the project to J. Flores
Construction Company, Inc. of Oakland. Notice to Proceed was issued on June 10, 1996, and the contract
work was substantially completed by the completion date of October 17,1996. The remaining work
consists of minor punch list items that do not affect the project acceptance.
The total authorized budget for the Phase 2 project, including the cost of engineering design, District forces,
testing services, contractor services, etc. is $460,000. An accounting of the project costs will be provided
to the Board at the time of project close out. It is appropriate to accept the contract work at this time.
RECOMMENDA11ON: Accept the contract work for the construction of the Rossmoor Sewer Improvements
Project, Phase 2 (DP 5124), in Walnut Creek, and authorize the filing of the Notice of Completion.

ISSUE: Board approval of the South Orinda Sewer Improvement Project is required prior to the filing of a
Notice of Exemption under the District's California Environmental Quality Act (CEOA) Guidelines.
BACKGROUND: The 1986 Collection System Master Plan identified numerous sewers with inadequate wet-
weather hydraulic capacity in the Orinda area. Wet-weather overflows occur frequently along the Moraga
Way trunk sewer during the rainy season. Overflows are of particular concern since the watershed drains
into San Pablo Reservoir, a drinking water supply for EBMUD. Some Orinda area sewers also experience
periodic dry-weather overflows due to root and grease blockages and structural deficiencies (offset joints,
damaged pipes, etc). The majority of the collection system in the Orinda area is over forty years old and
requires extensive maintenance to keep it functioning properly.
The 1992 Orinda Sewer Improvement Program Facilities Plan -and its 1995 update included a long-term
capital improvement program to address the identified problems. The proposed South Orinda Sewer
Improvement Project (see Attachment A) is a combination of three sewer improvement programs planned
for the area.
1 . Approximately 14,000 feet of sewer will be replaced in Moraga Way and Glorietta Boulevard to prevent
wet-weather overflows.
2. About 10,800 feet of sewer located in the Overhill Creek and Underhill Road area will be replaced or
rehabilitated to prevent dry-weather overflows due to blocked or deteriorated pipes.
3. Approximately 13,400 feet of sewer main located elsewhere throughout the South Orinda area will be
replaced or rehabilitated. These sewer improvements were identified as high priority improvement needs
by the District's Collection System Operations (CSO) Department and the Planning Division based on
overflow and maintenance records.
Approval of the South Orinda Sewer Improvement Project is requested at this time so that CEOA compliance
can be completed and staff can proceed with right-of-way acquisition and completion of the final design.

To minimize construction impacts on traffic and nearby residents, the project will be constructed in two
phases: Phase I of the project is currently scheduled to bid in March, 1997 with construction starting in
late April, 1997; Phase II is planned for construction in 1998. Also, several "no dig" technologies
(including microtunneling, pipe bursting, and directional drilling) will be used where feasible.
Other measures are included in the proposed project to avoid, minimize, reduce, rectify, or compensate
for construction-related impacts. These measures will be identified on the project plans and specification
and address dust control; odor control; erosion control; protection of soils; provision of adequate drainage;
construction equipment noise suppression; protection and restoration of structures; precautions for
working near sensitive and unique vegetation; protection and restoration of vegetation, landscaping, and
structural improvements; compensation for right-of-way use; public health and safety precautions;
community notification of construction schedules; traffic and circulation controls; and preservation of
cultural resources. Coordination with Orinda, Moraga, Lafayette, and other affected public agencies is
ongoing.
Staff has concluded that this project is exempt from CEOA under District CEOA Guidelines Section
5.2(b)(3), since it can be "seen with certainty that there is no possibility that the activity in question may
have a significant effect on the environment." This certainty is based on the District's past experience
with numerous sewer construction projects of this nature and the specified construction methods and
mitigation measures included in the project.
Some project elements also are exempt either under District CEOA Guidelines Section 18.2(b) (repairs and
minor alterations to existing public sewer facilities) or Section 18.3(c) (replacement or reconstruction of
existing utility systems). The project elements which will address dry-weather overflows will restore the
originally-designed capacity of the affected sewers. Other pipeline capacity increases in this project will
occur to accommodate wet-weather flows or the technical requirements of the "no dig" construction
methods. The Board of Director's approval of this project will constitute an independent finding that this
project is exempt from CEOA.
RECOMMENDATION: Approve the South Orinda Sewer Improvement Project (DP 4928) and authorize
staff to file a Notice of Exemption.

ISSUE: Board of Directors' authorization is required for the General Manager-Chief Engineer to execute
professional service agreements for amounts greater than $50,000.
BACKGROUND: The Dougherty Valley development is a proposed residential community of approximately
11,000 homes located in southern Contra Costa County on the former Gale and Gumpert Ranch properties.
Central Contra Costa Sanitary District has been identified in the project's approved environmental impact
report (EIR) as the preferred provider of sewer service for the valley. The "Dougherty Valley Sewer Service
Study - November 1995," prepared for the District by G. S. Dodson and Associates, considered nine
alternatives for sewering the valley. The report concluded that the preferred District service alternative would
be the construction of an approximately 4,SOQ-foot-long utility tunnel to convey wastewater by gravity from
Dougherty Valley to the San Ramon (Larwin) Pumping Station. The capacity of the San Ramon Pumping
Station would be increased in the future, as needed to accommodate the additional flow. Wastewater from
Shapell Phase 1 (The Country Club at Gale Ranch), currently under construction, will flow by gravity through
Canyon Lakes Golf Course to the District's existing sewer system. The alternatives, including the tunnel,
were discussed with the Board at its meeting on December 21, 1995, and during deliberations considering
approval of the 1996-97 Capital Improvement Budget (CIB)/1996 Capital Improvement Plan. The
development area and sewer alignments are shown in Figure 1.
A "Preliminary Design Report - Dougherty Valley Tunnel" was completed by Woodward-Clyde Consultants
in February 1996. This report summarized the results of Woodward-Clyde's evaluations and presented
preliminary interpretations, conclusions, and recommendations for final design. Construction of the tunnel
appears to be feasible, but additional subsurface explorations and geologic investigations are recommended
before final design.

It is now appropriate to proceed with the subsurface exploration and geologic investigations. Woodward-
Clyde has been selected to perform this work as the investigations are a direct extension of its February
1996 Design Report. Staff has negotiated a cost-reimbursement agreement with a cost ceiling of
$67,600. The project is included in the 1996 - 97 Capital Improvement Budget starting on page CS-42.
The CIB total project cost estimate for this project is approximately $11.2 million.
Staff has concluded that this agreement is exempt from the California Environmental Quality Act (CEOA)
under District CEOA Guidelines Section 17.3 since it involves a feasibility or planning study for possible
future actions which the District has not approved, adopted, or funded, and the outcome of the study will
not have a legally binding effect on later activities. Board of Directors' approval of this agreement will
constitute an independent finding that it is exempt from CEOA.
RECOMMENDATION: Authorize the General Manager-Chief Engineer to execute an agreement with
Woodward-Clyde Consultants with a cost ceiling of $67,600 to provide subsurface exploration and
geologic investigation services for the Dougherty Tunnel Installation, DP 5902.
