ISSUE: The owners of property identified as 459 Deborah Lane, Walnut Creek, have requested that the
District quitclaim a portion of the public sewer easement which lies within their property.
BACKGROUND: The subject easement was granted at no cost to the District in 1969. It was created to
provide service to the parcel located adjacent to and northwest of the Coe property. This northwesterly
property was connected to a new public sewer located in Sorrel Drive in 1991. The subject easement is,
therefore, no longer required and may be quitclaimed. The District's processing fee has been paid by the
owner.
Mr. Coo is an employee of the District. Staff and District Counsel have reviewed whether Mr. Coe would
be subject to any conflict of interest requirements associated with this action. Staff and District Counsel
have concluded that no conflict of interest provisions apply, including those set forth in Government Code
Section 1 090.
Staff has concluded that this action (the proposed quitclaim) is exempt from the California Environmental
Quality Act (CECA) under District CECA Guidelines Section 18.6, since it involves a minor alteration in land-
use limitations. Board of Directors' approval of this quitclaim will constitute an independent finding that this
project is exempt from CECA.
RECOMMENDAll0N: Approve Quitclaim Deed to James R. Coe, et ux, Job 1646 - Parcel 2; authorize the
A"esident of the District Board of Directors and the Secretary of the District to execute said Quitclaim Deeds;
and authorize the Quitclaim Deeds to be recorded.

.ISSUE: Construction has been completed on the Crescent Drive, Miner Road, and Los Arabis Drive Storm
Damage Repair Project (DP 5162) in Orinda and Lafayette, and the work is now ready for acceptance.
BACKGROUND: The Crescent Drive, Miner Road, and Los Arabis Drive Storm Damage Repair Project
(DP 5162) originated during the winter storms of 1995 through 1997. The Crescent Drive site in Orinda
had a landslide in December 1995 that damaged the 6-inch VCP sewer in the easement behind two houses.
A temporary sewer line was immediately installed. A year later further storms reactivated the landslide,
threatened the two houses, and destroyed the temporary sewer line. Another temporary sewer line with
a sump pump was installed until a replacement sewer and piers were installed by contractors under
emergency declaration. The Miner Road and the Los Arabis Drive sites were damaged during last year's
heavy winter storms and were added to the project.
This project consists of work at three sites. The work at the Crescent Drive site consisted of installing two
retaining walls above the sewer line, slope protection along the creek bank, and installing a storm drain
system from the road to the creek. The work at the Miner Road site consisted of replacement of a damaged
culvert under the sewer line with slope protection along the creek and installing a storm drain system through
the easement. The work at the Los Arabis Drive site consisted of restoration of a minor earth movement
on the slope. This project is described in more detail on Pages CS-59 and CS-60 and CS-51 through CS-53
in the 1997-98 Capital Improvement Budget.
On August 7, 1 997, the Board authorized the award of a contract for construction of the project to
Engineered Soil Repairs, Inc., of Walnut Creek. Notice to Proceed was issued on September 8, 1997. The
contract work was substantially completed on November 25, 1997. The remaining work consists of minor
punch list items which do not affect the project acceptance.

STORM DAMAGE REPAIR PROJECT, DISTRICT PROJECT NO. 5162 IN ORINDA AND LAFAYETTE, AND
AUTHORIZE THE FILING OF THE NOTICE OF COMPLETION
The total authorized budget for this project is $371,000, including cost of engineering design, District forces,
testing services, geotechnical services, contractor services, etc. An accounting of the project costs will be
provided to the Board at the time of project close-out. It is appropriate to accept the contract work at this
time.
RECOMMENDAllON: Accept the contract work for the construction of the Crescent Drive, Miner Road, and
Los Arabis Drive Storm Damage Repair Project (DP 5162) in Orinda and Lafayette, and authorize the filing
of the Notice of Completion.

ISSUE: Approval by the Board of Directors is required for travel outside of California or if the expense will
exceed $500.
BACKGROUND: Alex Rozul, Associate Engineer, and Michael Penny, Assistant Engineer, work in the
Infrastructure Division where they are involved in the design and construction of sewer pipeline projects,
some of which may include microtunneling in order to reduce adverse impacts to the public.
Attendance at the three-day seminar, Microtunneling, sponsored by the Microtunneling Research Institute
of the Colorado School of Mines, will provide Alex and Michael with comprehensive and updated knowledge
in the fast-growing field of microtunneling construction. Last year, the District sent two Engineering
Department employees to this seminar, and both spoke very highly of the applicability and practicability of
the material presented. Participation in this seminar by Alex and Michael was not anticipated at the time
the technical training budget was completed, but adequate funds are available in the budget as a result of
employees not attending budgeted training sessions.
RECOMMENDATION: Authorize the attendance of Alex Rozul, Associate Engineer, and Michael Penny,
Assistant Engineer, at the February 4 through 6, 1998, three-day seminar, Microtunneling, sponsored by
the Microtunneling Research Institute of the Colorado School of Mines at Golden, Colorado, at a total cost
of $3,400.
