agencies.
BACKGROUND: The District opened bids for the Recycled Water - Customer Connections, Phase One,
Project on November 21, 1997, and plans to award the project at the December 4, 1997, Board meeting.
As part of the project, approximately 5,500 feet of 8-inch pipe will be constructed in Golf Club Road in
Pleasant Hill to serve two customers. Approximately 100 feet of the pipeline will be installed under the
United States Bureau of Reclamation {USBR)/Contra Costa Water District (CCWD) Canal (see attached map).
Staff has negotiated a grant of easement from the United States Department of the Interior, Bureau of
Reclamation via the Contra Costa Water District for work within the USBR property. The District plans to
begin providing recycled water to these new recycled water customers as early as April 1998.
With the acceptance of this Grant of Easement, all easements related to the Recycled Water - Customer
Connections Project have been acquired.
RECOMMENDATION: Adopt a resolution accepting the Grant of Easement from the United States Bureau
of Reclamation and the Contra Costa Water District.

.IS.S.UE: Peters Ranch Estates, General Partnership, the developer of Subdivision 5718, has requested that
the District quitclaim the subject easement.
BACKGROUND: The subject easement was granted at no cost to this District in 1 993 to provide for access
to District sewer facilities. The lot which this easement lies within has been sold, and new owners want
to build their home in the area of the easement. The developers, Peters Ranch Estates, has granted a
replacement easement to this District within the adjoining Lot 346 of Subdivision 5718. This new easement
will also be the driveway access to Lot 345. The replacement easement is adequate for District access
pu-poses, and the existing easement may now be quitclaimed. The District's quitclaim processing fee has
been paid.
Staff has concluded that this project (the proposed quitclaim) is exempt from the California Environmental
Quality Act (CECA) under District CECA Guidelines Section 18.6 since it involves a minor alteration in land-
use limitations. Board of Directors' approval of this quitclaim will constitute an independent finding that this
project is exempt from CECA.
RECOMMENDATION: Approve Quitclaim Deed to Richard E. Broyles and Lynne V. Broyles, Job 4868;
authorize the President of the District Board of Directors and the Secretary of the District to execute said
Quitclaim Deed; and authorize the Quitclaim Deed to be recorded.

ISSUE: Construction has been completed on the M2-A Force Main Rehabilitation Project, District Project 5225,
and the work is now ready for acceptance.
BACKGROUND: The M2 system, which conveys wastewater from Maltby Pumping Station to the treatment
plant, consists of two force mains. The original force main (M2-A) was constructed in 1970 with reinforced
concrete steel cylinder (steel) pipe. A second force main (M2-B) was constructed in 1991 with high density
polyethylene (HDPE) pipe. As part of the M2-B project, a portion of the existing M2-A steel pipe was replaced
with HDPE pipe. Severe corrosion problems in a section of the remaining steel pipe located at the north end
of Basin C rendered the M2-A force main inoperable as of Summer, 1997. This project replaced about 200
linear feet of the corroded steel pipe with HDPE pipe (see Attachment 1 for project location). Additional
information can be found in the 1997-98 Capital Improvement Budget (CIB) on pages CS-69 through CS-70.
The Board of Directors authorized award of a construction contract in the amount of $246,725 to D. R.
Lemings Construction Company of Concord, California on August 7, 1997. The contractor was issued a
Notice to Proceed, effective September 2, 1997, with a required contract completion date of December 31,
1997. The District took beneficial use of the restored M2-A force main on November 3, 1997, with all work
being substantially completed on November 18, 1997, approximately six weeks prior to the required project
completion date. The remaining work consists of punch list items, which do not affect project acceptance.
It is appropriate to accept the contract work at this time. The total authorized budget for this project is
$378,000. An accounting of the project costs will be provided to the Board at the time of project close out.
RECOMMENDATION: Accept the contract work for the construction of the M2-A Force Main Rehabilitation
Project, District Project 5225, and authorize the filing of the Notice of Completion.

ISSUE: Specific approval by the Board of Directors is required for traveling outside of California or if the
expense will exceed $500 if the activity was not included in the current year Operations and Maintenance
Budget.
BACKGROUND: The Underground Construction Technology Conference is being held in Houston, Texas on
January 13-15, 1998. The subject of the conference is underground construction and rehabilitation. The
conference includes extensive exhibits of trenchless and conventional technologies by various
manufacturers. The District uses various trenchless technologies such as microtunneling, directional drilling,
pipe bursting, cured-in-place, etc. to facilitate the construction of projects in difficult locations as well as
reducing the impacts of construction on the public.
Tad J. Pilecki, Senior Engineer in the Infrastructure Division, has been invited to present a paper on the
subject of Microtunneling. Tad has worked extensively with microtunneling on the South Orinda Sewer
Improvements and the Pleasant Hill Relief Interceptor Projects. Tad will also be attending other technical
presentations and the manufacturer's exhibits.
This specific conference was not included in the 1997-98 budget. The request for Mr. Pilecki's participation
was made after the budget was prepared. There are sufficient funds in the Infrastructure Division Training,
Conference, and Meeting account to cover the cost of attendance at this conference.
RECOMMENDATION: Authorize attendance of Tad J. Pilecki, Senior Engineer, at the Underground
Construction Technology International Conference on January 13-15, 1998, in Houston, Texas at a cost of
$1,500.

ISSUE: The District may exercise the power of eminent domain to acquire public easements only if the
District Board of Director.s adopts a Resolution of Necessity that meets the requirements of the California
Eminent Domain Law. In deciding whether or not to adopt such a Resolution, the District must first hold
a hearing to allow affected property owners to appear and be heard.
BACKGROUND: The next portion of the Pleasant Hill Relief Interceptor Sewer (PHRI Phase 4) and the
Recycled Waterline Project to be installed in 1998/1999 is located between Taylor Boulevard and a point
south of Gregory Lane predominately in Ardith Drive. In February of 1 982 and 1 986 and January 1 997, the
collection system serving the Pleasant Hill community experienced significant wet weather related sewer
overflows. The completion of PHRI Phase 4 will correct the overflows experienced this past January in the
vicinity of Price Lane and Gregory Lane. District staff is proceeding to acquire the needed right of way for
this next phase of construction and also the right of way for the subsequent phase.
The selection of the Ardith Drive route for the PHRI was part of the detailed alignment evaluation that
occurred in conjunction with the preparation of the Environmental Impact Report for the Pleasant Hill/A-Line
Sewer Overflow Protection Project (EIR). The Ardith Drive and Contra Costa Boulevard routes were
determined to be the most viable alignments, and the Board at its September 4, 1991, meeting certified the
Final Program EIR for the Pleasant Hill/A-Line Sewer Overflow Protection Project and approved the Ardith
Drive route. The Ardith Drive route was selected over Contra Costa Boulevard for the following reasons:
· It eliminated the need for trunk sewers downstream of Ardith
· It avoided traffic and utility disruptions along Contra Costa Boulevard
· It has the lowest construction cost
· It has the best hydraulics
· The fewest number of residents would be impacted
· Traffic impacts would be less

The same evaluation looked at the routing of the recycled water line and reached the same conclusion that
the original Ardith Drive route was the best. On September 16, 1993, the Board approved the Negative
Declaration for the Recycled Water Pipeline Project.
District staff is presently completing the design of PHRI Phase 4. Construction is currently scheduled to start
in November of 1998. District has been negotiating with owners of twelve properties along this section of
the proposed alignment and has reached settlements with eight of the property owners. Negotiations with
the Mount Diablo Unified School District are proceeding slowly and successful completion is anticipated.
Little progress has been made over the past year with three of the remaining property owners. On
September 4, 1997, the Board held a public hearing and adopted a resolution to acquire easements from one
of these property owners (Mrs. Maryellen Smith) through eminent domain proceedings. Negotiations with
two additional property owners have not been successful and staff considers it appropriate to proceed with
the commencement of eminent domain action at this time. The locations of the two remaining easements
are shown on the attached maps.
The property owners, Mr. George E. Lowery and Ms. Evie Gass, have received offers of just compensation
based on an appraisal prepared by a licensed real estate appraiser. District staff has continued negotiating
and will continue to negotiate with the owners in the hope of reaching an agreement. It is now appropriate
to proceed with the adoption of a Resolution of Necessity to obtain needed property rights to provide for a
timely start of construction of the project. In making its decision whether or not to adopt a Resolution of
Necessity, the District Board is required to first conduct a hearing giving the property owners, whose
properties the District proposes to acquire by eminent domain, reasonable opportunity to appear and be
heard. On November 14, 1997, there was mailed to the addresses appearing on the last equalized County
Assessment Roll a Notice of Public Hearing notifying all persons whose names appear on said County
Assessment Roll as having an interest in the property described in Attachment "A" of the proposed Resolution
of Necessity of said hearing.
RECOMMENDA nON: Conduct a hearing to receive input from the property owners on the following issues:
1 . Whether the public interest and necessity require the project;
2. Whether the project is planned or located in the manner that will be most compatible with the
greatest public good and the lease private injury;
3. Whether the property rights sought to be acquired are necessary for the project; and
4. Whether the offer pursuant to Government Code Section 7267.2 has been made to owners
of record of the subject property.

A RESOLUTION OF NECESSITY FOR THE ACQUISITION
OF PUBLIC EASEMENTS FOR SEWER PURPOSES
AND AUTHORIZING EMINENT DOMAIN PROCEEDINGS - GASS, LOWERY
WHEREAS, Pursuant to the State of California Health and Safety Code Sections 6514 and
6512, the Central Contra Costa Sanitary District is empowered to acquire by condemnation
proceedings sewer/recycled water line easements for public use, to wit, for purposes related to
wastewater collection and transport, and the District intends to construct, own, and operate
sewers as part of its Pleasant Hill Relief Interceptor, D.P. 4985; and
WHEREAS, the Central Contra Costa Sanitary District has identified the need to acquire
permanent and temporary public sewer/recycled water line easements more particularly
described in Attachment "A," attached hereto for said purposes, and said easements are located
within an incorporated area of Pleasant Hill, Contra Costa County, State of California; and
WHEREAS, on November 14,1997, the District gave mailed notice as required by law of
the hearing on this Resolution to the affected property owners, Mr. George E. lowery, and Ms.
Evie Gass; and
WHEREAS, said Notice of Hearing indicated that the affected property owners have the
opportunity to appear and be heard;
WHEREAS, the hearing set out in said Notice of Hearing was held on December 4, 1997,
at the time and place stated therein; and all interested parties were given an opportunity to be
heard; and, thereupon, the hearing was closed.
WHEREAS, all oral and documentary evidence has been duly considered.
NOW, THEREFORE, the Board of Directors of the Central Contra Costa Sanitary District,
does FIND, DETERMINE, AND RESOLVE as follows:
1. The public interest and necessity require the proposed project for which said
public sewerlrecycled water line easements are to be acquired.
2. The subject project is planned and located in the manner which will be most
compatible with the greatest public good and the least private injury;
3. Said public sewer/recycled water line easements are necessary for the proposed
project; and
4. The offer pursuant to Government Code Section 7267.2 has been made to the
owners of record of the subject property.
BE IT FURTHER RESOLVED THAT:
The Counsel for Central Contra Costa Sanitary District, Kenton L. Aim, is hereby
authorized and empowered:
To acquire in the District's name, the above referenced public sewer/recycled water line
easements by condemnation;

ISSUE: On November 19, 1997, sealed bids were received and publicly opened for providing television
inspection services for a two-year period for Capital Improvement Projects. The Board must authorize
award of this contract or reject bids within 50 days of the bid opening.
BACKGROUND: The Infrastructure Division televises approximately 70,000 feet of sewer pipeline each
year as a part of the design of various capital projects. The purpose of internally televising sewer
pipelines is to evaluate the physical condition of existing sewers, particularly with regards to cracks, joint
offsets, pipe alignment, sags, root intrusion, grease build-up, and corrosion, and to locate lateral
connections. The results are also used to determine the type of reconstruction during the design phase
of projects.
By publicly bidding a contract master for TV inspection work which a contractor may be required to
perform on several projects through the contract period, the District will obtain a lower overall cost,
increased scheduling performance, and a significant reduction in paper work associated with negotiating
and issuing separate contracts. The purpose of the Bid Request is to fix the unit cost per each portion
of the work for certain potential projects, while obtaining the lowest overall cost for the District, and
not to arrive at a total lump sum bid amount.
A Bid Request for annual television inspection work was advertised on November 8 and 13, 1997. Six
bids were received and publicly opened on November 19, 1997. These bids are listed in Attachment 1,
Tabulation of Bids. The Engineering and Purchasing staff conducted a technical and commercial
evaluation of the bid and concluded that Subtronic Corporation is the lowest responsible bidder. The
initial contract amount will be $99,450. Future revisions may be made if additional work is identified.
The Engineer's estimate for the proposed contract work over a two-year period is $155,000.

Staff has concluded that this contract is exempt from the California Environmental Quality Act (CEOA) under
District CEOA Guidelines Section 17.3 since it provides sewer design information that will not have a legally
binding effect on later activities. The Board of Director's approval of the contract will constitute an
independent finding that the contract is exempt from CEOA.
RECOMMENDATION: Authorize award of a contract to Subtronic Corporation, the lowest responsible bidder,
for providing television inspection services of sanitary sewers for a two-year period.

ISSUE: On November 19, 1997, sealed bids were received and publicly opened for providing locating
services for underground utilities for a two-year period for Capital Improvement Projects. The Board must
authorize award of the contract or reject bids within 50 days of the bid opening.
BACKGROUND: The Infrastructure Division needs to determine the location of approximately 15,000 feet
of sanitary sewer mains, 200 side sewers, and 35,000 feet of other underground utilities each year as a
part of the design of various collection system capital projects. The purpose of locating the underground
utilities is to verify record information. The results are used to evaluate alternatives during the facilities
planning and design phases of projects to minimize the need for potholing during design, and to minimize
change orders during construction.
Staff has found that bidding the locating work on an annual basis results in a lower overall cost and a
significant reduction in paper work associated with negotiating and issuing separate contracts. The purpose
of the bid request is to establish unit cost for each portion of the work for certain potential projects, while
obtaining the lowest overall cost for the District and not to arrive at a total lump sum bid amount.
A bid request was advertised on November 8 and 13, 1997. Five bids were received and publicly opened
on November 19, 1997. These bids are listed in Attachment 1, Tabulation of Bids. The Engineering and
Purchasing staff conducted a technical and commercial evaluation of the bids and concluded that Precision
Locating is the lowest responsible bidder. The initial contract amount will be $59,650. Future revisions may
be made if additional work is identified. The engineer's estimate for the proposed contract work over a two-
year period is $87,000. There is a significant difference between Precision Locating's bid and that of the
second bidder. Precision Locating is a specialist in providing locating services. Precision Locating has done
a great deal of work for the District previously and has provided good quality service.

will not have a legally binding effect on later activities. The Board of Directors' approval of this award of
contract will constitute an independent finding that the contract is exempt from CEOA.
RECOMMENDATION: Authorize award of a contract to Precision Locating, the lowest responsible bidder,
for providing locating services of underground utilities for a two-year period.

.ISSUE: On November 21, 1997, sealed bids for the construction of District Project No. 7181, Recycled
Water - Customer Connections were opened. The Board of Directors must authorize award of the contract
or reject all bids within 50 days of the opening of bids.
BACKGROUND: Central Contra Costa Sanitary District (District) is planning to provide recycled water service
to landscape irrigation customers in Pleasant Hill in the Spring of 1998. District Project 7181 will connect
seven customer sites (Attachment 1) to the recycled water system and make anyon-site conversions
needed to meet Department of Health Services (DHS) requirements. This project includes installation of
5,500 feet of 8-inch distribution pipe along Golf Club Road in Pleasant Hill to provide service to the Diablo
Valley College site and the Contra Costa Country Club Golf Course site. Five other sites, Buchanan Fields
Golf Course; Chilpancingo Park; Pleasant Hill Corporation Yard; Franke Salfingere Park; and the Pleasant Hill
Community Center, will also be provided recycled water service. Each site will be metered and also tested
to ensure no cross connections exist to the satisfaction of Contra Costa Water District and DHS.
Plans and specifications for the project were prepared by District staff. The project was advertised on
October 24 and 31, 1997. The Engineer's estimate for the construction is $774,000. Ten bids ranging
from $649,881.30 to $993,991 were received and publicly opened on November 21,1997. A summary
of bids is presented in Attachment 2. The Engineering Department conducted a technical and commercial
review of the bids and determined that the lowest responsible bidder is D. R. Lemings Construction for the
amount of $$649,881.30.
District staff will provide all contract administration and inspection services for the project including shop
drawing review and offices engineering support. The funds required to complete this project, as shown in
Attachment 3, are $838,000. The total project cost is anticipated to be $1,044,000. Construction of the
Recycled Water -Customer Connections Project is included in the Fiscal Year 1997-98 Capital Improvement
Budget (CIB) on pages RW18-21. Staff has conducted a cash flow analysis of the Sewer Construction Fund
and concluded that adequate funds are available for this project.

On September 16, 1993, the District Board of Directors approved a Negative Declaration and determined
that the project would not have a significant effect on the environment. A Notice of Determination was filed
with the Contra Costa County Clerk on September 21, 1 993.
RECOMMENDA nON: Authorize award of a contract for construction of the Recycled Water - Customer
Connections Project, DP 7181, in the amount of $649,881.30 to D. R. Lemings Construction, as the lowest
responsible bidder.
