ISSUES: A public hearing is required to establish the Haven Lane Contractual Assessment
District No. 98-3 (C.A.D. No. 98-3). A public hearing is also required to create an
assessment district pursuant to the procedure adopted under Proposition 218, which
amended the California Constitution, Article XIII 0, Section 4.
BACKGROUND: On September 3, 1998, the Board of Directors adopted a resolution
directing the preparation of a report for a demonstration project known as Haven Lane
C.A.D. No. 98-3 for the purpose of installing a public sewer along Haven Lane in Walnut
Creek. A draft report has been prepared and assessments are being estimated. It is now
appropriate to schedule a public hearing to offer interested parties the opportunity to
comment on the proposed assessments and related issues. A resolution is attached,
which, if adopted, will set the date for the public hearing on February 3, 2000. Provisions
of Proposition 218 require a minimum of 45 days between the sending of the notices of
the hearing and the hearing itself.
RECOMMENDATION: Establish February 3, 2000, as the date for a public hearing
regarding Haven Lane C.A.D. No. 98-3 pursuant to California Constitution, Article XIII 0,
Section 4, and Streets and Highways Code, Sections 5898.20 and 5898.24.

intention to create Forest Lane Contractual Assessment District No. 99-1 for the purpose
of installing sewer improvements on Forest Lane in Alamo. As required by Proposition
218, an Engineer's Report estimating assessments for properties within the CAD has been
prepared. It is now appropriate to schedule a public hearing to offer interested parties the
opportunity to comment on the proposed assessments and related issues. A resolution
has been prepared and is attached, which, if adopted, will set the date for the public
hearing on February 3, 2000. Provisions of Proposition 218 require a minimum of 45
days between the sending of the notices of the hearing and the hearing itself.

ISSUE: The District may exercise the power of eminent domain to acquire public
easements only if the District's Board of Directors adopts a Resolution of Necessity that
meets the requirements of the California Eminent Domain Law. In deciding whether or not
to adopt such a Resolution, the District must first hold a hearing to allow property owners
to appear and be heard.
RECOMMENDED ACTION: Conduct a hearing to receive input from the property owner
(Royal Ridge Home Owner's Association) regarding the necessity of the District to
condemn for easements, and after the conclusion of the hearing, adopt a Resolution of
Necessity to acquire permanent easements by eminent domain and authorize the filing of
the eminent domain action, the deposit of the amount of probable compensation, and the
application for Order of Possession.
AL TERN A TIVES/CONSIDERA TIONS:
1 . Direct staff to pursue another alignment - this would involve constructing the
tunnel and trunk sewer through an alternate alignment considered less favorable
by staff due to questionable hydraulics, sub-standard pipe slopes, higher
construction and maintenance costs, longest alignment alternative, utility conflicts,
and a potential for odor and pipe corrosion. (Note: The City of San Ramon prefers
an alignment different than that selected by District staff.)

TUNNEL AND TRUNK SEWER PROJECT, DISTRICT PROJECT NO. 5902.
2. No action by Board - no action will delay the acquisition of the needed right of way
and possibly delay the start of construction.
FINANCIAL IMPACTS:
Easement costs of $20,000 in addition to legal expenses associated with the filing of
eminent domain action and obtaining an Order of Possession. These expenses are
included in the authorized budget and in the existing reimbursement agreement between
the District and developers. Therefore, there will be no cost to the District.
BACKGROUND: In June 1997 the District annexed the eastern half of the Dougherty
Valley in southern Contra Costa County. Developments proposed for this valley include
approximately 11,000 homes on the former Gale and Gumpert Ranch properties. Central
Contra Costa Sanitary District was identified in Contra Costa County's 1996 Final
Subsequent Environmental Impact Report, Windemere - Phase I and Gale Ranch - Phase
II (SCH# 96012003), as the preferred provider of sewer service to this southern area of
Contra Costa County.
On September 4, 1997, the Board of Directors approved the Specific Facilities Plan for
Wastewater Utility Service to Dougherty Valley and Tributary Properties and determined
that construction of a new gravity tunnel and trunk sewer between the valley and the
District's existing San Ramon Pumping Station was the most appropriate means for
extending service to the area. The "Dougherty Valley Sewer Service Study - November
1995" prepared for the District by G. S. Dodson and Associates considered nine
alternatives for sewering the valley. The report concluded that the preferred District
service alternative would be the construction of an approximately 4,800 foot long utility
tunnel to convey wastewater by gravity from Dougherty Valley to the San Ramon (Larwin)
Pumping Station. The alternatives, including the proposed tunnel, were discussed with
the Board at its meeting on December 21, 1995, and during deliberations considering
approval of the 1996-97 Capital Improvement Budget {CIB)/1996 Capital Improvement
Plan.

On May 21, 1998 the Board authorized an agreement with the engineering firm of Brown
and Caldwell to provide preliminary and final design services, including selection of a
preferred tunnel and trunk sewer alignment. Brown and Caldwell's Dougherty Trunk
Sewer Supplemental Routing Study of March 24, 1999 concluded that the current
proposed alignment through Estero Drive was the preferred alignment (map attached).
Among the reasons for the preference of the proposed alignment were:
. Sufficient hydraulic capacity and hydraulic performance;
. Ease of construction due to the straight route and lack of home frontage on the
north side of the street for the Estero Drive portion;
. Existing terrain allows for the minimization of required micro-tunneling;
. The Estero Drive alignment was the least expensive alternative studied.
The same study by Brown and Caldwell listed as reasons for rejecting a second possible
alignment through Pacific Gas and Electric Company's sub-station (also shown on
attached map):
. Questionable hydraulics, shallow sub-standard slopes and low velocities requiring
frequent cleaning and creating a potential for odor and pipe corrosion;
. This alignment was approximately 1, 600 feet longer than the other alignments
considered;
. This alignment was the highest cost alternative studied by approximately $1.15
million.
At the request of the City of San Ramon, Brown and Caldwell performed a more in-depth
study of the alignment through the PG&E substation site. City staff prefer this alignment
as it would cause less disruption to residents. Additional investigation determined that
other complications with this alignment are:
. An extensive existing network of overhead and underground PG&E facilities at the
substation site, with additional facilities already planned at this site by PG&E that
will impact the trunk sewer constructability;

. Existing sewer and storm drain pipelines, and existing topography, that constrain
the vertical alignment and limit the hydraulic capacity and velocity of the
downstream portion of the pipeline.
Right of way for the preferred alignment has been acquired with the exception of
easements from the Royal Ridge Homeowner's Association. Staff has negotiated an
agreement, including purchase price, with the Association's Board of Directors. However,
the Association's Declaration of Covenants, Conditions and Restrictions and amendments
thereto stipulate that no dedication or transfer of property shall be effective unless an
instrument signed by two-thirds (2/3) of members agreeing to such dedication or transfer
has been recorded. After reviewing the CC&Rs, the title company (First American Title
and Guaranty Company) being used by staff for this transaction determined that such
document will be needed to issue a title insurance policy. To date, this member
agreement has not been produced.
Although an agreement has been reached with the Executive Board of the Association,
2/3 of the Association members have to sign the agreement. Staff considers it
appropriate to proceed with the commencement of eminent domain action at this time in
order to meet the anticipated construction schedule and its proposed construction start
date in mid-2000. Additionally, the Association's process to acquire the needed
signatures from among their 84 members may be time consuming and the outcome
uncertain.
In making its decision whether or not to adopt a Resolution of Necessity, the District
Board is required to first conduct a hearing giving the property owners, whose properties
the District proposes to acquire by eminent domain, reasonable opportunity to appear and
be heard. On December 1, 1999, staff mailed a Notice of Public Hearing to the address
and all persons listed on the last equalized County Assessment Roll as having an interest
in the property described in Attachment 1I A" of the proposed Resolution of Necessity.
RECOMMENDED BOARD ACTION: Conduct a hearing to receive input from the property
owner (Royal Ridge Home Owner's Association) on the following issues:

After the conclusion of the hearing, adopt the attached Resolution of Necessity to acquire
permanent easements by eminent domain for the Dougherty Tunnel and Trunk Sewer
Project. The resolution will also authorize the filing of the eminent domain action, the
deposit of the amount of probable compensation, and the application for Order of
Possession.

A RESOLUTION OF NECESSITY FOR THE ACQUISITION OF PUBLIC EASEMENTS FOR
SEWER AND RECYCLED WATER PURPOSES AND AUTHORIZING EMINENT DOMAIN
PROCEEDINGS - ROYAL RIDGE HOME OWNER'S ASSOCIATION
WHEREAS, Pursuant to the State of California Health and Safety Code Sections
6514 and 6512, the Central Contra Costa Sanitary District is empowered to acquire by
condemnation proceedings sewer/recycled water line easements for public use, to wit, for
purposes related to wastewater collection and transport and distribution of recycled water,
and the District intends to construct, own, and operate sewers as part of its Dougherty
Tunnel and Trunk Sewer Project, D.P. 5902; and
WHEREAS, the Central Contra Costa Sanitary District has identified the need to
acquire permanent public sewer/recycled water line easements more particularly described
in Attachment "A", attached hereto for said puposes,and said easements are located
within the incorporated limits of the City of San Ramon, Contra Costa County, State of
California; and
WHEREAS, on December 1, 1999, the District gave mailed notice, as required by
law, of the hearing on this Resolution to the affected property owner, Royal Ridge Home
Owner's Association, an unincorporated association; and
WHEREAS, said Notice of Hearing indicated that the affected property owners have
the opportunity to appear and be heard;
WHEREAS, the hearing set out in said Notice of Hearing was held on December 16,
1999, at the time and place stated therein; and all interested parties were given an
opportunity to be heard; and, thereupon, the hearing was closed.
WHEREAS, all oral and documentary evidence has been duly considered.
NOW, THEREFORE, the Board of Directors of the Central Contra Costa Sanitary
District, does FIND, DETERMINE, AND RESOLVE as follows;
1 . The public interest and necessity require the proposed project for which said
public sewer/recycled water line easements are to be acquired.
2. The subject project is planned and located in the manner which will be most
compatible with the greatest public good and the least private injury;
3. Said public sewer/recycled water line easements are necessary for the
proposed project; and
4. The offer pursuant to Government Code Section 7267.2 had been made to
the owners of record of the subject property.

BE IT FURTHER RESOLVED THAT:
The Counsel for Central Contra Costa Sanitary District, Kenton L. Aim, is hereby
authorized and empowered:
1. To acquire in the District's name, the above referenced public
sewer/recycled water line easements by condemnation;
2. To prepare and prosecute in the District's name, such proceedings in the
proper court as are necessary or appropriate for such acquisition; and
3. To deposit the probable amount of compensation, based on an appraisal,
and to apply to the appropriate court for orders permitting the District to
take immediate possession of and use said sewer/recycled water line
easements for said public uses and purposes.

ISSUE: Appointment of individuals to management positions requires the approval of the Board
of Directors.
BACKGROUND: With the Board appointment of Charles Batts to the position of General
Manager, a vacancy was created in the District for the Director of Engineering. Jay McCoy,
the Environmental Services Division Manager, was appointed as the Provisional Director of
Engineering on March 31, 1999. This created a vacancy in the position of Environmental
Services Division Manager. Curt Swanson was selected to fill this vacancy on a provisional
basis on March 31, 1999. Subsequently, Ann Farrell was hired as Director of Engineering.
Shortly after Ms. Farrell joined the District, she identified the Environmental Services Division
Manager as a critical member of the Engineering Department team and requested that the
recruitment for the Division Manager position begin in Sept. 1999. The recruitment process
included advertising in "Jobs Available" and Northern California newspapers for interested
candidates over a several-week period and placing the announcement on the District web
page. Based on qualifications, a short list of seven applicants was selected for a panel
interview. The interviews were conducted by three management-level professionals from
outside agencies. The panel further refined the short list, resulting in the recommendation to
consider four individuals. Ann Farrell interviewed each of these four individuals at length, and
selected Curt Swanson. Mr. Swanson received his engineering education at the University of
California at Davis. He has been an employee of the District for 18 years. During this time, he
has taken on increasing responsibilities and assignments, and is well prepared to be
Environmental Services Division Manager.
RECOMMENDATION: Adopt resolution appointing Curt Swanson to the position of
Environmental Services Division Manager (M-26, $7,334 - $9,320), effective December 1,
1999.

ISSUE: Board approval is required to adopt a new job classification and salary range.
BACKGROUND: The mission of the Communication Services Division is to provide
communication, information, and educational resources and support to meet the District's
internal and external outreach needs. The Division consists of a Community Affairs
Manager, Public Information & Graphics Coordinator, a Graphics Technician III, two Public
Information & Production Assistants, and an outsourced in-house reprographics/copier/
mail service operation.
Public Information & Graphics Coordinator Ken Grubbs has been functioning as a
supervisor in the Communication Services Division (CSD) since 1993. During that time the
scope of his supervisory responsibilities has grown as the public information, pollution
prevention and environmental education needs of the District have expanded. In addition
to supervising the functional areas of graphic design, reprographic services, and District-
wide copying operations, Mr. Grubbs is also responsible for developing, deploying and
maintaining the District's web and Intranet sites. He directly supervises Graphics
Technician III, Son Nguyen and Public Information and Production Assistant II, Chris
Carpenter. Mr. Grubbs also functionally supervises the two contract employees of the
District's outsourced in-house reprographics/copier/mail service operation and administers
the contract with them.
Mr. Grubbs' responsibilities have increased through the reconfiguration of the District's
print shop in 1996 into a digital production facility. Due to this reconfiguration, the
productivity and amount of work of the District's design and reprographic functions have
significantly increased while overall costs have been lowered. Examples of the type of

work now being successfully undertaken in-house include the District's Integrated Pest
Management and pollution prevention programs, the Countywide Green Business program,
the multitude of environmental and business trade show exhibits, and several student
education programs such as the Sewer Science High School program, the Kids-in-Garden
teachers' workshop, our internal newsletter The Lateral Connection, and the formatting
of our community newsletter The Pipeline.
During the MSCG salary survey 3 years ago, the Public Information and Graphics
Coordinator position was surveyed without sufficient matches-due in large part to the
way that other public agencies organize and staff their public information functions. The
table below shows a market comparison to positions similar in magnitude and level of
responsibility as currently handled by Mr. Grubbs.

responsibility within the District, it appears that an S-72 range ($4705-$5697) is the
appropriate level for the Public Information and Graphics Supervisor (Coordinator) position.
The position of Public Information and Graphics Coordinator is the only technical
supervisor position paid at the S-68 range. The table below shows a comparison with
other S-72 range supervisors at the District.
