SUBJ ECT REPEAL ORDINANCE NO. 157 WHICH ADOPTED TITLE 8, GARBAGE, OF THE DISTRICT CODE, EFFECTIVE JANUARY 1, 1998 SUBMITTED BY Paul Morsen, Deputy General Manager INITIATING DEPTIDIV Ad ministrative ISSUE: Board approval is required to repeal a District ordinance. BACKGROUND: The District has been involved in the franchising of solid waste since the 1950's. Title 8, Garbage, was added to the District's Code to provide guidance in that area. In 1986, Ordinance 157 was passed, repealing the existing Title 8 and adopting a new Title 8, Garbage. In early 1996, the garbage contracts between the District and the garbage collection companies expired, and the District's franchising responsibilities were passed on to the Central Contra Costa County Solid Waste Authority (CCCSWA). The District agreed to remain a member on this Solid Waste Authority for a time to help ensure a smooth transition to the cities. The CCCSWA passed its own ordinance governing solid waste activities. At a recent Board meeting, the District's Board made the decision to withdraw its membership in the CCCSWA effective December 31, 1997. Since the District is no longer the franchisor of solid waste, and since the District's Board has decided to withdraw from the CCCSWA, there is no longer a need for Ordinance No. 157 and the existing ordinance would be redundant to the CCCSWA. RECOMMENDATION: It is recommended that the Board repeal Ordinance No. 157, effective January 1, 1998. REVEWED AND RECOMNIENDED FOR BOARD ACTION S:\ADMIN\POSPAPER\REPEL 157 .PP ORDINANCE NO. AN ORDINANCE REPEALING TITLE 8, GARBAGE, OF THE DISTRICT CODE BE IT ORDAINED by the Board of Directors of the Central Contra Costa Sanitary District that Title 8, GARBAGE, of the District Code be repealed as of January 1, 1998. This ordinance shall be published once in the Contra Costa Times, a newspaper of general circulation, published and circulated within the Central Contra Costa Sanitary District and shall be effective upon expiration of the week of publication. DATE TYPE OF ACTION November 10, 1997 ACCEPT CONTRACT/AUTHORIZE NOTICE OF COMPLETION SUBJECT ACCEPT CONTRACT WORK FOR THE HOUSEHOLD HAZARDOUS WASTE COLLECTION FACILITY PROJECT, DISTRICT PROJECT 7165, AND AUTHORIZE THE FILING OF THE NOTICE OF COMPLETION SUBMITTED BY Munawar Husain, Associate Engineer INmA T1NG DEPT/DIV Engineering Department/Plant Engineering Division ISSUE: Construction has been completed on the Household Hazardous Waste Collection Facility Project, District Project 7165, and the work is now ready for acceptance. BACKGROUND: This project was built using the design/build approach. The contractor was required to finalize the design, obtain the appropriate permits from the County and the Fire District, build the facility and obtain sign-offs on the permits at completion. The project facilities included a 4,500 square foot building, 4,300 square feet of attached canopied areas, a loading dock, containment and temporary storage tanks, roads, driveways, parking areas, security fencing, and gates. Demolition of an existing metal building at the project site and demolition of concrete paving at the former batch plant property was also included in the scope of work. Grading, drainage, and installation of a recycled water line from the treatment plant for landscape irrigation was included in the project work as well. Details of the project are also included on pages TP-102 through TP-104 of the Fiscal Year 1997-98 Capital Improvement Budget. See Attachment 1 for the location of the work completed under this project. The construction contract was authorized to be awarded to C. Overaa & Co. of Richmond, California on October 1 7, 1996 by the District Board of Directors. The contractor was issued a Notice to Proceed with Design on October 30,1996. The contract completion date was August 31,1997. The contract work was substantially completed on October 2, 1997, and the District assumed responsibility for operation and maintenance of the facilities from this date. Contract completion has required extra time due to delays in the delivery of numerous items, equipment, and tanks. Negotiations are in progress with the contractor to address delays and time extention issues. It is appropriate to accept the contract work at this time. The total authorized budget for this project is $2,128,000. An accounting of project costs will be provided to the Board at the time of project close out. RECOMMENDATION: Accept the contract work for the Household Hazardous Waste Collection Facility Project, District Project 7165, and authorize filing of the Notice of Completion.
